1/5/2023 To: Brian Neenan, Superintendent From: Brian Freeman, Assistant Superintendent for Business Re: Thomas Faculty Bathroom Renovation -2018 Capital Project Bid Acceptance Cc: Board of Education Attached you will find the results of the third phase of the capital project work at Thomas High School that was approved in December of 2018 by the Webster CSD voters. The bids were opened on Thursday, December 8, 2022, at 10:00 am at the B&G Warehouse. Bids were accepted for General Contractor, HVAC, Plumbing, and Electrical contractors for faculty bathroom renovations. After opening the bids the project team had concerns with pricing that was above budget and the number of participants (companies) participating in the bid process. In addition, the low bidder for the Plumbing contract withdrew their bid later that day and one bid that was sent in was left blank on the Electric contract. Based on the recommendation of the project team, the best path forward would be to reject all bids. We are working on incorporating this work into a larger scope of work to be done at additional buildings to increase bid participation in the near future. Below you will find a resolution to reject all bids for the General Construction, Mechanical (HVAC), Plumbing, and Electrical contracts.

WHEREAS, the Board of Education of the Webster Central School District (the “Board of Education”) solicited bids from prime contractors for construction services in conjunction with its 2018 Capital Improvement Project (the “Project”); and WHEREAS, bids were received and opened on Thursday, December 8th, 2022 at 10:00 am ; and WHEREAS, the bid solicitation documents for the Project authorize the Board of Education to reject any and all bids; and WHEREAS, the District’s architect and construction manager recommend rejecting all bids and rebidding after clarification of the scope of the work and such other adjustments to the bid solicitation documents as are deemed necessary or convenient; and WHEREAS, based on the recommendation of the architect and the construction manager, the Board has determined that it is in the best interest of the School District to reject all bids submitted in connection with the bid solicitation for the Project; NOW THEREFORE, the Board of Education, under their reserved power in the bid solicitation documents to reject any and all bids, hereby resolves to reject all bids submitted in connection with the Project and: 1. Authorizes its President, the Superintendent of Schools, or their designee to notify each bidder of the rejection of its bid in compliance with this Resolution and the bid solicitation documents and take all actions necessary or convenient on behalf of the Board of Education to reject the said bids. 2. Authorizes the architect and construction manager to clarify the contract documents, include proposed alternates, and rebid the work for the Project either on its own or as part of a larger capital project. 3. Upon Board of Education approval, this Resolution shall take effect immediately.
