The parking of vehicles is hereby prohibited on all Town highways and county roads within the Town of Webster and outside the Village of Webster, between 12:00 midnight and 7:00 a.m. from November 1 to April 1. [Amended 3-25-1982; 9-23-1982]
B.
In the event that a motor or other vehicle shall be parked or standing in violation of the above subsection, the Town Highway Superintendent and/or the Town of Webster Police Department is hereby authorized to have such vehicle removed by such commercial towing service as may be available within the Town. The owner of the vehicle so removed shall pay such towing and/or storage charges as may be levied for the removal of such vehicle. The payment of such charges shall be in addition to any fine levied under the provisions of this article. [Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
§ 320-3. Penalties for offenses. [Amended 4-2-1987; 9-7-1989; 9-2-2004 by L.L. No. 3-2004] A.
A violation of this article is hereby declared to be a traffic infraction. Any person violating the same, by parking a vehicle in an area designated as a "no parking area" ("unauthorized parking") or by parking at a prohibited time in an area where parking is otherwise permitted ("overtime parking"),

shall, upon conviction, be punished by a fine not to exceed $25, except that any person violating this article by parking in areas designated as "fire lane" or "no parking fire lane" shall, upon conviction, be punished by a fine not to exceed $50. B.
If, after a period of 10 business days after issuance of notice of a violation for unauthorized parking or for overtime parking, the fines for such violations have not been paid in full to the Town of Webster, the fines for such violations shall double. [Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
C.
Additionally, in the event of nonpayment of such fines within 30 days after original issuance of notice of any of the within violations, the Town of Webster Police Department shall be authorized to issue a warrant for the arrest of any person who has committed a violation of this article and/or to refer collection of the relevant fine to a collection agency.

ARTICLE IX Speed Limits [Adopted 1-12-1967] § 320-11. Preamble. Whereas, the Town of Webster became a Suburban Town governed pursuant to Article 3-A of the Town Law of the State of New York on January 1, 1967, and whereas, § 1662-a of the Vehicle and Traffic Law of the State of New York provides that Suburban Towns governed pursuant to the aforesaid Article 3-A of the Town Law may establish maximum speeds at which vehicles may proceed within such Suburban Town on streets, roads and highways other than state highways maintained by the state on which the State Traffic Commission shall have established higher or lower speed limits than the statutory 50 miles per hour speed limit provided by § 1620 of the Vehicle and Traffic Law, now, therefore, be it resolved as follows. § 320-12. Maximum speed on all roads; exception. The maximum speed limit for vehicles within the Town of Webster on all roads on which the Town has the power and authority to set such maximum speed limits shall be 30 miles per hour except for such roads as this Board may specifically designate that higher or lower speed limits shall apply. § 320-13. § 320-14. Roads maintained by the state. No maximum speed limits are established hereby for the following roads which are state highways maintained by the state on which the State Traffic Commission has established speed limits: Lake Road west of Route 250 [Repealed 1-6-2011 by Res. No. 556] Route 104 Route 250 § 320-15. Applicability. This article shall apply only to public roads within the Town of Webster lying outside the corporate limits of the Village of Webster.

ARTICLE X Shopping Center Regulations [Adopted 8-8-1974 by L.L. No. 1-1974] § 320-16. Purpose. The purpose of this article shall be to improve and promote the health, safety and general welfare of the community pertaining to traffic regulations at parking areas of shopping centers. § 320-17. Authority to regulate and control. Pursuant to the authority granted under § 1660-a of the Vehicle and Traffic Law of the State of New York and in accordance with the written request of Webster Plaza located at Ridge Road and Hard Road, the Town of Webster does hereby authorize the Town of Webster to: A.
Prohibit, regulate, restrict or limit the stopping, standing or parking of vehicles in specified areas of the parking area.
B.
Order that a lane at least 30 feet wide be kept open in front of stores for the movement of traffic.
C.
Order that one-way traffic be maintained from the most southerly portion of the L-shaped building in a northerly direction and then westerly to exit on Hard Road.
D.
Adopt any such additional reasonable rules and regulations with respect to traffic and parking in a parking area as local conditions may require for the safety and convenience of the public or of the users of the parking area.
§ 320-18. Violations. The violation of this article adopted pursuant to § 1660-a of the Vehicle and Traffic Law of the State of New York shall constitute a traffic infraction within the meaning of § 1800 of the Vehicle and Traffic Law of the State of New York. § 320-19. Penalties for offenses. Every person convicted of a traffic infraction for a violation of any of the above provisions of this article adopted pursuant to § 1660-a of the Vehicle and Traffic Law of the State of New York shall, for the first conviction thereof, be punishable by a fine not to exceed $50 and for a second or subsequent conviction shall be punishable by a fine not to exceed $100.

