Erika Corsi

Before we go through the agenda and start the meeting, I just wanted to make a

reminder out to the applicants and the board, that the PowerPoint presentation is a one to one

with every application that was submitted for tonight’s meeting. So, it is the role of the applicant

to go through that five criteria that will be up on the screen. It’s the criteria that you filled out in

your application to obtain an area variance. So, I just want to remind the board and the applicants

of that before we get started.

Pg. 85 May 13, 2025 Zoning Meeting

(ERIKA CORSI READ INTO THE RECORD)

1. WICKERTON ADDITION: Located at 1023 Wickerton Lane. Applicant Patrick

Augino Jr. is requesting an AREA VARIANCE to allow a rear setback of 45.10’ where

50’ is required, associated with the construction of an approximately 598 SF addition to a

single-family dwelling on a 0.43-acre parcel having SBL# 079. 16-3-20 located in the R-3

Single Family Residential District under Section 350-12 of the Code of the Town of

Webster.

Appearing before the board Patrick Augino. As mentioned, I would like to add about a 600 sq ft

to the rear of my house and it will require a 5 foot variance off the rear setback. Mainly adding

an extra bedroom upstairs. My family is getting a little older and I would like my daughters to

have separate bedrooms if possible.

So, the plan is not to change the character of the neighborhood. We will maintain the roof height

as it is now. Same siding, same, you know, no real impact to the lot or the house as it is.

Alternates, basically the proposed addition is to create the extra space for my daughters to have

their separate bedrooms. We really like the neighborhood, like the schools that we’re in, prefer

not to move. The housing market isn’t always the greatest and lack of affordable four bedroom

homes is a little challenging right now .

Michael Short

I think part of the intent was did you consider alternate locations or alternate

solutions (o what you are presenting.

Patrick Augino

Yeah, so the layout of the house creates a bit of a hardship that they way it’s laid

out we couldn’t go onto the other side of the lot . It’s got a cathedral ceiling. It would completely

change and mess up the layout of the house. So, requested substantial deviation basically no real

major effects to the neighborhood, it continues to function as the same and getting this variance

does not create any adverse effects on the value or desirability of any of the nearby properties.

There should be no impact to the environment you know, not contributing to any kind of flooding

or runoff, Gutters and whatnot will be maintained and connected to the existing drainage systems

where possible. Again, this isn’t sort of self-created due to the layout of the house, this is really

the only location that we can put it. The lot is a little kind of wonky with some of the angles. So,

it shouldn’t cause any major issues.

Michael Short

So, I will open it up to the board for questions.

James Spampinato

Siding, everything is going to remains the same as what is in place now.

Patrick Augion

Correct.

Michael Short

So, this is a two-story addition, correct.

Patrick Augion

It is.

Michael! Short: Height wise, there is a section here, we’re showing 8 ft ceilings; don’t have an

overall height. In retation to your current house, what would the height be. Right, I mean you got

three, four different eaves on the house. Where is the eve of this addition going to land.

Patrick Augion

The ridge of the addition will be no higher than the rest of the house.

Michael Short

When we say the rest of the house because the garage ridge is lower, or the

main....

Patrick Augion

The garage goes like this so we’re going to behind it like this, behind the garage

and only 4 feet will be extended out that you would see from the road and the roof would come

down...part of it would come down over the garage roof that goes like this.

Michael Short

So, it will be taller than the garage eve, but it will not be any taller than the main

house’s eve.

Patrick Augion

No. We will maintain all the soffit. The house has soffits on every roof line on

all four sides. Will maintain all the soffits to keep the character of the original construction.

Michael Short

So, if you can look at the screen here and we got the garage off on the left where

the cursor is, that is the highest ridge. Is that the ridge that you are talking about or is it actually

the lower ridge.

Patrick Augion

It’s not. Will be raising the height of the ceiling of the rooms. They’ll be equal

with the existing house and the roof pitch will be equal with the highest peak on the house that

you would see from the side.

