captions Language: en In the zoning, it's 35,000 square feet per lot. Correct. I I think uh it's been about a month since I reviewed, but that that's what the requirement is, right? That's correct. Is there a reason you didn't take any additional um space away from parcel three um to to accommodate that? Yeah, it was an agreement between the two land owners. Um as we have our property lines right now, I don't know, did any of you visit the property recently? Um we had some survey stakes that follow the the new proposed property lines. So as it's proposed currently, it matches um what would appear to be visually uh the lot line.
Thank you. Other questions from the board members? No. N um is anybody here from the public that wants to speak for or against uh this variance? No. Back to the board. Any other questions from the board? Okay. Going to uh vote on seeker. Uh, I make a motion for a type two action under seeker pursuant to NYCRR section 617.5 of the environmental code. Second. Second. All those in favor? I um K, you want to do findings? Um, yes I can. I'll say the request is not out of character with the neighborhood. The lots in that area are a variety of sizes. Many of them were probably created before the code reflected what it is now.
Um, there's really no impact on the neighborhood. I have three lots right now, two of which are substandard in size. One meets the size requirements. I will still have two lots that are substandard in size, just changing the proportion of their substandardness. and lot three still remains adequate in size. So there's really no harm, no foul. Um the benefit really it's can be achieved by other methods but not not truly because it's it matches the natural topography and it also you have there's a couple of features that have to be incorporated into the mamalor's lot that it's it's really the minimum amount in order to do that.
Um it's not an undesirable change driving by no one's even going to see it and know and agreeable between the parties that own the different properties. It it really isn't going to impact anybody but them. And I'll say it's relatively insignificant in that the third lot is still going to remain a large enough lot to do single family construction without any need for variances. Yeah. And to your point, it's uh you have two non-conforming, you still have two non-conforming, and you have one conforming. So, yeah, it it's I appreciate that the owner of lot number three is willing to horse trade in order to make a solution that works for everybody.
You don't always see that. Yeah. Um with that, anybody have anything to add or don't. All right. Um, I will make a motion to grant an area variance at 1315 Lake Road on behalf of Jonathan Olivia in order to allow a minimum lot size of 19,457.9 square feet where 35,000 square ft is required on a 66 acre parcel with SPL number 050.01-1-51 located in an R1 single family residential district. Second. Mrs. Wo. Hi, Mr. Senola. Hi. Hi, Mr. Prescott. Hi, Mr. Short. Hi. You have your area variance. Um, you have one year uh to to get the area variance in place. So, thank you. Thanks. Next up, uh we have Best Buy Auto Supply.
You can come on up. Um located at 771 Ridge Road. Applicant Alan Mallet Mlette Mallette. Um zoning district is MC Medium Intensity Commercial District. The request is a use variance to allow service garage to an existing auto sales business. And the proposal is the construction of an approximately 2,856 square foot detached service garage. Um relevant sections of the code 3 section 350-18 which is medium intensity commercial district and 350-101 D2A uh use variance. You're up. So my name is Al Mlette uh here with Best Buy Auto Sales 771 Ridge Road in Webster. Um looking for a use variance you said to obstruct the service department uh behind our current um sales building uh to be approximately 34T by 84T um in dimensions.
Um you know we we we feel that it's uh you know it' be a significant thing for our business to uh um get the opportunity to grow and uh reduce costs of uh what we're currently paying to uh outsource our current service situation to uh multiple other businesses within the Webster area and also bordering towns. Um Guess it's my opinion. It's just pretty self-explanatory what I'm asking for. Um it's uh definitely would uh help us expand and uh continue to grow in this area. Be happy to answer any questions anybody has. The the service that you're looking to do um you sell pre-owned vehicles. Do you do the service are you looking for service?
because you do service on the vehicles beforehand or do people come to you for repairs post purchase? Uh we're looking to service our own vehicles that we that we sell prior to uh getting them ready for for our customers. Okay. Um that's the biggest portion of it. Um we do also sell extended warranties. So that would also allow us to service our customers after the sale as far as mechanical issues and concerns that they may have uh after the sale as well. Other questions from the board. How tall um are you proposing the structure to be? I'm sorry, say that again, sir. How how tall are you proposing the structure to be?
Uh to my understanding, the the height of the walls would have to be a 14 foot high in order to accommodate the the lift that would need to be put inside. Okay. Uh if anybody in the uh audience wants to speak for or against this project, come on up. Back to the board. Any other questions from the board? Is it going to be a metal building? Um yes, we're looking to do a poleb barn style with uh metal outside and all five doors on the same side. It said five, right? Correct. Correct. Five. Yep. That Let's see. That would be on the west side, I'm assuming. The parking lot side. Yes, the parking lot side.
Yes. Yep. Can you can you put on the record some proof regarding how you calculate the out of pocket cost of labor uh to external vendors as opposed to how that would compare to your own mechan mechanics? You got to pay, I'm assuming, uh some type of hourly rate, some some benefits. um and what what that savings would would look like for you. I mean, did you take a look at for for example in the year 2024 what you spent out of pocket to an outside vendor even if it's multiple mechanics and compared to what your cost savings would be if you could do it in house? I mean, I haven't we haven't really figured out exactly the penny.
I mean, it's just I mean, well, it's not really the penny. The the statute requires for the area variance, right? right that you got to show some financial hardship in a vacuum just it's I mean I did include in the thing that you know in the last 70 days of 2025 from February 24th to through May 5th of 2025 uh in them 70 days time frame we've paid out in just labor costs in the area of $60,000 right so I mean to hire to hire you know mechanics per hour and and and and such would definitely be a significant uh savings to to the business. No problem. No. Right. What I'm simply saying is is if this were to be challenged, right?
The board has a has the burden. Actually, you have the burden, but we have to show that the record would reflect the financial hardship. And and let me just finish. It's more of a conclusion if you show the gross number and say I could do it cheaper. You may be 100% right, but can you establish what that would be? Yeah. Well, I mean, with the economy growing the way it is and the cost of everything going up, I mean, some of the garages we've already are currently doing business with are asking for, you know, to increase our labor rates alone. And it's uh, you know, it's to continue to do business.
It's uh it's it's going to be difficult to to you know find labor rates that are affordable to willing to work willing another business is willing to work within you know affordable guidelines and labor rates that uh that incur part of uh not only servicing the car before the sale but you know standing behind all of our vehicles we sell after the sale. It's you know there's a lot of there's a lot of Let me um I guess I'm not conf No. Yeah. Hey, let me ask it this way. Um, what are the labor rates that you are being charged from the outside vendors? Currently, right now, I'm being charged anywhere from 70 to $75 a labor hour.
Okay. And what do you believe that you would be able to hire a mechanic for? Uh, we'd be able to hire a good mechanic for 25 to 30 an hour. Okay. So, there's a difference of about $50 an hour. Correct. Right. Um, I think that this is more along the lines of where you're right. Well, you got to add in, you know, some benefits. You got to build the building. You got to pay the taxes. You got to pay the utilities. You got to pay the supplies. You got to buy the tools. Again, there may be a net savings there. But if if it's a hardship is required, you got to put something in the record, right? And what is the um what what's the return on investment or what is the um how long how long would it take to pay it off including salaries tools that you have to purchase unless the mechanics are coming with their own tools.
Um mechanics generally do come with their own tools you know it's so then it purchasing the building uh hiring the employees how long would it take to pay paid off based on what you're currently paying and then obviously increased rates. Well, what we're currently paying um again, I would have to guesstimate it probably take a good eight years, maybe 10 years. I mean, it's uh it all depends. I mean, the business is the business of car sales is is I always refer to as a roller coaster. You know what I mean? It's always it's up and down. If business slows down, it's uh takes longer. It takes longer.
If business increases, which we're hoping being able to do something like this would hope allow us to increase um our sales. It shouldn't take as long. John, let me ask you this. What what documentation would we need to be able to to your point? I mean if if we are ever challenged we need to be able to produce ultimately you need to be able to produce but um to be able to what have you seen in the past that that would be beneficial? This is unusual because usually we're talking about historically the sale of property, the lack of buyers, the inability to release spaces and the numbers are more objective and led themselves to a calculation.
Right. This is this is unique and so it's Mr. Mlette, right? Yes, sir. Right. So what over the next 12 months if we get six more use variance applications we try to stay away from you did it for this guy but you didn't do it for that guy. So the measuring measuring stick really needs to be the same for everybody. So, in terms of what you would need is just, you know, you don't need to pay $10,000 for the analysis, but some analysis that breaks down the difference between this this relationship that you have with vendors, which is really at either a retailer or wholesale cost to you because you're in the business as compared to having these folks in house and what that real cost is.
I I simple, very simple math is I can hire someone for $25 an hour. I'm paying someone else 75 $50 delta. That's easy. But let me finish. But that cost is more than $25 to you. And so if you can if you can do a projection that puts together what that additional cost is, then I think the board is going to have a a more accurate picture as to the the financial hardship that exists. I don't have a vote in this, but whether you know the board feels that $10 is not a financial hardship, but $40 an hour is, I think that's what the board will turn on. Can I ask you a question? Actually, based on what he's saying.
So, you said you spent $60,000 roughly in how many months? A 70-day time frame. A 70-day time frame. Yeah. A little over. quote out of that he made mention basically you're looking at an extra 50 bucks if that was you per transaction based on outsource do you know what the mortgage payment or the payment is going to be on the building I guess what he's looking for is if if you did 50 cars in that time times you know $50 extra an hour and each car was four hours there's 200 bucks per car out of that 200 bucks how much is going to the building, how much is going to the insurance, how much is going to that kid?
