[clears throat] I'll tell you when I'm ready. I'll wait till I hear from you. In trouble.

You tell her when you're ready. 40 minutes.

Okay, it's about 1 minute to 7, so we can get started a little bit earlier. You don't mind? Would you join in the pledge of allegiance?

Pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all.

[clears throat]

Okay, Katherine, you want to call a rule, please?

Sure. Mr. Anderson

Mr. Chardy

here. Okay, we're good. Okay, what do we got? We have six items actually on the agenda this evening. The first one's at Ino on address sign located at 855 Publishers Parkway. The applicant is Steven Stanley of Vital Signs who is requesting sign approval associated with the installation of one eternally illuminated 60qt wall sign on a 44.14 [cough and clears throat] acre parcel located in an office park district under section 2657 of the code of the town of Webster.

[clears throat]

Yes, sir.

Good evening. Steve Stanley from Vital Science at 764 Ridge Road. Um, as the gentleman just stated, um, a 60 square foot internally illuminated channel letters with Lexan face with applied translucent vinyl to the faces. Uh, constructed from alum aluminum and internally lit with LED modules mounted flush to the building. And that's pretty much it.

That's to say, huh?

I had one small change from the original design from the customer. Um, it's just the color of the vinyl on the face. Nothing major, but I'm sure you guys want it on record. Little lighter blue. Yes. And a bit of a lighter blue. And then the automation will be what we call [cough] main night perforated vinyl. So, and during the day it will show black and at night when it is illuminated will show white.

Is this

If you didn't give us this, I wouldn't have known the difference in the blue when you did it.

Very similar. I wouldn't even have known the difference. Well,

very similar board.

I appreciate you doing that.

Um, a question. Is [clears throat] this This is the U Calvary building.

Correct. It's the old Calvary Robotics building.

The same company or what's the deal?

Um, I believe they sold or were bought, but they're rebranding. So,

but is it's still the same company, same owners or

uh I can't speak to if it's the same owners. I I'm I'm not 100% sure, but I think either they were bought or they were sold. Calvary [clears throat] was

the same type of manufacturing,

I believe. So, yes.

Could you tell me why the sign is located to the right on the top there?

I'm sorry.

Not in the middle. The sign isn't located in the middle. I'm just curious why it's all the way over to the right.

Uh that's exactly where the placement of the current sign is.

Okay. Right there. Is are you comfortable with that, Josh? I mean, it's the same type of an operation, so I don't think there really need to.

Yeah. As long as the material nature of the business isn't changing,

that's fine.

And you've got it designed according to the code. So, all right. Anybody any questions on that or?

Nope.

None there. Also,

you want to do a secret around it?

Yeah. Town Western Plan Board consider request by applicant Steve Stanley from Vital Signs to install one internally lit 60q ft wall sign on a 44.14 acre parcel having SPL number 079.06-1-32.11 located at 855 Publishers Parkway. The planning board classifies a proposed action as a type two action under section 617.5C9 of the state environmental quality review regulations and therefore is not subject to further review.

Okay, that a motion. We need a second.

Second.

Have a second. All in favor?

I

Okay. So, make a motion on it.

I'll make a motion. [clears throat]

I'd like to make a motion to approve the NVO sign located at 855 Publishers Parkway. The sign approval is associated with the installation of one illuminated wall sign on a 44.14 acre parcel and it's located in an office park district under section 265-7 of the code of the town of Webster.

Okay. You might want to put in there your drawing V. I guess it's V1 V.1

V.2 V.2.

Is that what it is? that one.

One is the original one.

Oh, that's on the new joint. I'm saying the original one. Yeah. Okay. All right. All right. That's a motion.

Seconded.

Have a second.

Mr. Jardina.

Hi,

Mr. Malta. [clears throat] Hi,

Mr.

Hi,

Mr. Anderson.

Hi,

Mr. Better. [clears throat]

Hi,

Mr. Gassic.

Hi,

Miss M.

Hi.

Okay, good. All set. Thank you very much. Have a good night.

Have a good night. Thank you. Also, [clears throat]

second item on tonight's agenda, Bay Ridge Corner Reubdivision located at 423, 425, and 429 Ridge Road and 1036 1036A Bay Road. The applicant is stock Misdale, Misdale, excuse me, uh requesting final site plan approval in association with the proposed reubdition lot line adjustments of five single family residential lots into four single family residential lots on a 2.5 acres located in an R3 single family residential district under sections [cough] 269-11 11 296-14 and 350-12 of the code of the town of Webster.

Good evening.

Yes, sir.

I'm Walt Baker with DSP Engineers. With me tonight is Scott Misay, the surveyor for the project. As the board will recall, we were here last May uh with a couple revisions that had to be done in uh prior to that meeting and uh we received preliminary approval in May with the condition that we go to the zoning board and seek the variances which were noted on the plan based on the fact the uh property lines from the 1920s 1930s.

Yeah, somewhere around there. Some of them go right through buildings. So obviously uh in order to uh sell the properties, property lines had to be corrected. So uh we were calling it a lot line revision and adjustment and uh we showed that on the maps. We did receive preliminary from the planning board with the condition going to the zoning board which we did last month. We're at the ZVA and uh they agreed with all the revisions we proposed. So uh they also gave us uh final approval for that and condition with the planning board is we had to come back after the zoning board meeting uh for final approval site plan approval and then uh we could take the map to the county for filing and get the lot lines corrected.

Okay. Thanks. Yeah, we had we've had this a few times. It's been in something that was done years ago and

God only knows how they ever came up with the the design of that thing. Uh I think the biggest one of the biggest concerns we had was the the septic systems.

