Good evening and welcome to the Zoning Board Appeals meeting for February

11, 2025. Before we move forward, if there is going to be any public comment, we are going to

limit public comment to 5 minutes. We have | item on our agenda today and I do have proof of

publication here for that item.

MCALPIN INDUSTIRES

Located at 875 Publishers Parkway. Applicant Matt McAlpin is

requesting AREA VARIANCES to aliow the construction of a 300,000 SF multi-phase

building, with the first phase being 120,000 SF, where the maximum allowed is 45,000 SF on a

25.65 acre parcel having SBL# 079.06-1-32.123 located in an OP Office Park .District under

Section 350-21C(1) of the Code of the Town of Webster.

Josh Artuso

Just to add a little bit of context and get it on the record, as you all know, any

development within the OP District requires a referral from the Town Board. So, this project was

initially presented at a Town Board Workshop on December 5, 2024. The Town Board that

same night did approve the resolution to refer it to the Planning Board for the purpose of site

plan review and the project and the applicants appeared before the Planning Board last month at

the January 7" meeting for Sketch Plan Review which brings it to tonight's application before

this board.

Erika Corsi

Reviewing PowerPoint regarding ORDINANCE (SEE ATTACHED)

Appearing before the board was Matt McAlpin. Good evening and thanks for having us. So, I

just want to do a quick introduction of our team and who we are before we get started. I promise

to keep that under 2 minutes. My name is Matt McAl]pin, and I am the President and CEQ,

owner of McAlpin Industries and with me tonight we have our CEO, Darla Lacey and our

recently retired CFO, Mark Lockerby and now Consultant and our partners at Costich

Engineering, Mike Ritchie.

So, McAlpin Industries, we are a contract precision sheet metal fabrication house so when you

think of sheet metal components, we get it in, we cut it; form it; we insert hardware; we manually

weld it; we paint it and we assembly it. Our parts go into a lot of different assemblies that you

may have exposure to in your day to day lives but we don’t have any product that we can

necessarily point to, so we are business to business. So, whether you have ridden in a high bred

bus; high speed train; use a self-kiosk at the store or ordered something on line the way that that

product gets to a warehouse to your front door, we have a lot of automation components in that.

We do some medical parts; parts that go to data centers; HVAC systems, that sort of thing.

The company was started in 1964 by my grandfather. He was on the family dairy farm here in

Webster and long story short, he decided to open up his own tool and dye shop in

64. So, we

have come a long ways and in fact, this Friday will be celebrating our 61°. Our company has a

strong culture. We are very proud of that, and we work very hard at that every day. We are also

a Veteran owned company, and we are very excited to partner up on this project in Webster. It

has been a long time coming. We have been looking for a good place to expand our business for

going on 2 years now and we had a couple of things we were working on that didn’t work out but

this property and we are excited to be here.

So, it’s important for us to get this variance being over 40,000 square feet in an Office Park we

believe that this building, it really fits the area and there are a couple of buildings right next door

adjacent to the property that are larger than 40,000 square feet and in fact, one is almost 400,000

I believe and another one that is 160,000 and again, we are really excited to be here and we take

a lot of pride in what we do and we like to say that we do things the right way and part of that is

being part of your community and we have already started to reach out to our neighbors and

talking to Mirror Show Management and we are going to go speak with them next week and we

even started talking to some of the neighbors to understand what their concerns are and

everything has been going well so far. A lot of strong support from the community and a lot of

support from the Town Boards so far and I really appreciate that. So again, just really exited to

be here and appreciate the support. So, with that I am going to turn it over to Mike who can

answer any questions on the variance that we are seeking approval on.

Mike Ritchie

Thank you. I am Mike Ritchie with Costich Engineering and again, we did submit

application requesting an area variance for the approval of a 300,000 square foot manufacturing

warehouse and code permits 45,000 square feet. I would be happy to go through the standard

criteria if you wish but that was submitted as part of the application.

