AREA VARIANCE STATEMENT OF DIFFICULTY
An area variance shall be granted only if the applicant can establish EACH of the fotlowing, in accordance with Section 350-102 of the Zoning Ordinance:
. Essential Character. Indicate how the variance will impact the essential character of the neighborhood. No undesirable change in the essential character of the neighborhood will occur and no detriment will be created to nearby properties if the area variance is granted because:
The building is set well back from the eastern property line 49'-2" and the southern property line is 80'-0", so it will not crowd neighboring properties and be masked by large pines on Bay Rd, nor will it appear out of scale from the street. The materials (corrugated metal roof and vinyl siding to match existing house) are consistent with common residential pole barn additions in the area, The structure will not alter the residential appearance or essential character of Countryside Lane.
. Alternates Considered: Indicate the benefit sought by the granting of the variance and why the benefit cannot be achieved by some other feasible method other than an area variance. Identify the alternatives to the variance that have been pursued, and why they are not feasible (include evidence where necessary to support your conclusion):
Alternate locations within the allowable property boundaries would be out of character and negatively
impact the neighbors visually. The suggested placement puts the addition out of site of the neighbors and will blend in with the rest of the property.
. Significance. Indicate why the requested variance is not a substantia! or contextually significant deviation from the current code/regulations (is the difference between what the code requires and what you’re requesting significant):
The zoning code setback is 60 feet from Bay Rd as the property is a comer lot | am reducing that by no more than 10'10" to 49'2" given my lot size of .84 of an acer and the significant distance from Bay Rd it is not a substantial deviation form the code
. Physical and environmental conditions. Describe any potential impacts on factors such as drainage, traffic, dust, noise, odor, public services (e.g., compliance with the Town Code requirements to be varied would result in structures over an easement, removal of mature trees) provide mitigation efforts if any are to be utilized:
There will be no potential impact of any of the above.
. Not self-created. The alleged difficulty was not self-created because (consideration shall be relevant to the decision of the Board of Appeals but shall not necessarily preclude the granting of the area variance):
The difficulty is not something we created. We just need a regular garage/pole barn for storage on a residential lot, next to the existing garage where it makes the most sense. The size and setbacks in the zoning rules don’t leave enough room for a building that actually works for that purpose. We didn't do anything to put the property out of compliance — we're only asking for enough relief to put up a practical accessory building in a legical spot.

ABSTRACT OF TITLE No. 82744, LIBER 194 OF MAPS, PAGE 6&2, LIBER 8870 OF DEEDS, PAGE 153. TAX ACCOUNT No. 063.140-—02-030.

The Town of Webster Zoning Board of Appeals 1002 Ridge Road
Webster, NY 14580
Letter of Intent for Area Variance — 539 Countryside Lane (Parcel 1D: 063.14-2-30) Dear Chairman and Members of the Zoning Board,
Please accept this Letter of Intent and the accompanying application for an area variance regarding the property located at 539 Countryside Lane, Webster, NY 14580.
| am requesting an area variance from the Town Code to construct 2 30' x 48' addition to the existing primary residence/garage structure on my property. Local code requires a minimum setback of 60 feet from the east property line along Bay Road. Because the proposed addition will sit 49-2" from the east property line, | am respectfully requesting a side/rear setback variance of 10 feet, 10 inches.
Project Description & Specifications
The proposed building will be a 30’ x 48' post-frame pole barn physically connected to the existing garage and aligned flush with its front facade. The structure features 16' walls, a metal roof matching the existing roof, and vinyl siding selected to match the existing house. For access, it will feature one 10' x 10' overhead door on the front and one &’ x 8’ overhead door on the west side. The building will be anchored on secure concrete footings with a finished concrete floor, utilizing a clear-span design with no interior posts. The addition will contain no living space and is intended for non-habitable residential and accessory storage, including personal vehicles and maintenance equipment.
Justification & Minimization of Environmental/Visual Impact
This specific location groups the pole barn with the existing garage to preserve practical access and prevent structural sprawl. Moving the structure further back to meet the 60-foot setback is impractical, as it would directly conflict with the physical placement of the existing garage and disrupt established driveway access.
Furthermore, this configuration intentionally keeps the barn out of the main backyard, minimizing any visual impact on neighboring properties. The building will sit approximately 80' from the south property line, which features an existing 5-foot earthen berm topped with mature pine trees for exceptional, natural privacy.
Feasibility Alternatives & Relief Requested
A smaller building would not provide the storage volume necessary for my residential equipment. Relocating the building elsewhere on the lot is functionally impractical, and expanding the existing garage is not a structurally viable alternative. | am therefore requesting the minimum relief necessary to place this accessory structure in the only sensible, logical location on the property.
lam requesting the minimum relief necessary to place this accessory structure in the only sensible, logical location on the property. Thank you for your time, consideration, and review of this application.
Sincerely,
Dominic C. Zicari 539 Countryside Lane Webster, NY 14580
