Good evening and welcome to the Zoning Board Appeals meeting for January
14, 2025. We currently have three items on today’s agenda and for public comment period. We
will be limiting public comments to 5 minutes. I have proof of publication in the Webster Herald
for all items.
Josh Artuso is going to be talking about adjustments and changes we have for our presentations
moving forward.
Good evening, everyone, as the chairman mentioned, we are introducing a new
format to our meetings starting tonight. We are going to be conducting a power point
presentation in which the town staff will present portions of the application and then the
applicant will be responsible for presenting additional information specific to their application
and then will turn it over to the board for discussion. So, bear with us as we are working through
this new format for the first time, but we will indicate when it is your time to speak, So, with
that, F will turn it over to Erika.

associated with the new Bill Grays Tap Room and redevelopment of the former Hegedorn’s
site on a 6.68-acre parcel having SBL# 079.15-1-1.1 located in an HC High Intensity
Commercial District under Section 265-7 of the Code of the Town of Webster.
Appearing before the board was Jim Gray with Bill Grays Restaurants, Direct of Facilities for the
company. We are proposing the three and will start with the monument sign first. The initial
proposal was for 15 feet, and we met with the Planning Board last week and we broughi that
down to 10 feet from their recommendations and for their approval. We are just trying to stay in
line with the rest of the...some of the other monument signs that are on and around that area.
The corer of Ridge and Hard and the Target Plaza is also similar size and one on Hard Road by
the White Water Plaza entrance there that goes into BJs so that is kind of where we are with that
one and then the building itself, we proposed all three of those and all three of them have all been
part of our brand and we have multiple examples of that. Our Bill Grays in Ontario and actually,
our Bill Grays in Webster has all those and minus the tap room. It has the home of the world’s
greatest cheeseburger, and the Bill Grays signs, and we have three on that building as well and
then multiple site businesses, they also have three signs on these buildings as well and some
more. We are just looking to......we are pretty proud of what we are doing in that plaza and
redeveloping it, and we just want to make sure that the building is......... the center of that
Pg.2 January 14, 2025 Zoning Meeting
building shows are restaurant and also, we split for all of our tap rooms we generally split our
restaurant side and our tap rooms side anyway, so we always try to designate both of those as
separate. So, that is another reason why we are applying for that.
With the new process, does the board have to read this in.
What do you mean when you say “read in”
Usually, we go through the agenda, and we read it.
It’s in the record now so we are all set.
Very good. Questions from the board.
You want to start with the monument sign is that what you said.
And if you want, unfortunately couldn’t get it in time for this and I do have the revised
copies of the proposed 10 foot sign if the board would like to see them. (SEE ATTACHED)
HANDED COPIES TO THE BOARD.
Yes, that would be great. Does the board have any questions on the monument
sign.
Ido not. This is actually what I was going to ask the applicant if they would
consider.
Ok, will move onto the building signs. Does the board have any questions on the
building signs.
I guess I am wondering on the need for all of them. I did go to Bill Grays in
Irondequoit, the tap room there and I also went to the tap room out in Ontario. The both have
road signs and the one in Irondequoit had....is significantly less signage as far as all in one place
and even in Ontario the signage just appeared less. ] understand the need to have the tap room
entrance separate from the Bill Grays entrance but is there a way to incorporate, say like the Bill
Grays on the tower over the restaurant door with worlds greatest cheeseburger just to reduce the
number of signs because you are asking for two more than technically than are permitted. Just
curious as to why.
Well again, the center sign...the larger one was kind of is showing like an overall
umbrella that basically the two are....we have two different tenant spaces basically because
originally, we developed the site as...there are two towers on there already so to keep in line
with the symmetry of that as well we have the one sign for the restaurant and the one side for the
tap room and then obviously the arching. The theme is Bill Grays in the center and that is kind