Erika Corsi showing Project Location and others on screen. (SEE ATTACHED)

Michael Short

I am good, but I would like to ask the board.

Mike Ritchie

So, another item, we have submitted to the Planning Board for Special Use and

Site Plan Review, and we are anticipating going to the March meeting. So, we would be happy to

answer any other questions the board may have and thank you for your time.

Michael Short

So, questions from the board. So, Phase | is a 120,000 square feet and it’s

primarily to the south of the property. Phase 2 & 3 and those will end up expanding north. I

didn’t see....how much of a buffer between Publishers Parkway and the northern most...tree

buffer are you proposing.

Matt McAlIpin

I don’t know the exact distance but that northern if you will, I think it's 4%to5

acres.

Mike Ritchie

NOT CLOSE ENOUGH TO THE MIC, KIND OF HARD TO HEAR. It’s

roughly 300 feet to the north. I don’t have the exact dimension from the edge of disturbance for

the final build out to the top but that northern portion is 743 feet, so we are half way into it so its

approximately 300-350 feet to with no disturbance at all. Existing.

Chris Centola

Are those going to be listed to remain on your plans.

Mike Ritchie

Yes, the are listed on the grading plans, like the proposed clearing limit. That is all

shown on the plans.

Michael Short

Access is only going to be through Hard, correct right, nothing onto Publishers.

Mike Ritchie

Right. (NOT CLOSE ENOUGH TO THE MIC, KIND OF HARD TO HEAR)

Initially we had discussed potentially having a second access off of Publishers, but I think it’s

not really warranted, especially it being a shift to tight operation. Most of the first shift

is there before anyone uses the road so that access off of Hard Road will primarily be unused

because most of the time the employees are showing up to work and quite honestly, J think you

had mentioned, 3 in the first phase and 3 to 6 truck trips per day so really there is not a lot of

truck traffic proposed. We are proposing a minor radius increase on the existing driveway on

Hard Road just to make sure that any trucks coming in will have no problem entering but with

that, there really didn’t seem to be much of a need to put in a 1,000 foot of extra road. I think the

big part to is the traffic pattern for people coming in and leaving, most everyone is getting off on

104 and turning right into the site and not many people would be coming from maybe from Five

Mile Line and over, so it seems a little bit redundant.

Matt McAlpin

The original plan had two access points but the more we looked at it and

knowing the traffic on Publishers and there is no sense on having additional traffic cut through

there especially when schoo! gets out, so we decided a couple of months ago, actually a month

ago to get rid of that access point.

Mike Ritchie

NOT CLOSE ENOUGH TO THE MIC, HARD TO HEAR. They did have a

traffic study completed for this just to ensure that there wouldn’t be any conflicts with that

driveway at Hard Road and the conclusion of the report stated no changes to that driveway or to

that road would be needed. Even at full build out.

Michael Short

So that report went all the way out to full build out then.

Mike Ritchie

Yes.

Michael Short

You indicated, correct me, I think you said 3-4 trucks a day.

Matt McAlpin

Yes, about 3 trucks a day.

Michael Short

At full build out?

Matt McAlpin

At full build out, it’s hard to say but 6 to 7 on an average.

Michael Short

And when we say trucks are we talking 18 wheelers or are we talking...

Matt McAlpin

Yes.

Michael Short

Ok. Phase 2 is the headquarters, how many employees and I guess not factory

workers, just how many employees.

Matt McAlpin

In Phase 2 and 3 are hypo thetical at this point. The need right now to grow the

business is we need to put up a 120,000 square foot and that is going to be all operations. We

wanted to make sure that if we were going to move into this space is that we have the

opportunity to expand, if and when we need to and have that flexibility in the future and one of

the thoughts was, do we headquarters there, do we have office staff there and if that is the case

that is a total of 115 employees that would be in phase 2 additional and out of those 115 I would

say about 60 are office staff.