ARTICLE XI Regulation of Vehicles on Public and Private Property [Adopted 5-11-1978 by L.L No. 2-1978] § 320-20. Title. [Amended 11-5-2009 by L.L. No. 3-2009] This article shall be known and may be cited as "Article XI, Regulation of Vehicles on Public and Private Property." § 320-21. Legislative intent. It is the purpose of this article to preserve and promote the health, safety and general welfare of those inhabitants of the Town of Webster who wish to use and operate motor-driven vehicles on private property or municipal property. It is also the purpose of this article to prevent those inhabitants of the Town of Webster who wish to use and operate motor-driven vehicles from trespassing on public or private property in the Town of Webster, from annoying inhabitants and from creating a public nuisance. § 320-22. Restrictions. [Amended 10-16-2025 by L.L. No. 1-2025] It shall be unlawful to operate or for the owner to permit the operation of any type of motor-driven vehicle or conveyance, including but not limited to two-wheeled vehicles known as "minibikes," "trail bikes" and "motorcycles" and four-wheeled motor vehicles known as "go-carts," and except no-wheeled vehicles, such as but not limited to snowmobiles and limited-use vehicles as defined in Article 1 of the Vehicle and Traffic Law, under the following circumstances: A.
On the private property of another person without the written permission of the owner or occupant of said property. Said written permission must be in the possession of the person operating the motordriven vehicle and must be presented upon demand to any peace officer or police officer so demanding.
B.
On any property owned, leased or controlled by the Town of Webster, except on trails duly designated by the Town for the use of such vehicles at the times and in the manner so designated.
C.
On privately owned property as follows:
D.
(1)
In such a manner as to create loud, unnecessary or unusual noise so as to disturb or interfere with the peace and quiet of other persons or that meets or exceeds the maximum permissible sound pressure levels set forth in Town Code § 209-5.
(2)
In a careless, reckless or negligent manner so as to endanger or be likely to endanger the safety and property of any person, including the operator of said vehicle.
(3)
At a rate of speed greater than reasonable or proper under the surrounding circumstances.
(4)
While in an intoxicated condition or under the influence of narcotics or drugs as defined by § 1192 of the Vehicle and Traffic Law.
(5)
Between sunset and sunrise or when lights are required for safety, without displaying at least one lighted headlight and taillight.
No person shall park any vehicle, as defined in Town Code § 324-2 , within a cul-de-sac, unless said vehicle is parallel to and immediately adjacent to the gutter. Parking of any vehicle in the center of a cul de sac shall be prohibited.

§ 320-23. Enforcement. The Webster Police Department through the Chief of Police of the Town of Webster, any other police officer and any other peace officer shall enforce the provisions of this article. § 320-24. Exceptions. This article shall not apply to police and emergency vehicles. § 320-25. Confiscation and redemption of vehicles. Any member of the Webster Police Department or any other enforcement officer who shall encounter any person operating a motor-driven vehicle or conveyance in violation of this article shall remove said vehicle or conveyance to a place designated by the Chief of Police. The owner or duly designated agent of the owner of such vehicle or conveyance may regain the same upon payment of all expenses and charges necessarily and actually incurred by the removal and/or storage of said vehicle or conveyance. § 320-26. Penalties for offenses. [Amended 2-10-1983 by L.L. No. 1-1983] A.
Any person, firm or corporation violating or permitting the violation of any provision of this article shall be guilty of a violation and shall be subject to a fine of not less than $10 or more than $100 or to imprisonment of not more than 15 days, or both such fine and imprisonment.
B.
In the case of a second or subsequent violation the court may order confiscation of said vehicle or conveyance in lieu of any fine and/or imprisonment. Any vehicle or conveyance which is confiscated, pursuant to this section, will be sold at public auction according to the appropriate procedures and laws affecting public auctions by municipalities.
C.
In the case of a third or subsequent violation any person, firm or corporation violating or permitting the violation of any of such provisions of this article shall be guilty of a misdemeanor and shall be subject to a fine of not less than $10 or more than $250 or to imprisonment of not more than one year, or both such fine and imprisonment.
D.
In addition, any and all persons, firms or corporations violating or permitting a violation of any of the provisions of this article or omitting or refusing to do any act required by this article, shall severally, for each and every violation and noncompliance respectively, be liable for a civil penalty of $50. The imposition of all penalties for any violation of this article shall not excuse the violation or permit it to continue. The application of the above penalties or the provisions of this article shall not be held to prevent the enforcement of this article by other action.