And at the end of the day, is that $200 leave you with a hundred or 10 bucks? At the same time, you know, I look at the hardship could be at any given time, these businesses could just tell me they're not no longer going to do business with us either. So now, you know, that would create an even more of a hardship to try to to try to do business. Well, that's the other question. They did do that is like turnaround time is as shops get busy does it impact say you're taking I you do a lot with Midas you do a lot with bar if if they're doing capacity for their regular customers does that then impact the lead time of you being able to get the vehicles back yeah absolutely it does which currently right now justify the loss of sale or whatever but it it's certainly an impact currently right now Uh we're about a 3 to 4 day turnaround from you know the getting the vehicle into the service garage and getting it it's gone through and parts ordered and and getting it back and and ready for our customer.
And if uh you know I feel if we had our own shop that would definitely help speed up the process because now we're not relying on other businesses to conduct our business. Right. But but there's a cost associated with that that's going to decrease the the hardship. Right? It means now you got to have parts on hand. A lot of mechanic shops don't don't do mufflers. Those figures are labor only costs. I pay we already are currently pay I'm ordering I'm currently ordering our own parts and having them shipped to these separate garages. So all of these bills that you've provided in your hardship statement that's all labor labor only.
No parts involved to take those numbers and convert. Okay, this is labor when I go to Midas and I go to Bar and I go to whoever else versus labor if it was my own including you know I'm paying 20 $30 an hour plus figure double that by the time you get benefits of $60 an hour but you have more control as well over the number of hours not just the hourly rate. Is there a way that you could take this and make that a table of outsource spending versus insource spending? I mean, yeah, you could you could simplify it even as little as uh you know, one job, per se. Uh say the labor cost to uh remove a transmission out of a vehicle calls for 10 hours.
Okay. I'm paying that that current shop, you know, 10 labor hours at, you know, we say $75 an hour to where if we have in our own in-house mechanics, our own hermit garage, that 10 hours, our mechanics might be able to get it done in eight. So therefore, we're only having to pay our in-house mechanics their hourly rate for for the eight hours compared to, you know, the 10 hours that it would that we're going to get charged from outsourcing all of our service currently. So to to give a breakdown, I mean, sure, absolutely. I could uh I could sit down and break down a lot of different invoices that that that incred total amount that we're that we're out outpaying in uh in labor costs.
Even if you can like I hate to have you go receipt by receipt by receipt but you know this this much to this particular vendor you know totals by month or by your fivemonth window or whatever the numbers that you gave me of that $60,000. What would that cost be if it was within your shop as opposed to having to source it out? Because parts are going to be the same cost no matter what you're providing the parts to them. Yeah, the the parts costs are going to are going to are going to stay the same. Um Alan, if if you could do I mean because we can continue going around. I I guess what I what I'm going to propose is um that for me and I I'll ask the board as well.
We have to do our due diligence for the town and we need to have call proper documentation to be able to say we did our due diligence for the town. Um, if you could provide kind of a breakdown of, you know, what you would anticipate hiring an employee at, what the cost of, uh, benefits would be for that said employee, uh, and then what the labor cost, and you've already provided what the labor cost is, but it's not at face value, right? I mean, you spend $60,000, and if I do the math backwards, there's a $40,000 labor uh labor difference between what you spent versus what you would spend if you had uh had that in-house.
For us to have have the proper documentation would make our lives a lot easier. Not that I want to delay this. I'd much rather go through it, but having that we have again we have to have the due diligence. We have to have it in the file. We have to be able to if we're ever audited, we can we have to be able to say that we've we've reviewed the documentation. We understand what it is. Uh, and the board agreed that it is a hardship and here's the documentation to be able to to do that. You don't you understand what I'm asking for? I mean, I'm not clearly asking not clearly sure what it is you're asking for, but I mean, I said having to rely on other businesses that could shut you down at any given time would it would it would put us in a a more extreme of a hardship than what we're currently in.
You know, currently we don't have that as a as a right. But the the the requirement is a a a financial inability financial inability to achieve a reasonable return. I don't even think you establish what a reasonable return is. So if you look at the at the statute and the language and then from there you put your presentation together and be able to persuade the board hey look I can't get a reasonable return because these are these costs are let's assume a reasonable return on the sale of a used car is 15%. And let's say because these mechanical costs you're only getting 4%. But if you had your own shop, you'd get 15%.
That's the kind of analysis the board would need to decide whether you're really under a financial hardship or it's just not a good location for that operation. It doesn't mean they're not going to approve it. They may very well approve it, but you got to give them the proof. Josh, can I ask a question? Sure. And the slide on the screen is exactly where I was going with this. The building two doors to the east is an auto sales operation that has a built-in service department. The business two doors to the west is an auto sales and service department all within the same confines, all in the same MC zoned area.
Across the street is outside storage which allows auto service. But Why are those allowed to have it but not every business along that? It's it's a combination of they were either pre-existing non-conforming before the current MC regulations came into effect or they pursued use variances. So, so they they went potentially they went and achieved the variances that we're we're asking for and they provide the information necessary. Hyundai was pits Pontiac and that was here before most of right um pre-existing non-conforming the Nissan dealership I don't remember like it's just it's always been they they needed an area variance to expand their service department I don't remember them getting a use but I don't vision group.
So they have a vision building right across the street from Garber where I get service. Henderson's old building which is now west is right on that side. So I know a little bill and that side of the road is allowed but on the south side of the road we can't do it just based on how the zoning is four I think the Vision the Chevy and the Subaru because Garber has two because they've got the two um and then the Ford they all have service department but they're allowed the the Chevy and the Ford are allowed because of being on the north ones have it too the old Pontiac building has a service department HC So could and and maybe this I think Thomas landscaping breaks one of them up.
Correct. Thomas is in between. It's a weird in between vision and us. I just have one question for you. Um when you transport cars to wherever you're getting them taken care of for service, do you guys drive them yourself or do you like truck? Oh no. We have to drive them. We have to Okay. gas them and drive them. The only reason I asked that is that could that could also so it adds to it. It's a hazardous crashes possibly because take two employees to do that as well. Yes. They got to take a personal car to go pick up the other one. Well, or dealer car on a dealer plate but yeah it takes two people to transport.
That's I was curious. One of the locations we are we had the only way we could find a reasonable rate was we had to go all the way to Ontario in Wayne County. So it's a you know it's a 15 minute drive there 15 minute drive back for two guys. It sounds like you can provide the information. Again, I I guess we could provide I'm not there's not a doubt in my mind about that. I just I don't This is my first time in in getting involved in something like this. So, it's like, you know, fully prepared, but yeah, there there's no I mean, there's no shame anywhere, right? Lots of hidden costs that that can come into that come into factor with a lot of this.
Absolutely. We need that presented to us in a documented form so that we can put it into our file so that if if and when we are audited, we have the documentation just like Ramy, you do your taxes, you keep all your all your receipts and everything else. This way if the IRS ever audits you, you're able to produce. So that's what we're asking for. But as far but as far I mean but the but a lot of the factors if I'm if I'm correct if I'm wrong, you're asking what it would say for us is there are unknown numbers. I don't I don't really fully You have to make a saving. You can project it. Yeah, you're projecting.
You gave us a loan. If it cost you 25 bucks to to hire or that's what you pay someone, but it cost you 75 somewhere else. There's a savings even when you include benefits. It would let's say it's doubled. So, it's 50 versus 75. You just you just say we just say 25 hours of labor hour time per hour per employee plus you can add the time to shuttle these to different places as well and say on a given a given month I I it takes six hours of my employee time to get the cars back and forth. This way when we have that information it's easier for us to make a decision and hopefully you'll present it.
So we agree with you so we can grant you your variance. Right now it would be difficult for us to do because we don't have anything to prove that you do other than your word which is good but we need something that you can present to us that's on paper. So unfortunately we just need to have the proof. So, if we move forward with I did provide with paid document receipts of of we've we've got what your cost is, but what's your cost avoidance if you were able to do that inside? Just add your employee in there. 35 bucks an hour you pay the guy. If that was your company and not bar, what would you have made on every I would go back to each transaction and pretend like that was your employee working on that vehicle.
What would that cost? How much money would you have made on that transaction if you were paying your employee? So just you know out of this I don't know April 7th Midas auto 18 $1,818.99 I don't know what was done. I would go back and look at what was done how long it took. And if you were paying me $35 an hour plus benefits to do that job you might have only had to pay me 400 bucks. Well, you you now have $1,400 for your company times how many transactions now you can come to us and say, "Okay, if I was paying Adam $35 an hour plus benefits, and Adam did every single one of these jobs from February to May, Adam would have made x amount of dollars based on $35 an hour benefits, and my company would have made boom.
I or or I would have spent less. I would have lost less." Right. Well, spending he's buying all of the materials, so it's really just labor. So, he's going to make money on every single one of these. How do you want him to present it in a spreadsheet? Yeah, I think a spreadsheet would be the easiest spreadsheet of, you know, outsourced outsourced cost and then what your estimated cost would be if if you were able to have done that in house and then we can look at that delta and it gives us um the numbers make sense. I understand what you're telling us, but if if we say yes to you, we say no to someone else, and someone turns around and sues us, we need to justify that.
But this is why we said yes, because here's the data that shows the the excess cost that you had to incur because you did not have the ability to do the service. So, if you can show us this is what you paid out, but this is what it would have been internally. Plus, you're saving the labor of the two guys driving back and forth to pick up and drop off cars. Yeah. So, does that make sense just in a spreadsheet? Alan, if if I was I'm just going to use May 5th 67449. I'd have a column with cost uh for outsource 674 uh49 plus whatever the cost of your two employees to drive it there and back plus the cost of whatever the gas is for you taking it to and from, right?