James Spampinato

They stagger shifts of operation.

Matt McAlpin

Yes, we run 2 shifts right now and 1* shift and little bit heavier than 2™ shift.

Pg. 31 February 11, 2025 Zoning Meeting

Michael Short

What are those hours.

Matt McAlpin

First shift starts at 6 AM but some of them start a little bit before that.

Michael Short

Second shift ending.

Matt McAlpin

Second shift is | AM.

Michael Short

Ok. So, there will be traffic leaving second shift...early morning AM or however

you want to say it.

Matt McAlpin

There would be about 20 of our associates working on second shift.

Corrine Volo

And you are consolidating both Hollenbeck Street and Macedon facility and this.

Matt McAlpin

No, no, no.

Corrine Volo

So, this is an addition to.

Matt McAlpin

The first phase is all growth.

Corrine Volo

Do you plan on bringing those in eventually or..........

Matt McAlpin

One thing in our business is that we are always changing and in fact we just

changed things last month. I am certainly open to what the future may hold but as of right now

we need the 120 for growth and expansion. As things evolve in the next 2,5,10 years there is a

possibility of a consolidation but at this point, our primary focus is expanding the company and

getting that space to do that.

Chris Centola

Further down the line for signage (this is for PLANNING BOARD) obvious U of

R sign is already there are planning on being adjacent to it.

Matt McAlpin

We started, and we have not been able to get in touch with that facility yet but

one thing we do want to discuss with them is something better with the sign because there are

some residents in that area that people pull into their driveways, and they are thinking that the are

going into the U of R building and obviously that is bothersome to the residents. So, we would

like to work with them and get a new sign up that would be a little bit easier to identify where to

go and one thing that we have talked about, and we haven’t brought it to the town yet, but maybe

that road needs to be called something else and give it a different address because if you plug in

the U of R’s address on Hard Road and now you are pulling into a residents driveway. So, if it is

a different street name and their address is on that road, our address is on that road, it would be a

lot easier if people plug it into their GPS and they will be able to find our location a little bit

easier.

Pg. 32 February 11, 2025 Zoning Meeting

Michae! Short: Because right now, if they plug in your address, it will be Publishers Parkway,

and they will drive up and it will be a bunch of woods. Question about during construction, as

you mentioned one of the neighbors concerns pulling into their residence to go to the U of R.

There has also been concerns during construction of that facility of dust and constant

construction. Is there any mitigation means that you would be proposing during construction to

minimize the dust and dirt on the roads etc.

Matt McAlpin

Yes, we have heard some concerns in fact, we started talking to some of the

residents and Mark Lockerby, if you want to come up, he has had most of the conversations, but

I think the advantage or the benefit of this location compared to the U of R building is we are not

adjacent to the residents property so any dust that is in the air, we are over 800 feet away from

early stages of construction. It turns out the biggest concern we have heard from residents is not

necessarily the dust, it’s the geese and I joke about it, but Mark has already become an expert on

how to keep geese out of your retention pond, but you have had conversations with some of our

upcoming neighbors, do you want to explain.

Mark Lockerby

Three of the residents that back up to U of R parking lot and I also spoke with

MSM, Vice President of Operations there and we also spoke to a resident that attended one of the

prior meetings, so we have a good understanding of concerns. There questions were related to

things of what we could improve on from what you have experienced maybe before. One was

geese and we have a number of scenarios and MSM has utilized this scenario, try and work to

improve things and they have some scenarios that have worked for them and there is also some

guaranteed solution, one being solar where you have lighting set up that deters geese from the

area and there is a couple more that we are exploring, and we will be working on those. That

was number one.

What you mentioned about the dust we have a lot of things....so, there is two things associated

with one was sometimes a backup of the trucks going into the site. We think we can elevate that

multiple different ways again exploring a lot of different ways but traffic coming from the north

instead of all coming from the south it would be another means that we are exploring plus I have

other ideas I want to develop a little further. The dust part of it............