Michael Short

Josh, can you go back to the aerial view real quick. So, if you can, see the cursor

there, Is that the ridge..,.and unfortunately, I did get to see the house, but I wasn’t able to meet

with anybody there, otherwise I would have asked these questions while I as there. There’s that

ridge where the cursor is and then there’s a higher ridge there. Which ridge is the addition going

to match. Because the addition is going to be closer to the lower ridge based on the locations.

Patrick Augion

Just give me a moment. (APPLICANT APPROACHED THE BENCH WITH

DRAWINGS TO SHARE) SEE ATTACHED. We did the drawings on this rather extensively.

We are hiring an architect for the final.

Michael Short

Yes, I did go through those.

Patric Augino

This is the existing house, and this is the existing house . This is the garage roof

coming up high. This is the existing right here and this is our new roof . So, the ridge lines can

be equal to what you see on the side.

Pg. 87 May 13, 2025 Zoning Meeting

[

Michael Short

| am just trying to figure out if this ridge is....there is essentially three ridges.

Patrick Augino

There’s this house, it has extensive roofs.

Michael Short

Ok.

Patrick Augion

So, what I maintain here it’s the same pitch so that the look is the same. This

wall goes up against this wall and this soffit where I have them checked like that. That part of the

soffit has to come out. That wall starts right there and then we come out 4 feet. You lock from

the road; we’re only 4 feet from the garage so everything’s behind and it’s really not changing

things.

Michael Short

Thank you. Another question I have, have you had any communications with

your neighbors to the rear. I believe it’s like 991 Jackson and 989 Jackson.

Patrick Augion

Not 989 but I have talked to 991 and they didn’t seem to have a problem.

Michael Short

Okay. Any other questions from the board.

Adam Prescott

It’s currently a three bedroom. You're going to four. I am sorry.

Patrick Augion

Yes

Adam Prescott

And the septic, I saw that you couldn’t do a certain area because you would have

had to reconfigure your current septic system. So, is that what I was reading.

Patrick Augion

Not septic, just the layout of the house.

Adam Prescott

I thought is said something about requiring the reconfiguration of a septic system.

Patrick Augion

No, we are on............ (EVERYONE SPEAKING AT THE SAME TIME)

John Accorso

Actually, I di have a question. The....it’s a bedroom on the second floor, what’s

going on the first floor.

Patrick Augion

Well, the point is we need the bedrooms upstairs and on the main living area.

We need four bedrooms. One of the smallest bedroom on this side that will be adjoining the

addition. Part of that is becoming a hallway into the new addition for the two bedrooms that are

upstairs. Thus, leaving the downstairs, large area. There’!! be a master bath put down there with

a guest room bedroom below.

Michael Short

Thank you. The addition does have three bedrooms in it though, correct.

Pg. 88 May 13, 2025 Zoning Meeting

[

Patrick Augion

It has three now. One’s coming out to become partially a hallway to the new

addition. So, there will be four bedrooms upstairs and a suite downstairs for company.

Michael Short

This becomes a total of 5 bedrooms. The house when it’s all said and done.

Patrick Augion

Yes, 4 up and | down.

Michael Short

So, it becomes a total of 5 bedrooms when done. Right, cuz the addition will have

2 bedrooms upstairs and 1 bedroom downstairs and also looks like a laundry room upstairs and

then, I don’t know some storage sink space, shower I guess and some kind of on-suite type space

on the first floor.

Patrick Augion

Correct.

FINDINGS OF FACTS

(MICHAEL SHORT)

Because of the location of the addition being in the rear of the property, it does not affect the

essential character of the neighborhood itself. Only a small portion of the addition will be seen

above the garage roof line. Due to the layout of the current house, this is really the only location

to be able to place the addition itself to be able to have the bedrooms location to the south would

not work with the current layout of the property itself. This is not a significant addition, I believe

it is about 500 square feet if | remember correctly so it’s not significant in any means.