So maybe you add another $20, $30 to that, maybe it's more. And then on the other uh column right next to it, what your cost would be if you were to do it in-house. Obviously, you lose the employees that are driving it. You lose the gas that uh isn't necessary. You have the hours that are necessary for the mechanic itself at and you give us an assumed rate, right? I mean, that's the that's what that's the best you're going to be able to do. We get it. But you give us an assumed rate of X and you're going to do the research to tell me, you know, to tell us what you're hiring somebody at and what the cost of benefits are for that particular employee.
Uh to give us a total all-in number of again, maybe it's 35, maybe it's 25, maybe it's 40. I I don't know. You need to tell us what that is. Um the other piece that I would like and John alluded to to this earlier is what is uh industry standard for profit profitability on each car sold uh when you factor in auto repairs and what is your average right because this is this really then talks to what the hardship is as John mentioned if it if it's taking you you know if if industry standard is 10% profitability uh Um, and because the cost of uh auto repairs is continuing to increase, you're now down at 9% or 8%.
Now, that talks to the hardship as to you going outside to get the work. Does that make sense? Exactly. Yeah. I you guys pretty much all in your own words self-explanatory exactly how it could benefit us. But I understand and and we need that. Like I said, had I had I had I known what to what you were looking for, I could have I could have definitely provided all that. It's not a problem. What it's not going to make you feel any better, but it's not the first time we've sent asked someone for additional information and come back the next uh meeting and then they actually, you know, reviewed it and um got approval.
So, this is not unfortunately for you, it's it's not an uncommon thing. It's we just need that additional information to I understand. I get what you're I get what you're saying. Thank you. If most auto sales places have services that be enough time. Yeah. Do you think one month uh if we table this till next month have it back in 24 hours. It's I'm trying not to prolong this any further. You know what I mean? It's a the process is trying to drag out. We we'd anticipate to try to hopefully break down and and have uh have something done before snow falls. Sure. But prolonging this another 30 days is uh could you take a look at it when he brings it back?
My understanding this property once was already approved for this. The previous landlord had told me that he had already went through all this and got a proposed building had architect drawings done up and and was already approved for that. the initial word that's what I got and then when I brought it back too would be on the property no if there was a previous use variance it runs with the property and there is no there yeah so there is no use variance for this property he did not he did not give you the proper information okay well that's and that's and that's fine like I said if it's uh because a use a use variance will stay with the property uh indefinitely so if if we don't have it on record we We don't we don't have it.
So, um 24 hours. Yeah. I mean, so I'm going to suggest that we table this until next month. Bring the documentation. Uh Josh, uh will you be able to take a look at it and and give us any Yeah, I took notes of what you're looking for. So, yes, once we receive it, we'll confirm that it fits the spirit of what you're looking for. Okay. So, to make this clear, the only do at this point is getting just this this uh addition. I I'll ask the board. Does the board have any other questions specific to the building or to the use variance itself? Not the financial hardship portion of this. I would just do my Don House invitation to say there's not going to be a second floor.
Nobody's going to live there. Nobody's going to live there. No one's going to live there. I mean, it's not going to be an office. I could I spent enough time there. I could definitely sell my house and just uh the corner, but it's not going to have a no other question. No, just enough just for a lift in the five days. Yep. Thank you. So then we will table this until next month, which July 8th. Is that correct, Josh? I'm sorry. July 8th, I think. July 1st. July July 1st. July 1 is Yeah. No, that the eth July 8th. Um, so we will see you on July 8th, Alan. All right. Thank you for your time. Thanks.
Can I get a second? Okay. All those in favor? I All right. Next up, we have uh privacy fence located at 479 Sandy Stone Circle. Yeah, keep that. Um, property address is 479 Sandy Stone Circle. applicant Roland Mayor uh and representing agent Roland Mayor. Zoning district is R3 single family residential district. The request is a six foot fence in the front yard of a corner lot and the proposal is to construct a sixoot privacy fence uh in the front yard of a corner lot. So uh relevant sections of the code is um section 350 uh-12 which is a single family residential district and then 350-79B which is no fence in excess of 4t in height shall be erected in the front setback of any residential lot.
And before we hand it over to the applicant, I would like the board to know that they did receive letter from the highway department back uh May 2nd, 2025 to install fence over a town drainage easement. So in in uh with no objection, I guess is that with the letter? Yes. Yeah. So the the town board approved the license agreement on condition that they get a variance. Gotcha. Thank you Josh. So good evening. Good evening. I am Roland Meyer. Um one thing I did want to point out is in the agenda it highlights our property is 1.8 acres. It's actually 473 acres. And I just wanted to make sure that the SPL number um the 078.016-1-07 016-1-070 is what shows on our survey.
Uh I don't know if the leading zero makes a difference, but I want to make sure that the if the agenda would make any difference here. I just wanted to correct that. Um, so as the uh the town planner, Miss Corsy pointed out, we are requesting a area variance to put a privacy fence in the back portion of our property, which because we're a corner lot, is our front yard. Um, we have multiple front yards. So, the red portion here is what the area variance would be for. uh it would go from the corner of our house over to where a tree line currently exists and then follow the inside of the tree line to the back of the property.
Um the appointment that we had with the town board was to put that rear portion of the fence in that is in the drainage easement. Um we had the letter from the highway department. He came and took a look at the property said it shouldn't be an issue. um no one would try to access that uh portion going there anyways because it is all wooded um and there is access in multiple other areas. So he said it shouldn't be a problem. And when we mentioned the uh fence would go along the tree line, he said that wouldn't be a problem for the rightway given that the plows um wouldn't have any issue since the fence would be on the inside of the trees.
Um and then from the look of the neighborhood, it'll be on the inside of the tree line. So, it would only really be seen in winter months when those uh trees drop their leaves. Uh that would both provide my daughters and and my family privacy for our usage of our property. Um but it wouldn't look uh negatively. It would it would actually match the the landscaping quite well in the winter months. So, I What kind of fence are you proposing? It says six foot privacy fences. All kinds of six foot privacy fences. Exactly. It not barb boyer. No, we're we're actually we've got quotes for uh cedar and for white vinyl.
Um right now we're leaning more towards the white vinyl because it matches the home and the portion of the fence that already exists um running along the inside of the the property before the pool fencing. Okay. And that would be a solid fence no matter what the material. It would be a solid uh fence regardless. Yes. The reason I'm asking is because though a good portion of it is behind um behind the uh the trees, there is a you will end up seeing a good portion of it. Uh as you come around the corner, you do see it. Um so it's just curious as to what that is. And absolutely wood stockade rots and doesn't look nice after about 5 to 10 years.
Yeah. When it starts to deteriorate, it's it's bad. We did get u we requested quotes for composite as well. Um but the the companies in the area don't deal with composite or at least the ones that we've talked to so far don't. So Gotcha. We're leaning towards the the white vinyl. The white vinyl. Okay. Other questions from the board? No. No. Anybody in the audience want to speak for or against this project? and come on up. All right, back to the board. Any other questions from the board? I just really want there's only going to be the How many access points into the closed in yard will there be?
There'll be if you count the access from the home. You can access it from our porch. So, you would go out our rear sliding doors from the screen porch that would give access to it. And then we'll have a double gate on the portion that is running from the corner of the house to the tree line that will allow um both lawnmowers uh we I have a riding mower that I use for the so I'll continue to be able to get our maintenance to and from the shed and if we needed any maintenance or anything they could access. So we we we do get quotes for the double gate. So it'll be an eight foot access on that side.
Okay. And then the pool the pool side has um yes there is a you see where it says gate right there in the existing vinyl they could access the pool area from there and then from the pool area another gate to access that fenced in portion. But the intent is to put one 8oot gate in the new section correct of fencing. Yes. Okay. The intent is to do what we're seeing on here would in the blue that would all be um the new fencing all the same fencing. All the same. Okay. Are you doing any landscape like so on either side like you're just going to so the fence you know one foot on the one side one foot on the other you're going to run stone or mulch or is it just going to be you're going to let the grass grow back in?
We'll let the grass grow back in. There is a small portion at the rear of the property that the town gave us the u drainage easement uh waiver for that um it it rises up and comes back down. So we would level some of that as the fence came through because uh we we don't want uh significant gaps and the vinyl fencing follows the contour of the land and we'll have our seven-month old puppy in the back so I don't want to dig in under. Yeah. So you'll be the top that six foot will be all the way across. You're not going to have points where it drops or anything like that. Exactly. Correct. Any other questions from the board?
No, it's really not going to be seen. The neighbor most impacted is across the street and with the tree line, he's really not going to see it. Gotta love corns. Everybody wants them, but then you go try and do this. Yeah. Yeah. Um, with that, I'm going to do a motion on Seeker. Uh, I make a motion for a type two action under Seeker pursuant NYCRR section 617.5 of the environmental code. Second. All those in favor? I want to do findings. Sure. um allowing the variance of defense uh will not affect the essential character of the neighborhood. There are many lots in the general area that have fences.
So, and especially with the material, it should look good uh to provide privacy for uh his his yard. There is no other remedy except a fence that will provide the amount of privacy and security to keep this dog in. So there is no other remedy. Um the requested variance is not substantial. As Karen mentioned, the only person that's really the mostly effective is across the street and even that has some existing trees that should help screen it. And then um the uh the area variance does not have an adverse effect on physical environmental conditions. And uh while it is uh self-created, it is a minimal request to allow him to use uh his backyard and his pool in a relatively private manner.
