Lots 1-4 of the Bay-Ridge Corner Reallotment Subdivision (Southeast corner of Bay Rd & Ridge Rd) Owner: FG Martin LLC (James Guck) Addresses: 423, 425 & 429 Ridge Road 1036 & 1036A Bay Road

To whom it may concern,

I have been hired on behalf of FG Martin LLC to perform a resubdivision for the purpose of redesigning conflicting lot lines of 5 existing lots into 4 lots. Currently, due to the age of the structures, many are located over their respective boundary lines. We would like to perform a lot line adjustment moving these lines to make extremely non-conforming lots a little less non-conforming by placing structures solely on the lots they were intended to be on. The goal is to best average lines between structures and meet setback requirements the best we can, though not all lots even have enough space between structures. Currently, the 4 proposed lots do have existing public access to the nearest right-of-way. The purpose of combining 1036 & 1036A is because originally 1036A was built as a guest house and therefore has some shared and some independently metered utilities running through 1036. At some point a lot division line was created separating these addresses but we would like to return them to one lot and apply for a zoning variance to allow for the guest house. My contact email is Scott@MeasdayLSM.com and my phone number is 585.505.4548, Email is the best communication.

AREA VARIANCE STATEMENT OF DIFFICULTY

An area variance shall be granted only if the applicant can establish EACH of the following, in accordance with Section 350-102 of the Zoning Ordinance:

. Essential Character. Indicate how the variance will impact the essential character of the

neighborhood. No undesirable change in the essential character of the neighborhood will occur and no detriment will be created to nearby properties if the area variance is granted because:

We are moving lot lines to be of similar shape and size of the existing simply to not have any more building encroachments

Alternates Considered

Indicate the benefit sought by the granting of the variance and why the benefit cannot be achieved by some other feasible method other than an area variance. Identify the alternatives to the variance that have been pursued, and why they are not feasible (include evidence where necessary to support your conclusion):

Benefit is so that clear title will be valid in case any lot is sold. Less liability if buildings lie on their own lots. There are no other alternatives that could be considered unless we use different lot line configurations. We kept the lines as close as possible for similarity purposes.

Significance. Indicate why the requested variance is not a substantial or contextually significant deviation from the current code/regulations (is the difference between what the code requires and what you're requesting significant):

Some setbacks and areas seem to be significant but it's because the structures are so old and current code was created after their existence. Most of the requests are existing or get better with the newly designed lines. Along with setbacks and areas, a couple lots need a road

frontage variance, along with Lot 4 needing a guest house, accessory building variance as there is a house, 2 garages/pole barns, and a shed.

Physical and environmental conditions. Describe any potential impacts on factors such as drainage,

traffic, dust, noise, odor, public services (e.g., compliance with the Town Code requirements to be varied would result in structures over an easement, removal of mature trees) provide mitigation efforts if any are to be utilized:

No disturbances will occur. In fact, the current owner removed some dilapidated accessories (decks) so that less variances would be needed.

Not self-created. The alleged difficulty was not self-created because (consideration shall be relevant to

the decision of the Board of Appeals but shall not necessarily preclude the granting of the area variance):

Due to the design of some lines, we are creating some of the variances we seek. However, these requests are lessening the severity of

what existed prior to the redesign. We are making severely non-conforming lots a lithe LESS non-conforming.