Correct.

And that's you redid them all. That's that's all in good shape now.

And other than that, I don't have any concerns. Anybody?

And there was an issue with the drainage to the south property owner, the adjacent [snorts] property owner.

What's that one?

The guy to the south had concerns because he had a ponding in his yard. So, uh we met with him and we revised that. Put a culvert under our driveway to drain it to the creek channel. And uh the gentleman's real happy now.

Okay.

Did a good job.

You got all your variances and everything, so you're set with that. All right.

Um this is for final. So we don't need to do a seeker on this. Anybody have any concerns or somebody want to make a motion for approval of this site?

Didn't we already do a seeker? Yeah, we did. I don't have the drawing number. I'll make a motion that we approve the Bay Ridge Bay Ridge Corner subdivision at 423, 425, 429, and uh 1036 and 1036A of Bay Road. The applicant was Scott Measley. Okay. Okay. And we're looking for final approval, which I believe they've conformed to everything. Engineering was satisfied. They received the necessary variances. And so I make a motion that we approve that site as presented.

Second.

Seconded.

Mr. Kani.

Hi.

Mr. Jardina.

Hi.

Mr. Malta.

Hi.

Mr. Anderson.

Hi.

Mr. Better.

Hi.

Mr. Gassic.

Hi.

Mrs. Bman.

Hi.

Okay. You're all set.

All right. Good luck.

Thank you very much.

Yep. I'll see you guys.

Next item on tonight's agenda is Seven Brew located at Hard Road. Applicant brew team New York. LLC. Doug Beichel is requesting final site plan approval in association with the development of a 510 square foot prefabricated double drive through only coffee stand on a 0.73 acre parcel located in a highintensity district under sections 269-11 and 350-9 of the code of the town of Webster.

Yes, sir.

Hi. Good evening. Uh Doug Beechel with this uh Brew Team New York LLC. We're a franchisee of 7 Brew Coffee. Um here seeking final site plan approval for our Seven Brew Coffee Shop on Hard Road. Um, we've made some modifications since our last appearance with the bio retention facility in front and a couple other engineering concerns that we've we believe we've we've addressed satisfactorily with uh the engineering staff.

Okay. Um, there were I don't think we want to go through them all, but I guess Josh, as far as the PRC comments, they sent back all the revisions and modifications.

Yes.

Is engineering all okay with that stuff? I not to go through them all.

Yes. Our understanding is that the engineering department um has accepted the responses and the additional information that was provided.

Okay. And with that, is anybody who've gone through you okay with them? You all right with so? All right. Um, I was over there the other day after we had that heavy rain and that swale that's in the front goes across the properties. I wanted to see how that was working. And I went over there Sunday morning after Saturday's heavy rain and it was working. The water had subsided, gone down. This is not to do with you, but the project next door, Popeye's there. They have white birch trees, some beautiful trees, probably about a 3, 4 inch caliber, and they planted them right in the center bottom of the swale. Why is beyond me?

Yeah.

And the water was laying there. They are not going to survive. They're going to die. I'm sure

they're setting right in water.

Now, back to yours. Hope you're not doing the same thing. No, our revision that added landscaping to that has additional trees to sort of mimic what they're doing there, but they're on the ups slope

on the sides.

Yeah. Okay. So, you have All right.

And then part of what Popeye's did actually they infringed onto your site by oh gosh, I don't know, maybe looks like about 20 feet or something with their landscaping. If you look at it, you look where the lot line is about 20 feet of it.

Yeah. Yeah. And ultimately we're going to connect.

See it there? Yeah. See it right there.

Right. [snorts] Yeah. So there's Yeah. Some of their trees do spill over.

Yeah. So now your site is going from there uh going down just continuing landscaping, but nothing dead in the bottom of the swale. Correct.

Correct. I mean there there will be a there will be a structure inlet structure down there with a pipe that connects over to the inlet structure to the north and the Popeyes.

Okay. Now, have have we got have we got us a landscape drawing of that? Has that been presented?

Yeah,

because I think it's something we asked a preliminary. It should be done for final approval.

I sent the uh most upto-date version of these plans to all of the planning board members via email. So, you should have received that.

Okay. You got it there?

Should be. It's

I think it's right there. Right there. Yep. And then there's [clears throat] a table on the right that identifies

what it is.

Yep. Okay. There's I think there's actually I think we had a revision past that that we sent that shows at least four trees in the front and we eliminated some of that um landscaping around the burm in order to at the end of the drive-thru to kind of accommodate larger trees that

may or may not have been sent along. I'm not sure. When that whole project initially came in with Dairy Queen and Taco Bell and so on, that was one of the things the engineers showed was that swale going through there landscaping and so far it's looking pretty decent. Um, this I think will add to it too. So, okay, I'm okay with that. You guys all right with this?

Yep.

All right. Any questions on it? They've addressed all the engineering details. We saw the bill Oh, got a couple of things though is we brought up at preliminary. The lights are extremely bright at night. Those you can dim down, you said. Correct.

What we have now is we have uh shielding. So, it's basically sort of a it's a it's a aluminum shield that goes over the front of those. Okay. So, that'll make it sort of a down light. Um we can no longer dim them because they flicker with that particular LED module. Okay.

[snorts]

So, uh, the shielding is used in municipalities that would like a less bright option and those that detail is typically on our elevation drawings. Um, and it is on these I checked last week. However, um, you know, I would make that a condition of our building permit that they're they're captured in the building drawings. And also I think we brought up the speakers. You can

dial those down to if they become extremely loud and there's any concern by people because with car dealers they used to put these speakers and you know Charlie we need you blah blah blah

and everybody around was like hey what's going on with this? So that all got changed. So the bottom line is everybody's kind of queued up with that so you can do the same.