All right, that um do we want to add as well that the town board and the highway department have also agreed that this is okay to do zoning board? I would say that in the in the motion the motion versus Okay. All right. Good motion. Sure. I'd like to make a motion that uh we allow an area variance uh located at 479 uh Sandy Stone Circle to applicant Roland mayor to allow a fence in the front yard of a corner lot associated with the construction of a 6ft tall privacy fence on a um what is it 48 acres uh 473 yes okay 473 acre parcel having SPL number 078016-1-7 located in the R3 single family residential district under sections 350-12 and 350-79 of the code of the master.
Excuse me. Second. I'd like to uh just add to the six foot privacy fence either be cedar or um white vinyl fencing and that um the uh a portion of the fence has already been reviewed and approved by uh the Westtown Highway Department in the rear. Mr. Collah I Mrs. Volo I Mr. Mscar I Mr. Prescott I Mr. Short I All right. You have your variance. You have uh one year to complete the project obtaining uh building permits, etc. So, good luck. Brilliant. Thank you. Thank you. Next up, uh driveway expansion located at 227 Oakwood Lane. Applicant Randy Sprag, is that correct? Sprag, pardon me. uh located in R3 single family residential district.
It requests to allow one foot side setback where minimum is minimum of five is required um with the proposed expansion of a driveway to the west by 486 square ft. um relevant sections of the code section 350-12 single family residential district and 350-12B 5B2 which indicates a driveway uh has to be 5 feet from the side setback except in the case of a flat lot or a common driveway. So uh yes, my name is Randy Sprag. It's my wife Mary Sprag. Can you speak into the mic please? I'm sorry. uh Rainysburg, Mary's we're having our driveway replaced, dug up and repaired. And at the same time, we are looking to have the uh driveway extended on the west side of the driveway and down the side of the west side of the garage between our fence and between the garage.
It would roughly be one foot, just over a foot from the property line, existing property line. Currently, it's just between the garage and the fence. It's just dirt. And then we had stone put in last year just to get rid of the mud. So, we're just looking to improve the visibility of it and just improve the use of the uh area. So, the intent is to pave where it is currently stone. Is that correct? So, that's just dirt right there. And we're going to the stone. No. Uh picture on the on the right. You got stone behind the fence. Correct. The intent is to pave over the stone. Correct. So, it would be ashvalt all the way back.
Is that correct? Correct. Okay. What are you uh parking on or what is the use for the use? We have a third vehicle. In the winter, the vehicle will probably be parked behind the fence. Uh we'll store our garbage and recycle bin behind there. Uh it's just just a basic use to make it simpler than stone. Uh and yeah, just a little flatter and a little more usable. I mean, it's uh you know, it'll be access to the backyard. That's the only access, you know, unless you walk out the main door in the garage or the uh back of the house. So to get any think wide back there, we would just go through the gate and over the uh driveway to get to it.
So access to the backyard isn't changing uh by putting the driveway there. Access isn't changing. So is there at the end of the day is it you you said garbage a third vehicle would be parked there in the winter time. will park a third vehicle behind the gate. Okay. Currently, the third vehicle is parked in the driveway behind one of the cars. So, in the summer, it would be parked on the side, you know, if it's driveway there. And then in the winter, it'll be behind the gate because it's just a summer vehicle mainly. Okay. So, the gate is indeed staying. The gate is staying. Yes. Yes, the gate will stay.
It swings open uh to the outside. towards the road. Questions from the board. Have you spoken to the neighbor? Yes, I've spoken to I've pretty much spoken to four neighbors. Okay. So, both on the, you know, one on the west side, one on the east side. Uh the current owners on the west side, they are completely fine with that. Uh they said they don't have any issues with it. Uh the neighbors across the street, they're, you know, fine with it, too. Uh Jean on the east side, he's fine with it. And uh Dan and Bay on the across the street on the east corner, they're good with it, too. And uh the other one on the west corner, they're currently a rental, so the owner's out of state.
I haven't been able to contact them. That I'll open up to anybody uh from the public want to speak for or against this project? Nope. Back to the board. Any other questions from the board? No. All right. Like to make a motion for a type two action under seeker pursuant to NYCRR section 617.5 of the environmental code. Second. All those in favor? I There are I don't know if officially or unofficially. There's at least three driveways on that street within the stones throw of this house that are probably the same setback or perhaps less. Um hard to know, but just based on where the mowing lines are, they're quarter acre lots.
They're fairly narrow. Um the current neighbor on the east side, his lot, his driveway is extended, comes up, it's probably a foot and a half, two feet from our property line. Yeah. And as long as it doesn't change the drainage to the neighbor's yard, um it's fairly common in their whole off of section of town. I didn't see inside. I didn't see beyond the gate, but I don't know where it's grading, but all likelihood it is going to be pushing water. It's It'll be graded to go to the backyard and Okay. It'll just our backyard slopes away. I know. But realistically, as far as Well, when they when they pave it, can you make sure that they are paving it not to your neighbors property?
Yes. Correct. It can discussed it can either be pitched forward to the front of the house or to the back of the house. Yeah. Obviously, you don't want it pitched to the house. So, um because we don't want any water shedding. Uh you have to maintain the water on on your property. Yes. All right. I don't want your neighbor to come back here and say my my property is now flooding. I wouldn't want that either. Okay. That was my that was my concern. That wasn't pain. The asphalt is the gravel infiltration asphalt doesn't. Right. So request not out of character for the neighborhood. There are other uh properties that have have uh similar um uh driveways that are there.
uh it's not going to be detriment to uh nearby properties especially if you are having it graded properly and uh so it is sloped either to the back of the house or to the front of the house not away from the house. Um the benefit really is not achievable by any other method to to have a paved access point. You want it next to where the garage is. That really is the uh the only access point itself. Uh this is not substantial. uh the fencing, the the look of the neighborhood, the look of the house is not going to change uh by doing this. Uh there's no adverse effects uh physical to the environmental um difficulty though self-created is is not of uh significance.
Um and it's not a undesirable change. So I I think um we Does anybody else want to add anything else to the findings? Most people won't even know that it's paid, right? as they drive it back. So there's Right. It's a dirt area right now. It'll actually look nicer. Yeah. I think you know the asphalt will actually improve it. Yep. All right. um like the um uh sorry area variance to allow a one- foot side setback uh at 227 Oakwood Lane uh where a minimum of a 5-ft setback is required in association with a driveway expansion uh along the side of the garage for uh on a 0.28 acre parcel having SPL078.05 05-1-63 located on in the R3 single family district under section 350-12 of the code of Webster uh to also have the uh drainage slope to be either to the rear of the property or to the front of the property.
Second Mr. Short I Mrs. Volo I Mr. Prescott Hi Mr. Santo Hi Mr. I'm scared. All right. Uh, you have your variance. Uh, you have one year to complete the project. I believe you still need to obtain a building permit. Correct, Josh? Yes. Building. So, you'll still have to proh obtain a building permit for it. All right. Thank you. Good luck. Thank you. All right. Okay. Next up, we have Lockwood Electric at 633 Basket Road. Applicants Lon Lockwood representing agent Greg McMahon from McMahon Laroo. located in the industrial district. The request is an a an east front buffer area of 26.60 ft where 50 is required, a southside buffer area of 13.20 ft where 20 is required, a north side buffer area of 19.2 2 feet where 20 is required and a west rear buffer area of 24.1 ft where 25 ft is required in association with the construction of a new electric facility after you.
Good evening. I'm Greg McMahon from McMahon Laroo and also Lan Lockwood who is the applicant. The project that's being proposed at 633 Basket Road is the construction of a new facility for Lockwood Electric. And uh as part of this uh this is in the industrial zoning district which carries with it a buffer requirement. And due to the size of this lot uh and the necessity for parking and access uh we're requesting uh variances on all four sides from that buffer requirement. Actually the west side and the north side variances are I would say rather minor. Uh the larger ones are on the east side and the south side of the project.
And these variances are are for parking are for pavement. They're not for the building. And uh we're looking we're we're mitigating uh with landscaping on the east side of the building. There's an existing uh row of large evergreens along the west side and uh we we feel uh it's in keeping with the neighborhood. There are several other industrial uses on on parcels in this area uh that have paving or or other facilities uh which we feel are are within the same distance from property lines as we're proposing. We'd be happy. One question I have in the project overview that you provided us, um, you listed office space for Lockwood Electric, fleet parking and vehicle maintenance facilities, leasable garage spaces for other tenants, and a dog, uh, dog daycare facility.
Can you talk a little bit more about the dog daycare facility? Sure. Um, it's a business that we're going to start after we build the building. Um, I have two of my kids that are interested in opening this dog daycare. So, that's going to be that's what that portion's for, so they they can run a business. There seems to be a growing need for it. There is, I will attest to that. I cannot find any place to uh to bring my dog. But with that, um a dog daycare does fall under uh different regulations. Um it's allowed in this in here, but there's minimum lot sizes, uh other setbacks and other things that um I don't know if the board took a look at when they were looking this over.
Yes, but not knowing where within the site the dog daycare is, I figured that would need a variances later. So, Josh, can you address it? I'm going to look I wasn't aware that that was uh a concern. I'm going to have to look at the code. the code the the definition under the code includes um daycare under the definition of kennel, right? I know it's a specially permitted use by the town board. Um so we've identified that as a step in the process that they have to go through um from the actual zoning issues. Yeah. in terms of dimensional requirements um associated with that particular component of the use.
No, we we'd have to crunch some numbers. So, I'm going to look at Can you identify what building or what where the intent would be for the dog daycare on on the map that's up on the screen? Uh it's going to be the northerly portion uh probably the north quarter of the building and include that existing uh metal building which is going to remain on the site and be connected with a uh a small connector over to the new building. So the intent is the existing metal structure that's there now that would become the dog gate there. And it looks like you're fencing in that based on what I'm seeing it looks like you're fencing in that area.