Matt McAlpin

We have worked with our builder to help us understand some of the things that

they would do to mitigate some of the concerns. (HANDED BOARD SOME PICTURES TO

VIEW-it was Letchworth Park-SEE ATTACHED) we have adopted that philosophy.

Mark Lockerby

So, first and foremost, ] think the construction entrance and stagging area and

getting all that set up in advance and then they start the clearing of the site the trees and such and

the cuts and fills as needed to start....they would do the retention ponds and put those in place

and again, that helps a lot and the run off that has been experiences by some of the neighbors.

That will elevate that and prohibit that. Also, putting stone for the parking and the building

having that all done inadvance We will also elevate some of the dust and also putting the

green areas; putting the dirt and the seeding, those would also elevate the dust and also the run

Pg. 33 February 11, 2025 Zoning Meeting

off and elevate the run off and rough grading on the detention ponds, again for the run off and

also for, as you are doing the building site if there is any water that needs to be extracted can be

pushed towards those retention ponds.

Michael Short

You guys are looking at ways of mitigating that during construction and finding.

There is a plethora of means to use but you guys are exploring it to be able to mitigate those

concerns of the residents in the area.

Mark Lockerby

Yes

Mike Ritchie

(NOT CLOSE ENOUGH TO THE MIC, HARD TO HEAR) SWPPP inspections

will be weekly if not bi-weekly inspections and obviously if there are any site conditions that

need to be remedy whether dust or erosion or anything else it will be noted to the owner and the

contractor and the town.

Michael Short

And will hear about it and then you will hear about it.

Mike Richie

(NOT CLOSE ENOUGH TO THE MIC, HARD TO HEAR) I think if you notice

to, the dust is really like a June, July, August type of issue and you don’t see as much in the wet

weather and hopefully if the schedule works out, will have mass earthwork and mass grading be

done early Spring, early summer and stabilization and that is what really cuts down on the dust.

You can get those bare earth areas to get grass to grow and that goes away. You had mentioned

the stabilized construction entrance, and we have seen sites where we see a street sweeper...or

even hose down an extinct portion of the access road to make sure you are not tracking anything

out onto Hard Road. We see that regularly and understand that concern that people would not

want dust all over their car.

Mark Lockerby

I also left a card with all the neighbors and my cell phone number. There is

another site out in Walworth and that worked out extremely well. So hopefully I get the call

before anyone else does.

Chris Centola

If they do the job that you believe that they are going to do, you have more than

enough distance from the edge of the existing road to the actual construction site. Without

seeing the grading plan or the erosion control plan I am assuming your construction entrance is

right behind the existing one so if you need to, have a couple 10-20 extra feet of gravel and that

will diminish a lot of the stuff that you are bringing off site before you get to the road.

Michael Short

Is there anyone that would like to speak for or against this project . Just a

reminder, you have 5 minutes. Name and Address and then your concerns.

Dave Malecki and I live in West Webster off of Gravel Road. (SEE ATTACHED PAGE THAT

Michael Short

With that, T will return it to the board. We did received one comment on line.

John DeMarco

Read the comment out loud FROM DAVE NACCA WHO RESIDES ON

HARD ROAD (SEE ATTACHED PAGE OF COMPLETE EMAIL)

Mark Lockerby

The construction for ...we have a similar building that is 120,000 square foot

building that we built 9 years ago and from the initial shovel in the ground to complete with the

actual equipment moved in, it was seven months, and we were in at the end of

September...really October so it won’t be an extended duration like that. Same contractor, same

group.

Michael Short

Quick question, the follow up to that comment, three phases but as we discussed

here tonight , phase one is the immediate phase that is necessary. Phase 2 and 3 are not

necessarily planned but developed for future growth. In your best estimation, how long before

phase 2 and or phase 3 actually gets constructed knowing that the economy is different; now we

have new tariffs; and everything else going on so it’s really a shot in the dark , best estimation.

