impacts * The Zoning Board of Appeals granted all requested variances on September 12, 2023 «

The objective for this evening’s presentation is to provide a high-level summary of how the

Project has evolved since the June 6, 2023 meeting. So, as 1 mentioned, tonight’s presentation is

to provide a very high level of how it has evolved sine June. So, just to orientate everybody,

(NOW VIEWING PAGE 5 OF THE PRESENTATION) with the site, I am going to start at the

top. We started with 6’ landscaped berm depicted in green; the stormwater facilities; we have the

auto entrance; and then we have some decorative fence; we have the auto parking which is

employees only; and then we have decorative fencing for one of our neighbors and the parking

lot you can see around G, truck entrance, so that is coming off of Tebor Road for the milk

receiving trucks and then further down in the bottom left hand corner is the wastewater treatment

facility and we have another 6” landscaped berm running parallel with

104. On the other side of the top page is out finished goods and then the automated storage & retrieval

system and the proposed building in the center accommodates all that and again we have more 6°

landscape berm for our line of site for our neighbors and then we have extended the 6’ landscape

berm and the concrete fence on the top of it. As I said, we are going into a bit more detail around

the line of site.

Josh Hough

(GOING TO PAGE 6 OF PRESENTATION) Alright, so now that we have oriented

you to the site, we want to zoom out a little bit and talk about the utility infrastructures that are

going to be upgraded. Now, the first one is power and so RGE is upgrading their substations and

they are going to be changing out their transformers and then running new lines so you can see

the orange, that is the electrical coming east to west and the second thing is gas, and the gas is

shown here in the gray about a mile and half, 7,200 linear fect to the site to be able to provide.

The third thing is the sewer so we will have a wastewater pre-treated facility and it will discharge

into the public main and further in we will explain about the public main that runs through the

site and also the Town of Webster will be upgrading the sewer that is shown in green over on

Phillips and then the water is shown here in blue over on Tebor and it wil] go froma 8 inch toa

10 inch project so those are the four areas of infrastructure that will be upgraded as part of the

project. The other offset improvement will be roadway infrastructure (GOING TO PAGE 7) So,

the first improvement is the extension of Boulter Industrial Parkway to Salt Road, and it

currently ends at the baseball fields, and it will extend over to Salt Road and the intersection of

Mitcheldean Drive and that will be an improvement that the Town of Webster is going to be

making. As part of the Fairlife project, we will be doing a turn lane al Basket Road and 104,

there will be a right turn Jane to improve the traffic there. So, that is the off-site improvements

that will be part of the project for utility and roadway. (GOING TO PAGE 8)

So, now talking about mitigation, So, there are four things as far as mitigation for the neighbors.

One is visual, the next is lighting, then noise and berm/wall design. So first of all, ] just want to

talk a litle about the visual. The line of site, going east from the residential side of the property

and looking back (towards the facility, as Darren had said, we do have a berm and it is a 6 foot

berm that rons along the property and on top of that we will have a 14 foot concrete sound wall

and then in front of that we will have some landscaping and we do have another slide to go

Pg. 251 September 19, 2023 Planning Mecting (Special Mceting)

through that talks more about the landscaping and the trees that will actually be on both sides of

that wall. One thing that we wanted to point out in this view is the road way that runs

north/south along the residential side we intentionally looked at the light poles and we wanted to

make sure that those were low so, they are a 12 foot pole on a 4 foot base so there total height of

16 feet and another thing that you can see is that the ground we maintained the berm and came

up from existing but because the site going from drain from south to north we did have to drop

portions of the site so you will see as you actually come into the site and it will actually be

below the top of that wall as well. The other factor that goes into that, is that when we are

looking at truck movements, trucks are generally 13 % feet tall so with a 14-foot wall and a 6-

foot berm, it does hide the view of all the trucks on the site. (VIEWING PAGE 9) So as part of

the visual, we worked with the neighbors, and they were very gracious and allowed us to come

onto their property. We worked with them to get pictures from there homes and looking towards

the site. So, the one on the bottom, those are actual pictures with the building. It also includes our

wall and some of our landscaping and the actual picture was taken just about a month ago and we