Environmental and physical conditions of the area are not greatly affected in the area. Though this

is self-created, the layout itself and the desire again does not have a significant effect to the

neighborhood. Does anybody else want to add anything.

RESOLUTION 25-0021 Michael Short made a motion for AREA

VARIANCE

Located at 1023

Wickerton Lane. Applicant Patrick

Augino Jr. is requesting an AREA

VARIANCE to allow a rear setback of

William Hart is requesting an AREA VARIANCE to allow rear setback of 46.3’ where

10 located in the R-3 Single-Family Residential District under Section 350-12 of the Code

Appearing before the board was William Hart. If you go to the instrument survey map, that’s

probably the easiest way to explain this. So, the addition will be at the back of the house. If you

look at the north side, you will see a current structure that used to be a hot tub room that is falling

apart and then there’s a deck. And then where the where the red rectangle is where we would

plan to build the house for the addition.

Michael Short

The deck is remaining.

William Hart

Yes. By the way, the ridge line of the addition is going to be about 3 feet below

and perpendicular to the ridge line of the house.

Michaei Short

Appreciate that, thank you.

Adam Prescott

Are you taking down the hot tub room that’s falling apart?

William Hart

Yes, it won’t take much work. The character of the neighborhood, we don’t

anticipate any adverse effect to the neighborhood. The siding of the house or of the addition will

be the same as the siding on the house and J just want to point out that the entire house is

surrounded by undeveloped woodland. Alternates considered, we considered one alternate and

that is where the existing hot tub room is However that would not work and if...could we just

go back to the map again. So, if you look at the map, the area where the existing how tub is, is

only about 10 feet and we are looking at building a 14 by

16. In addition, as was mentioned

previously, the septic system is there, the collection tank, and then piping into the leech field. So,

we would have to work around that and lastly, the connection point to the house would go right

into the master bedroom there. So, that’s not particularly desirable. If we go into sustainably ,

the room that we’re proposing to build is about 0.005 on a 1.88 acre lot so we think that the small

size of both the variance and the room would render it not particularly substantial . The impact

on the environment, we are going to put gutters on the room and tie that into the existing gutter

system. So, we’ll be using the existing drainage. Traffic I think is not applicable. I don’t know

what circulation means. Can somebody tell me.

Michael Short

It is the movement around your fine. It’s not applicable to this particular project.

William Hart

Thank you. Dust and noise, obviously during construction there would be some

dust and noise so that would be short term. In addition, any dust or noise would be mitigated

from the neighbor perspective because of the surrounding undeveloped woodland. I don’t think

it is applicable; public services, we will have electrical in the room but that’s it and so we’ve

concluded that it shouldn’t have an impact on the environment. So, that created difficulty. It’s

really the pre-existing conditions and layout of the house. So, the house itself is about 71 feet,

and we’ve got about 10 feet at the hot tub room that’s going to be demolished and about 35 feet

of deck That leave about 25 feet where we are proposing to put the room in,

Michael Short

Ok, I will open it up to the board. Any questions, comments that you may have.

Did you have any correspondence with neighbors to the south or east of you?

William Hart

I did with both of them and they’re both willing to support the variance.

Michael Short

Okay. Yeah, you’re deep into the woods. I think there’s quite a bit of wooded

property between you and our neighbors, so I don’t think there are any issues here.

RESOLUTION 25-0023 Michael Short made a motion for AREA

VARIANCE —: Located at 624 Maple Drive.

Applicant William Hart is requesting an AREA

VARIANCE to allow rear setback of 46.3’ where

50’ is required, associated with the construction of an

approximately 224 SF _ three-seasons sunroom

addition to a single-family dwelling on a 1.8-acre

parce! having SBL# 063.16-1-10 located in the R-3

Single-Family Residential District under Section

350-12 of the Code of the Town of Webster which

was seconded by: Anthony Moscaret.

