Section 6.4 of the Contract provides for a project contingency and use there of. The provision allows for Navitas to utilize the project contingency for unanticipated costs it has incurred that are not the basis for a Change Order under the Contract Document. Section 6.4.2 (amended in Amendment 3) that any Contingency Savings will be shared with 90% going to Town of Webster and 10% going to Navitas.
As of 3/24/26 the project contingency stands at $988,924.
All major systems and pieces of equipment have been mechanically started and all buildings/underground utilities have been installed.
Navitas’ evaluation of project risk has determined that Navitas is comfortable with $500,000 of project contingency to address any remaining risk items before final completion.
Since the unspent contingency funds will ultimately be returned to the Town, Navitas is prepared to permit the Town to utilize $488,924 of project contingency to complete items that are not part of the contract scope by utilizing Navitas subcontractors and agreements within the remaining contractual time of the agreement.
The following potential items have been identified
e Maintenance Shop Heat - $128,620 -The maintenance shop heat was not considered a necessary improvement at the beginning of the contract. Upon commissioning of the new heating system for the administration building it was determined that the shop heating was not sufficient. This scope will replace the heating system for the maintenance shop with a natural gas fired radiant heating system
e HSOW Dumpster Enclosure - $121,384 —- The new HSOW acceptance facility screens debris from septage and grease interceptor waste. The material is collected into tip dumpsters and then transferred to a roll off dumpster for removal and hauling to the landfill. The original design involved transporting the dumpsters to the Service building for placement in the screenings/grit dumpster. It was later determined that a dedicated dumpster near the HSOW facility would be a better location.
e Aeration Slide Gate Install/Plus Upsize Gates $59,146 — During the design of the project the TOW determined thai the slide gates in the aeration basin did not need replacement. During the upgrade of the tanks, the tanks were drained which allowed for a visual inspection of the gates. Upon inspection it was determined that the gates should be replaced.
e Spare Sludge Pump Wet Ends - $35,778 - Limitations on space within the solids building prevent the installation of a spare sludge dewatering feed pump. In order to
eliminate risks from equipment failure the purchase of the spare feed pump provides a shelf spare to allow the plant staff to quickly replace any pump components in the event of failure, removing the risk from supply chain disruptions.
e Material Matters Consulting Agreement - $51,000 - During the design of the system the final use of the fertilizer product had not been determined, therefore a commitment to a consulting agreement to market the material was not deemed prudent. With the options available to the Town it has been determined that marketing the material as a fertilizer with a monetary value is the preferred path and the consulting agreement will support the Town in getting the greatest value for the product.
e Primary Clarifier Ice Prevention System - $66,860 — The primary clarifier gear drives can experience ice build up during extended periods below 20F. The current system of managing ice build up utilizes heat lamps to prevent ice accumulation. An enhanced insulation cover with an integral convection heater provides additional reliability for the system, preventing operator call outs overnight and on weekends. Due to the potential for explosive gases on the surface of the primary clarifiers the system requires explosion proof components.