Mark McAlpin

Best estimation phase 2, 5 years and phase 3, maybe 10 years from now.

Michael Short

Ok, perfect.

John DeMarco

(NOT SITTING CLOSE ENOUGH TO MIC, HARD TO HEAR) you already

own the property or it’s contingent on these approvals.

Mark McAlpin

We do not own the property yet.

John DeMarco

There is a pending contract.

Mark McAlpin

Yes.

John DeMarco

Contingent on anything other than the approvals you are seeking.

Mark McAlpin

I don’t believe so.

John DeMarco

And all said and done, the phases that are in the application, it looks like about

30 % of the coverage of the property.

Mike Ritchie

The building yes, the building is about 30% the total lot coverage building and

pervious area is just under 50 % of the lot.

Michael Short

Based on your calculations, I believe it was 49%.

Mike Ritchie

Yes.

Please type your comments —_After thving through hell with the LeFrols construction of the

in the box below: URMC Building & Lot In my backyard not too long ago, |

implore several suggestions & requests for any construction

behind and continuing beyond the URMC driveway entrance &

bullding including this proposal.

1- Immediately upon ANY construction, the very first step

necessary Is another road access via separate area other than

the current URMC (875 Hard Road address) private road

entering! exiting only onto Hard Road. This entalis allowing the

construction vehictes more than one direction for what will be a

seemingly endless cycle of extreme dirt, noise and chaos

during construction via Hard Road only. This Is necessary not

just for the construction of the buildings end parking lots etc but

for the initial land prep start of the very beginning as well, such

a8 tree removal, soll rearranging additions removal etc.

2- The site sketch plans initially show a gigantic retention pond.

My experiance with the ratantion ponds for URMC are a

nightmare with absolutely zero control of the geese population

and therefore annoyance of honking and mainly geese poop

beyond what I can property convey In short ordar. 1 would

suggest off the top of my head al the very least come kind of

permanent 2-4" high fencing along the retention pond extreme

exterior to its south, east and north. Should McAipin Industies

ba fine with geese & their pocp all over thelr parking fot, | guess

i's not needed to the west of the retention ponds.

(Separately, retention ponds and gease populations badly need

to be addressed by the Town of Webster In some way & form,

anywhere there ere these ponds, because living In Webster

with the explosion of the geese poop makes for hell for enyone

Iving nearby and Not « pleasant Webster experience

whatsoever.

> The Road with no name that currently leads le URMC with

an address of 875 Hard Road is simply unacceptable. Dozens

Hf not hundreds cf cusiomers to URMC have pulled in my

driveways looking to drive thru my backyerd lawn trying to get

to thelr butiding and parking lot becaues thelr bulding Is Jit up

and thelr address is Hard Road rather than the road that Is off

Hard Road. If the town has to take ownership of that access

road and maintain tt, then maybe LeFrols Construction or

McAlpin Industries needs to pay Webster extra annuat

maintenance fees. The current placement of the burden on me

of fixing my lawn every time cars drive back across and around

my lawn irying to access URMC Is no longer acceptable or

reasonabte. It ls simpty not acceptable or reasonable ic allow

ANY expansion of ANY business or company or residents

bayond URMC to make matters Infinitely worse than already

dangerous and bad eltuation for my home.

4- Regerdiess of an immediate second entrance off Publisher's

Parkway for any construction beginning, the three homes In

front of 875 Hard Road (693 Hard Rd, 679-881 Hard Road and

693 Hard Road) and their residents including all tenants, |

‘would suggest the paid In full compensation amount of an

ennual membership for each vehicle or adult resident to (Go

Car Wash or Delta Sonic both In Webster) because the

alrbome dirt and dust during construction from the work and the

construction vehicles |s weil bayond reasonable. If its a 2 or 3

year, of 4 of even 5 year construction process, whatever It may

be, $0 it be enough for each year compensation pald to the

homeowner to also dispense to tenants if applicable.

