Town Board Meeting
Great tonight, huh? Uh, well, welcome everybody to the Thursday, May 1st, 2025 Webster Town Board meeting. We will start with the pledge of allegiance. I aliance to the flag of the United States of America to the republic for it stands one nation under God indivisible with liberty and justice for [Music] all drag out. So you Council woman here right here. Attorney for the town Taylor. Okay. Well, our first order of business tonight is a public hearing uh to consider an amendment action to a TDD that was set up in
2019. Um, and from what I can see, speakers are uh the developer I think the developer engineer designer and the developers don't think anybody You got it. Potential speakers are those three. Um, but I I will just say this uh for the town board. You will notice that there is no agenda item tonight. Uh depending on what tonight goes, we put that on the Thursday, June 5th. Oh, I'm sorry. That's right. Today's May 1st. Thank you, Ann. Um yes, it would go two weeks from tonight. Okay.
Yes. Thank you. Uh so with that being said uh we will open the public hearing and in order of who is on here I don't I got I got Michael and I got Charlie. Okay. And the gentleman coming up right now speak right and yourself engineering on behalf of Charlie Fox. as well for PB amendment which involves four properties on the south side of Ridge Road by the west side of the site property
address 26 plan for medium intensity commercial and medium high [Music] res included the ordinance was a little different relative to also approved in was allowed for storage and senior living which were not allowed commercial right at the time and our users were storage back application to this board last fall amendment of the proposal of the PD staff primarily regarding updates that happened in the PD or the fact that our interpretation
was not included. change the boundary of what instead of it being 26 acres holdings commercial and residential it's been changed acordance with uses that commercial which are intended to demonstrate what capacity would be general commercialist that allows In the ability to use discretion
relative change that commercials. That's over public town discussion within that.
Um, I'm I'm a little confused. My name's 991, which is behind the existing commercial uses on That site is approximately did you say 27 acres or 26 [Music] All of this is [Music] 26 here. This is commercial. This is residential. [Music] And that's what we're looking at is all commercial. And then what about the portion south of Yeah. Um, it's a great question and actually help.
Um, I appreciate the map that you have up there on the screens for anybody in attendance who are watching this. Um Josh uh Artuso the brown is MC which is medium MC purple very pretty purple is MHR which is res okay so the 991 along with this what is 1030 or to the right of that. This this is part of this 26 acres. There's purple and there's brown in your 26 acres. So really there's a zoning line that goes through the middle of this developer's 26 acres. Okay. Now here's the thing and and like Mike said, I'm not sure it was one of our first PDs back in 2019. I don't know that history, but I do know this. our DPW department who was involved in the process of issuing that PDD. Nobody from that department in that 2019 is here anymore. Josh Artuso
um is the community development director, he was very instrumental in the last couple months here on this. Uh the town legal who was here in 2019, they're not here anymore. Kyle's been very helpful. uh the town ward really, you know, Patty, I think you're the only one that was here in 2019. Here's a revelation for everybody. We're all human. Um they made a mistake in 2019. And the beauty of that, and when I say they made a mistake, is that yeah, they issued the PDD, but by the technical terms of town code, you can't have a PDD on residential zoning. It's as simple as that. And I got to tell you something. You might want to go up there because anybody listening to this did not hear you. They did not see you. Charlie, if you want to go up, you guys want to do a line. Go ahead. If you want to go on the microphone and so we can senior senior. So I I want to make sure I'm trying to help you. Okay. Let's not adjudicate this or litigate this now uh because we don't have to. Um bottom line is PD is
appropriate for MC. It's not an appropriate thing in our code or law for MHR. So we are correcting what happened in 2019. That is what they are here asking us to do. Uh it is really as simple as that. They are not coming here saying what do you think about this 20story tower we want to build or we want to build a nuclear power plant. They're not going to do that. Okay. The first thing they have to do before they get any Charlie's level before they get any design of what to do on this property the first thing we need to do is get the skeleton of it correct which PDD needs to be truncated back to be correct to be on C the law and just common sense that Kyle and gives us the ability to correct errors. It was an innocent error. I'm not going to sit here while they don't work here anymore on those. So, we're not going to take them out for public. God knows when I'm gone, they'll find million mistakes that I've made. Hopefully, correct them. This is an easy correction. Would you say that Kyle? I
