Zoning Board Meeting
All right. 7:00.
Ready.
Okay. Uh, welcome to the uh Webster Town of Webster uh zoning board of appeals uh today of March 10th, 2026. Uh today we have two items uh on the agenda. Uh there are three tabled items uh for the April 14th uh meeting. Um when when we get to public comment uh period, we will limit to uh public comments to five minutes uh per public comment. Um, and because there's only uh two two uh applicants today, uh I don't suspect us uh running long, but if we uh get near 10:00, uh this board does reserve the right to um to table matters at that point. With that, uh stand for the pledge of allegiance. I pledge allegiance to the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible, with liberty and justice for all.
Mr. Short
here,
Mrs. Volo
here,
Mr. Spanada
here. Mr. Senola
here.
Mr. Corso
here.
Miss Corsy
here.
Mr. DeMarco
present.
Our first
first agenda item is for a special use permit for 261 Bulk Road. applicant Tammy Proof is requesting a special use permit to allow two potbelly pigs as pets. If you'd like to come up to the podium. Uh I would also like to put on the record that um the applicant did receive a previous special use permit that is set to expire I believe this month. Um, and along with that, you'll [clears throat] have a letter from the code enforcement officer stating that the property is in good condition. Uh, and there's no concerns from him. So,
I'm just reapplying. I guess I guess this is a new thing for you guys. So, you told me in 5 years to come back and here I am. I haven't had any problems with them. Okay.
Any questions from the board?
No, I we saw this application five years ago. Um there was a one-year check from the code enforcement officer with a letter of compliance and that it there were no issues. Um I visited the property and you wouldn't know it. It's a dog backyard or whatever.
Yep. Any any other questions from the board? No. Does anybody want to speak for against this project? No. Back to the board. Any other comments? No. Um make a motion for uh seeker uh pursuant 617.5.
Second.
All those in favor? All right.
All right.
Does this one mean do I have to come back in 5 years or am I like good at this point as long as there's no
Because it's a special permit. The maximum we're allowed to allow is 5 years. So you would have to come back for 5 years.
Okay.
But no uh no interim check.
No what?
No interim check this time.
I don't know what that what is that. So
we had we had you come back for a status report. Okay.
As a condition of the last approval, but since we haven't heard anything, I don't think there's any need for that.
Okay, [clears throat]
you want to do the findings.
Here's the uh
there's findings that are Thank you.
that are not on my sheet. Um All right. The use will not prevent the orderly and reasonable use of adjacent properties. Um, as I had stated upon visiting the property, it's a fenced in backyard that um looks no different than a fenced in backyard that would have a pet dog or I guess cats don't stay in backyards. Um, the public health safety, general welfare, and order of the town will not be adversely affected by this proposed use in this location. Um, the board had agreed upon this five years ago and we've not had any complaints and it's not been an issue. Um, and it's just located on one single lot. The use will be in harmony with and promote the general purposes and intent of the most recent comprehensive plan of the town and zoning ordinances. That's true. The proposed use will not interfere with the preservation of the general character of the neighborhood in which such building or use is to be conducted. Um, that is again true, but visiting the property, you're not going to know what uses the backyard and and lives in the house. The
physical characteristics and topography of the proposed site make it suitable for the proposed special use. That's true. It's um just a standard residential lot with no special equipment for it. and the use provides appropriate landscaping in or other forms of buffering. The backyard um where they would be visible is surrounded by a fence and then there's like privacy curtains on the edges of the fence. So um unless you poke your nose over the fence looking, you're not going to know what's in the backyard at all. So it meets all of the criteria for a special permit. And um
what do we do?
Do we make a motion just to renew it?
Yep.
Or extend it.
It's I guess it's not That is a renewal, I guess.
Mhm.
Yeah, I think so.
Okay. Um, I will make a motion to grant a special permit to allow the continued use at 261 Vulk Road for the um, how do I rephrase it? For the keeping of two pet pot belly pigs with the Can we adopt the conditions from the previous minutes in 2021?
Well, we've got different board members. We do have different board members. All right. Um so for the a use variance for a period of 5 years at 251 v 261 bulk road for the keeping of two potbellied pigs um and not more than two and they will continue to be kept in the same enclosure and in the same manner as you have been. Um what do I condition it? You should add um [clears throat] the no need for an interim.
There is no there is no need for an interim one-year check. The special permit would be granted for the full period of 5 years from this evening.
Erica, do we have any other conditions than the prior approval?
No. And looking at the approval from last time, it was for the five years um for the two pot belly p.
Okay. So, we did we didn't limit the number or anything like that. The
you did to two. I'm not getting anymore.
Two's good.
Okay.
Second.
Okay. Mrs.
I
Mr. Colola.
Hi,
Mr. Corso.