We living through the construction of URMC and the unending

alrbome dirt on our lives and in the road was Insanely unjust.

And just out of curiosity, the front end off of Publishers is that going to kind of

have a wooded look with or are the loaded to the back end of the property.

Mike Ritchie

I think if you were to look from Publishers, you are not going to notice that it is

even there.

Michael Short

Alright, with that I will bring it back to the board. Any other questions.

Chris Centola

The only thing I had is the access off of Hard Road even though the lot is on

Publishers and has Publishers address are you going to change and make it easier for people to

find because as Mr. Short said, if your address is Publishers Parkway you are not going to have

any clue on how to get there.

Mike Ritchie

Agreed and we will work with the Town Clerk. The are usually deal with

addresses and whether it is possible to rename that private drive just to make it more specific or

not. I think if it would based on how I saw the tax parcels and the orderly development of

addresses, it would get a Hard Road address because it actually does have currently, it’s a flag

lot, the pole portion does touch Hard. So, I think if it were to be renamed on that private road, J

believe it would have a Hard Road address.

Chris Centola

Thank you.

Corrine Volo

Do you anticipate with the shift employee traffic and delivery and shipment of

goods, do you anticipate having a lot of customer visits as well or...

Matt McAlpin

Not in our industry. We do have customer visits and if I had to take a guess

maybe 10 a year. We don’t have any walk in traffic or anything.

Corrine Volo

But it would definitely be less customer traffic then Calvary, which is somewhat

larger in size and very similar operation but much more with working with the customer.

FINDINGS OF FACTS

CORRINE VOLO

1. This request is not out of character in the neighborhood: It will not change. There are

several other similar businesses or similar size complex in the area. We have Calvary

Pg. 36 February 11, 2025 Zoning Meeting

aa

7. Robotics, which does much of the same work and in a larger building. We have the Sports

Complex between Mirror Show Management and also manufacturing to some degree.

There will not be a detriment created to nearby properties:

The benefit is not achievable by any other method: The 300 foot square foot building ts the

maximum that the applicant is requesting based on projects of the growth of the business

even though it is going to be in 3 phases but given the size of the lot and the location of the

building I don’t think it will look anymore out of place than the Calvary Building at the

other end of Publishers Parkway.

This request is not substantial

It is in that 45,000 square feet is permitted by code but its

certainly not out of character or less substantial given the other buildings in the area and

other buildings within office park districts within town not even within this

There are no adverse physical or environmental impacts to the site or neighborhood: Will

not have any adverse physical or environmental impacts to the site or neighborhood. There

will be a slight increase in traffic but nothing that is out of the ordinary for that type of

work. The light will be mitigated, the dust and dirt will be mitigated during construction

and it’s far from any of the residents on Hard Road that I do not think that light or noise

will be an issue.

The difficulty is not self-created

It is in that the owner does require a larger building than

what is allowed but there are really no proprieties in Webster that would meet the criteria

of the size of the building that are currently available.

This is not an undesirable change:

Michael Short

I would like to add that from Publishers Parkway building and construction is set

far enough back that anyone on Publishers Parkway will mostly never know that the facility is

there and similarly from Hard Road the facility is set far enough back off of Hard Road has no

visual impact to any of the surroundings.

Chris Centola

At least to phase one.

Michael Short

No, phase 1, 2 and

3. Because phase 3 is 800 feet off the driveway.

RESOLUTION 25-0008 Corrine Volo made a motion for AREA

VARIANCE Located at 875 Publishers Parkway.

Applicant Matt McAlpin is requesting AREA

VARIANCES to allow the construction of a

300,000 SF multi-phase building, with the first

phase being 120,000 SF, where the maximum

allowed is 45,000 SF on a 25.65 acre parcel having

SBL# 079.06-1-32.123 located in an OP Office Park

District under Section 350-21C(1} of the Code of