Is that am I reading that correctly? Yes, that's what was being proposed on here. Okay. And that that does border just for information that to the north of that is an access for an industrial business that actually falls behind this and also accesses out on Salt Road. Right. So there's a a fairly wide parcel that is just a road access. Okay. To the north of this. So Josh, the other only others, I mean, from a zoning standpoint, um, under 350-22 for again the the dog daycare portion of this, uh, there's the minimum lot size of 63 square, uh,,000 square feet, which this is probably pretty close to that because this is an acre and a half roughly, right?
So be pretty close to that. The other one is 80 ft uh to all lot lines um for the main uh for the main for the structure itself. Um and then and then it gets into noise barriers and confinement and and other components. But from a from that standpoint uh for from a dimensional standpoint, it's it's those components there. Um, yeah, I drive I drive by this all the time. I mean, it's it's an industrial area. It's not anything. Yeah. Sorry, you were going to say something correct. No, I just if if the kennel business were to be part of and I'm I guess I looked at it that as a separate that's going to need permits from the town and probably variances in order portion of it.
So, I looked at the building and then the kennels. Yep. We'd like to do that if we could. Um, which let me ask you that. if we were to strike a dog daycare facility from this project overview um to be able to move forward with the building. I think kind of along llines what you're saying Karen and then at a later time come for the variances and uh needs for the the dog kennel uh dog daycare. Would that be acceptable to you? I'm not sure what that would mean. I think what what they're saying. Would you stop the project? Is that what you're asking or would you The variance isn't for the kennel. That's part of their This is what we'd like to put in there.
That's their operation. That's what they'd like to do. But they're asking for the building and the buffers. Yeah. So, we would just if anything we would hear I would think would just be for the building and the setbacks, not how they plan to I just don't want to say yes. And it's in here that it's going to be a dog daycare and then all of a sudden a dog daycare sets up. We could condition it. Absolutely. Yeah, I think that would be a condition to ask. I would carve it up. Okay. Yeah, because that would be in order to do that there there would be permits that are required anyway. We've done that for any of the dog daycarees in town.
They've all had to come before this board. Okay. But it doesn't say dog daycare in the But it's not in the application. Not in the application itself or in the We could give approval to build the building. Yep. And then Okay. We we acknowledge that there is a town board special use permit required for that particular use on this side. Okay. Yep. And just to clarify, we were just reviewing the code um for the doggy daycare, it would only require a variance for the 80 ft from the property line. So it the lot size is within the minimum and everything. Yep. So, okay. Just so that's on the record. All right.
Um, and I I guess I'd just like to say none of the neighbors have, you know, they're all happy for me to do it. The waste management is the closest and the water authority. Yeah. It's Yeah, I don't see it being an issue in any way, shape, or form. It's just again dotting our eyes, crossing our tees as well. Well, and the the neighbors across the street, even though it's industrial area, there are residences across the street, but the current location of the business is across the street. So, they're already looking at this lot, right? Yep. Including the uh he lives right across He lives right.
Yep. He's never going to leave work. So, your view will be better. Your commute will be incredibly short. You're within walking distance. That's the plan. All right. Uh any other uh any questions from the board outside of the uh dog daycare? No. Uh anybody from uh the public want to speak for or against this project? Please come on up. Nope. Back to uh the board. Any other questions you guys might have? Uh I do have a question. And what is the proposed height that you are looking at for the building? I know the the walls are going to be I don't know off hand. I've I've got architectural elevations here.
If you just No, I thought Well, I mean I don't know. Uh there are tw uh 20 according to the uh um GLA's plans were 20 ft to the eaves and probably midline we're talking about 28 to 30 ft. Okay. Gotcha. All right. Thank you. Uh any other questions from the board? If not then um you good? No. Yeah. No. Yeah. Yes. Okay. No questions. All right. I'm going to make a motion for a type two action under seeker pursuant to NYCR section 617.5 of the environmental code. Second. All those in favor? Hi. Hi. Findings. All right. Um the request is not out of character. I got you. Okay. Um not out of character for the the neighborhood.
There is residential on one side, but uh it is an industrial area. Uh I mean we got waste management right down the road. There's uh the water authority is right there. Right. Yeah. there's now a milk plant, right? So, it's uh it's not out of character for the neighborhood. Um this won't be uh won't be a detriment to any of the nearby properties. Um the benefit is uh not not achievable by any other method due to uh the need for the parking spaces uh the size of the building uh and the the size of the the lot itself really doesn't provide the the adequate uh space for the buffer uh zone itself.
Uh it's not a substantial request again because of all the industrial buildings around it. uh there's no adverse effect to the environmental uh around uh around the area itself. Um difficulty self-created uh at the end because the applicant wants the uh the building there. Um but again there is no other way to to really achieve the parking requirements, the size of the building uh for the company for his company. Um that any other findings anybody else wants to add? the the buffer, it's to the parking area. It's not to the building. So, it's not like the building is going to be closer to the lot line than than allowed.
It's just a parking area. It's just above building 103 ft away from the Yep. And you've got planting shown on the preliminary site plan. So, I'm assuming that you're going to do some juzing just to make it make it attractive to the neighbors across the street. Absolutely. All right. Uh, with that, um, do you want me to make a motion or do you want to? Yeah, you got it. All right. I would like to make a motion to grant an area variance at 633 Basket Road to allow an east side, which is the front buffer area of 26.6 6 feet or 50 ft is required. A south side buffer area of 13.2 feet where 20 ft is required.
A north side buffer area of 19.2 feet where 20 ft is required. And a west rear buffer area of 24.1 ft where 25 ft is required on a 1.5 acre parcel with SPL number 066.03-1-9.11 located and industrial district second. Mrs. Fa I Mr. Senola hi Mr. Mscar hi Mr. Prescott hi Mr. Short hi you have your varants uh you have one year to complete uh you're going to need building permits and if you go and do a doggy gate daycare you're going to need a planning board and other approvals as well. So thank you. Thank you. Thank you. Next up, uh, conver commercial vehicle parking located at 741 Haley Drive. Bridget Fitzgerald, um, zoning, zoning district R3, single family residential district.
Uh, the request is to allow parking of a 20 foot commercial food truck on a crushed stone pad in the backyard. Sections of code that are relevant to this is 350-12 which is R3 single family residential 350-44D which states commercial vehicle which is not a semi-tractor semi-tractor trailer semi-trail or construction vehicle having an overall length of 21 ft or less may be parked outside of private property in residential district subject to the following conditions which brings us to 350-44D2 such vehicle shall only be parked on the driveway or in the garage. Hi, I'm Bridget Fitzgerald at 741 Haley Drive.
Um I am asking to park our small food truck of 20 feet by 10 foot tall in our back yard um area due to the um unique structure of our land. Um it would be visible to one lot which is lot 51 on the map. Um and but there is wooded area and 40 ft plus um well 40T to their lot line um of wooded area. There is some trees like some foliage that's missing um from that area. Um, we have parked it there for the past three years and no one's seen it. Um, we didn't know we were doing anything wrong. We had a crusher pad, stone pad poured to park the vehicle. Um, and then last year we got a complaint because um, I was pregnant.
We didn't get it into storage. Um, we got it into storage a month later than we usually do. So, we're just asking to park it there during foliage season of um from end of May to um end of September if possible rather than using the front drive driveway um because that's where my husband uses. He unloads and loads um our brick andmortar um products in from our garage into his vehicle. So um and we are trying to um make everyone happy. We don't want problems in the neighborhood. We are friends with with most of the neighborhood and nobody really has a problem. Um but besides the one lot I think that can see it probably has a problem.
So, we were thinking we can put um a camo netting. I think a lot of the neighbors kind of requested that we put a camo netting like as a a solution um to those neighbors. Maybe that would like match the foliage. Um we did look into planting trees, which was really not cost-effective for us. Um and we looked into fencing, which my husband really doesn't want to do. Um, but we're willing to and open to any ideas. Questions from the group. You said you park you want to from May till September and then after that goes into a storage. Yes. Which is an hour away. So, so it's only a few months out of the year that you're looking to do it for more of a convenience factor.
Correct. Never mind. Is that your shed right next to it, I'm assuming? Yes. Yeah. Other questions from the board. Okay. You said your husband doesn't want to do a fence. Why not? Um I think you already from what I see is behind the you already have a fence. Yes. Um on I guess the fence on the other side to block it just for the neighbors convenience. I guess he doesn't want to spend all that to do that as well as it's only would be six feet and the truck's 10 foot and he's like it's going to be a sail in the wind and just I don't know. So that's like why he wouldn't want to do that. But then on the other hand like if we do park it in the front, this is off topic.
If we park it in the front it's visible to the entire culde-sac rather than one neighbor when we can try and appease them. Have you had conversations with that neighbor to find a solution? I wasn't sure that it was them that even Fair enough. Um, complained. So, no. Did we received a couple of letters from neighbors? Were those provided to the applicant? No, I don't believe they were. Okay. Other questions from the board? Are you going to extend the driveway all the way back like or gravel straight back or are you going to drive over the grass like it looks like you kind of currently do to get back there?
Yes. Yeah, we have um like we just drive over the grass. Okay. So, you leave it existing like it is basically. Yes. So, that's the where the crusher stone pad is is right next to the shed. Okay. Does it do you take it out on a daily basis or No, just for events. Um usually weekends. It's never running in the driveway. It just has freezer. So, we keep it plugged in and the shed um has electric to or actually the pool pump has electric to do that with. My my concern when I visited the property was that it was a refrigeration type of truck, so it was plugged in. You were going to hear the droning of the compressor going all the time.