JOHN W. DANFORTH COMPANY
John W. Danforth Company Terms and Conditions of Sale
Definitions:
Entity that purchases goods and/or services be it a contractor, building owner, or other. Seller: Entity to whom Buyer's subcontract/purchase order for goods and/or services is issued to. Manufacturer: Entity that manufactures goods and/or provides services.
Acceptance:
Acceptance of a quotation by the Buyer is also acceptance of all JWD Terms and Conditions of Sale set forth herein. The quotation provided shall be signed and dated by the Buyer where applicable and returned to Seller as proof of acceptance. The processing of the order will commence only upon receipt of the signed accepted quotation. JWD reserves its right to negotiate any contract terms prior to final execution.
Seller has not accommodated any work beyond what is shown or specifically scoped. Pricing is reliant on assumption that Architect/Engineer has depicted a complete and operable system.
Permanent Equipment for Temporary Heating/Cooling
The permanent systems/equipment are not to be used in any way for temporary heating and/or cooling during construction. If request to use these systems is made by Owner, maintenance and operation of these systems during construction will have an additional cost. Additionally, it will cause the commencement of warranties for these items to go into effect immediately upon their use.
Submittals:
Submittals will be provided only after Purchaser's subcontract/purchase order is received by Seller.
It is assumed that any materials/equipment listed by Engineer as “or equal” will not result in any additional costs or scope modifications for any disciplines (electrical, civil, structural, etc.).
Release for Manufacturing:
All goods that require submittal approval will only be released for manufacturing upon the receipt of written approval and authorization from the Buyer. All goods that require submittal approval prior to releasing for manufacturing will be ordered exactly as shown in the approved submittal unless specifically instructed otherwise in writing by the Buyer.
Terms of payment are payment in full within thirty (30) days of invoice date unless otherwise authorized in writing by Seller (issuance of contract documents by others is not considered written authorization by Seller).
Our intent on this project is to pre-fabricate materials that are to be installed on site. During this process fabrication will be pre-built well in advance of physical installation on the jobsite. Any changes made could adversely affect this process, and will be billed accordingly, as appropriate.
Warranties:
Warranties on workmanship, equipment, and controls will commence at the substantial completion of building commissioning and individual system acceptance OR per individual manufacturer's standard warranties; not at substantial completion of the entire overall project (the date of which is driven by the finish work of others, not JWD or its subcontractors). Seller is not responsible for preventative maintenance if equipment is received and intended installation dates are subsequently delayed due to no fault of Seller.
Change order requests shall be in writing from the Buyer. Charges associated with change orders will need to be approved by the Buyer and will be charged to the Buyer.
Duct Sealing & Testing All interior and exterior duct to be sealed per SMACNA Seal Class specified. Duct leakage testing per SMACNA HVAC Air Duct Leakage Test Manual only.
Pipe Pressure Testing Any systems that cannot be easily segmented in large portions (ie: condensate drain, steam humidification, etc.) will be “in service” tested, not a separate pressure test.
Hot Taps, Line-Stopping, and Line Freezing
These complex services come with inherent risk and are performed as an alternative to shutting down/draining systems, for the benefit of Buyer. Due to these inherent risks, Seller does not guarantee successful completion of these procedures. Seller does not guarantee that coupon will be
retained. Seller bears no responsibility for any damages to the system, loss of services, or resultant repairs due to failure of any services. Pricing is based upon typical pipe grade/wall thickness & flow rate velocities. Extra costs related to extraordinary circumstances not defined in the detailed scope of work provided by Seller shall be at Buyer's expense (including, but not limited to, additional cutter sharpening, additional sealing elements, etc
Cancellation of Orders:
Cancellation of orders by Buyer may be subject to a cancellation charge by the Seller or Manufacturer. This will be determined on a case-by-case basis. Any request to cancel a complete or partial order shall be submitted in writing by the Buyer.

CW,
Just a follow up to our conversation, we can come down to $74,700. Running the numbers on the slide gate, while it seems like we are adding only a few inches, we are adding 4.4 sqft per gate (36x36 is 9sqft, 42x46 is 13.4sqft).

WGZ0076200_ WEBSTER WRRF PROJECT, NY INSULATED CHAIN GUARD ASSEMBLY WITH HEATER Summary of Proposed Design:
Brentwood's recommendation for a heated guard solution is to provide new chain guards with foam board insulation added to the interior surfaces, which then reduces the needed sizes of the heaters inside the guards.
The new proposed guard designs incorporate foam board insulation with an insulated bottom/base, with a drive opening cutout, and encompasses the limit switch to reduce airflow into the guard. It is understood from the customer's previous feedback that energy efficiency is important at this plant. The geometry of the guard has been optimized to suit the smallest wattage XP heater feasible (300 W), based on standard theoretical calculations to maintain an internal temperature above freezing at a considered low temperature of -14 degrees F (as Brentwood's research indicated to be a worst case for this site/location).
Below are some images present the design of the new proposed chain guards with heaters.

Selection of Temperature Code
Refer to the atmospheric condition table (Table 2, page 6) at the beginning of this catalog for detailed selection data for the temperature code.
To minimize cost and physical size of the heater, select the heater with the highest temperature code that suits the environment. In Table 8 and Table 9, page 14 a check mark () under the temperature code indicates that the surface temperature of the heater will not exceed the coded value listed in the atmospheric conditions table (Table 2, page 6) at the beginning of this catalog.

Construction & Installation
The Norseman™ XB explosion-proof convection heaters utilize Thermon Heating Systems’ unique copper free aluminum extruded convector and patented x-Max® terminal housing. Large convector surface area and high mass fins ensure safe and efficient low temperature heat transfer to the environment. Convectors are black anodized to resist oxidation and maximize heat transfer.
The x-Max® housing can be equipped with multiple tapped conduit entries throughout its length to facilitate installation. A track and trolley system and threaded covers at each end allow easy access to internal components.
All units, except the single heat sink units, have a built-in terminal block for simplified electrical connection.
The Norseman™ XB units are intended for wall or floor mounting with the heater positioned vertically as shown. Dual purpose brackets for floor or wall mounting and wire guards are supplied as standard.
Special Wattage & Lengths
Table 10, page 14 lists the maximum design wattages for the four standard heat sink lengths and configurations.
If standard units listed in Table 8 and Table 9, page 14 do not suit your application, a special unit based on Table 10, page 14 can be supplied (check factory).
