The meeting was open to the floor for public comment and the following Webster residents
appeared before the Town Board.
Mark Stoch, a Webster resident, addressed the Board regarding civic leadership and public
service. He emphasized that the most important responsibility of local government is
maintaining public trust, noting that trust is earned when officials act in the best interest of all
residents rather than promoting individual causes or personal beliefs. He referenced the recent
Pride flag discussion as an example of how quickly public trust can be challenged when actions
appear to favor one group.
Mr. Stoch encouraged the Board to focus on fairness, professionalism, shared principles, and
respect for all residents. He stated that disagreement is natural in a free society, but local
government should prioritize what unites the community. He concluded by expressing hope that
every resident, regardless of background or beliefs, can trust their government to act impartially
and thanked the Board for their service.
Charles Stewart, a non-Webster resident, addressed the Town Board to report what he
described as the discovery of alleged Bigfoot remains in the Adirondack Park, stating he had
photographic and footprint evidence and that several Indigenous Nations had acknowledged the
specimen. He claimed the creature appeared to have died due to violence from another similar
creature.
Mr. Stewart expressed safety concerns about recent reported sightings near Chimney Bluffs and
Route 104, noting that some residents had described seeing a large bipedal figure in the area. He
requested that the Town consider posting warning signage, sharing information on its website,
and using him as a resource for further investigation.

Kevin Lockhart, a Webster resident, addressed the Board to discuss the permitting history of the
Webster Solar Garden proposed for the Xerox property at 750 Phillips Road. He explained that
the controversy surrounding the project stems from a gap in the Town’s Zoning Code regarding
how large-scale solar developments are approved in industrial districts. Mr. Lockhart outlined
the timeline of approvals involving the Planning Board, Town Board, and Zoning Board of
Appeals, noting that the ZBA ultimately upheld the Town’s interpretation that the project
required an Industrial Use permit rather than a Special Use Permit because it is located in an
Industrial District.
Mr. Lockhart stated that although the project’s approvals were upheld, the situation highlighted
an ambiguity in Chapter 155 of the Town code, which specifies approval pathways for large
scale solar in Residential and Commercial Districts but not Industrial Districts. He urged the
Town Board to amend the code to clearly define the required permits, approval processes, and
hearing requirements for industrial solar projects. He emphasized that clarifying the Zoning Law
would help developers, avoid future disputes, and reduce the risk of costly litigation.
Fr. Michael Nicosia, a Webster resident, addressed the Board regarding the recent removal of
the Pride flag. He acknowledged concerns that the flag’s placement may have been
inappropriate and recognized that the decision to remove it was made with the intention of being
fair and equitable to all residents.
He stated, however, that the removal has been perceived by members of the LGBTQ+
Community as a signal that they do not fully belong in Webster. He emphasized the importance
of optics in public decisions and expressed concern that the action may unintentionally push
marginalized communities further to the edges of civic life. He thanked the Board for its time.
The following comments came from emails or online form submitted by the individuals:
Pam Mancine-Verna, Webster resident: Thank you for the pride, professionalism and
dedication that you bring to your job, every day. Your efforts are recognized and appreciated!
Keep up the good work and know that many of us are counting on you to continue to represent
the residents of Webster.

17. WHEREAS, a petition, pursuant to General Municipal Law Article 17, was presented to the Town

in the Town of Webster to the Village of Webster, said territory being described in said petition

In advance of the following Resolution, the Board held a discussion regarding sewer service for
the proposed Xerox annexation. Board members noted that the sewer arrangement is not yet
finalized and will depend on the parcel’s future development. The Town and Village intend to
formally document their shared understanding regarding future sewer service as coordination
continues.
The Board additionally clarified for the record that annexation into the Village does not remove
the parcel from the Town or eliminate it from the Town’s tax base. Following annexation, the
property would remain within the Town while also becoming part of the Village.
Resolution No. 285: MOTION by Supervisor Scialdone, seconded by Councilman Cahill, to
approve a petition to annex a portion of land on the Xerox campus from the Town of Webster to
the Village of Webster pursuant to Municipal Law Article
17. WHEREAS, a petition, pursuant to General Municipal Law Article 17, was presented to the
Town Board of the Town of Webster, New York on May 7, 2026, for the annexation of certain