Um when I visited the property, the truck is plugged in. It's silent. Um, but you hear the pool pumps from all of the pools in the neighborhood that So, there's the droning noise that you got. Um, the we we did receive letters from three neighbors. Um, one of the neighbors is is the neighbor, I guess, on the other side of the woods who's really the only one that's going to see it. um the other two letters from standing in the backyard at any place I can't see their yards. So if I can't see their yards, they're not going to see it. Um but I do understand that from the one neighbor it is it is going to be visible.
Um and because it's a commercial vehicle, the code dictates that it should be in the driveway. Um, I also pulled up the code for outside parking of recreational vehicles, um, which are allowed to be significantly larger than this. Um, they can be up to 40 feet in length and 13 feet tall and side of the side of the house, right? They would be allowed behind the house, next to the house, or in front of the house as long as they're 20 ft from the road, which So you could park a much larger vehicle there if it weren't a commercial vehicle. A commercial vehicle for a business. Would it help if our address was our business?
That's our permanent business address. No. Okay. No. because you're in a uh you're in a residential neighborhood. Got it. Doesn't Yeah, that won't change anything. Other questions from the board? It's fairly wooded. I mean, during the season, I could see where you probably have to squint to see the truck and since it's not going to be in the fall, but would you consider adding landscape some additional plan material um to help screen it to kind of plate some of your neighbors. So, we did look into that. We had um two estimates done and they were for green giants and to to hide it. And we also did just regular pines um and they were well over three grand.
So, we were trying to think of the most cost-effective way because we want this food truck to make us money. Well, and the the green giants do grow fairly fast and the deer don't eat them. Um, I don't know of the two companies that you contacted, I don't know if you wouldn't consider planting them yourselves or um what size trees they were putting in. Yep. They were going to be um five foot trees and then they said they would grow about 2 feet a year. Um Correct. But you could probably once again even even you planted five footers, it's going to be a while before they actually not only grow to height, right?
But grow to a width that actually physically screens it. It's the attempt that's there. So it's not And it would it would break up it would break up the wall. Well, I just it it's not an immediate effect, right? You could plant 10footers the same height as a truck and they're not going to be six feet wide. Yeah. You said you explored fencing but it wasn't cost effective. Was it just a 20ft section or did you look at actually like a whole row? Like how big was the fence that you guys? We didn't look into getting a fence at all. We were looking into planting trees more so. My husband didn't want to do the fence.
The only reason I asked on that one side, which if you're looking at the vehicle will be to the left, you know, from your driveway. If you put a few 4x4 posts into the ground and then, you know, you separated them 5 ft apart to go 20 l feet and then just ran one by sixes or, you know, on it and just tacked them up with the space. You could almost create your own privacy fence probably for very minimal money like vinyl or um at that point you could use you know pressure see pressure treat it and paint it but you would secure the 4x4 posts and I'll say like 16 feet you know go four feet into the ground.
Now you've got a 12 your 12 foot high and if you separate them every five feet and you could run your one by sixes going down the length 20 feet and it's really open to the front and the back. You're just using it to to block that in. It's very I' I've done it, you know, stuff to block out at my rentals. It's very cost effective and easy to do. Okay. I don't know if that's something that they would, you know, say, "Okay, based on that, it really it hides it at that point and really answers all the questions of visibility, you know, and heightwise it, you know, you don't have to wait for anything to grow it.
If down the road you got rid of that to pull the post out of the ground is easy, right? Just cement it into the ground. And would that like heightwise be like six feet or um I think you can order them. I would probably that you got to go before below the frost line and everything. So, I mean, if you grab 12 16 foot 4x4 posts, you're accomplishing, you know, at the end, you're at least going to be 10 foot high. You put and that won't be like a sail in the wind. You want zero, five, you put it in four feet in the ground, it won't be a tip. You buy five, 4x4, 6x6 posts, and you would go from 0 to 20 ft.
Okay. you plus where you're placing it. It I'm assuming you'd be placing it in the trees. So I mean it's not out in the open. It's not out in the field. Um other well even if you were to consider that it needs to be about minimum 10 if not 12 feet tall to do that 16 four feet in the ground just about 12 feet above ground. No I understand math. Just a matter of it would look nice. That's a structure at that point in time. Not permanent. Well, it's just a 20 foot for the town. You can take it down. Let me That's really I mean these there's probably a number of Yeah, let me um really decision. I'm going to see uh if there's anybody from the public that wants to speak for or against the uh project, please come on up.
Come on up. Nice to meet you. Nice to meet you, too. So, I'm Please state your name, address, and uh Got it. Yep. I'm Tom Punka. I live at 745 Halley Drive. I live on the northeast side of the property that's asking for a variance, which I'm adamantly opposed to. This When I sit at my kitchen table, okay, or my family room, I look out the patio room door. I see a nice stone patio. I see a flower garden. I see a nice lawn, a couple trees, and I have a pink commercial food truck as my backdrop. It has advertising on it, phone number, QR code. It's not the look that I was going for when I built in Lake Breeze Estates 26 years ago.
I chose a residential lot so I could enjoy the tranquility of a nice backyard. I didn't choose to go uh to a strip mall next to a restaurant next to a billboard next to a parking lot or a commercial lot. I chose a residential lot. It's I'm quite shocked at some of the comments that were made here, but uh um you know, we have kids in the backyard. That commercial truck is driven into the backyard, has a hot undercarriage. Kids kick balls, they hit balls, they chase balls. If a little kid had their ball in that area and they tried to get that, they could end up scraping themselves, burning themselves, let alone burning natural vegetation, pine trees, pine needles, blowing leaves.
It's uh it's a residence. It's not a commercial lot, you know. Then then having a food truck that brings a different aspect. Okay, we got food scraps. I've been in some of the nicest restaurants um and I've seen what goes on. There's uh you know, are we going to have an increased rodent problem, mice, uh rats? I've been complaining about this for three years, two and a half years actually. And uh finally you got a new code enforcement officer that finally handd delivered the the request. So um thank you for getting that new code enforcement officer. I'm a licensed professional engineer. I deal with codes all the time with my business and codes the main purpose of them are for the health, the safety and the general welfare of the community.
I don't see where having a commercial food truck in a residential lot is going to meet those standards. And fortunately, the town of Webster put together a code book that includes 350-44 that that doesn't allow this. And as far as 16 foot poles in the ground. Um, so let let me ask you this, right? Because the code does allow a commercial truck or commercial vehicle on the property, right? So they can have the vehicle in their driveway. Um, so that that is allowed. Absolutely. So let me ask is is there something that would that I mean right now it's affecting one person. That person is you, right?
I mean at the end of the day it's not affecting 737, 743, uh, 735 or at least they haven't voiced their opinion. So, I guess my my question, we can we can by all means say no and it'll most likely be parked in the driveway. Um, which it would then be affecting more people. It won't affect you because you won't be able to see the driveway. That's not true. Is is there is there an opportunity for some level of screening or is there something and that's that's why I asked earlier if if the applicant had a conversation with with the neighbors um which here's the discussion is there is there something that would be um amanable uh to you for for that right is my question so I was going to finish my convers ation or my my facts here.
You uh you know, having this commercial food truck is it's certainly going to devalue my property and potentially my neighbor's property. The the owner has options. They can park it in their garage modifications. They can park it in their driveway or they can park it off site. This is a residential neighborhood. And you know, I I trust that the zoning board is going to uphold the codes that the town of Webster put in place. Excuse me, sir. As far as your your five minutes are up. So, I mean, at this point, okay, know how it values your property. Well, and everybody else. I'm in real estate. So, I just want to know how it values your property.
Okay. So, I'm in a residential area. Yep. I'm not next to a commercial lot. A residential area has a different value than a commercial lot. And if I have to have a pink food truck with advertisement on it, I you know, you were the gentleman that asked um you suggested 16 foot poles. Now, if I'm not mistaken, you're only allowed a 4ft fence and maybe you could get a variance for a six-ft fence, but 20 foot poles. No, six foot. First of all, 4 foot of it would go on the ground. So, you'd be left with a 12t high fence. So, so I can put up a 12oot fence. If you come here and ask permission to do so, absolutely.
And with the right reasoning, you could be granted to do that. But you still haven't answered my question. How does it devalue your property? She's not running the business out of there. She doesn't have customers coming to the home. She's storing her vehicle there to then take her business out of Webster. So, how does it devalue your property? Because we've got a pink food truck in our backyard that's visible from So, if your neighbor buys a purple car and parks it in the driveway, does that devalue your property? That's ugly. Not at all. Because a purple a purple car is about four foot maybe five foot high.
I don't have a 10 foot or pink camper. What about camper foot RV? Pink. An RV. An RV is usually tan or brown usually. But it's a twice the size. What if she decided to get a pink one? I'm just trying to figure out what it is because you already admit that she could park it in her driveway. Yes. Because that's what her code says, right? But but and you would have no problem with that then? I don't have a problem with that. She has she can she can do what the So it's still deval your property then parked in the backyard or parked in the driveway. It's just parked. It's in a driveway. It's not in a it's not in a residential uh backyard.
How does that change the driveway to the backyard? The resident doesn't it doesn't change. Kids play in the backyard. that that development has houses. I've sold enough over there. I'm well aware. And they're going quite high over there. So, doesn't seem to bother people to spend $750,000. We We don't use our back patio anymore. The past three years, we haven't even put out our table and chairs and our umbrella. So, because your kids and your kids are You have a sit up there. I'm going to go back to my my previous question. Is there something that could be done if a barrier of sorts was put up to block the view of that vehicle?