Yep.

Okay. That's great. All right. I guess we're good with it. Tony, just just I do want to note cuz he has also mentioned it. Um, we want to make sure in the approval if there is an approval that we mentioned the right revision because the updated plants that Erica circulated again those BMS in the back are not there but there's four trees and then he also has a storm piping to collect the snow storage which is the part that we asked them to account account for. So there's extra piping there where the curb is and a catch basin there as well. So that's why there's no uh landscaping small BMS there. So we just want to make sure that we say like revision I think it's five

is the most up-to-date revision that uh accounts for the updated landscaping plan.

Okay.

You're good with that then?

Mhm.

All right. Anybody else? Anything?

What's that?

Okay.

All right. Um, again, this is in for final approval. Anybody any other concerns or

nothing? Somebody want to make a motion for this?

I'll make a motion for final approval [cough] for the seven brew located on Hard Road. Uh, subject to project review committee comments. Uh, subject to preliminary approval conditions. Subject to all applicable government fees. Subject to the Department of Public Works approvals, significant construction shall occur within one year as deemed by the planning board to expire on July 7th, 2027. Conditions of preliminary and final approval are depicted on the cover page of the final design plans. Engineer for proposed project shall provide a letter of certification that all proposed work was completed as per planning board resolution of final approval before certificate of accuracy will be issued. Uh letter credit to the town project shown include the fee for engineers final inspection. All storm water facilities are to be constructed first subject to resolution of final approved minutes. The pools are subject to

drawing number. They have a drawing number.

What I've got here is well I had on on the drawing that we had was 90 91.193 and v revision date was 4926.

The most revision date is 629.

That's what I was going to All right. Yeah. What is it?

629.

629. Okay. That's the latest one. All right.

Okay. That's a motion.

All right. That's your motion. You might want to add Let me see. I've made a few notes.

They had the lights be you want to put in the volume control

should be involved with that, you know, in your resolution,

right? And also the uh

and and the lights being

the dice

the lights being shielded.

Yeah.

And I think those are the two biggest things that we didn't have in there. Anything else? Anybody? No, I think

well just a minor point. Uh

oh, go ahead.

The sign. Is there a sign for seven brew? And if there is, can we have a numeric number address put on it?

I don't know if they've come in. Have you got a sign application to or no?

No. Typically our sign package is is our building mounted signage, but is the request that there's an address placed on the building? Yeah, I think we have I don't know that we have an address assigned to this. So, um we have to research that because there's there's a gap between Popeye's and the bank next to us. I think it goes from 929 to 935. So, this individual parcel, as far as I can tell, doesn't have an address. So, we'll

the rest of the board think that they should make an effort to get back to us with a sign and another I don't know. What do you think, Josh? I mean, should they have a separate

So, yeah, [clears throat] since they're not proposing a monument sign, um, there is a requirement anyway for emergency services that the address be located somewhere on the front of the building. And once the assessor officially assigns the address, that would be a requirement anyway. So, do we So, what do we do now with regard to the sign then?

Well, it doesn't necessarily have to be on the sign.

No, I'm not talking about just that, but this the sign is already included. Is it a lit sign? We don't know.

The sign on the on the building, correct?

Right. That's what I'm talking about.

Let me see if we have

What is the sign? What does your sign on the building actually look like? They're in the elevation drawings which

were part of one of the initial applications. I'm not sure if they're part of these revised civil drawings.

So, yeah, there's a there's a circular sign on the front of the building. There's a sign on each side of it. And then there's um a couple of directional signages. Signage down low like you see typical

entrance and so on.

Yeah. And then there's these chevrons on two sides of the building that are basically an arrow that are directional as well. And they say this way for coffee. I forget what they say to be honest. Now I'm drawing a bike. Um, but there's two of those. And typically they don't usually factor into sign calculations, but

should we ask the applicant to come back in with the drawing so we can get an idea what it looks like?

Oh, there you go.

Right there. Yeah. A 1.1 A 1.2. Those are

Okay. That's the sign that's going to be going on the building, correct?

Yes.

Okay. And then you have one on either side.

Yeah. If you scroll down to the next page.

Yep.

There's one on both sides over the side entrances.

All right.

And then if you scroll up again, um,

now are they they all they meet encoders? one excessive by code

in terms of the size in relation to the facade of the building.

We'd have to do some calculations to confirm.

Oh boy.

Well, so you know, maybe you I mean generally you're going to need a sign showing entrance. you're going to, you know, exit, uh, different signs like like any fast food place has. Maybe we should have just a pack, you know, approve that as a separate package.

Is that separate than building permit for signage? Is there a separate permit than

I think you could No, we could give a final approval, but just make it subject to [cough] within the next month.

Yeah, I can. You present a drawing to the town of whatever signs because I don't know how many you've got there. It's hard to tell, you know.

Yeah.

Where you're going to place them and so on and so forth.

Yeah. I have a package I can put together shows square footage where they are on this particular site plan.

Okay. So, in the resolution, there's no signage included, Dave. Right.

Right.

All right. And what else did we have? That was it. Landscaping. We had that. Uh snow storage.

I think we asked for that.

Yeah, there's snow storage along the perimeter of the property. There's a sort of basically we put a a gravel shoulder behind the between the curb and the property line.

Figure it out.

And then we have an under drain that will help with the mitigation or the dispersion of water. And then we have a note on the site plan for um right there circled in red basically saying that if there's any time that the lanes are blocked or there's excessive snow that would be loaded and trucked off site.

Right.