of what our mind set and also for the fact that it’s the main tenant for the plaza itself. We own
and it’s kind of like we are the feature tenant of the space. Then again, the one in Irondequoit and
I understand there is less signage on it but it’s also a much smaller location and I believe the
square footage of that place is 7,000 sq feet and the new tap room, the new proposed site here for
that building is 15,000 sq feet and it also doesn’t have a tap room as well. Like Seabreeze is a
good example of that as well, if you go down there.
There is another one in Irondequoit besides Seabreeze.
The Irondequoit one. I thought you were talking about the one on Ridge Road.
Seabreeze.
We also have you know...the other thing I wanted to mention to, is our current
location in Webster doesn’t have a tap room. It has all that stuff. ..it doesn’t have a tap room
sign on it but it has 3 signs on the building on the south side of the building is Bill Grays and
home of the greatest cheeseburger because the home of the worlds greatest cheeseburger has
been a brand, like it’s part of our signage for awhile now and Ontario being one of our oldest
locations and Webster has been here forever and we have it at our Henrietta location as well and
I think there is one more that I had on here and I was looking it up this morning, yes, Seabreeze
has that as well on the southside of the building as well oh sorry, the westside.
Bill Grays on Hard Road, it’s only Bill Grays on Hard Road side right.
Yes, correct. What I am saying, I am using that as an example for the fact the worlds
greatest cheese burger is part of our signage for the years and again, we are using that specific
spot to designate the restaurant side and the tap side as well and then Bill Grays in the middle.
Now are there more signs that are going to end up going up on that Hard Road
fagade of ...........c eee (APPLICANT SPEAKING OVER)
The only signage that we would have at the very end...when it’s all said and done it
will be at the very far end of the tower, north end tower, whenever it comes in it would be
basically as the Webster Wine & Spirits. We would probably do one facing the east side of the
building on the plaza face and then one probably facing north over facing north, the hotel and
that.
Well, 1 kind of agree that world’s greatest cheeseburger is kind of a name sake for
what you guys do, and it has been on the signs forever, but it is not the name of a building and
not the name of a business. It is an advertisement and that to me, could be put in a window
rather than up on a 10 x 10 sign.
Pg. 4 January 14, 2025 Zoning Meeting
Yes, I understand what you are saying, I just want to site again that it’s been on our
buildings for forever. I understand what you are saying but my counterpoint is just everything I
discussed before.
If that wasn’t there that would get you down within the allowable square footages
for signage.
Other comments from the board. No, so I will open it up for public comment. Is
there anyone who would like to speak for or against the project.
We are the general contractor here and I think roughly a year ago
in November we brought in a 3-D sign that showed the same facade with the same signage and
that was basically approved as long as we dropped that monument sign down to 10 feet so the
signage on that fagade is nothing new and what they are trying to do is really, they like to keep
family orientated on the Bill Grays side and more of the tap room on the tap room side and home
of the worlds cheeseburger, is Bill Grays.
When you said, I’m not clear on the wording but you say, it was basically
approved. When was that...
Yes, one of the comments was if we were to drop that
When?
It was the November meeting in 23 I believe.
It was at the time of site plan approval.
We did a 3-D rendering sitting across the street that we have a copy of that we
had to present here.
That was a Planning Board approval.
And I’m sure they said any variance you will need to go before the Zoning Board
of Appeals which is where you are now. So, while the site plan was approved the sign size and
location were not given any variances at that meeting.
Well, it was pretty clear, and I don’t know what the meeting minutes actually say
but it does talk about reducing the pylon sign to 10 foot. When all the owners were here, and
they agreed to do that at that point and time.
You understand there is a distinction between the functions of the two boards.
Pg. 5 January 14, 2025 Zoning Meeting
100%. We were at both of them, zoning and planning.
I don’t recall you being here for the zoning board.
Your site plan didn’t require and variances so you would not have had to come
here.
Any additional comments
I think that’s it for now.
I will bring it back to the Zoning Board.
What is the game plan for memorializing the power point in the record. Another
words, during the course of the presentation this evening, the staff went through a number of
different pages, and I don’t know if they went through all the pages or not and obviously one of
the benefits doing it electronically is that the town is not printing out 24 pages and putting them
in our files so, have you flashed through all of them on our respective screens this evening or
only choice selections based on the narrative that was occurring.
The second description you just gave.
So, I think we have to smooth that out somehow...how many pages is this
presentation.
The presentation is about 47 pages because it is an exact one to one with the
applicants application. So, the application that is submitted to us that is presented to you all on
the board is put into this power point, so you have seen.
So, there is an affirmation that there is nothing in the power point that was not
provided to the board members through conventional means.
Correct.
And the staff notes as well.
The staff notes are an internal and public note for everyone. So, high intensity
commercial district, that is public knowledge ............
J am not questioning whether it’s public knowledge but that...those notes were
also part of that 40 some odd paperwork that each board received.
The power point was not provided in paper form to...
Pg.6 January 14, 2025 Zoning Meeting
I know that...the equivalent if the 47 frame was received by the board members
electronically.
Yes
TOO MANY PEOPLE SPEAKING AT ONCE. THE CONVERSATION WAS DIRECTED TO
ERIKA.
Yes, and that included the staff notes.
Yes
Ok, I just wanted to make sure for the benefit of the applicant and the
community that we are not seeing anything that is not reflected in the record.
Yes understood.
Rich Mastin and I am Vice President of Bill Grays. We met with the Planning Board on three
separate occasions, Two in this format and one in a work study format. Josh, I am not sure if
you were there or not, but we were in this room in a U shaped discussion and there were three
key points that the Planning Board pointed out to us that we wanted to work together with the
town on. One was the side walk, what side of the road it was going to go on and I had suggested
to the town that we would be willing to put the sidewalk in on the east side of Hard Road
because of the challenges that the contractors would have with putting in a sidewalk with the
underground piping and the flow of the land, how it was graded down. There were some
concerns with the pitch and the second concern was the dumpster area on Ridge Road and that
we needed to have that properly secured with concrete walls and it was to be gated closed, and
we agreed not to have 18 wheelers delivering or pickups off of Ridge Road. So, we are installing
a brand new loading dock on the far west of the building around the back and that and that is
where the large tractor trailers are going to come in. The third concern we had, and the town had
was the signage and we agreed to do everything that the town had....the Planning Board had
asked us to do with the sidewalk, the loading dock, the parking as we should, and we had asked
for here is out presentation for the signage package that we need for this building to make
ourselves knows that this is now the Bill Grays plaza not the Hegadorns plaza. Bill Gray and
Bruce Hegadorn both since have passed, Mary Hegadorn passed last night. They were partners
back in the 60’s and we made an offer to the Hegadorn Family Partnership, Bill Grays to