FINDINGS OF FACTS

(MICHAEL SHORT)

The essential character of the neighborhood, I don’t want to say deep in the woods, but you are

surround by a wooded lot in all areas. By making this addition, it’s really not going to affect the

surrounding neighborhood. As part of this project, you are going to be tearing down a small hot

tub addition as well so, this is a little bit larger. We are moving, trading one for the other. Though

you did look at the location of the hot tub which would keep you behind the 50 ft mark, that

location does not access the family space. It does only access the master bedroom, so it was not

an ideal location. The orientation of your house to the property line is not parallel. It’s kind of

.. off by about 5 or 6 degrees which is also causing some of the issues with the setbacks. This is

not a significant change. Again, we’re removing one addition, and we are adding another addition.

The physical environmental conditions are not changing. That area is not wooded, and you are

not really affecting anything in that particular area. Again, it’s self-created because it’s something

that the applicant desires, it is the most practical location and it’s not a detriment to the project

itself or to the property or surrounding areas itself.

Michael Short

Does anyone else want to share anything else on the findings.

3. ARGENTO GAZEBO: Located at 1840 Schlegel Rd. Applicant Jason Argento is

requesting an AREA VARIANCE to allow a 1,208 SF addition to a pre-existing non-

conforming 912 SF pole barn (totaling 2,120SF) on a 5.2-acre parcel having SBL# 066.01-

1-46.1 located in the LL Large Lot Residential District under Sections 350-13, 350-36,

350-95 of the Code of the Town of Webster.

Appearing before the board was Julie Hus and Kevin Feor (speaking): Jason was called out of

town and this is Julie Hus, his significant other. I am a retired contractor, so I offered to come

and speak on their behalf. We have a pre existing non-conforming metal pole barn, and they

would like to build an open gazebo or a picnic shelter where the roof line matches the existing

gabled roof line of the metal building The sides are open with pose and header typical shelter or

gazebo. There is no intention for concrete at this point. They haven’t decided if they would

hardscape it or gravel it, etc....etc... The reason for the structure is that not only do they have tow

dogs and they would like to be able to be out outside and entertain when it’s raining or extreme

sun. So, put a couple picnic tables in it. Where they’re located is all iarge lots. It’s pretty much

Webster East so it not as dense as Webster West these days. So, it’s not unusual to have accessory

structures or barns in that part of town. The building is pretty much sheltered visually from the

road because of four mile creek and ok so for those reasons we don’t really think it will change

the character of the neighborhood. We did consider alternatives, but this just seemed the logical

spot to put it where it would be the least visible from the road and from the neighbors. The east

side again, there is Four Mile Creek and all woods and the neighbor on the west side is not going

to be able to see it because it’s on the east side of the pre-existing non-conforming pole barn.

Substantially, I mean the variance is not really asking for a setback, but it is asking for a

reasonable size grant from the ZBA but the additional one structure at 900 some odd square feet

is pre-existing was there when they bought the house and this structure is open and it’s just a roof

line, post and a header. The impact on the environments negligible. It drains on grade; there is

no impervious surface being added at this point and time and honestly, everything drains to Four

Mile Creek. It is self-created, there is no question of that but given the size of the lot and just

putting it where it’s least visible from the road or have any impact on the neighborhood or the

rest of the neighbors, it seemed like the logical spot to put it where it would be least noticeable. I

would be happy to answer any questions.

Michael Short

Can you tell me what the height of the eve of the existing building is.

Kevin Feor

The height of the existing ridge on the pole barn which we’re going to match...?'m

going to say, is 15-16 feet.

Michael Short

That what I guessed when I was out there.

Kevin Feor

I built their addition but ’'m hazing and guessing memory. My memory is not a

great as it used to be, unfortunately.

Michael Short

No worries. Other questions from the board.