Okay. And I remember asking that was one of the things we required.

All right. Anything else?

Yeah, just one thing. The new landscaping plan does have a birch tree in the swale.

Are you serious? Just cuz you mentioned it, I'm bringing it up. Maybe if you want to move it outside of the swale area, but right now you have two trees that are in the swale area.

That's good. Nice catch.

Maybe you should put that in there. No plantings directly in the swale either side. Landscaping should be

I thought they were on that first on that first topo line. I guess I was,

you know.

Yeah, we'll include that in the

All right. Okay, that's in there. Okay, that's motion. Need a second.

Second.

Have a second. M

Mr. Malta.

Hi,

Mr. Jassic.

Hi,

Mrs. Maltton.

Hi, Mr. Better.

Hi,

Mr. Anderson.

Hi,

Mr. Jardino.

Hi,

Mr. Pashan.

Hi.

Okay, good luck with your project.

Thank you. Appreciate it. Yeah, if you can just get a landscape landscape, if you can just get your uh signage plan in, give it to Josh, you know, prior to

Yeah, those are I I can turn those around if I

But you're al you're you're good to go with this right now.

Well, we're we're going to be moving quickly. So,

how's the other place going up there? I see cars are training and doing stuff.

Yeah, training. Saturday, I think Saturday, even though it was the 4th, was our caffeine for a cause day where we give away free drinks in exchange for donation.

Um, I haven't followed up on the results of that, and I'm not sure who the the local charity was.

This is free commercial time, so go ahead.

Yeah. So, it it's it's it's doing very well, but the actual tech technical open date is the 13th. So,

well, good luck with this.

It's coming up.

I'm sure you're going to do well there.

Yeah. No, it's they're they've been they've been received um rather well in this market. So, we're we got plenty more coming.

Good luck. Thank you. Appreciate it.

Have a good night.

Next item on the agenda is an accessory structure located at 1052 Lake Road. The applicant, Amanda Castanza, AIA, whatever that means, is requesting preliminary final site plan approval in a public hearing in association with the construction of a 615 ft accessory building on a 0.55 acre parcel located in an R1 single family residential district under section 350-36 of the code of the town of Webster. Hi. Um, we're the homeowners, U Cam and Wayne Gandandy. Uh, Amanda Castanza is our architect who is in Hawaii celebrating her mother's 80th birthday today. So, we didn't make her come here. So, hopefully we can answer all of your questions effectively.

Wish her well for us.

Pardon?

Wish her well.

Yes. Um so um the project consists of demolishing an existing twostory structure at 1052 Lake Road and combining the lot with our lot at 1050 Lake Road and um building an accessory structure using part of the foundation of the um existing home um a [clears throat] much smaller format. Um, we have already received review by the Army Corps as well as a permit from the DEEC and Amanda has worked very closely with the town uh regarding the various um variances that we have to get and we were before the zoning board in May and got those variances approved. Um so now we're here at the planning board to get this approved as well.

Okay.

Okay. Anybody had any issues with it or what was it 600 and some square feet I think it was

indoors. Yeah.

Was that right?

The indoors.

Yes.

Yeah.

And then the the other additional is the is the overhang. So we have outdoor space.

Okay. Materials on it similar to the house. How you make it look what it looks like.

We're trying to make it look like one property or the post.

Nice. And it's strictly for storage and things like that. Not no apartment, no part of the reason for rentals to rent stuff, you know, storage space and stuff. Okay. Right.

Yes. That's exactly why we were interested in purchasing the property was to prevent [snorts] uh Airbnb from

taking over.

Okay.

This application includes a public hearing.

Yeah. The board. I'm sorry.

You okay with it? Now I know you guys are all right with this too. All right. Again, this is a public hearing. So if there is anyone here, neighbors or anyone wishing to speak either for or against this. [clears throat] Not seeing anybody. Then we'll we'll close the public hearing. Bring it back up to the board.

Oh, looks good to me.

Yeah, I love the landscaping.

Yeah, it's

nice area. Only thing I'd suggest is probably have to you're going to demolish the house, the current house. [clears throat and cough] Then you're going to combine that to lot 1050.

Yes.

Okay. Then you're going to start the project. So you really should combine it because you can't put a can't put this thing on that lot as as it stands today. So you're going to need to combine the lots together and then you can put the building up. Correct.

Yes.

Okay. We're good with that.

All right. Dave or

the landscaping boulders that are being put in are are those in the water as in you're going to be doing work in the water or outside the water?

This is on the south side.

On the south side. Okay.

Yeah. So, actually you're taking the driveway out so there'll be actually more green space.

So, there'll be less water runoff. So, that's another ad.

Got it. Uh, okay. Good. Yeah.

Derek, you want to do a secret?

Yep.

Uh, town wiser planning board consider request by applicant, excuse me, Amanda Castanza AAA to construct a 615T accessory building and a 0.55 acre parcel having SPL number 049.11-1-15 located at 10 52 Lake Road and an R1 single family residential district. The planning board classifies the pro proposed action as a type two action under section 617. C2 of the state environmental quad review regulations and therefore is not subject to further review.

Okay. Motion second.

Second.

All in favor?

I.

I. Okay. Motion [clears throat] for the accessory building.

I'll make a motion for the accessory structure located at 1052 Lake Road. Um the lot is restricted to one accessory building. The building is to conform to the size and location presented in the plan. Placement of the building shall conform to all setback requirements. Um and is that building going to be placed uh closer to the road than your house?

No.