also looked at the winter view so we wanted to see what it would look like when the leaves

dropped so this particular one is right here (SHOWING ON THE PRESENTATION), and this is

number one and looking towards the site you can see the silos there and you can see a little bit

better as you look at the winter condition. (VIEWING PAGE 10) and the next one is number

two, so here is the summer condition and then here is the winter condition. The silos over here

and then the ASRS which is the highest point of the building and then we have one more that we

wanted to show you (VIEWING PAGE 11) this is number 4 on the left this is the summer view,

and this is the winter view and once again you can sec the ASRS with a little bit of the wall back

here, but the ASRS is promptly what you can see.

(VIEWING PAGE 12) The next thing we did is mitigation with the acoustic analysis. What we

evaluated Is, we looked at what the ambient noise was al the site so we had sensors located in

four locations around this area just to see what the normal noise is at night and then from that we

analyzed once this facility is in operation the increase in noise and what would have to be done

lo make sure that we are not increasing the sound at the property line by more than five decibels

and that we keep the sound below the 50 d during the nighttime. So, based on that acoustical

analysis, we do have the 14 ft sound wall on top of the berm that runs along this north area along

the cast side and down to the corner down here. So, based on that acoustical analysis, that does

Jimit the noise impacts to the residents. One thing to point out to, as we start the project the

intention is to clear the site, We are going to do the clearing and grubbing and then we will start

the berm activities. That is one of the first things that we will start with and then the next thing

will do is start pulling in the sound wall. So, the intention is to get the sound wall in carly so as

we do construction, we are already mitigating the noise even at the beginning. (VIEWING

PAGE 13) The next thing we looked at as far as mitigation was for light, so we did a photometric

study and it is hard (o sec in this but if you wanted to zoom in, each one of these little dots is a

number so it is looking at the light spill from each of these light poles, so we analyzed at the

property line to make sure that there was zero spillage. So, all of the light poles within the

facility are 16- or 20-foot light pole on a 4 ft base but out at the auto entrance, because there are

residents that are just to the north at that auto entrance, and we want to be conscious of that and

Pg. 252 September 19, 2023 Planning Meeting (Special Mecting)

make sure that we are not adding a lot of extra light to their yards but also providing light for our

employees as they are coming in, We used 4-foot bollard lights that shine down so it will create a

safe passageway for the autos to come in but not create too much light for the residents that are

Just to the north of that. (WIEWING PAGE 14) and then the last mitigation aspect is traffic. So

,we did an analysis first looking at all the trucks that use the Boulter Industrial Park Way and all

came out of Salt and down to

104. This intersection at Salt and 104 it is faster moving and there

is on ramps and off ramps. Basket because there is not currently turn lanes, it just limits the

amount of traffic. So, we first looked at it as all the trucks would go to Salt, but we understood

that we can’t limit all the trucks. Truck drivers are going to go where they want to go so, we did

do an analysis at what happens if the trucks are coming west bound on 104 if they came down

basket and by doing the improvements by doing the industrial parkway in the turn lane, we were

able to keep the levels of service as they are currently and you will see here to the right, these are

the changes in AM and PM wait times in seconds. (VIEWING PAGE 15) So moving from

mitigation to more of a deep dive of the site there are a lot of things that we want to talk through

. We are going to go through Auto Entrance & Parking * Truck Entrance & Staging « Emergency

Access Points * Security & Fencing * Snowplow Storage & Operations Facility Signage (front,

truck, and auto entrances) » Utility Plan * Water * Fire Protection * Private Sewer * Public Sewer

* Natural Gas ¢ Electric * Wastewater Pre-treatment ¢ and the tanks that go along with that;

Wastewater Equalization Tanks * Stormwater * Erosion/Sediment Control Plan « Landscaping so

we have a bunch of slides to get through for you. Hopefully a lot of good information.

