For many projects involving work in and around streams, lakes, and wetlands the US Army Corps of Engineers (USACE) may have regulatory authority in addition to this Department. If you have not already done so, you should contact their Buffalo District Regulatory Branch office at 716- 879-4330 to obtain any required federal authorizations prior to commencing work. Also, as a reminder, be sure to verify whether any local approvals are required for the project. If you have any questions on the extent of the work authorized or your obligations under the permit, please feel free to contact me at 585-226-5466.

Julian Dock Project

To Whom It May Concern,

in support of the enclosed Federal Consistency Assessment Form, review of the policies referenced in the form (in order) are as follows:

Policy 44 - The planned dock system construction will not adversely affect the freshwater wetland as the open piles will not impede water flow along the shoreline or damage submerged aquatic vegetation in any way.

Policy 7 ~ the planned dock system construction will not adversely affect the fish and wildlife habitat as the only disturbance below the OHW will be 8” steel pilings with no concrete fill. The pilings will enhance structure that fish and wildlife can utilize.

Policy 2 encourages siting of water-dependent uses near the water — the new docks in this project will be water-dependent uses of boating, swimming and fishing.

Policy 20 deals with public access — the land directly upland and adjacent to this project is privately owned. The proposed dock construction will not change the public’s access to the water column or the navigation areas in any way.

Policy 21 encourages water-dependent uses of boating, swimming and fishing which will be enhanced by this project.

This project also complies with the policies of the 1998 Town of Webster LWRP.

Thank you for your consideration of these justifications.