territory in the Town of Webster to the Village of Webster, said territory being described in said
petition which is annexed hereto as Schedule A (“Annexation Parcel”) as Tax ID#065.03-1-41,
which parcel is bounded on the east by Phillips Road, on the north by Chiyoda Drive and the
west by Panama Drive; and
WHEREAS, a joint hearing of the Town Board of the Town of Webster and the Village of
Webster was duly noticed and published in accordance with Article 17 of the New York State
General Municipal Law; and
WHEREAS, said joint hearing of the Town Board of the Town of Webster and the Village of
Webster was duly held on said petition for annexation, according to the law in such cases made
and provided, at the Village Board Meeting Room, 29 South Avenue, Webster, N.Y. on
June 2, 2026 at 7:00 p.m. at which time all parties interested in the matter were heard and all
objections presented; and
WHEREAS, the annexation of land by a municipality is an 'action' as defined in the State
Environmental Quality Review Act (Article 8 of the Environmental Conservation Law) and the
regulations of the Department of Environmental Conservation at 6 NYCRR §617 et. seq.; and
WHEREAS, a short form environmental assessment form was submitted with the petition and
the Board of Trustees, conducted an uncoordinated review of this proposed action; and
WHEREAS, the Town Board of the Town of Webster does wish to move forward with the
proposed Annexation of the proposed Annexed Territory and to proceed with the fulfillment of
its respective obligations under the State Environmental Quality Review Act; and
WHEREAS, the Town Board of the Town of Webster has duly considered said petition and the
evidence presented at said public hearing:
NOW, THEREFORE, IT IS FOUND, RESOLVED, AND ORDERED AS FOLLOWS:
1. The above “WHEREAS” clauses are incorporated herein as if set forth in full.
2. The Town Board has reviewed the short Environmental Assessment Form (EAF), has taken a
hard look at the potential environmental impacts, and has adopted a negative declaration, a
copy of which is annexed hereto; and
3. The aforesaid petition for annexation substantially complies in form and content with
General Municipal Law Article 17.
4. The proposed annexation of the annexation parcel in the Town to the Village as described in
the aforesaid petition is in the overall public interest for the following reasons:
a. The parcel is located within the Reimagine Webster Brownfield Opportunity Area which
was certified by New York State as a designated Brownfield Opportunity Area;
b. The subject annexation is a key step to implementing the vision established in the
Reimagine Webster Brownfield Opportunity Area Plan;
c. Combining the annexation parcel with the adjoining parcel to the south, which is located

for the future redevelopment of the combined parcels;
d. Redevelopment of the combined parcels is mutually beneficial to the Village and the
Town;
e. Xerox Corporation, the owner of the annexation parcel, is supportive of the Reimagine
Webster Brownfield Opportunity Area Plan and its objectives and wishes to assist the
Village and Town in reaching such objectives.
5. There exists both in the vicinity of and within the annexation parcel sanitary sewer mains
owned by both the Town and the Village. It is the intention of the Village of Webster that
any future redevelopment of the annexation parcel be connected to the Village sanitary sewer
collection system unless it is agreed by the Town and the Village that connection to the
Village system is not feasible or cost prohibitive. In which case, the Village and the Town
would negotiate an appropriate intermunicipal agreement to address the potential Town out
of district sewer user.
6. That all unpaid or delinquent taxes levied or charges made against the Annexation Parcel
shall be due and payable and collected in all respects the same as if such territory had not
been annexed.
7. That any other taxes levied or other charges made against or on account of the annexation for
the fiscal year in which the annexation shall take effect shall be paid to the Town of Webster.
8. That any taxes levied or other charges made against or on account of the annexation for a
fiscal year commencing after the date such annexation takes effect shall be due and payable
to and collected by the Village of Webster.
9. That the Annexation Parcel, after annexation, shall remain in the same special district with
respect to the North East Joint Fire District, but not any drainage district, and accordingly
shall continue to pay for such services on the same terms as prior to the annexation.
10. That there is no other indebtedness, liabilities or interest in connection with the Annexation
Parcel and accordingly, no amount is otherwise due to the Town or Village in connection
with the annexation.
11. The consent and approval of the Town Board is hereby given to the annexation of the
territory now situated in the Town and described in the aforesaid petition (Schedule A) to the
Village.
12. That the Town Clerk shall file this Order, together with copies of the Annexation petition, the
notice, the written objections, if any, and testimony and minutes of proceedings taken and
kept on the public hearing.
13. That no election shall be required with respect to the instant annexation as there are no
residents residing in the annexation parcel and based upon existing case law, an election is
not required under such circumstances.
14. That the Supervisor is hereby authorized and directed to execute this Finding, Resolution and

15. The Town shall cooperate with the Village of Webster in its preparation of a partial map to

show the exclusion of the Annexed territory from the Town of Webster and to file copies of
such map in the office of the Village Clerk, the Town Clerk, the Office of the Monroe
County Clerk and in the Office of the New York Secretary of State. The Supervisor, in
cooperation with the Mayor, is authorized to arrange for the preparation of such maps
through Monroe County offices, including the Geographic Information Systems office and/or
Real Property Tax Office.
16. With respect to any issues that arise with finalizing the annexation of the Annexation Parcel,
the Town shall work cooperatively with the Village of Webster.
17. The Supervisor, and any officer, employee or consultant, as directed by the Supervisor is
hereby authorized to take any and all actions necessary to carry out the provisions of this
Finding, Resolution and Order.