(VIEWING PAGE 16) So, first of all, I want to start off with the auto entrance, so this is on the

northside of the site, and we have a blow up over here that kind of shows the...to kind of let you

know where you are at, but this is the auto entrance off of Basket. So, there are some existing

facilities. There used to be a Penske facility and then the Rock Gym so we will still provide

access to those facilities and then you will come back, and we have our auto guard house here

and we have two lanes in and two lanes out and you will notice that we don’t have a sidewalk all

the way to Basket and currently on Basket there is not a sidewalk or bike lanes or any type of

pedestrian Jane traffic. It is really not set up for that, bul we do understand that there might be

pedestrians that get dropped off or need to walk in, so we do have a sidewalk that goes from the

auto guard house, and it is ADA accessible. It goes from the guard house all the way back to the

office entrance and then for the employecs that are driving in there will be drop arms and gates

and there will be a guard there. There will be 24-hour security and as those vehicles come in,

they will come down this drive and we have multiple types of fence that we will go through Jater,

but the idea is to create a farm type atmosphere. So, you will sec that there is a fence that is along

the drive that is 4 ft and what we call a farm fence it is the double rail and will show a little more

about that, but il just creates the ambiance that we want for the facility.

Just south of the guard house you will see that we that we do have the storm water pond and we

will talk a little bit more about those as we get further in. Now, coming down into the auto

parking lot, 1 do want to highlight that we have landscaped parking lot islands and there are trees

in those, and we will talk a little bit more about those as we get into landscaping. You will notice

these kind of more bold shapes and I do want to highlight those; those are the dry swales so that

Pg. 253 September 19, 2023 Planning Meeting (Special Meeting)

is part of our two-part stormwater treatment system. When you look at it, it just looks like a

grass swale so this kind of highlights it because it is just the way that it comes out in the

drawings, but it is just a grass swale that you would see when you are going into the facility. We

will talk a little bit more about fencing as we get further in, but I just want to highlight that there

are some changes in the fence. So, we do have the decorative fence this is the metal picket that

comes down to the auto parking lot. Based on some of the conversations with the residents, or

actually one of the business owners right here, Jerry Kebler, he did request that we put in a fence

thal is a solid fence instead of the decorative metal fence so that is why you see a change going

from decorative metal to a horizontal wood fence that goes across this whole parking lot. That

creates a solid barrier so that our employees looking back towards his facility would see the

fence and not into his property.

A couple of other things to point out, we do have employee areas so there is an outside eating

area just here of the northside of the auto parking lot. Coming down we have all of our ADA

parking, just north of the entrance along with a drop off area and then ADA parking on the

southside. So, J put a lot of information out to you before I move to the truck entrance, any

questions on that at all?

Anthony Casciani

No. So, far it looks like you guys have covered everything.

Josh Hough

Alright, excellent. That is our intent to answer most of your questions with this

presentation. So, one of the questions that we get a lot is whal happens when a full side uck

accidentally come to the auto entrance and unfortunately, we had a video, but it is not playing

but we have accounted for that. So, if a what’s called a WB67, so your standard tractor trailer

does show up at the auto entrance we have created enough turn radius for that truck to come in

and when he sees that he is al the wrong entrance he has the ability to maneuver back out and go

back out to Basket into the truck entrance. | did want to point out, we did put large rocks so if

you got to the site now, there are already large boulders out there that are kind of protecting and

providing security. We are going to maintain those because truck drivers kind of go wherever

they want unless you put in rocks or something that will physically stop them. So, we have

placed those boulders around the truck turnaround.

I apologize that the video is not working but if you wanted to see we can show you that at a Jater

lume. (VIEWING PAGE 18) Moving down the truck entrance so all of our truck traffic is

intended to come off of Tebor so they will come in and they will turn to the south and in this area

right here, we have [5 spaces so the goal is that there are no trucks stages on Tebor and we have

looked at how many trucks are coming in the facility per house and we based that on how many

trucks can we process through and we have 15 staging positions here and two more at the guard

house. We have a total of 17 staging positions for trucks or tankers to wait until they go into the

facility.

Anthony Casciani

How fong does it take to empty out the trucks approximate?

Pg. 254 September 19, 2023 Planning Meeting (Special Mecting)

Josh Hough

45 minutes ,

Anthony Casciani

If you have a dozen trucks there...

Darren Ward

So that is just to get to the guard house and once you pass the guard house then

you drive up to milk receiving so there is space for many, many, more trucks once you go past

the guard house and then we have 9 milk receiving bays inside so we can process nine trucks

simultaneously.