purchase the property and we would re-develop it and kind of keep it in the family because a Jot
of the Hegadorn family members are also owners of the Bill Grays. Getting back to the world’s
greatest cheeseburger, as Jim mentioned to all of you, that is our identity for all those people that
come to the Town of Webster, for all the sporting events and using the hotels, have no idea what
Bill Grays is. They truly don’t. Years ago, we approved the town and asked for a variance to
put home of the worlds greatest cheeseburger on the south side of the existing building. We have
done that and other locations because we are finding the same thing that Rochester is a great
Pg.7 January 14, 2025 Zoning Meeting
community for all different types of events and people need to know outside of this market what
Bill Grays is. If you are not from this area and you come to Webster, what’s Bill Grays? I don’t
know, it could be a book store, it could be anything. It doesn’t say its Bill Grays restaurants it’s
Bill Grays. Yes, it says Bill Grays tap room, but Bill Grays is in small print, and home of the
greatest cheeseburger was trademark back in the last 80’s early 90’s and we are proud of that
designation because that is who we are. We are about cheeseburgers, kids meals, fish dinners,
and custard, that is our product and we in courage the board to please consider our request for the
three signs on the building. We are willing to reduce our monument sign and even though there
are others that have larger with possibly fewer tenants at least fewer tenants on their sign. We
requested 15 and we are willing to go down 10 feet but please, give us our three signs so we can
do our best to re-pay back what we need to pay back in this project. As Charlie, our general
contractor, every time he puts the shovel in the ground, it’s a new surprise and a new surprise
does not come at a cost of a hundred dollars, it’s 10°s of thousands and we are really looking to
try and bring something great to the community by having Bill Grays. I don’t know if you have
all been in the new liquor store, Sherry and John Gonzalez (Sherry Hegadorn) and it’s beautiful
from what they had. I think it’s six times it’s size. We are going to do the same thing with Bill
Grays. When you come in it is going to be amazing and then with the next tenant on the end and
then what ever we do for Don and Rick Waring below when we redevelop their space. Please
take it under serious consideration, we are not asking for a lot, this is a simple thing and
hopefully you will grant us that approval. Thank you for your time.
Have you ever watched Shark Tank before?
Yes, I watched all the seasons.
So, if this was Shark Tank, everybody would have a cheeseburger tight
now....(LAUGHTER) before the presentation.
I might have certificates in my car....(LAUGHTER)
I am just kidding. I am trying to make it a little lighter.
But when you make me come back next month, I will be sure to bring the
cheeseburgers and the milkshakes...(LAUGHTER) being on a Tuesday it will be great plates.
(LAUGHTER) Thank you again.
I don’t know if it’s possible, on the town website but not in our packets under the
Zoning Board there is a picture of the Bill Grays with all of the signs across the front, not just
this slice so that it gives us the perspective of the whole building. Is that possible to pull up.
If they don’t have it, I have copies.
Pg. & January 14, 2025 Zoning Meeting
Because I...when I looked at this, I said that’s a lot of signs in a little space but
looking at all of the towners and the entire length of the building the perspective is different.
BOARD HAVING DISCUSSIONS AMOUNGT THEMSELVES
So, the only additional sign that is listed is Food Market, that is the only
additional sign. Is that correct.
Correct.
{ understand that it is not a food market (A LOT OF BOARD MEMBERS
HAVING CONVERSATIONS) and it’s only going to be on the tower off the north face and the
east face.
Yes sir.
At that point and time.
Yes, we would only, on the east side of that building there will be just Webster Wine
and Spirits, the Bill Grays package and then one sign at the very end.
What is next to...one the left side of the Bitl Grays sign. Is that just a dimension
or is there actually something there.
Left side of...
Even in our small packet there is like a white out.
I believe that is a dimension
Ok. Any other comments?
I am not sure which file this came from, but the record should reflect the
application submitted a full view of the entire front of the plaza and the context of the signage.
Just from my perspective, the wine and spirits sign dimensions is that......are the
world’s greatest cheeseburger and the tap room the same.
Every single one of the square signs that you see are all 10 x
10. Corrine Volo: Thank you.
Pg. 9 January 14, 2025 Zoning Meeting
Are you open to suggestions. Take the two signs on the sides and make them 9 x
9. Jim Gray: So, I feel like that would create like....a 10 x 10, Webster Wine & Spirits is already a
10 x 10 sign and that would create a...it wouldn’t be uniform across the whole front of the
building.
If you go 9 x 9 on those signs and shorten the Bill Grays sign by 5 feet that would
bring you down within the allowable square footage for your frontage and the Food Mart could
go back up to 10 x 10 and then you would have symmetry on both ends and a little smaller in the
middle.
From my perspective, I don’t know, I guess I am not seeing what that ends up
gaining and I don’t know what we are loosing by having the 3 signs there and I do know that it
doesn’t meet current zoning code. From my perspective Iam not seeing....what I’m seeing, I
see 4 signs, one for each tenant if you will, tap room and the cheeseburger location is your tenant
locations and ultimately, I understand Bill Grays is the restaurant but in this instance jt is also the
Bill Gray’s plaza essentially if you will to a certain degree . I understand the request , but I don’t
know what we gain out of it losing a foot other than it will end up conforming to the square
footage requirement. I don’t know if we are really gaining much.
EVERYONE SPEAKING AT THE SAME TIME.
I think if the applicant wanted to avoid getting a variance their design
professionals could have offered that before they even came here tonight so for what ever reason,
that is the size that they want, they are asking for the variance and if for whatever reason they
were not to get it, they could go ahead as he suggested and make them smaller and put them up
tomorrow. Well, get their permits and put them up tomorrow if they wanted to so I think I
understand what he is saying and from they have always had that opportunity
but for whatever reason they have chosen to apply for the variance, and we should based on the
sign size that they gave us.
Just a suggestion.
Yes, that is a good point. We had conversation up here I guess I will ask; do you
mind answering his question. I don’t know if you already answered his question, would you guys
consider it.
We designed this, and it was kind of our intent to have this up like this and I would
like to continue to try and work towards having the square footage that we have on the building.
Ok I appreciate it. Thank you.
Pg. 10 January 14, 2025 Zoning Meeting
The Bill Grays tap room in the middle, and you have your liquor Wine &
Spirits on the corner and then you have Bill Grays and then you have room for....after the tap
room... future
Yes, after the tap room we have an addition, Food Mart ...something to just to show...
But that will also be 10 x
10. Jim Gray: Correct.
That is what I’m getting at.
And I think one more around the comer.
Now, if I look at the plaza across the street just as another example, just looking
for long stretches of fagade, there is a whole lot more signage and there is a whole lot more
tenants. There are many more signs in the plaza across the street in the same relative length just
based on there are more businesses but it’s excessive as far as the number of signs is what is
permitted per code but based on the number of signs for the length of that building, I don’t know
that it looks out of place. It kind of balances itself.
Alright, any other questions from the board at this point. If we are all set then, I
would like to vote on SEQR.
RESOLUTION 25-0001 Michael Short made a motion to TYPE Hl SEQR
which was seconded by: Chris Centola.

