June 2, 2023 To: Brian Neenan, Superintendent From: Brian Freeman, Assistant Superintendent for Business Re: Bus Patrol Resolution Cc: Board of Education Attached is an agreement to participate In The Monroe County/BusPatrol School Bus Stop Arm Enforcement Program proposed by Monroe County. The Agreement relates to Vehicle and Traffic Law §1174-a, commonly referred to as the "stop-arm law." The Agreement provides for the installation of stop-arm monitoring devices on School District buses. Under the terms of the Agreement, a third-party (BusPatrol America LLC) would be responsible for procuring, installing, and maintaining the stop-arm monitoring systems, and any payments owed to BusPatrol America LLC would be paid by the County. The Agreement commences on the date the cameras are installed, and terminates on December 1, 2024 with an option for renewal. Authority for the Agreement is set forth in the Bus Camera Safety Act (Chapter 145 of the Laws of 2019) and Section 1174-a of the Vehicle and Traffic Law, which authorizes the County to install and operate school bus photo violation monitoring systems on school buses owned and operated pursuant to an agreement with the School District, and to establish a demonstration program imposing monetary liability on the owner of a vehicle if the operator of the vehicle is captured on the monitoring system illegally passing a stopped school bus. The School District is authorized by the School Bus Camera Safety Act (Chapter 145 of the Laws of 2019) and Section 1709(43) of the New York State Education Law to enter into such an agreement with the County for the installation and use of school bus photo violation monitoring systems. As to penalties received from violations, V&T Law § 1803 requires a county which establishes a demonstration program to remit penalties to pay them monthly to the State Comptroller who will then return 90% to the county in which the violation arose and 10% to the appropriate city, town or village. Webster CSD receives no proceeds for the violation, only free install and maintenance of the camera system. Below is a resolution approving the agreement: ADMINISTRATIVE OFFICE: 119 South Avenue, Webster, New York 14580 Main Switchboard: (585) 265-3600 • Fax Machine: (585) 265-6561 • Web Site: www.websterschools.org