Josh Hough

That 17 is just before the guard house. After the guard house there is a large amount

of storage thal we can have within the site, but we want to make sure that there is not any staging

oul there on Tebor and that is why we have that large amount before the guard house.

Anthony Casciani

Thank you.

Josh Hough

So, after the staging we do have the guard house here and they will come down to

the south and go past the wastewater pre-treatment facility and come over to the truck scale, so

they do go into the building for the truck scale operation. One they are tested and scaled then

they will come up and go through the milt receiving which is up here and as Darren said, there

are 9 bays currently. Once they are done there, they will put out of the milk receiving and come

back, scaled again and then go back to the guard house. So, the intention with milk receiving is

the trucks do not have to go into reverse movement and the benefit there is we don’t have the

reverse beeps from the trucks, and it is also safety wise. Any of the finished goods products or

anything that has to go to the north, they would go pass the scales and then they will go up

further to the north up to the trailer parking area.

Now one thing I do want to point out on here is the gravel road that you see outside of the berm,

so we worked with Art and the wastewater department. The public sewer that will be coming

through the site and goes outside the berm and then it cuts across right here, that is what you see

as this dash line. So, this gravel road that you see is the access for the town if there is ever a

maintenance issue with that sewer line. On the south side, ] do just want to point out the

wastewater treatment facility so in the center we have the main building; we have the aeration

basins on the left side and the equalization tanks on the right side. To the south of that we do

have another berm that will be landscaped to provide screening to 104 and then on the very

southside of that, we have included a 20-foot easement for the future route 104 trail casement.

So, before | move off of the truck entrance, is there any questions?

Board

No

Josh Hough

(VIEWING PAGE 19) So, now | want to talk about emergency access. So, what we

have done is we have taken the site and we rotated it a little bit. So just to orient, north is to the

right just so we could get it a little bit larger so that you could see what is happening. So, for

firetruck access or emergency vehicle access, they can come into either entrance. Either the auto

Pg. 255 September 19, 2023 Planning Meeting (Special Meeting)

entrance or the truck entrance. At the truck entrance we do have the fire pump house and fire

tank. That is also where the FDC and fire department is located in the pumper hydrant . There

will be no FDC’s on the building. So, when the fire department comes in and they need to

charge the line, everything will happen at the pump house. The fire tanker on the pumper truck

can pull right up in the pavement area and stage here and then connect to the pumper hydrant

which is charged by Monroe County Water Authority and connect directly into the fire loop. Ha

fire truck does come into the auto entrance they can come around, it has all been designed to

allow for the fire trucks to be able to maneuver through the parking lot and they can slage.

There is a drop off area here and they can go into the office and talk to security there. If they do

need to go to the other parts of the site, there is a connection here that connects to auto parkin glo

the truck area or if they come in and they realize they need to go to the back this is also an access

drive that the fire trucks can use to go to the parking area and those will be plowed for winter,

(VIEWING PAGE 20) So moving from the emergency vehicle access and just talking about the

fencing. We have five different types of fencing on site and the one we talked about most is the

sound wall. So, this is the orange line on the east side of the facility . It is a 14-foot precast

concrete sound wall, and it is specially made for absorbing sound and then we have also used a

texture 1s the stacked stone to create an irregular shape so that the noise just doesn’t bounce off

and go between the buildings so this will actually disperse the sounds even more . We tried to

look at it to create the best solution (o avoid increases in noise or any challenges with the sound.

Tt will also be painted in a color that matches the nature surroundings, so it is very similar to the

color that is showing. (VIEWING PAGE 21) The second type of fence is the horizontal wood

slot fence. So, that is the one | talked about over on the auto parking lot. So, this one was

requested by Jerry Keebler and the intent is to create a look that follows with the farm so we

would be using a wood that is similar to an old barn so as employees come into the parking lot,

and they Jook over at the wood fence it would have that look of the old barn look but then it does

have the metal which ties into the decorative metal fence to the north and to the south.