| am going to back up a minute. Did...,..Erika, did you want to cover anything
within the staff notes before we do findings or....
I can read them out Joud if you'd like but it was pretty much covered by the board.
So, there weren’t any extra.
One thing that I will say was that the Planning Board did conditionally approve the
monument sign per Zoning Board meeting tonight at 10 feet.
Pg. 11 January 14, 2025 Zoning Meeting
And we did receive a letter from chairman Casciani stating as such.
And we also received a revised 10 foot monument as well during the board
meeting.
Chris Centola for Building Signs:
There will not be an undesirable changes to the essential character of the neighborhood or the
development. While there are other remedies based on the building design and the existing size
that is there the proposed signage is in character and creates a more coherent and adhesive facade
along all road access side of the building. It is not a substantial request. There are no detrimental
physical or environmental impact conditions or actions because of this request and while it is self-
created once again based on the design of the building and the design which is there now, I think
it is a good remedy and works well with the building.
Does anyone want to add anything else because we also have to do the......do we
have to do the monument sign as well?
Well, I think the conditions are similar. I don’t know if we want to do two separation
resolutions, one for each sign. Building sign vs monument.
There should be a separate finding. (COULDN’T HEAR THE REST, TO FAR
FROM THE MIC)
Corrine Volo for Monument Sign
1. There will not be a detriment created to nearby properties: It will not create detriment for
the neighborhood. The other monument signs in the area are either at this height or slightly
taller. The BJ’s sign looks to be approximately 10 feet as well and there are signs at the
plaza across the street that are less than 10 feet but the are also plaza signs across the street
are greater than 10 feet, so it is certainly not out of character with the neighborhood.
2. The benefit is not achievable by any. other method: No other remedy. The application
originally requested a 15 foot sign height and has agreed to reduce it to 10 feet which is a
significantly less impact, so they have actually improved upon the request.
3. There are no adverse physical or environmental impacts to the site or neighborhood: There
are none.
4. The difficulty is not self-created: While it is self-created the monument sign is permitted
and also really is required in order to identify the businesses that are in the plaza for traffic
and direction of traffic. ] do also want to note, that you also agreed to include the address
on the sign which is.........Thank you! It’s for safety.
And it’s an area where there are monument signs all around so there are no adverse
or visual impact anywhere else in the area so,
Pg. 12 January 14, 2025 Zoning Meeting
RESOLUTION 25-0002 Michael Short made a motion to
APPROVED BILL GRAYS SIGNAGE
Located at 964 Ridge Road. Applicant
Charles P. Kelly is requesting an AREA
VARIANCES to allow:
* (3) single-faced building mounted facade