No. Okay. building should not be placed nearer to the front property line than the rear line or the footprint of the main building or residence upon the lot. Um, no point on the building will be higher than the existing structure. No commercial use shall occur on the parcel. The accessory building shall be used for personal use only as defined by the town code. Significant construction shall occur within one year as deemed by the planning board to expire on July 7th, 2027. Going to comply with all requirements of any state, county, and town agency. All site workers be in compliance with the standards of the town of Webster. Subject to all engineering and governmental approvals. Subject to all appropriate governmental fees. Subject to resolution of final approvements. Probably should put in there, Dave, that [clears throat] no construction of the building until the two lots are combined.

Yep. Hey, go ahead. Add that.

Okay,

that's your motion.

That's the motion.

Okay, you need a second.

Second.

Have a second.

All right, Mr. Malta.

Hi,

Mr. Jardina.

Hi,

Mr. Pashani.

Hi,

Mr. Anderson.

Hi,

Mr. Better.

Hi,

Mr. Gassic.

Hi,

Mrs. Maltman.

I

Okay, we have to do a final approval on this also. has to be a separate.

I'll make a motion for the final approval for the accessory structure at located at 1052 Lake Road.

It's exactly the same as the preliminary

subject to all preliminary approvals.

Say just sub to all preliminary approvals.

You want to set Did you already put in there preliminary for time?

Yeah.

Construction to begin with a year.

I already did that.

Okay. Then you got then that's it. That's The final approval is the same as it.

Second.

Have a second.

Okay. Mr. Malta.

Hi.

Mr. Gardina.

Hi.

Mr. Fishani.

Hi.

Mr. Anderson.

Hi.

Mr. Veter.

Hi.

Mr. Gassic.

Hi.

Mrs. Mner.

Hi.

Okay. Good luck with your project.

Thank you.

Thank you very much. Have a great evening.

Have a good night.

The fifth scheduled item on tonight's agenda is Sienna Reserve located on Orchard Road. The applicant Insight Land Development Incorporated is requesting a one-year final site plan and subdivision approval extension along with a public hearing associated with the creation of 10 single family lots on a 5.94 acre parcel located in an R3 single family residential district under sections 269-10 296 6-27 and 350-12 of the code of the town of Webster.

Yes, sir.

Good evening. My name is Mike Boacheski with BME Associates. Um, with me tonight also is Rudy Newfeld from Insight Land Development. Um, the summary of the project um covered it pretty well. Um, Rudy's looking for a one-year approval extension. The Sienna Reserve was a 10 lot subdivision that was approved um in August of 2025.

Um and he's basically just looking to um for the the approval extension just to to allow his construction scheduling to to work out for them. Um so no changes to the project are proposed. Um just just looking for the approval extension tonight. Mhm.

That project was under H homeowners association, wasn't it? I believe Rudy

that was under homeowners association that project. Yeah, remember that

all.

Okay.

And the sewer, you're okay with all the sewer connection coming through. You got and all that.

Yep. That's

So you're good with that? All right.

No, no changes to the to the sign.

There's nothing other than just an a one-year request for extension. Anybody any issues? I have no issues with that.

I'm sorry.

Yeah. Well, it's not a public hearing, but if you want if you want to say something.

Yes, it is. It is a public

I'm sorry. It is. I take that back. It is. Yes. Go ahead.

You got to go give us your name and address.

Yes. My name is Cliff Kane. I live at 781 Blue Creek

and I have some questions as far as as as far as the water in this retention pond here and then also they have a spillway and then also where is the um waste water? Where is that going? Because right currently the way it is right now if we have excessive rain we we've got excessive uh flooding in our backyard. So, how how was when you look at this spillway and this and then also this um or I'm sorry, the retention pond and then the spillway, it actually will spill right over into those properties on Linda Lane and it's already a swamp back there when we get excessive rain. So, has that been addressed?

Boy, I don't recall off the top of my head now with it, but had to have been addressed somewhere back in there. But you're bringing up a legitimate question

cuz the past two years we've had two floods in our backyards where we get 3T of water and the water gets within about 15 ft of our house.

Okay. So So part of that [clears throat] part of that would be resolved by the development of the detention pond. That's the purpose for the pond. You probably got more water running off of that property right now than once that pond is developed because that'll hold the water. it'll fill and release it slower than what it was.

So, you think there's going to be less less water going towards our property? Then

it'll it'll go slower. It's going to be as much water ultimately, but

because it looks because it looks as though they're grading the the whole um all the the homes are being graded towards that. So, my concern is that now that is how is it currently graded? And then when they change the grading, will that even increase the amount of water that's going towards those properties? I don't have the answer to that, but that's just a question I have.

We could have we could have your engineer respond to it.

Sure. Go ahead.

No, my the other question just had to do with the storm drain where they tie into the storm drain because we have a storm drain at a corner back corner of our property and then when we get that excessive rain, that storm drain can't handle it and that's where we get the flooding. So I was just wondering if you're tying into the existing storm drains also that could be problematic with heavy rains also.

We can have

Yeah, he can he can address that for you.

Okay. So, I um the subdivision design um that was approved back in August includes a storm water management facility in that northwest corner. Um that basically is is designed it's to handle the storm water runoff for the proposed subdivision um but also work with the existing drainage patterns. Um, so we're not changing existing drainage patterns. Um, but we are proposing the storm water facility to handle any of the runoff from the the roadway and new houses um that are proposed. Um, eventually it does go to the northwest. I believe there's an existing uh storm sewer and section that it all flows to um that are that's in the rear yards of some of the houses on Blue Creek Drive. But that's not being um connected to um the pond itself will will discharge um and daylight into the the existing swale, but then then it flows north into

that existing storm sewer to the north. And those the the SWIP the storm water pollution prevention plan along with the design of the pond was all reviewed back with the the original approval. Mhm.