don't want to will say it's easy, but she represents right what the developer moves forward within we don't know I can't wait to see when we come back here uh you know after it's important to note too that the impetus behind this is that we're unable to make any plan application for the portions of the commercial property right. So anybody who's been interested in commercial development follows it's really that simple. I want to make sure I went a little deep and well on this as far as explaining because we don't have a full board tonight. In two weeks, May 15th, I assume that we'll have a full board and that John K will be here. I will ask him to read the minutes of this that does a wonderful job on and I will ask him also to watch the video and
audio of this part of it so that when we do come back here on May 15th this should be a relatively simple resolution to pass on question to do this you have to subdivide the property two separate just think that question is for Kyle or Josh once again all due respect to Mike and to you're the client I would like to answer it does not require subers Any other questions or comments from the board? This is the public hearing and to be honest with you uh I would I don't know I can't figure out this five and a half years. I was somewhat a little bit stunned that nobody from the public was
here to a very advertised public hearing. Usually some people there's 45,000 people in town will come and say something. So but that's why we wait for the public input and we try best as we can to not do a resolution on the same as public hearing. It doesn't that's not a good look for us. We want to hear what the public has to say. given that format form form of a public hearing. It was tonight. It's closed. We're done on this agenda. For anyone who's tuning in after you post it, it's closed because there's no coming. Yes. Thank you very much. Thanks Ann and Mike Charlie. Always good to see you. Thanks for your time. Um, our next item, uh, I know you had minutes attending board members. Well, first I nobody signed up to speak for the five
minutes over the floor or anything their heart desires. Is thatbody? So the floor minutes approval. Uh can I bring this for? Sure. Um they were tabled from our last meeting. Um you supervisor, you were not at the meeting and I was I was presiding in place. I could not make a motion or vote on these because I had not been pres but Jenny and Jennifer and I were here. There's three of us. So I I have read those minutes. I make a motion that we approve the workshop minutes from April 3rd. Supervisor I council. Council extreme. Councilwoman Right. I make a
motion regular board meeting from April 3rd. Supervisor Ir. Councilwoman Councilman And then three of you were here. That was Matt. So I will make a motion that we approve the April 17th, 2025 minutes by Councilwoman. I supervis All righty. So, you and I crossed you and I crossed paths until yesterday. It's because I was here to uh review the bills and I found everything to be in order. So, I would make a motion that we approve them as submitted by our director of finance. Councilwoman I. Councilwoman I. Supervisory I. And um first of all, when Paul is not in attendance, he's almost like a security
blanket to me. I like my account in the room, but he said it'll be okay. I'm gone this week's good. So with that being said, I have reviewed warrants as submitted by all motion that we approve them. Second. Supervisor clarity. I councilomani I counciloman hi councilwoman I and I have reviewed purchase orders submitted by the director second supervisor I councilwoman hi councilomani I and moment Um I I want to thank Councilwoman Wright. Um she has taken a bull by the horns and has started a team task force, whatever you want to call it, to digitize our heavily papered purchase orders and vouchers. Yes, and I'm really excited. I'm super excited.
had a very productive first meeting. We're also talking disposal. Not not Oh, not a garbage district or a garbage. It's just for our Yes. And it's not looking for digitize. [Music] Um, next one. I'm gonna let Josh explain why we're this. Yeah. So, if you may recall regarding amendments to our property maintenance code, other sections deal with Unfortunately, we are still in the process of finalizing those edits. The deeper we got into it, we realizations other sections of the code. So rather than rush through make sure
it anticipate coming back instead of requesting a public hearing the next meeting on believe so I mean the way this resolution is written it's so specific come back. Thank you. That sounds all right. Okay. I'll make a motion to [Music] table 15. Supervisor Clarity I win. Hi, Councilwoman. Hi. Well, this is the resolution that spawns off of Josh's workshop presum.