I would just like to add as you read it all, the proposal is remove a single car garage |
4 if you will and replace it with a 2100 sq ft pole barn and the pool barn will be attached to the
existing chicken coop.
Pg. 13 January 14, 2025 Zoning Meeting
Ok, we are working of the details who goes who and when.
Appearing before the board was Suzanne Dutro and I lived at 580 Bay Road for 21 Years, this
year. It is the old Lorman Farm /Miller Farm, so a lot of people know it. So, I have been a proud
steward of a property in Webster, and it is a registered historic property. So, we are looking to
demolish the existing structure which was built much, much later than the house and the stone
house which Erika referred to the chicken coop. It did house chickens, pigs, and milk at one
time. Looking to build a pole barn where the garage is now that would probably more in
keeping with what is there. The garage that was built there does not accommodate vehicles.
We have never been able to put our cars in there so often when you drive by my house it looks
like I am having a party and it’s just because we are home. So, I do have a partially home based
business where we will be acquiring a truck this year and I would like to have a place to park
the truck, so the neighbors are not looking at a truck or a parking lot full of cars which are just
my kids and family so looking to house all that in that structure there as well as storage for us.
READ-SECTION OF ORDINANCE IN QUESTION. (SEE ATTACHED) Go to
slide regarding: CHARACTER OF THE NEIGHBORHOOD. If you want to go through this
and the samples that you provided us. It provides you the opportunity to discuss more in depth
with the board and I will go through the slides as you go.
Ok. So, the character of the neighborhood, we are one of several farm homes on
Bay Road so we are really not attached....we are attached to but not directly to the homes that
are behind us so it’s more in keeping with farm feel of Webster as you go down Bay Road you
can pick out farms. So, those are the ones that were relating to and that it’s not out of keeping
with that. There are other properties that you show here where they do have structures that are
closer to the property line. It’s unique in that it’s not a neighborhood so it’s in keeping with the
farm field of Webster which I really have enjoyed, and you can see them as you go down Bay
Road as you make that drive down towards the lake. That’s what we are looking to do is really
clean up the property and make it more in keeping with he original structure and some of these
houses have nicer examples (VIEWING THE SLIDES ON THE SCREEN)
In terms of alternates, it’s what we really need it’s just we need a bigger structure to
accommodate our needs. One of the benefits I feel is that next to the existing structure there is a
garden that came with the house that is stone, and it is quite high maintenance, and I am sure
my neighbors will very much appreciate us kind of cleaning up that area and having it be a nicer
view of what little view they have because you can’t see much of it. We are looking to
completely obscure the view where if you drive down DeRio which is the side street that runs
near. We are planning on planting trees so they will be able to see trees and they will see a
clean structure that looks like it’s part of a farm house rather than what they seen now which is
kind of a run down garage that was built much later and a garden that we do not care to keep so
it will be a better view and then from the road you will see what looks like part of the farm
house.