Right. Because as of right now, what I'm hearing is that the you're not using your backyard because there's a pink vehicle in your backyard. Um, at the end of the day, that that's that's pretty much it. It's a visual eyesore. I'm going to just use that word. Right. Didn't you hear my other points about the health and safety aspect? I don't see a health and safety issue. Safety issue. No. So having a commercial food, she's not running it. She's not She's customers coming to the home. You have food in your fridge. I mean, she's not running. You have just as many issues as the food in your fridge that she does.
So are you bringing mice and rats to the neighborhood? They're in my house. My My fridge is in my house. So, it's not I don't know. I'm I'm getting a a a very odd response that that the zoning board is willing to change the code that the town of Webster has put in place. No, she's asking for relief from a specific But this is a selfcreated problem. That's self-created, right? It's it's a business being run out of self-created. you always have the option of moving or doing or doing something. So there's very few applications that I've seen where you can fall back on itself creating. So aside from that, in all theory, if you were to park it in her driveway, you still would not be able to use your back patio because it affects you so negatively.
No. You said you could see her driveway. I can if if I go upstairs, I can see her driveway. So will you stop using your upstairs? Yeah. Yeah. Not going to go cuz I don't look out my windows usually up from the upstairs. Okay. Then how do you know you can see her? I mean she can't see the pink food truck from her backyard or Well, it's behind you. Well, I'm trying to make you happy. I'm not trying Well, you should have talked to me. You should have talked to me. How did I know it was you? Uh because I I wrote Okay. I would like to just guys if we let's thank you for voicing your concerns. The five minutes has elapsed.
So let's bring it back to the board to discuss any further questions that you have and we'll bring the applicant back to the podium and we will continue forward with the various process. with all that we've just heard uh additional discussion to from the board. I they seem to the applicant seem to have already looked at options to help screen it and none of them are acceptable to her as of prior to this evening. Maybe with this additional information, some of those options may be more palatable to her at this point in time because information she didn't have before. So, I don't know if that makes a difference any other board members, but yeah, it does to me because her husband already nixed even looking at a fence and we talked about a fence or a fence wall, something like that.
So, her husband already nicked that idea without even exploring it. So, they didn't really explore all options to No, and I don't disagree with you. I'm just saying she now has information that in theory the way she presented tonight didn't have prior to coming tonight tonight tonight's meeting. So maybe she wants to they want to explore other options. Maybe they don't. I don't know. This is the board discussion. We can directly ask her. I'm just trying to find a way where if it can be palatable to them or not. If not, you know, I'm ready to to vote if it if it comes up. I I feel for the um the the neighbor.
I mean, I get it, right? Having a um a brightly colored vehicle. It looks like purple, whether it's purple or pink, doesn't matter. Uh in the backyard, I I do get that. Um I think there we should be able to find a a solution. Um I guess is really what it comes down to. Uh to be able to park it um further back. uh than it than it is. Um I don't know. Trying to think where uh ma'am, you had mentioned that your I know you guys looked at using um you your husband nicks the fence uh without exploring it, but it sounded like uh you were also amanable to fencing is what what I had heard. I don't know.
Is that true? Yes. Okay. Uh, is there a reason the uh the commercial vehicle is parked next to the I believe that's a pole shed if I remember correctly. Is it is is there a reason it's parked back there versus next to the garage? Yes, because there's a crusher stone pad that is poured there and the shed has electric so we can plug it in. Um, and I guess so it's it's just it's it's not convenient for us to park it in the front driveway. I'm not talking about the front. I mean, regardless whether it's whether it's next to the garage, I mean, the front driveway, you wouldn't need to you wouldn't need to be here if it was parked in the front driveway because it's allowed by code.
Uh, if it was parked next to the the garage, um, you would still need to be here. We'd still have to have these conversations, but it would be further forward. Um, you know, that would that would honestly probably affect lot 52 more than lot 51. Um, but all the same, right? I mean, 52 and 51 would still be able to see the vehicle. May I ask about the um camo netting again? If it's the pink color that's the problem, we can put that over it every time. My fear with with camo netting is that it it's not um it's not a permanent solution. It um it does get damaged. Uh you mentioned a wind sail. I mean if wind does pick up and that's not tied down that will blow.
Um I mean I I've had tarps covering stuff in my backyard and we get some pretty pretty uh rough winds and my tarps are gone. Right. So, and more importantly, camo netting isn't going to be use as useful for the distances between you and your neighbors. It's better for aerial reconnaissance and stuff further away. It's meant to basically just throw off your your eyesight with the color of the uh truck underneath it. I don't believe the camo matting, unless it's solid and then it's a tarp is going to make any of difference to be honest with you. I don't think it's going to achieve what you want it to.
I understand the intent, but I don't think that's going to to hide it enough where your neighbors are suddenly going to say, "Hey, where'd the truck go?" Honestly, your best solution is to put up a 10-ft wall, fence, whatever you want to call it, uh, come for a variance for that to be able to hide that. Actually, they wouldn't need a variance for 10 foot. Yep. Anything Anything 8 foot or higher has to be at least 15. Okay. So, you you could do that without a variance. You'd still need the variance for the truck, but you wouldn't need uh as long as you're 15t off the property line, and the truck is 40t from that one.
Yeah. So, so I could put the fence up and park the truck there. You could park the feds up without a variance, but you would still need a variance to park the truck in this location. Hey, here's a question. Excuse me, miss. You said your storage place is an hour away, right? Yes. Did you ever explore moving your storage place closer? No, it's a big pole barn that my dad owns. Okay. So, from a financial standpoint, so from a financial standpoint is the reason you choose. Okay. That's that was just Great. Yeah. I know where Lockwood is leaving and there's going to be space opening. So, that's I just happen to know, right?
Yep. Okay. So, with the with that fence, Cross Town owns a couple of lots right next to my house and they last year in the fall came in to kind of do some separation. They built a burm and they dropped a 12ft stockade fence in really nice looking. Put a nice uh tree. Put another piece of stockade fence and and another little like bush tree and it looks beautiful. You know, it was nice separation. It gave them the height to built it up a little bit uh with the fence. So, I'm going to guess they if I were to look there's your you know that 10 foot and it does it looks really really nice that separation between my lot and their lot.
I actually thank the guys because you know I didn't pay for it. So, it looked nice. If you're looking at that fence, you know, in in that realm, that's, you know, another thing to explore is building that burm, dropping the post into the burm, stockade fence, some type of bush tree, another piece of stockade, because it it's nice to look at. It's not something that was just slapped up. Um, I don't know if that suffices. If you know the look, the problem is is obviously getting rid of. So, if they look out the back, they don't see that, right? the truck. So, it seems to be that's what we're trying to come to a conclusion with and a common agreement is if we can block the the look, does that work?
Right. So, other comments, questions, discussions? No, we want to give her an option to come back. could look at that if there or couple options at least if she wants to look at it. Otherwise, we can vote. I I I think it might be in their best interest if they try and resolve the major issue against it. Now, if they're not they don't want to or they can't for whatever reason, then we can vote. But someone we could ask her. I don't know. I mean, are are you interested in looking at potential options to to screen it or if you've already, as you know, you said your husband nicks the fence and the tree or the trees shrubs or arborites were were too expensive.
I can guarantee you the 12oot fence is not going to be inexpensive. Okay? So, it's one of those things where if you want to go back and discuss it to see if it's worth cost of of potentially screening it versus just finding a different solution uh potentially offsite or in your driveway or in your drive. If it's in your driveway, you're done. There's there's nothing else you need to do. But if you want it in your backyard, it's going to need to be screened and and screened is is covered. So either or blocked either fence or plantings a wall. Oops. Sorry. Um, not covering it with a net, but actually a physical physical a physical barrier so that the neighbors do not see if I were to agree to that today.
Is that something that would be granted or is that something that I would need to revisit? I have no problem if she agreed to that today personally. It solves the problem. Yeah. Well, and typically what we do is we condition it that within so many months the fence has to be up or the plantings or actually I'd like Adam's suggestion of a section of fence and now you're getting can you pull up the uh images again please for that you need drawings for that you're going to offset and put my only comment is right I mean that's a that's a really nice 24 inch diameter tree right next to so it's got to be the fence has to be inside of that or sorry outside of that if you move it closer to the property line, it will screen more.
Yes. The further away from the truck it is, the more the truck it'll scream. Yep. So, and I also would say you'd want to do it based and I wasn't looking for fence location, but there's an opportunity just beyond those clump of mature trees where it's a little more open where digging the foundations. If you were to go miss the roots, you're going to run into a lot of stuff. That's why I'm saying I want to make you think that if you say, "Oh, yeah. Fence, it's not going to be inexpensive." Okay, I'll do it for you. Well, yeah, you're definitely going to need Thank you. opposed hole digger that's more than just you're going to get a bobcat with a piece auger on it.
Or again, too, I think that's why Cross Town built the BMS because we're surrounded. It used to be a Christmas tree farm right road. They built up a five foot BM. they had five feet to already go into. So, it it solved a lot of problems. And what we're referring to is the roots hitting roots and rocks and everything that were in the ground. It's almost like they created the ground to skip all of that. And we're not saying this to scare you off. We're just letting you know what we think are potential um issues if you were to go or if you were to agree to that that you're going to have to something to It is the board's decision whether to condition the approval or to table this application.
If the applicant would like to discuss the financial options of fencing, then it would be recommended to table this evening to not provide extra. Yeah. So, let them get I would be willing for a fence. I'm sorry. Say that again. Yes, I would be willing to make a fence. Okay. So, with that, um, I would propose that we vote. I think you're Sorry. One thing you need to hit, if you're going to make a motion, there's going to be approval. Obviously, the fence has to be specific. But until that fence goes up, that truck's got to be put in the driveway or some place else. So, it's all contingent upon completion of the fence.