Make a motion to solicit bids for demolition services at 600 road tax. -11 and advertise in May 7th 2025 bids will be open for 24 days process for 24 days. Second supervisor I councilwoman I councilwomani I council woman Okay, the next two and I think this is what we're here for and I know Steven also commissioner John Han give a good I started working with Kristen very long time ago back in 2023 desire to f as large portion
possible backyard forunately this is one of the yards that has town east it's primarily for drainage drainage pipe that goes across her backyard originally we discussed the concept of the licensing agreement configuration that existed out there feasible. Um, so Kristen has been pursuing and establishing a way to have that portions of that easement removed from the property so we don't have to do the license agreement that's in a larger portion. Um, we've now got to a point where that can be done. So these are resolutions to abandon portions of utility. Turns out after research sewer and drain in the exact same footprint, which isn't typical. Makes this significantly more complicated, which is why there's two resolutions rather than one, and it requires signature. There aren't any related infrastructure pieces, parts, uh, in the portions that we're doing. There's only drainage. I've evaluated the drainage portions there. Kristen has agreed to reconfigure some of them. So there'll be
a portion on the rear portion of her lot that will be abandoned. One side of the lot that will be taken at her cost in more. So it's quite a complicated situation when we get down a lot with Josh and Kyle on the nuts and bolts of it. It's just a complicated huge getting these resolutions here all these configurations infrastructure a lot of stuff. So that's that's what the resolutions are for that possible I assume that you are not the No kidding. That's what happens when you assume it wasn't. No, it wouldn't be. You had a thousand pages and Okay. Well, I should have assumed that.
Um, yeah, we're finding out sometimes the way priorments utilities wasn't completely thought out. They have said we've been very exhaustive process. Thank all of you for patience and willingness to work collaboratively get it done. pets, children. Okay, there you go. Oh, okay. Congratulations. [Music] Well, I guess it's more highway.
Okay. Resolution to abandon portions of sewer storm water drainage located at 1129. Tax ID number. Councilwoman Right. Hi, Councilwoman. Hi, Supervisor. Hi, Councilwoman. I will also I counciloman I supervisory I councilwoman I All right the next item up tonight I got
a little egg on my face I'm gonna hear it everybody would be best to explain it. I was expecting the present on I'll leave it up to the board if you'd like me to present on your behalf. It's essentially any new development in the industrial district requires a referral from the town board to the planning board for the So we did receive this application for a believe a three tenant industrial type complex road 633 basket road entails indoor daycare operation spaces
parking space for business. As soon as I finally figure this out, I'll be done. You just hit when you said town right now. That's why it's got and it will be coming back to this ultimately for the industrial again. Well, anybody concerns about it? Should I keep my inside? Okay.
Well, most I would make a motion that we consider referring a proposed project located at 633 Basket Road. Tax ID number 66.03-1-91 to the planning board for the purpose of conducting site plan review pursuant to section 350-22D of the Webster Town Code. Second. Councilwoman Fati, Councilwoman Wright, I supervisor I Councilwoman Pat, how much you're going to give the explanation of this and I can say that I remember your predecessor here for a long time to bring us home. Okay, that that's that's what this is. That's an excellent segue. Uh so this is a a proposal to advertise for bids for a forsighted concrete box cover associated with the binar regional storm water facility.
I've been in to talk about that project before. It's a very large storm water flood mitigation uh project that's located in town park along ship builder street. Um it's a unique project. It's a partnership between town and water both funding it grants. Um so this is literally the last component. When this component goes in it, it goes it's a culvert to allow ship builders to go through but it also has the inlet portion that will allow water rises to a certain level within ship builders to divert into these large storage which is the purpose of the project. This past year we've had many many rain events uh that have led to concerns about flooding along this waterway. We know it was prone to flooding. So way back 2016 they started work on this 2018 some actual physical work began a large in 2021. So we're slowly working away this schedule. doing a lot of the work, a lot of the construction work as our portion of the project.
