AREA VARIANCE STATEMENT OF DIFFICULTY

An area variance shall be granted only if the applicant can establish EACH of the following, in accordance with Section 350-102 of the Zoning Ordinance:

A. Essential Character. Indicate how the variance will impact the essential character of the neighborhood. No undesirable change in the essential character of the neighborhood will occur and no detriment will be created to nearby properties if the area variance is granted because:

The requested variance will not create an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed six-foot wood stockade fence is a customary residential privacy fence and will enclose an area that functions as the side and rear yard of the residence. The fence wil remain entirely on the applicant's property and will not extend across the primary front yard along Hills Pond Road. The wood stockade destgn will provide an attractive residential appearance while providing privacy, security, and separation.

B. Alternates Considered

Indicate the benefit sought by the granting of the variance and why the benefit cannot be achieved by some other feasible method other than an area variance. Identify the alternatives to the variance that have been pursued, and why they are not feasible (include evidence where necessary to support your conclusion):

The applicant originally planned and contracted for a four-foot chain-link fence. After a neighboring dog bit the applica @ applicant reconsidere: the fance type and height due to concerns for the safety of the farnily’s children and dog. A six-foot wood stockade fence ee

barrier, greater separatton from neighboring animals, and improved privacy. A lower or oper-style fence would not provide the same protectlon, white moving the fance substantially toward the residence would significantly reduce usable enclosed yard space.

C. Significance. Indicate why the requested variance is not a substantial or contextually significant deviation from the current code/regulations (is the difference between what the code requires and what you're requesting significant):

The requested vartance is IImited to the portion of the proposed fence affected by the corner-tot setback along Brookevitle Drive. The fence will be located _ within an area that functions as the side and rear yard of the residence and will not extend across the primary front yard along Hills Pond Read. The proposed location allows the family to maintain a practical and usable enclosed yard while acoommodating the unusual configuration of the corner lot.

D. Physical and environmental conditions. Describe any potential impacts on factors such as drainage, traffic, dust, noise, odor, public services (e.g., compliance with the Town Code requirements to be varied would result in structures over an easement, removal of mature trees) provide mitigation efforts if any are to be utilized:

The proposed fence Is not expected to create adverse physical or environmental impacts. The project Involves Installation of a residentlal fence and does

not Involve changes to drainage, grading, utilities, public services, or the existing residential use of the property. The fence will be located on the applicant's property and will be positioned se as not to interfere with vehicular sight distance or access.

E. Not self-created. The alleged difficulty was not self-created because (consideration shall be relevant to the decision of the Board of Appeals but shall not necessarily preclude the granting of the area variance):

The need for zoning relief results in significant part from the property's existing comer-_ot configuration and the application of setback requirements to the secondary street frontage along Brookeville Drive. The residence, fot configuration, and street frontage are existing conditions that were not created as

part of the proposed fence project. The applicant is seeking the minimum practical relief necessary to provide a safe and usable enclosed side and rear yard,

680 Hills Pond Road Webster, NY 14580

Letter of Intent 680 Hills Pond Road, Webster, New York 14580 Area Variance — Residential] Fence

To the Town of Webster Zoning Board of Appeals:

I am requesting an area variance to permit the installation of approximately 138 linear feet of six- foot-high wood stockade privacy fencing, including one gate, at my residence located at 680 Hills Pond Road.

The property is a corner lot with frontage on both Hills Pond Road and Brookeville Drive. The proposed fence is intended to enclose a portion of the side and rear yard of the residence. Because of the corner-lot configuration, a portion of the yard along Brookeville Drive is subject to the setback requirements applicable to the secondary street frontage, requiring area-variance relief for the proposed fence location.

The fence layout is based on the existing yard configuration and is intended to provide a safe, secure, and private enclosed area for my family. The project was originally planned as a four- foot black vinyl-coated chain-link fence. After a neighboring dog bit our dog, we reconsidered the original design and elected to use a six-foot wood stockade fence to provide a more substantial physical barrier and improved separation for our children and dog.

The proposed fence will remain entirely on our property and will not extend across the primary front yard along Hills Pond Road. The fence is intended to enclose an area that functions as the side and rear yard of the residence while preserving a practical and usable yard area. The project does not involve any change in the residential use of the property, grading, drainage, utilities, or public services.

We respectfully request that the Zoning Board of Appeals grant the necessary area variance to allow the proposed six-foot wood stockade fence as shown on the submitted site plan and project

materials,

Thank you for your consideration.

Project Description 680 Hills Pond Road, Webster, New York 14580 Area Variance — Residential Fence

Project Description

680 Hills Pond Road

The applicant proposes to install approximately 138 linear feet of six-foot-high wood stockade privacy fencing, including one gate, around a portion of the side and rear yard of the existing single-family residence at 680 Hills Pond Road. The property is a corner lot with frontage on Hills Pond Road and Brookeville Drive, and area-variance relief is required due to the setback applicable along the secondary street frontage.

Area variance requested to permit a six-foot-high wood stockade privacy fence within the required front setback along the Brookeville Drive frontage of this corner lot, pursuant to Town Code § § 350-12 and 350-79.

The project was originally planned as a four-foot chain-link fence but was revised to a six-foot wood stockade fence to provide greater privacy, security, and separation for the applicant’s children and dog. The fence will remain on the applicant’s property and is intended to create a safe and usable enclosed yard area without changing the residential use of the property.