(VIEWING PAGE 22) Which the decorative fence is an 8-foot picket, and this starts at the sound

wall to the north, comes around the ponds, near the auto guard house down to the horizontal

wood slat and then it is going to continue down to the truck guard house or truck entrance, I am

sorry. One thing to point out here is that it does cover the ponds so we intentionally made sure

that the ponds were within the secured area so that they are not accessible to residents or kids

that might find their way into the facility. This is a completely secure area so those ponds would

be completely contained. (VIEWING PAGE 23) The fourth type of fence which is similar to the

decorative. It’s a picket but at the top it has a curve. It is similar to a chain link fence with the

three-strand barb wire, but this is kind of an upgrade version. So, it looks a little bit nicer but

provides that same level of security. So, this would come down from the truck entrance and

around the wastewater and then go around to the south side over to the wall. We intentionaily

move it to the back side of the berm. So that as the route 104 trail comes in, they are not right up

against a security fence they are actually up against the berm with the trees on it. And then the

last fence that we have that I talked about earlier (VIEWING PAGE 24) is our farm fence and

this is actually a concrete fence, so it has the look of wood, but it gives that feeling of being ona

farm and that is mainly at the entrance. It is not really a security fence, it’s Just to create more of

Pg. 256 September 19, 2023 Planning Meeting (Special Meeting

an ambiance. We did pull it back from the side of the road to make sure that there is room for

snowplow so that the snow can be removed, and you will see on the southside here, it is

extending further to the south so that snow can be piled up south of the auto parking lot. Any

questions about the fence before ]_ move on? (VIEWING PAGE 25) So moving into the

snowplow storage and operations so Tebor Road is a public road and so we were concerned and

working with Pat Stevens how the snowplow would end at the road turn around and come back

out. Once again, we have another video, but it is not working. This kind of gives you the feel and

you can see that a truck pulls in and turns around, backs up and goes right out.

We will provide an access easement for the snowplow and one thing to point out is this is the

securily fence and a gate right here so for some reason in winter conditions that the facility had

to shut down and this fence was closed the snowplows would still be able to come in turn around

and leave the site. The facility is 24 hours, and it should be open at all times but just in case we

made sure that there is room for the snowplow to be able to turnaround. Another thing to point is

the monument signs and we will get into monument signs in a moment but that is here on the

south side. On the northside as we look at utilitics our INAUDIBLE utility services are here, and

this was the best location for that monument sign.

(VIEWING PAGE 26) So, talking about signage, this is the front office and we wanted to give

you a look at what the office looks like and then focus in on the sign. The sign is large but when

you compare it to the whole office look, it is rather small. (VIEWING PAGE 27) So, this is the

overlook and as we zoom in you can see we do have the Fairlife logo on the office and it is 8 feet

tall and there is powder coated louvers with a back light on the logo and then as far as the

coverage, the sign equivalent is less than .1% square of the fagade footage. On the other signs,

(VIEWING PAGE 28) this is at the auto entrance and this would be just north of the auto

entrance and so this would be a internally lit sign and you can see in the daytime of what it

would jook like and then at nighttime you can see the logo and just the address would be lit so

there would be no actual lighting of the sign with up lighting or anything like that and then at the

truck entrance (VIEWING PAGE 29) we would have an internally lit sign. This is the daytime

view and the nighttime view you can see that the logo and all the wording is lit internally but

there are no up lights on this signage.

Before | get into utilities (VIEWING PAGE 30) is there any questions about signage?

Anthony Casciani

You must have read the code regarding signs?

Josh Hough

Yes, we did. Specifically at the auto entrance, we wanted to make sure that the

residences that are just to the north (hat they didn’t have extra lighting just like we looked at

bollard lights we wanted to make sure that the sign was not creating extra light into their facility

or their homes. Alright, so moving on to utilities, one again we have rotated the site so that you

can see ita little bit larger and so | will just walk through these real quickly. Coming down Tebor

Road so there are four things to point out that we do have the gas main that is shown in yellow

and that is going to be the upgrade that RGE is making. The green line is the public sewer and