So, in terms of size to accommodate our needs it really needs to kind of take up that space and
what we have now is oddly shaped and does not work for us.
May I ask, you mentioned earlier on part of the reason for it was to park your
cars because currently you don’t have the ability to park your cars in the garage but then you
indicated a business vehicle. Can you elaborate a little bit more on that aspect and I guess at the
end of the day, I have a 30 x 70 barn on my property, it’s a big structure, it’s massive. If I had
to guess, I could probably get probably close to 16 cars in my barn. So, a 30 x 70 barn, it’s not 2
cars it’s not 2 cars and a vehicle and a truck. So, talk to me for the reason for something that
large. I guess it’s really what I am trying to understand.
Well, we have 4 drivers; I have a work car and a personal vehicle as well so
that will be in additional vehicle on the property, and we have guests coming and it looks like a
parking lot so as many vehicles as we can fit would be helpful. It is also meant for overflow
storage and a creative space for me. So, it is a decorating business so we do utilize storage in
Webster at UHAUL so it would be overflow storage, but it would also be a work space that
would be enjoyed by me, so it is partially for my enjoyment as well to have a bigger space to
accommodate all that. My thought process was the next steward of the property is probably
going to be someone who is going to need that type of a structure as well so I am looking for the
longevity of the property as well because I am thinking of the historic nature of it and I would
at least like to bring that piece of it to a point where it could be enjoyed by the next family down
the road because for us it would function and I’m an old house person but it just doesn’t
function you need that space. It’s kind of dead space on the property to. It’s an oddly shaped
area on the property and we would be bumping into where the garden is, and it just makes more
sense,
Can you talk to me...... I don’t know your business but as far as I know business
is in an R-3 and I don’t know if try and look at the code what is allowed and what is not
allowed.
It’s a staging business for home sales so it’s really just overflow storage. The
business is not functioning there we function in the field. I didn’t want to get the confused. So,
it’s not a facility for the business but it would be helpful to me personally to have a creative
space to work on that and have some overflow because we just don’t have enough storage in
general on the property. There is no attic. It’s really limited storage wise. So, that is part of it.
So, I don’t want it to get confused and I was even hesitant to even bring up the business piece of
it because it isn’t a facility for the business, but the work truck would come home with me and
that’s part of it.
That’s one work truck?
One and then I have a work, Subaru that I drove today and then I have a
personal car and then we three other drivers as well with cars.
Pg. 15 January 14, 2025 Zoning Meeting
When you say drivers, is that three other vehicles or is that...... so what would
be parked at the residential property. So, if I did my math right, it’s 6 vehicles would be parked
at the property or....
So, there would be...yes
So, all 6 vehicles would be parked there. The 3 drivers that you talked about;
the one work vehicle, the Subaru which is a work vehicle; your personal and the other person.
That is what I recall you saying.
Right
SOMEONE FROM THE AUDIENCE SPEAKING AND I CAN NOT HEAR.
With out those kids, it’s those 6 vehicles. Is that correct.
It’s with, it’s for the family and the two business vehicles. They are personal
and they are not registered as commercial vehicles. It’s a small SUV used for the business. So,
I have 2 cars that I use.
You are allowed 2 cars. I am not...that’s fine. ] am trying to understand it again.
It’s a big structure and I am trying to understand the use of the structure. We have had other
people come in and ask for a pole barn and as we are having conversations with them, we come
to find out what the use is and then it brings up other questions and concerns. The intent is all
of those vehicles would be...so the intent is not all those vehicles would be parked inside there
because when the kids are home, I guess, they are coming and going right, would be my guess.
Yes, usually.
So, inside the pole barn would be 4 vehicles and I am going to say at all times. I
understand different times of the day with work and everything else but in general, 4 vehicles
will be parked in the pole barn itself.
But also looking for that work space, creative workspace and to have storage
because it’s an old house basement which I am sure you are familiar with. Which is a little
different than a newer home where you cans safely and happily put things in the basement and
no attic. It’s an old house with limited closet space so there is very little storage of really
unkind on the property.
I have an old house. I lucked out because I do have a basement, and I do have
an attic.
We have a basement but it’s an old house basement.
Pg. 16 January 14, 2025 Zoning Meeting
The plan that you provided us is one large open space. Two garage doors on
one side and it looks like two man doors and a hand full of windows. Just going off of typical,
roughly 50 feet of that 70 feet would be taken up by vehicles. Would you say that that is about
accurate plus or minus between 40 and 50 feet.
| think that is about accurate.
So, that ends up leaving you with 20 to 30 by 30 for your own personal studio or
storage, etc.
And just regular home storage to because that has always been a challenge the
house.
I will be honest, when I was looking at this packet and this particular image, I
was struggling with the offsets and what they were saying. Can someone tell me what they say.
It was really tiny in my packet.
The offsets meaning?
I think we were talking about 20 feet off of the...is that the north property line,
if I remember correctly or is it off the rear property line to the building.
BOARD MEMBERS SPEAKING OUT
The new garage will be 20 feet to the rear property line.
NOT SPEAKING LOUD ENOUGH ....
Yeah, the copy is so small. Can you let us know what the setbacks are to the rear
of the proposed building and to the northside setback because we have too small of a copy.
So, the rear setback requirement is 50 feet and
SOMEONE FROM THE AUDIENCE STEPPED UP TO THE MIC: to the northside is 26.5
feet and to the rear would be 40.8. AUDIENCE MEMBER APPROACHES THE BOARD
WITH MEASUREMENTS.
So, the intent is the front of the pole barn would be, I think it’s roughly where
the existing front of the existing garage is which aligns with the existing stone building and then
it’s a 40.8 off the rear setback so that’s a 10 foot or a little less than 10 feet variance that you are
asking for and then 26 feet off the north property line which I believe is a 15 foot requirement.
Pg. 17 January 14, 2025 Zoning Meeting
We apologize for the confusion. The application indicated a request for 20 feet
where 50 feet is required.
And that’s fine.
Initially so it must have changed or evolved.
So, I apology for that.
No, that’s in your favor.
Iam going to play devils advocate. The math doesn’t work. If I look at the
current building and it’s roughly 35 feet in depth and J double that, my current setback is 65 feet
so that leaves me with 25 feet setback to the rear property line if the building is truly 75 feet
deep.
So, I guess what I would ask 1s to have the building placed...
BOARD MEMBERS SPEAKING WHILE APPLICANT IS. HARD TO HEAR.
If we pull it forward and it was considered, it will create...... because we have a
porch and we have a 200 year old oak tree that we don’t really want to mess with the root
structure because it is older than the house. If we pull forward, it is going to be tighter with
parking because it is very narrow...unless we start cutting trees which we don’t want to do
because they are old beautiful trees.
Yeah, I think we are trying not to make you change the design but make sure that
if we have the rear distance that is what you are going to be tasked with keeping so if you ask
for a 20 foot setback and based on this it’s
25. Michael Short: And based on the drawings it’s 40 . So, right now we have 3 different
dimensions I guess from my perspective I would like to see a
We have this survey that I brought to you.
Yes, it’s an instrument survey map and the existing garage is just under 35, it’s
33.3 and you’d be doubling that so it you add another 35 feet, and the setback is 65 feet, do the
math, 35 from 65.
30. So, we just want to make sure.
Yes, the intention was to............. CHRIS CENTOLA SPEAKING OVER
APPLICANT
We need a number that...right now this application has 3 different rear setbacks.
Pg. 18 January 14, 2025 Zoning Meeting
Do you see what we are saying.
Yes, I do.
BOARD MEMBERS ALL TALKING AT THE SAME TIME.
The most current survey is from 1991, which was the previous owners.
That was the survey because I had not had it surveyed. So, I guess we would
default, and I apologize for the confusion. The size of the structure would be coming from the
same place as exactly what you just said.
It can be confusing when your doing it by hand or without a licensed
professional, so I understand. We just want to make sure we get it right, so it doesn’t impact
you further down the road.
At the end of the day, James Architect, it’s drafted on here and it is listed as 40.8
but they don’t have the dimension of the pole barn itself on here, so they did get it drafted up
and they did...so it ends up being....so that’s where the 20 feet is. So, Josh back to...you are
correct . If it is 70 feet which you guys are saying is a 70 foot pole barn, it’s a 20 foot variance.
Yes, I think when we met the last time, I think that is what was settled on.
It was.
BOARD MEMBERS HAVING DISCUSSION.
I guess any other questions from the board.
Since you are using it for storage is there any plans putting up any type of wall
structures to separate your garage from your storage area, work space area.
Probably not initially. I prefer it to be open as much as possible.
Are you going to heat it at all.
Possibly part of it but yet to be determined.
And when you say possibly part of it. If you don’t put walls up inside, your
heating all of it or none of it.
Right. I would like to finish part of it so that it’s climate controlled but not
necessarily the whole structure. So, it would probably be the back portion.
Pg. 19 January 14, 2025 Zoning Meeting
[
No plumbing will be in there correct, no sanitary, no water.
No plumbing needed.
Ok, so no sanitary or water will be in there. Electric obviously.
Yes. I did bring samples if you would like to see them.
I am confused on....we through around so many numbers on setback, I
We are at 20 feet from the rear property line is where we are right now. Alright,
I will open it up to the public. Is there anyone who would like to speak for or against the
project. No, ok, I will bring it back to the board for any final discussions.