Okay.

I have a concern. [clears throat]

If you want if you want to speak, you have to go up to the microphone. If you wanted to add something, go ahead. When you put in these properties, you're putting in roads and driveways and you're taking away a lot of the green that's right now that prevents some of the probably some of the flooding, I I think you're just going to exasperate the issue with rain and water going towards those uh towards Linda Lane and where in the back of those properties on Blue Creek where we're already having water issues when we get excessive water, especially, you know, springtime when you get the winter melt and then heavy rains. So, all right. Thank you.

That pond should take care of the drainage from that site.

That was that was the purpose.

Hi, just a just a quick question. Hi, how are you? Kevin Lockhart 100-2 Kbury Park. I see that the uh development is adding a new street Whispering Trap, what is it called? Whispering Pines. No, we already have that, right?

Pine whispering.

So, um I think what a lot of people are sensitive to was the proximity to the bird sanctuary trail. I know when you walk down the sanctuary trail that the developments can affect the sanctuary trail and the is the town I believe the towns that's town property the sanctuary trail.

Yeah, we're not open dialogue. You can just say whatever you you've got to say and then we're not going to answer questions, but if you it's an open forum. You can say whatever you need to say. Be done. We'll we'll take that into the

I didn't even hear you. What was your question? [clears throat]

So I suppose my question

bird song the park is that parkland.

Yeah. So I suppose what people are sensitive to is the proximity of the development. it kind of the the geometry of the development cuts into or at least is adjacent runs directly parallel to the bird song trail and so I just wonder if the if there's enough scrutiny being looked into the setbacks and the

well Kevin you the those are good points but these are all the issues when this thing came in time after time after time to reach this point and it received final approval so right now That's all been approved. And again, it's this is like any other subdivision. You know, we all love the trees, but there's

I think the other thing to note there is that they did voluntarily add a conservation easement on that site, a 65 ft conservation easement.

They did in the back.

Exactly. So, there's there's that that's built in as a buffer and protection against the trail.

And that was the purpose. Good point, too. That was the purpose when we approved it to save that piece. All those those lots go back, but they can't build anything in there on them. If you see the drawing, you see that space in the back. So,

yeah, they have physical markers at the property lines indicating a conservation easement that you're not allowed to clear or build anything in that conservation easement. And that's 65 ft from the landowner's property line inwards.

Great. So, I'll let people know that it's not inc that you guys did your due diligence not to encroach on the bird song trail. No, it won't do that at all. No.

Okay, great. Thanks.

Okay. Thanks, Kevin.

Okay. Anybody else?

Yes, sir.

Hi. Uh, Dan Dermasich, 789 Blue Creek Drive, neatly buffering the Sienna project. Hi, Rudy. Uh so I'm not raising any additional issues because my understanding is that everything is pretty much remaining the same. However, the issue that um Cliff is raising uh in terms of the flood possible flooding I get flooding as well. My understanding uh from Rudy with the initial plans was that the retention pond would deal with that the overflow of of water that I currently get right now uh from the uh right through the woods. You know, it just pours in so that uh I'm pretty close to what Cliff is describing uh as far as uh water in the backyard. So, I guess I just I'm up here for the purpose of clarifying a definitive answer to Cliff's concern is indeed, and if Rudy could respond to this or one of the engineers, uh will indeed is the

uh the response to that concern that the retention pond will deal with the overflow or are we subject to the possibility that it could still flood. How are we going to be sure that all that water is taken care of, that we won't be flooding again? So, that's the question. I And I think before you move on to another agenda item, that question should be dealt with. Okay. Thank you.

I'm If you you want to address that? I'm looking at the elevations. It look like there's a kind of a burm going across there. It's at 390 at the high side and it's all pitching down toward the pond which is 38 like 388 or something. It's it's dropping down. So the water is flowing to the pond according to what I'm looking at. And again that this got beat up pretty good back then. And that's why we designed it the way we did that. A lot of that woods is still there. The trees will still be in there. they won't be cut down and the pond should technically take care of the flow from that site and re and control the outflow. That that's correct. The the main thing to consider is the the storm water facility is designed to handle the runoff from the subdivision itself.

It's not designed to handle the runoff from the existing houses. Um there are existing swailes and storm tour end sections that receive some of that runoff around the those rear yards of the existing subdivision to the north. The the main factor for the proposed subdivision is the runoff from the new um houses and and roadways and the new development is mitigated with the with the proposed storm water facility. um that facility is meant to um handle the the runoff from the the development and then release it at slower rates like you said. Um so there there's a bit of a there's a two factors to to consider the runoff from the proposed development and then existing runoff from the existing subdivision to the north as well. The pond itself is designed to handle the runoff from from the subdivision and then maintain existing drainage patterns.

And and just know what you mean by that is you're detaining the water

to existing flows or less from what it was before.

You have a deep pool system here with aquatic benches. So it's going to store water on site permanently too over time

uh to some extent. But something to note is just like like you mentioned, you're you're managing looks like stuff items that are the the water quality, water quantity that's within your footprint of your project. But there is like you mentioned a bypass swale that is an existing swale on uh last name is gentle inflammia out there on the west side that goes all the way to the road. So, it looks like there's an existing swale there already that has drainage coming from the road bypassing your buyer retention and then going to those neighbors that are here with the concern of flooding too. So, um I I Yeah, I

Yeah, I'm not sure if you can see it up in the screen right next to the bio retention. You'll see the contours there, the lines. It's a It's a swale. Looks like it right there that goes all the way from the road and then goes up that way. Actually, this came in and was allowed to build with the smaller lots and that's that's how we end up creating that conservation easement in the back on both sides and the pond falls into under the HOA's jurisdiction to maintain. That's why we allowed that pond to be on those combined lots. Like they were there with more than a lot, but

that's correct. And part of part of utilizing So it was a cluster subdivision. Part of utilizing that cluster subdivision was to maintain the wooded buffers on either side. That clustering helps to reduce the overall footprint of the development, thus also helping to reduce some of the runoff. It's one of the it's one of the design factors of the of the subdivision. [cough] I believe is this. Did you see them on there? Similar drive. I think we had markers for the

Yeah, they're open space.