Adam Prescott

? (not sure who is speaking, camera is on applicant) you said he hasn’t decided

what he’s going to do for a floor yet. Gravel, concrete?

Kevin Feor

They’re going to remove the side and gravel it and then either pour concrete at some

point or hardscape it, meaning pavers.

Adam Prescott

? (not sure who is speaking, camera is on applicant) So, [’m assuming he would

have this all done before it’s finalized and everything and not just do that.

Kevin Feor

I think part of the floor ambiguity is a cost factor to be....] mean one’s probably

more than putting the structure up.

Michael Short

There is a small slope in the back if I remember correctly, right. It dips down a

little bit.

Julie Hus

It will be leveled out.

Michael Short

So, it will be the same. So, the floor of the gazebo will be the same floor as the

pole barn itself.

Julie Hus

Yes.

Michael Short

You have no intentions of enclosing this gazebo.

Julie Hus

No

Michael Short

Okay.

Adam Prescott

? (not sure who is speaking, camera is on applicant) Are you running any electric

or planning on putting any lights hanging.

Kevin Feor

At this point in time, Jason and 1 spoke about it, and he doesn’t have any real plans

and I’m like, well, you can always do solar. It’s not going to be a workshop and it’s not going

Pg. 94 May 13, 2025 Zoning Meeting

to be enclosed. I mean, he’s got the pole barn and garage, and he does use those for that but at

best maybe it ends up with a couple of plugs and lights. I mean,

Julie Hus

There’s existing electricity in the pole barn so I mean, I can see us maybe stringing

lights across but nothing significant.

Kevin Feor

Yeah, it’s literally 6 x 6 at 10 or 12 feet and microlam headers or treated headers.

Rafters on a metal roof to line up with the existing pole barn.

Michael Short

Erika, you had indicated that or it was indicated on the slide show that the existing

pole barn with the addition will be about 2200 square feet, I think is what it said, right.

Erika Corsi

Yes, that’s correct.

Kevin Feor

Yes, the pole barn is 900 and changes and the addition is 1200 so, it’s close enough

to 2200.

Michael Short

I don’t have any questions, anyone else? Ok, so we are doing......this is an area

variance because of total square foot of the building. Is that......... want to make sure that

we’re...that’s the or is it because it’s a pre-existing non-conforming structure.

Kevin Feor

I think it’s both. I wasn’t real sure myself.

Erika Corsi

It is an addition to a pre-existing non-conforming which has to be reviewed by the

board.

Kevin Feor

And then the total square footage exceeds what’s allowable, I think.

Erika Corsi

Yes

Michael Short

2500 I think is the max right ? For an accessory building I think is what it is.

Erika Corsi

Correct.

FINDINGS OF FACTS

(MICHAEL SHORT)

The essential character, this is in a large lot residential district and property of most of the

properties out there are 3 plus acres. This parcel is 5 acres. There are a lot of pole barn structures

out in this area so having an open gazebo attached to an existing pole barn structure is not outside

of the character of this area. There is no other remedy. Other areas were looked at and this is really

the best solution and most cost-effective solution to be able to provide the gazebo, and I am going

to call it open air pavilion for this property. Significance, it is a 1200 square foot open pavilion

that is being installed. It is not insignificant, however due to the large lot the surrounding area and

pole barns in that area, it is not a significant impact to the area and again, it’s not near any of the

setbacks or any of the neighbors as well. Physical or environmental conditions, they’re not

affecting any ground water, any drainage, they are affecting about 1200 sq ft of green area but

again, not significant and again, because it is a need that is a self-created element, but this really

is the best solution for this open area, gazebo area. Does anybody else want to add anything to the

findings.

4. MAINTAIN CHICKENS: Located at 255 Princeton Rd. Applicant Jessica Tierney is

requesting a SPECIAL USE PERMIT to allow a 12’ x 8’ chicken coop and no more

than 6 chickens on a 0.28- acre parcel having SBL# 063.18-4-3 located in the R-3 Single

Family Residential District under Sections 350-40, 350-75 and 350-103 of the Code of

the Town of Webster.