And I would have the code enforcement go off go out approve it and then advise the town so she can return if if the board approves it and return. Do you understand that? Yes. So until you know if if we vote and if we approve it um it we will be conditioning it uh with a fence. Uh the truck will not be able to be parked there until that fence respectfully so installed. So Pinterest is a wonderful thing. Give you good ideas. If the truck is in the property, it has to be in the driveway. Correct. So you can't just move it up next to the house or the garage. It has to be physically in the driveway.
Yes. Until the fence is up. Yep. All right. Other questions, comments, anything else? Say you're able to run cords from pole shed extension cords up to for the time being. Yeah. So power-wise, that's why you're doing you have ample power back there that you're tapping into. All right. So I'd like to make a motion for a type two action under seeker pursuant to NYCRR section 617.5 of the environmental code. Second. All those in favor? I find So sir, the the the public commentary part is over at this point. Um so it would be it would be out of order. If the chair wants to give you an opportunity, it's something that's going to add to their decision.
Uh you have to want to give the gentleman an opportunity to respond to anything. Sure. I don't know whether they close it or not, but it could be reopen. I'll uh I'll reopen it. You got footst. When you say plastic, I mean a vinyl fence is You're opposed to a vinyl fence. Okay. I would tell her to drive by to get an idea of what that looks like with the burm and the fence and the arborites and plants. Let me ask you this. And again, we're trying to find a compromise. If a 10-ft fence was put up, now we're talking, you said natural, right? So, I'm gonna I'm gonna sit here and say a pressuret treated 10- foot fence, right?
I mean, that that's wood. That's as natural as we're going to get. Um, with plantings that go in front of it, would that be acceptable? And I'm whether whether there's a burm or not, I I mean, from my perspective, it's being blocked. So, I guess we I wanna I want to understand, you know, the fence going up will end up uh avoiding any balls being kicked onto uh the applicant's property and going underneath the truck. Um it will block a view block the view to the vehicle. Um there's vegetation. I mean, I'm looking at this. there's a a 20 to 30 foot of um mixed, you know, mixed mature and sapling trees that are there.
Uh so planting arbor vites in that area, they're not going to grow. They're going to die because there's there's no uh sunlight that's within that area. Are there other types of vegetation that could grow in there? There is. I'm not I'm sure there is. I'm not a a landscape architect, but I'm sure there is. Um, so my question is, if there was a 10-ft fence that went up, would that be acceptable? Okay. Then you you wouldn't say it then, right? You wouldn't say it. Purple trunk or fence. Well, okay. I would like to bring it back to the board. To the board. So, we're not having an an argument. We're asking questions and responding with answers.
So, if there are no further questions, then we need to continue forward, please. So, I'm going to ask one follow-up question. Um, my question was if it was a fence and and your comment to me was if it was just a fence, the answer would be no. So, if it was a fence and vegetation, just a fence and vegetation, I'm I'm getting a head nod. So, that sounds like it. That's a yes. I'm trying to be realistic. I don't know what will grow in that area. As I look at the photo that's up on the screen, there's saplings, but nothing else is growing in that area. on that side that would be between you and and uh and the fence itself.
There might be stuff that grows. So if the applicant attempts to grow, let let's use our raid as an example and they die. Now you have a fence and that's so I'm getting back to I'm not saying I'm not saying we don't put that stipulation on that additional vegetation gets planted. You're planting in a dense, you know, small wooded area, the likelihood of anything growing in that area is is limited. So if there if it if she attempts it, the the vegetation dies, you end up with a 10- foot fence, which is, you know, the shed is, I don't know, an eight foot or a 9 foot shed. If the vehicle is not parked there, you you now still have a wall, right?
I mean, it's it's still it's the same length. It's the same component. So from a compromise standpoint, if we were to ask for a 10-ft fence with vegetation, would that be acceptable? You say 10 foot high or 10 foot high. 10 foot high fence. 20 feet long, give or take. 20 25. Yeah. 20t long to block the block the vehicle. Correct. Yep. Okay. All right. I guess if he's going to Yeah. If you're going to start citing the codes, I'm going to need you to speak into the mic. So, come on up. The town of Webster has has a code 350-44 which is for commercial vehicles and there's a code 350-45 which is for recreational vehicles.
Why are there why is there a distinction and uh because one of them is for a business purpose which excludes it from the recreational definition. So, and that's my point, uh, Mr. Demarco, is that is this is a commercial, this is a commercial business. This is a commercial food truck. It has their commercial advertisement on it. So, there's a distinction there. And the and you know, they give them options. You can park it in the garage, you can park it in the driveway, you can park it off site. I'm sorry. And I forgot your name. Tom Pyunka. Last name. Pyunka. Pyunka. Pyunka. So, we reopened the hearing because of the point that you were making about the screening and now we're going back to the beginning.
So, we're not going to rehash this all over again. Okay. Well, I I I understand the question. Uh, I guess the board can choose to respond to it or not, but we open the public hearing back just for that one issue, which you apparently are okay with it back there as long as the burm and the fencing is is within the criteria you're describing. Yeah, I'm Let's work with that and see see where we end up. One other question is is my letter part of the public document? The letter was received. We will make sure that it's part of the public record. Okay. Thank you. You're welcome. Thank you. All right.
Um, I did seek her. Yes. Okay. I I do we I don't know. I I guess if if it were to stay there, I would be in favor of plantings or a fence. that I don't know if we can demand well we can demand whatever we want but if it were a shed wall it would be a brown well there is a shed there a shed wall brown I don't I'm trying to balance I'm trying to balance it' be easier for her to come back with options and say I have this option of sections I have this option of solid we got to the point now we're like all going different I Yeah, I I think that would be better is to see what the proposal is. She might come back with something that none of us are even.
It might work, but it's nothing that we've discussed here. Her husband might come up with something since he's not here. You know, he might have an idea that we didn't think of. And from the town's perspective, we would like to have it a little bit more locked down on exactly what the end treatment is. You know, BMS and things like that because requires a fill permit. And then I've got drainage implications. Yes. Exactly. But we were on track for just a fence and now it's being a fence and bushes. Well, I guess really what it is is some kind of wall. It seems to be it's going to be a fence. It could be planting of arborites.
I I I guess that's where we're looking for you to come back and say here's how I'm going to create this 10t high by 20 foot long. I would do a 10 foot high by 20 foot long. And that's as far as I would go to please them. I wouldn't want to do anything more than that or I wouldn't want to do anything less. So that's as far as I would go on that topic. And I think that once that's there, it would probably be easier understanding what we're looking at. I think it would need to be longer than 20 feet just to block any of the rear uh and front portion. 22 maybe 25 24 25 no more than 25 at that 24 even fence section.
That's true. 12 foot sections. Yep. And if you separated them two feet, put something in between them. Now you misfit. Yes. You recognize what the board is trying to accomplish. Okay. So when when you say, "I'm not going to do anything more to please them." Maybe not. Maybe you meant me it differently than I interpreted. Yes. Okay, they they're objecting to it on that basis alone. Given the variance, the board might decide, you know what, they're not on board. They're not on board. So, so try to strive to balance it, right? The economics of the cost. Of course, I was talking. Let me finish. Okay.
And I'm assuming you have a pretty good idea of what they're looking for, whether you find it to be reasonable or unreasonable. Right. Right. Try to come back with a detailed plan that you believe not that it should satisfy your neighbors, but that it's likely to based upon what they've said. That's going to make the board's job a lot easier. Okay? Because in the end, they're your next door neighbors and they got pretty heavy weight on this board in terms of what they're going to be looking at. It's not just, you know, priority 10 with one being the most important. It's it's significant. So, so you might even consider running it by them getting their blessing.
Do you understand? You know what they say on the street? Do you feel me? Yes, I understand. Okay. So, I'm going to recommend that we table this until um July 8th if uh four weeks is enough time for you to uh pull together a plan of what you would propose to help screen the um uh the food truck. Uh the comments that I have had heard from um you know the public session is that a uh a 10-foot fence with some level of ve vegetation in front of it would be acceptable. Um please take that into consideration. Um and with that I I make a motion to table um is it 741 Halealley Drive? um commercial vehicle parking uh until July 8th.
Second. All those in favor? I I. So, we will see you uh July 8th. Okay. Thank you. In all honesty though, Pinterest is a wonderful thing for those ideas. I use it all the time for my rental. I will use it. What is the address that you're recommending? So, you're talking about me? Yeah. I'm sorry. So, if you drive down Vosberg Road there, um Vosber and Adams right at the corner. Cross Town has a lot right on the corner. Um, actually, is there a way you could pull up five that area on the map really quick? What's the address? Just put You can put mine in 530 Vosber. Okay. So, to the right 453, that lot right there next to Feeasant Run, Cross Town owns that.
So between I'm 530. So you'd see my above ground pool right there. Literally separating the two. They just put up that burm and they have three 12-oot sections of stockade as well as arborite. So it it just it's an idea. Again, it looks very nice. Okay. Um even if you got something off of that and changed it around, it's something to really go on. And truthfully, again, the reason why I say Pinterest and something like that too is if you bring it to them and show them this is what I'm looking at putting up there. Okay, it might work all the way around in a month, right? And visually, everybody's a visual learner.
It makes a lot more sense when they're looking at something versus telling them this is what's going on. All right. Thank you. Yep. Thank you. Thank you. Um, with that, um, make a motion to to, um, do not have minutes. Yeah, there's no minutes. So, make a motion to end, uh, today's board meeting. It's only meeting. Uh, this one here, do we need to indicate that it was table? I did. Oh, it's a because you made a seeker and then we started and Okay, thank you. Yeah, you got that right.