Yes, there are open space markers.

Okay. Because that that's the idea of those markers is to preserve that land. So, nobody that buys a house in there is going to go beyond that and start increasing their yard. Even though they own the piece of property, [clears throat] they can't go in there and cut the trees. Okay. All right. I So, anyways, the whole purpose of this this evening is a one-year extension request.

The trees over the roots.

Wait a minute. You if you want to talk, first of all, you have to come up to the microphone. But we're not going to re redesign this whole project. It's been done. And we're rehashing old stuff now.

You don't care about the environment?

Oh, I don't care about the environment. Thank you.

It's Gregor Scheler, 793 Blue Creek Drive. I have concern if you're going to be regrading the trees that you're trying to save, you put dirt over their root system, they die over time. So, how are you going to regrade without killing the trees that we're trying to save?

Because there's no grading being done back there whatsoever. then all the water is going to keep coming into my yard and my neighbor's yard because we're like this much higher lower than the property. So, it's just if you're not going to grade it, it's just going to come in.

Thank you. Is there any do you have anything else other than to add on?

Perfect.

Thank you.

I want to make a quick comment about

uh you can make you got one minute comment. We're not going to answer questions. Just a quick comment. So Kevin Mockart-2 Kettleber Park in the interest of preserving these people's interests and their home values and so on and so forth on Blue Creek. It occurred to me that there does not appear to be a gradient map and so when they talk about there when they talk about the grades and the gradients um I can't really follow along but I think because there's no gradient map

the maps show all of that stuff.

Well where does

there's elevations all over the maps

is it? It's up here, Kevin.

Um, while I'm looking at this Oh, wait. Is this not uploaded to the uh agenda packet for tonight?

So, is that not I'm not looking at that. I'm looking at something very similar to that.

So, where would people be able to access that the same document just

access what? We're not going to answer We're not Hold on. We're not going to answer any questions. We got your concern. Is there any other concern that you'd like to put? Yeah, my concern is that I'm not sure where people would be able to like let's say these residents want to go back home to Blue Creek and they want to examine the the gradient map.

Where could they gain access to that?

Thank you. We're not answering questions. I we know your concern. We take

appreciate you, Frank. Um, but can you make sure that these folks get a copy of that just for their reference? And then

if there's if there's anything that they're interested in that, they can go up to the town hall

and see see Erica maybe in this case and she would show you the map.

But the it's the thing is it's already been an approved subdivision. Nothing's going to change.

Well, if it's approved, why was it approved if they still have concerns tonight?

They had concerns before and they had to address them.

Did you guys Did you guys properly address their concerns?

We're going to stop. We're going to stop. Does you have anything else to add?

Yeah, I want to just make sure that these folks concerns with the gradients be in and the drainage is being properly addressed by you guys prior to moving forward.

Thank you.

Okay. Thanks.

Thank you. [snorts] I'll be very quick uh just to comment uh on the whole process of the decision making and what we could label I guess unintended consequences that we're not really sure you know if this is going to work 100% in terms of preventing the runoff and increasing the water that will be in our backyard. So, I guess what I'm warning you about as a planning board is the unintended consequences. And if they happen, who's going to be responsible for dealing with those? Is it going to be the HOA? Is it going to be Rudy and his company? Or is it going to be the town of Webster that's going to come in and say, "Well, we need bigger sewer drainage, I guess, in terms of going out, you know, toward Lake Ontario or whatever." But somebody should be asking that question in terms of unintended consequences of more water being in our backyard.

These questions were questions that were answered at sketch plan at preliminary and final approval which were several meetings along the way. All these things I don't know if you attended them. Were you living there at the time too or Okay, then you probably were here.

Well, I probably was. I was definitely

well that's the same drawing

but I I would hope you as good we heard you with concerns that citizens have

and as opposed to putting us down saying that's a good question we ought to be able to deal with that as all I'm saying

thank you all right [clears throat] anybody else nothing okay I'm going to close the public hearing bring it back up to the board. Yes, sir.

Go ahead.

Um, I'm going to look to the board for if you guys have any questions that you want me to get addressed, further details, if there's any other questions on the Rudy's construction schedule, the original approved plans, anything like that.

Well, I think we spent a lot of time when this was approved. I remember that.

I do know that. Yes. And there were a lot of concerns, a lot of questions asked and a lot of redesigning and so on and so forth. And that size of that pond was to control the water flowing off that property. Now, elevations and stuff, I'm sure they're accurate and the low point is right where the pond is. So,

on a time,

that's the generic little bit of review I'm looking at right now. On a time scale, when do you think the pond will the pond be done within the year extension or when do you is there a time period for when the pond starts?

I think you put in the resolution all infrastructure to be put in before you start building. So the pond would go in.

Yeah. And so from a from a construction sequencing standpoint, I I think this might answer your question a little bit better. From a construction sequencing standpoint, the pond is the first thing to go in. I understand that you have a time period right now maybe to alleviate some of the concerns of the people that are living there especially right now actually had a pretty rainy summer to begin that pond.