Now the physical ponds are there but it's not directly connected to ship street as it's so we are going out to the last uh material purchase over to have that once we get that purchased forces will install it this fall is the plan and then this facility hopefully the residents downstream here will start to see the effects of this facility I very happy about 14 last year. Obviously very excited about this a long time together with all the financial portions I know he'll be very happy to get out the books. numbers on it. It's very very large project very very large by the town as
well as the county. So the only other thing that's what the resolution is for did receive was a third it's not admissible but it's agreement between soil water and town which dictates what portions are being paid for. Last year I did have some indication that you know they they thought the project important that they were continuation I gave on portion of this outline that the initial plan cost to the town was much lower they're very aware of that they think the project is still very very valuable understand our community as well as the county um so let the agenda I have today actually increased the contribution that's coming from the for this project and increased it by $85,000. So they've now gone from their original contribution was 393,000 now $47,000 there's over 100,000 that's left. So until the project is completed
they won't reimburse. So that's the other key part of this video. Uh it's a little bit longer. It'll be the second meeting. So bids that we're advertising for June 10th. Yeah. So it'll be whatever the meeting is after that hopefully. resolution to that purchase at that time. probably if we don't finish the projects and it's so it's funny now that you explained it that way I don't know you should very
high. He would have been more excited to hear what you just said. This was always I do not feel the same. I'm somewhat dismayed to find out that we've done all of that work. Um, and it still isn't functional. So, this last piece, this is great news to finally bring this to completion. We'll all be happy. Paul Adams always great explanation by the way. And you queued us up for a couple weeks from now on. Uh, I will move that we solicit bids for pre-cast concrete box cover associated with the completion of the regional storm water facility located in Flint Park off Gravel Road to be advertised in
the May 7th, 2025 edition of the Webster Herald. bids will be due on Tuesday, June 10th, 2025. Second, I supervis. Okay. Um, it's funny this next one to see as our project Kyle plays out over the next few months. I really trying to take a look at what what contracts need to come by town to authorize Kyl Town is so broad everything just bubblegum up to the obvious. I say that because this one ends up
um over a 2 and 12 year period. The only reason about it is because our previous vendor information was acquired by Schneider which is a company assessing and we have had an agreement with another vendor that vendor was acquired by geospatial so there is a small amount required to transition to set up a new with the new system. And this system will be the community facing portal when we move forward with the reevaluation that's coming in. This will be the place where um residents, property owners can go and look at the property and see the valuation, what's changing and be able
to confirm that the information that is on record is accurate before part of that exercise. So um so that's why this resolutions. I love and even if we got this process, ah, this doesn't kind of fit the criteria. It's $7,636 period. Just having Jennifer to sign professional services agreement with a spatial LLC. for online assessment data in posting expiring December 31st
2027 total uh 763 the amount of $7,630 over the course of 50 months or 30 months Counciloman. Hi, Councilwoman. Hi, Supervisor. I council woman. Um, all right. I think you're okay. Sorry about that. So you recall we discussed this issue last fall. So January 8th this year on board of
8 in sewer line that is supported approach approach you DC on emergency. They did not agree with us. So this amendment is for important piece of that to help us move forward. I don't I hope this is this project uh we looked at it last year and that was to fix this thing permanent whatever. We did not get
awarded that grant. came back uh with this in January of this year and said here is here's a way we can do this for $100,000 and at least short up um and that 100,000 is more out of the budget this year andor I can't remember now again other pipes that are exposed. There's animals that are
under young lady chose three options. Um she came back in January showed how hopefully we're 100,000 or less resign at least we get the most urgent through our budget not giving up on the total I would move that we authorize the supervisor to sign an amendment with Barton Judas in the amount of $16,550 for continued work regarding ship street. Hi, Councilwoman Right. Hi, Supervisor. I councilwoman. All right. Right back to you. This is a
resolution, some storm sewer. Also, this 15 was record. are also sanitary and we've not done that yet. And this is a testong with that. that finer
number and I really enjoyed the meeting last week. Beautiful new chance to meet Steve Marsh. Um really great people and and a lot of that conversation was built around finishing this project. This is the approximate $7 million conveyance project Philips and as you as the board knows this is one that 96% of the principal interesting um I'm doing my best Paul Adams is right now um and as I I've been a broken record on this as long as the fair life are aware of these change orders aware of these things um they're paying 96 cents on the made aware and understand what troules
into road was going too smooth. It was going too smooth. The first 11,000 12,000 ft was just the last thousand ft tough for all the things we've already explained here. Um, and like I said, as long as made aware, document they were made aware, okay, um, we're we're in good shape to get this all done. uh go into August, pay the one year bond anticipation note, get the 96% and then tie up the longterm bond terms which Paul says nine years of this and then payment schedule part of project
$38,36,57 that we will pay once that is I want to hold this up. That was the first time I met Steve. Um, and I know now why the uh residents who have had a tough situation, but even when they called out to my office about this, they always said, "Boy, I'll tell you the in the whole such nice people in the business the one son's brother is on the back. This is just not a bunch of subcontractors don't care. This is a family business and I was really impressed. Yeah.