Appearing before the board was Jessica Tierney. I am requesting this special use permit in order

to maintain 6 chickens on my property. This will be located in my fenced in back yard. The

exact location of the coupe would be something that I would decide when I get the materials.

Judging by shade and also level ground but it would be somewhere by the existing garage... and

that would be a coop at first that would have a small chicken run on it, but I could expand that.

That was part of the plans as they grow. This is something that you’re aware. It’s becoming

increasingly popular in residential areas and there’s a lot of different materials out there

researched on and how this can be done that would still be a nice hobby for people but also

something that could be done in a neighborhood and doesn’t affect the neighborhood.

Michael Short

So, you mentioned by the garage, the images that we were looking at, is that

rectangle the area that you were considering.

Jessica Tierney

It could be, I’m just kind of now that I am looking into it more, I think it would

be better to have it closer to the garage just for the shade and just the lawn there might be better.

So, it’s kind of open ended with my end up.

Michael Short

Fair enough, but your backyard is fully fenced.

Jessica Tierney

Correct. I have chain links all the way around.

James Spampinato

You are not doing rooster, just the hens.

Jessica Tierney

That would be something that is up to you guys. The research that I have done,

it does seem sometime without a rooster, the hens sometimes don’t have as happy as a life because

they rely on the roosters to protect the flock, and I understand there are noise issues with roosters

but the types of chickens that I am interested in are called bantam silky chickens. So, they’re

really small and they historically don’t crow as often and understanding that you can only have |

rooster in the flock anyways. So, there’s considerations there. I would like to be able to have a

rooster just for the well-being of the hens.

Michael Short

I will say, generally, we do not allow roosters for the noise. So...but we'll have

the discussion open here. Any other questions.

{not sure who was speaking) : Yes, have you talked to your neighbors about

this.

Jessica Tierney

I have not. One of the neighbors directly to the side of me, there’s renters there

and as far as I know, no one else has moved in and then my other neighbors really don’t come

out much, don’t talk much, but the sign’s been there, and I’ve seen a lot of slow down and look

at the sign. So, I’m sure if they had any questions, they would ask or they would be here. It’s

kind of just the neighborhood just that everyone keeps to themselves and minds their business for

the most part.

Michael Short

Are you planning on...so, you mentioned the first coop that you get will end up

having a small run to it. As that evolves, it is your intent to let them roam free in your backyard

and the reason I ask that is, though chickens don’t fly, they do jump with their wings, and they

will jump over a chain link fence and go onto your neighbors property.

Jessica Tierney

Correct. No, I don’t plan on letting them free range for their safety as well, just

with predators around, I don’t want that for them. So, 1 brough a couple of pictures and J could

bring them up or just show. This would be kind of like coop that is prefabbed and then I would

either build an extra wood extension for the run or you can purchase ones that are made of chain

link that sort of attach to the coop to give them more space, but it would be enclosed so they’ re

not able to jump or fly.

Michael Short

Including a lid.

Jessica Tierney

Correct.

Michael Short

Alright, does anyone want to see the picture of the coop?

Anthony Moscaret

If you go with whatever design you go with, protection for other animals

getting in because foxes can jump pretty high and everything. I assume there’s going to be a

covering over it.

Jessica Tierney

Yes, and from our research, hardware cloth is the only way to keep out predators

so that is something that I am aware thai I will have to enclose everything in there to make sure

that they’re safe.

Michael Short

You will want to go down either 24 inches into the ground or 24 inches out, so

they don’t dig underneath as well.

Jessica Tierney

Yes. Don’t you like fan it out underneath?

Michael Short

Yes. Alright, I don’t have any further questions. { will you know...I’ll leave it

up to the board, but J would recommend...I think you indicated no more than six hens or chickens.

Correct?

Jessica Tierney

Correct.