Is there any time schedule?

I believe with the approval extension that would allow Rudy to get into construction within the next year.

So you don't have it next month or you don't have anything set right now? No, I think that's that's really what he's here tonight to ask for the extension so it allows him to to to work out his construction schedule.

Does he intend to break ground within the year extension?

Yes.

Mhm.

Okay. But Frank, yeah, that pond would be one of the first things that goes in that drainage. I was hoping that perhaps they had

there would be no sense in putting a pond in going in disrupting the soil now just to put a pond in.

As far as the as far as existing drainage patterns to the to the rear yards to the north, the the pond itself is designed to handle the runoff from the the development itself.

There are other drainage patterns to the west to the north that don't come into play with the proposed development. There is the um like was mentioned the the culvert under Orchard Road to the west of the development that's not being um changed that flows to the north to those rear yards as well. Um there's drainage from the the east to the north of the property that flows from the existing subdivision to the rear yards goes into the existing storm service system as well. So the this development the proposed development itself has been designed to handle its own storm water and then not discharge

above existing rates to the north. So

hopefully that helps kind of answer that question.

Yeah.

Well, we're just hoping all the engineering was done properly to alleviate any of the drainage. And again, that was one of the issues that came up when the project came in.

Yep. is the proper drainage of that site to that pond. So

I have to assume that that's what current engineering is about.

Yep.

So based on that, the applicant again is in here for one-year extension on this site. Anyone make a motion to that? I'll make a motion that we grant a one-year extension to the Sienna Reserve located on Orchard Road as requested. And that extension is good. Uh one year. So this date is what's today? The 7th.

Mhm.

July 7th, 2027.

I'll second it.

Have a motion. Have a second.

Okay. Mr. Kishani.

Hi.

Mr. Malta.

Hi.

Mr. Jardina.

Hi.

Mr. Anderson.

Hi.

Mr. [clears throat] Better.

Hi.

Mr. Gassic.

Hi.

Mrs. Maltman.

Hi.

Okay. Good luck.

Thank you very much. Last item on tonight's agenda, Burger King sign modifications located at 940 Hard Road. The applicant JP Lang Henry is requesting sign approval associated with the installation of three wall signs totaling 73.65 square ft on a 17.03 03 acre parcel located in the highintensity commercial district under section 265-7 of the code of the town of Webster.

Hello, my name is Rana Cassiss, 6699 Old Thompson Road. Um, I'm [clears throat] here representing Cassiss Pier Signs. We're going to be doing the work installing the signage. Um, we're working with Blair Image Elements and Burger King. Basically, it's just a rebranding of the store and just updating the signage to their new branding look. um where they currently have two sets of illuminated channel letters. We'll be replacing it with one set of channel letters, adding a building logo to the east elevation.

Um let me double check. Adding a building logo sign um facing the street where there isn't signage now. Just one internally illuminated logo with an embossed face. It lessens the amount of light that goes through the face rather than a regular channel letter face. Um, and then on both sides of the building, there's going to be adding a crown fixture, light fixture to each side as well. So, and then they're going to be replacing the drive-through elements just to update the, you know, technology inside of those because they've been up for a long time. Pretty much like for like change, just updated technology on the inside. So,

looks attractive. Are they changing any of the exterior of the building or you don't know that?

Um I think they're modifying it slightly. Um if you see that elevation

I mean it looks Yeah, I see some

they're changing some stuff where that building logo goes. There is going to be a wall instead of having that window there.

Okay. Anybody have any issues with the sign? We got enough paperwork here. This looks like for a sign we got I thought fair wife was coming back. Oh yeah. [laughter] Anybody any concerns about the sign?

No.

Yeah, I'm okay with it.

Dave, you okay with it?

Yep.

It's just an improvement on it. It's modification. Same same building, same everything.

I'll do a secret.

You guys all right?

Yep.

Okay, that's fine. Somebody want to make a motion?

I'll do a secret first.

Yeah, I got to do a secret. Yeah.

At town plan board consider request by applicant P. Langry to install three wall mounted signs totaling 73.65 square ft and a 17.03 acre parcel having SPL number 079.15-1-3.1 located at 940 Hard Road in a highintensity commercial district. The planning board classifies a proposed action as a type two action under section 617.5C2 of the state's environmental quality review regulations and therefore is not subject to further review.

Okay, you have a motion need a second.

Second.

Have a second. All in favor?

I

Okay, so I'll make a motion for approval for the signs. Basically all the same signs, same areas, just modifying and changing

colors and so on and so forth. Anybody saying you want to make a motion approval on it? I'm not sure. Okay.

So, Jas, you want to do it?

Uh, sure.

Sure. Go ahead.

I have it typed up. So, I would like to make a motion uh to approve the signage received by JP Langard, the applicant for three wall signs totaling 73.65 square ft and a 17.03 uh acre parcel identified at SPL079.15-1-3.1 uh in accordance with uh section 265-7 of the town code. Second.

That's your motion again.

Mr. Gassic.

Hi,

Mr. Jardina.

Hi,

Mr. Maltman. Or I'm sorry, Mr. Malt Malta.

Hi,

Mr. Kishani.

Hi,

Mr. Anderson.

Hi,

Mr. Better.

Hi,

Mrs. Malt. Hi.

Okay, I guess you're all set.

Thank you for your time.

Have a good day.

Thank you. Last thing is approval of the June 2nd minutes.

June 2nd minutes a

I wasn't here so I can't

I'll make a motion. Second favor. Hi.

Hi.

There you go, Tony.

That's it.

Okay, I guess with that, we're done for the evening.