What was [Music] it? Changes. What did it turn out to be? And this is where Paul originally thought and then we ran into that last thousand ft change or there's credits coming back. I was really done somewhere around 30th because then dust settles and bills all figure out exactly what it cost and that's how we tied up in August Kyle and I uh are tenatively scheduled in July for circle wagon meeting with Fair Life and their attorneys just to make sure we're all on the same page with the contracts that we signed with a year, two years
ago. And I think that very smooth especially as we get into August $7 million contract as we get into their first payment on the $22.9 million tie in just all the other things that we have just want to make sure the secret for their CO is now two years opinions of what it It's important in the room July when they want their certific. uh so they can start producing and see is a big part of that. I will make a motion to authorize the supervisor to sign a change order in the amount of [Music] $57,1460 for the Marsh pipeline. Hi, Councilwoman. I council
and I believe the next one is mine as well. These are items that we are surplusing and recycling from the sewer department. There are two eight items as listed on the agenda and I would move that we send those to recycling. Councilomani. Hi, Supervisory. Hi, Councilwoman. Hi, Council. Not bad. We got through 13 resolutions, a couple of board meeting minutes, public hearing in 59 minutes. Pretty good. Now, we'll go to the round table and we'll start with Art. All right. Well, I think you already facing a fast pace. our days over the next few months.
So there's a lot of basology bas at the same time. That's a big building down. So, we're around station.
sites today. So we've been working with most recently Johnie Follow that. I'm glad that uh busy as well. Uh so we are in the thick of mulch deliveries. Our mulch compost uh that we provide back to the residents as a result of our collection in the fall is going out. Uh I believe we're over 200 deliveries already so far. cubic yards delivered as well as the public platform pick up over on street is still moving very long. We're working through that few weeks round about the roads already. We started two different county efforts. Uh we actually skipped down to park this week road parks that we
weren't expecting to do that came up in the last month or so entrance to the dog park. We help them by paving that we road for some drainage improvements. We also are wasting that early this year because a lot of the preliminary underground work was done last year. that out of the way so that we can continue to move on whatever county work shows up as well as So off to a great start. Everything's going really well. And of course last week that we had to dedicate the building and do a ribbon cutting with members of people involved in the project as well as special thanks to Bridget organization that was appreciate that people already come to that nature. I would have to
agree. It was great to have the guys settled in. It was great to see their reaction to what was going on. Nice. We're starting to see the usual seasonal upswing in activity building. And we're also we did hold our first public workshop meeting associated with plan update project which was pretty well attended. We were happy to see that there was about 40 to 50 people in attendance. Over the next few months, we're going to be bringing our public engagement efforts to the people and we're going to be starting popup events. First one will be on Saturday May 10th for community arts day school presence there youth and we will also have
a summer celebration. We also have a survey that is accessible web page that will be open through June 15. So what you got? Well, that concludes my