This request is not out of character in the neighborhood: So, this request, it’s not our of
character for the neighborhood. The property is on Bay Road and is a fairly large road and
the structure that is presented to us is a gable barn style that is being presented and is
associated with an older historic house, farm house on the property. So, it is not out of
character for the area, and it is also well hidden by mature vegetation.
There will not be a detriment created to nearby properties: Again, because of the vegetation
around the perimeter of this property and the mature vegetation as well as additional 20
feet off the rear property line. This will not be a detriment to nearby properties.
The benefit is not achievable by any other method: This is really due to the need for storage
that is not available inside the house and the current garage that is not large enough to
house the applicants vehicles for the building or for themselves. Other locations on the
property would have affected some of the old growth or the mature vegetation.
So, for all reasons that we just talked about, and it will be
hidden view from nearby neighbors.
There are no adverse physical or environmental impacts to the site or neighborhood: None
For the need to want to store vehicles but it is not
unreasonable for this day and age.
This is not an undesirable change:
Pg. 20 January 14, 2025 Zoning Meeting
8. This request is not significant: There are other properties with structures, similar type
structures on their property. Does anyone else want to add anything.
I guess I just want to make sure we are not having any water, we are not having
any sewer, and you are never going to convert this to living space.
No
And the neighbors around you that are going to be seeing the building are they
aware of this, have you talked to them. (Mrs. Volo, postcards and signage is put out, everyone
would have known)
So, I have not. There is really only one and you will only see it from the one side
of the property and one of the neighbors really won’t see it and they are brand new, so I have not
even met them and have seen them there or be able to catch the. One of the other neighbors I
believe is in a nursing home and she’s not there, but it will be, I would think, a tremendous
improvement of her view which I am happy about because she is very meticulous with her yard
and I think she will enjoy a better view because what she is looking at now is a weedy garden
and a dilapidated garage so this is going to be neat and clean and I would think, a much better
view for them. Although I would have liked to discuss that with them with the holidays and the
efficiency of getting on the schedule and I was out of town so but I’m hoping their very happy
about it because I think it will be nice and it’s one eye sore on the property is really is that
structure and brings everything else down and it was like that when I bought it and we tried
everything to make it look good and it just really needs to be redone.
And based on our conversations, you are not running a business out of this
property or this building, correct.
Correct. It will be for storage for over flow and creative space but no, it is not a
facility for a business.