Hi,
Mr. Spanado.
Hi,
Mr. Short.
Hi.
You have uh you have your special use variance for another 5 years. You will have to come back in 5 years to do this again.
Okay.
Um but
All right. Thank you very much. Appreciate you.
I had one question before you go.
Yeah.
Uh how long do they live for?
15 to 20 years if they're healthy. Yeah. So, I might be here another one or two times.
That's what I was saying. [laughter] All right. Thank you very much. Appreciate you.
Thank you.
Okay. And our second application for this evening is a garage edition located at 1068 Fawnwood Drive. Applicant and representing agent Brian Kosal is requesting to allow a side setback of 3.4 feet where 10 ft is required. I would like to bring to the board's attention that this is in a cluster development. So the side setbacks do differ from what is designated in the R3 single family residential district. So
you're up. Uh yeah, basically uh I'm Brian Kosal and we live at 1068 Fawnwood Drive and uh we're seeking a variance uh to do u widen the existing garage that is there um by 11 ft wide and 37 ft long, which is the same length as the existing garage that is there. Um basically that's about it. question from the board.
I have one. Um, actually, it's not for you. I I think it's more for legal counsel, but it's it's a question of the distance between the proposed addition and the garage next door seems to be rather narrow, and I'm wondering if it vi if it would be a violation of the fire code if it's that close.
May I elaborate? Uh there is a uh 8 foot wide black top driveway next door. So then and then they are off the 10 ft as well. I don't know if that answers your questions or
Well, I I don't know what the fire code requires. It's the only thing I'm asking.
Erica, do you have that?
I don't have that on hand. [laughter]
Shoot.
The H. All right. My phone is not letting me into it. But um I had actually had Erica send me that setback because I was concerned with the distance between the two buildings. And the house at 1070 had a I think it was the 15t side setback. It was more than this one.
Um shoot that open.
There's a section handy. Why is it not letting me shoot?
I I'll run that down if you guys want to keep going. I'll get an answer.
Well, while they're looking that up, can I also ask you um how are you going to get in your backyard from the future? Is there
uh we're just going to have a man door and that would be on the the east side. We'll have a man door and then we also have an exit like with a patio in off of the kitchen in the normal house. Um, we're just going to have a garage door uh to open. And this is just storing of basically my personal vehicles. So, that would be it. And, you know,
be able to get your uh lawn equipment through there.
Uh, yeah, we have a shed uh a shed on the property already. That's everything is stored back there. But you could also get through the other side of the the um you know, the property line as well. There's an opening of I don't know 10 to 15 ft there as well like on the other side.
Thank you.
Did you look at um other options other than going to the side like going to the back 50? Um, if we were to go into the back, uh, the way that the garage is set up now, it has it would be you'd have to take off basically the living room. 15.
So, you know, unless you had a driveway that would go around wrap around the house, and we have a pool in the back, so there's you're not going to be able to put a uh, you know, like a standalone garage back there.
I mean,
you know, the other option would be to basically put a trailer, you know, you could you could technically put a trailer there and store a vehicle in a trailer, which I don't want to do.
Sure. But that would technically be an option.
I believe it's 15 ft.
There there was um the survey that was sent to me. It was at least 15 ft. I think it was like 15 and a half.
Um
and then the fence itself was right on the lot line.
Sorry. Are you if we were to approve it, can we make a contingent on the building inspector any submitted plans for building permit knowing that they'd have to follow code?
Sure.
Yeah.
Obviously,
it's kind of incumbent.
I mean, they have to anyway,
right? But I'm saying but at least this way we've done our due diligence even we don't have the answer tonight because obviously
you can make it even closer depending on the material
of the structure. We can't you can't tell by the plan submitted. It's
my understanding with fire code. It's not usually to it's usually building to building is
is it building to building or building to the lot line?
I thought it was building.
I thought it's building to building. It's so that they can drive their truck
in between the
or in a more densely populated area. The way I was told it's
to keep them safe of fire. So if you had like like in a more densely populated area, you had two garages 3 ft off the property line. It's not the six feet. Correct. But they're going to want make block instead of wood frame.
So there will be at least 18 ft between the two buildings.
There's 18 ft between the two buildings.
If the the other one is at 15 ft and if this is going to be at three,
it didn't appear to be. That's
Does it go roof lane to roof lane? I didn't measure it, but when I drove by the survey because it's it's building to building the driveway looks to be over the property line
when if you look at the aerial
res. [cough]
And obviously when you're out there, it's not like the property line is, you know, made known exactly. Well, and the fence is on the lot line which goes up to behind the hedge.
