Town of Webster Highway Department Advanced Clean Truck (ACT) Legislation
Advanced Clean Truck (ACT) New York State Legislation mandating a certain percentage of truck manufacturers sales be Zero Emissions Vehicles (ZEV) . The legislation was originally developed and implemented in California. It was adopted in NY in 2021 and begins implementation in 2025. The legislation is specifically for Medium-and heavyduty vehicles. The requirement for manufacturers on Class 4-8 vehicles for sales in NY is 11% ZEVs in 2025 and increases annually until 2035 when the final requirement is 75% of sales in NY.
Limited Sales
No major heavy-duty truck manufacturer currently has the ZEV sales required to fill all orders for traditional diesel heavy-duty trucks.
Tech Gap
There is not currently a ZEV that is viable for Snow and Ice operations as we see them in NYS. (Long Hours with minimal breaks combined with Hydraulic PTO Equipment)
No Short-Term Private truck purchasers may have the option to register trucks in other states to reduce the projected impacts in the short term. Municipalities do not have Options this option. No Current Letters have been sent to Governor Hochul and the EPA from The New York Movement for State Automobile Dealers Association, The Trucking Association of New York and The American Truck Dealers group, but no action has begun. Change
ACT 2025 and Beyond: We cannot currently place orders for 2025 model year trucks.
IMPACT
Model year 2025 trucks would come with a title that states they can not be initially registered in the State of New York. Our fleet of over 30 medium- and heavy-duty trucks will continue to age and become more costly to repair. The potential for increased breakdowns during major storm events threatens our ability to serve the public and provide safe roadways.
Efforts to Change the Current Situation Communicate the negative impacts this legislation is having on Webster to State and local elected officials
Coordinate with other municipalities to develop strategies and action plans
Work with New York truck dealers to think outside the box in the short-term
Support automotive and trucking organizations in their efforts to lobby for change
Work with the Monroe County Highway Superintendents Association to lobby for change
Potentially pass resolutions related to this issue / topic that can help strengthen the call for change
Proposed Adjustment to Mitigate Impacts Utilize remaining 2024 truck budget in combination with transfer from Special Drainage Fund to purchase an in-stock Vac Truck currently planned for purchase in 2025. The Vac Truck will be utilized for both on road hydro excavation and drainage work, therefore the cost will be shared between the Town-wide Fund and the Special Drainage Fund. The price of the new Vac Truck via Sourcewell Contract is $501,577.88 Since we are unable to order the remaining 6-Wheel Dump truck in this year's budget we propose using those funds, +/- $314,464.00, towards the purchase and transferring the remaining balance of +/- 187,113.88 from the Special Drainage Fund.