Appearing before the board was Emma Oakes and I am a Project Manager at Costich
Engineering. I am here representing the Genesee Land Trust for one of their nature preserves in
Webster, the Ave and Harman Braman Nature Preserve, and it is located at 1775 Ridge Road.
Over the last few years, they have been able to make some improvements to the site to improve
access for visitors. They have worked with NY State DOT; the town Planning Board to get a

sign being in nature preserve, there are a lot of trees on the property and a lot of trees that my

those neighbors won’t really be able to see the sign when they are on their property. There is a

commercial business across the street that will probably be able to see the sign in 6 months out
of the year. They have some pretty dense existing deciduous trees that have low canopy, low

during the spring, summer, early fall months. There is an existing sign at Union Hill Cemetery
Just west, down Ridge Road from this property. It looks like it’s an historic sign, but it is either
on the right of way line or right close to the right of way line.
It was probably there even before the right of way was actually there.
Probably. I don’t know how old that fence is. MOVING ONTO THE NEXT

for this sign. A lot of them include tearing down the existing vegetation and those big nice
mature trees that of course my client would like to maintain if we were to situate the sign and
meet the setback requirement. It would actually put the sign on the south side of the existing
parking lot in the woods and you wouldn’t be able to see it from the road.
MOVING ONTO THE NEXT SLIDE....SUBSTANTIALITY. We don’t fee! that this is a
substantial request. There is no lighting on the sign. It’s natural colors, it’s green and the sign
frame itself will be made of wood so there is nothing flashy about the sign at all.
MOVING ONTO THE NEXT SLIDE...IMPACTS ON ENVIRONMENT, We don’t feel that
there is any adverse impacts on the environment here. Really, the only disturbance on the site
would be when the post holes are dug to install the post for the sign. No significant
construction; no adverse impacts to drainage and actually will improve traffic and circulation to
and from the site.
MOVING ONTO THE NEXT SLIDE....SELF-CREATED DIFFICULTY. We don’t feel this
was self-created and we are really responding to the existing conditions on the site as best that
we can by not impacting the vegetation here; by increasing visibility to the site. I will also add
that we coordinated with NY State DOT, and we originally wanted the sign to be as close to the
road as possible for better visibility and they indicated that that was not possible to located
within their right of way. So, we pushed the sign further south onto our property and we also
sort of played around with which side of the driveway do we put the sign and going back to the
DOT comment we felt that if we put the sign on the east side of the driveway apron it would
impact or clutter the view shed with some of the DOT existing signs over on the side of the
driveway so we really feel the west side of the driveway is the best spot for this.
Questions from the board.
Do you have an image of the sign.
Yes, we do, and I can give you all images and I have another image of another
nature preserve that has one of the signs installed so you can see what it will look like. EMMA

HANDED OUT PICTURES TO BOARD. (SEE ATTACHED) It’s a little bit misleading. The
first page has a bunch of different signs on it but it’s really only two of those that are being put
up. Those are just the proofs from the sign manufacture,
What is the overall height?
6 feet
So, as I am looking at the second nature preserve, the top of
the 4 x 4 would be the 6 foot.
Yes, the top of the frame.
I can tell you; I drive by that particular area more frequently than not and
frankly, I didn’t even realize that there was a nature preserve there and the same with the
parking area until I drove by it. There is a grade change though from the road to where you are
proposing. A couple of feet, 2 feet.
Yes, 2 feet.
Is that why the 6 feet.
Yes, because of that grade change.
I did an informal sign survey today, driving around town and looking at the
different town parks just to see what we did because I know the town has it’s requirements as
far as signs and monument signs for businesses and offices and whatever, I was trying to see
what the town actually did and I found signs where, actually, the Gasnell sign is
probably, location wise from the right of way and the edge of the road, right about where this
sign would be. The Vosberg Natural Trail was a little bit further back; the Herman Road sign
was back in the parking lot and very difficult to see unless you knew it was there and was
looking for it. Anyway, there are signs within the Webster Parks system that are...look very
much like this only the colors are different and location wise, were similar and then once | did
find the parking lot, which took me a few passes past it, I tried to figure out the line of site from
where the sign is. Is it going to be setback from the front of the fence or in line.
in line with the edge of the pavement.
Which is still far enough back that it did not impede my view of the road as I
was pulling out which was my bigger concern is that is a busy stretch of road, but I certainly
don’t want anyone getting clobbered coming out. Anyway, there are town park signs similarly
located.

Ay
Not so much a question more of a comment, putting it on the west side, I
understand the reason why especially with the DOT signs there. Driving from the west to the
east, you still are not going to see that sign because of the trees.
We have considered pruning. Potentially once the sign is in and my clients sees
it, they will probably prune some of those canopies.
I was going to offer and not so much for this particular sign, but you might want
to put one at the trail head as well because as of right now, it’s a parking lot and nobody knows
what it is. Putting the sign up is a great idea because it allows people to know what is there.
Any other questions, NO. I will open it up to the public and seeing that there is no public here,
I will bring it back to the board for final discussion.
I think it works well and like I said, I drove by it twice trying to make sure I had
the right curb cut so signage would definitely help if they want to encourage more people to use
it and obvisioyly it’s an amenity that people will use it a lot more once they know it’s there.

The application is such as submitted will not present an undesirable change in the character of the
neighborhood it’s in. While there are other remedies it would involve clearing trees which make
part of the site worth walking and going to so in that respect, there weren’t any reasonable remedies
that would work. It’s not a substantial request as far as a variance goes; there are no adverse effects
or physical or environmental to the existing conditions on site. While it is self-created, I believe
the trade off for putting it where you located it as opposed to clear cutting 3 or 4 trees is more than
worth the variance allowed.
I do want to add that it does not block the line of sight pulling in and out of the
parking lot so it’s not a safety issue.