No, what other but I'm saying but when you're out there you unless [clears throat] you're really talented you can't tell where the prop
No, even if there's a fence that the fence is properly located. I think your suggestion, Chris, that we approve it [snorts] subject to uh it meeting fire code would be
right. But and as as Mike Mr. Short said the building inspector and the uh permit grant getting his permit, they're going to have to prove that. But we'll make it just contingent and we've done our due diligence.
Yeah. I mean,
in my thought,
yeah, I it's incumbent anyway, but there's no harm in indicating there may be a concern.
I don't think we're making him do any extra step that he wouldn't do even when you mention it.
Correct.
Other questions for the applicant at this point.
Be the same siding as you have now.
Yeah, they're going to make their best attempt. Obviously, it's, you know, it is vinyl siding. We're going to stay with that. And you know, it's it would be they're going to kind of use what we have and kind of fade it in or whatever
to their best knowledge. I mean,
3 foot4 is so close. Just
go ahead.
And you've discussed this with the neighbor that is on the side of this addition.
Yeah, they're very well aware of it is. Yes. Okay.
Uh, open it up to public comment. Anybody want to speak for or against this project? No. Okay. Back to the board.
Other comments, questions? [clears throat]
Your current garage, um, does it go the entire 42 foot depth of the house or is there living space behind it? It has um currently now you could pull two cars in and then
one of the stalls has a smaller area in the back. It's not big enough to put a car.
Okay.
So, what we're hoping to do is when I expand that then I could put you know have like two, you know, um one after another like in a head and then also have cars parked.
Okay.
So, you would have a single and then a double and then another double. [snorts] Um, I'm not
How many cars total are you?
I'm hoping to have uh three and then I have like a motorcycle and a four-wheeler, but it would be like four spaces.
Four spaces. Gotcha. Okay.
Like an L. Sorry. I If that makes sense.
Yep.
There really is no place else.
There's It's so close though.
It is right. It is so close. It is also It is also a cluster development as well, which
that much closer.
I mean, there are cluster developments with zero lot line.
Yep. Yep. [clears throat and cough]
It just really comes down to you visit a site if you think it's detrimental to the neighborhood. And
when I But I drove by I I well I stopped but um I didn't see how it would have a negative effect like he like Karan said if long as 1070 is okay with it. I think they're the biggest made aware.
Well if there's no other comments I'll make a motion for uh seeker. Um make a motion for seeker uh pursuant 617.5
second.
Second.
All those in favor?
I first you want to do the findings.
Sure. The uh approving this uh application will not uh change the essential character of the neighborhood. It's already a uh cluster development and there are very uh the side setbacks vary between lots and and housing types there. So the essential character won't be uh impacted widely. Um, the applicant hasn't uh uh doesn't really have a lot of alternates based on the the existing yard size and the pool in the shed in the back. So, there weren't uh any really feasible options to uh consider an alternate uh application or location for a garage. the uh it's uh the variance is not a significant deviation from the code uh and the uh the construction of the addition have
any adverse impacts uh on the uh to their property. There is a slight impact on the uh labor at two at 1070. uh but uh the applicant has said that they're okay with it. So I don't believe there are any u impacts on the environment there. And while it is uh self-created, I don't think there are any other alternates to uh to allow him to expand his garage area. Anybody else want to add anything? Nope. All right. Um, make a motion. Well, uh, yeah, I guess in the motion with the conditions. Bear with me. I got to get the Thank you. Read that. Uh, I'd like to make a motion uh for a area variance located at 1068 Fawnwood Drive uh to allow a side setback of 3.4 4 feet where 10 feet is required associated with the construction of a 470 47 square f foot
uh garage edition on a.37 acre parcel having SPL 080.04-1-66 located in an R3 single family residential district under section 350-12 of the town uh of the code of the town of Webster. um with the condition that uh you will need to get all uh appropriate um building codes uh permits required. Um I do believe that you will have special construction needs being so close to the property line uh including fire rated walls will need to be constructed is my understanding. Um that the siding will match the uh match the the house to the best of your ability. Uh, was there any other conditions that we wanted needed? No.
Um,
yeah, there's my motion.
Second.
Second,
Mr. Short.
I,
Mr. Stollo.
Hi,
Mr. Corso.
Hi,
Mr. Stampinado.
I,
Mrs. Bolo,
I.
You have uh your variance. Um, you still need to go get your building permit. you have one year for um for meaningful completion of the project. Um yeah, good luck.
Awesome. Thank you guys very much for hearing me and taking the time. Appreciate that.
Thank you.
You good luck.
Thanks. Is there meeting minutes?
Was there meeting minutes?
Excuse me.
Um
yeah, I think we got I got that one. And I have the appropriate
Yeah.
I will make a motion to approve the January 13th of 2026 zoning board minutes.
Second.
All those in favor?
I caught up Was there is it only the one? I thought we had a couple that we needed to do.