Pg. 257 September 19, 2023 Planning Meeting (Special Meeting)

that is going to be increased to an 18 inch and that is currently being reviewed there is a lot of

evaluation that has to take place and the Town of Webster is going through that evaluation. Over

here on what is the north side, is the blue line and this is the water main that we will be

upgrading and then the orange line is the overhead electric that RGE will be upgrading to the site

so those are the utilities that will be coming down Tebor Road. As you come onto the site, I will

go into a little more detail with he next slides and talk about water. Al of our water will come in

just north of the truck entrance and our blue lines are our water distribution, The red line is our

fire protection. You can see that we have a private fire loop that runs around the building, and I

will talk to you about that in a moment and then the green lines are sewer and so we will talk

more about that but there is a public line that runs through the facility and then we have our

private sewer lines and then we have the gas and the electric that come over to the facility as

well,

So, Ict me dig into those a little bit deeper. (VIEWING PAGE 31) So talking about water, we

will have a 6 inch and 8-inch connection here at Tebor Road at the end and we will have meters

and back flow and they will be in aluminum hot box and that is where all the meters and back

flows will be and then they will enter into the sight and be distributed out to the different

buildings. (VIEWING PAGE 32) Talking about fire so as I said earlier, we do have a fire tank

and fire pump so we will have an 8-inch service to the building, and it will also be in a hot box

and then it will enter into the fire pump house and will go out of valve into the tank for filling the

tank and then there will be a fire pump that pressurizes this line around the facility. We do have

hydrant space of 300 feet on the center, per the code, and then there is all the building

connections that you can also see, multiple ones for the different zones in the building. This is a

10-inch fire loop, and we are looking at just an 8-inch line coming in and it is a 250K gallon

tank, so it meets all the requirements for the code for one hour to be able to meet the larger zone.

As | talked about earlicr, FDC, the fire department connection is here around the fire pump

house and pumper hydrant is here at Tebor Road. So, the fire truck can access that and they can

connect to both of them and be able to charge the line if needed. Talking about the private sewer

system (VIEWING PAGE 33) We do have sewer lines that run from all different buildings. The

guard house, the office, all those run down closer to Tebor . There are three lift stations so there

is going to be two sanilary sewer lift stations located here, one located here, and those sanitary

lift stations will discharge into a manhole and then it will be gravity into the city system. The

reason why we are having to do life stations is (he site generally grades south to north and

unfortunately, we are having to pump the sewer it needs to go the other direction. So, we are

having to pump up hill on some of the sewer lines. That is why we have those lift stations. The

third station is the process station so all the equipment that is inside and when it discharges to £0

to the water facility, we have a process life station that is here and then discharges into the

pretreatment facility. Coming out of the pretreatment facility that will be a line between these

two tanks they are INAUDIBLE basins, and we will have a Parshall flume and a meter so the

Parshall flume and it will either be a concrete vault with the Parshall flume in it or it will be

fiberglass. It is a closed top sealed lid. So that controls the odors or any issues there and there

will be a meter inside there that will be used to monitor the flow from the facility. The

connection to the public system is there is going to be one here for this private system that

Pg. 258 September 19, 2023 Planning Meeting (Special Meeting)

connects here the wastewater will connect here right by this corner and by the wastewater

facility and then some of the other buildings like the truck scale building and the truck

guardhouse will connect directly into the public sewer which I will talk about here in just a

second. (VIEWING PAGE 34) Really which is the perfect time so the public sewer so currently

if you go out Lo the site there is a sanitary sewer line that runs (o the north and runs parallel with

Tebor Road, and it comes right across here. As part of this project, we will be relocating that

sewer to come down as far south as we can go. The original plan was to take it all the way to the

south of the property line but just because of inverts and elevations, we were only able to get it to

this point so it does cut through part of the site and because of that there are going to be access

easements and there are easements on top of the sewer lines, and we will be doing that part of the

construction from this point here all the way over to Tebor, Moving from sewer into natural gas

(VIEWING PAGE 35) as we said earlier, the line will be upgraded on Tebor, and it will come

across Our site over lo the utility area on the east side of the building and then the same thing

with the electric so electric will be overhead until it gets into the facility and then it will go

underground and come around the south side of the facility and over to the main clectrical room

and the transformers and the electrical service will be on this side.

Moving to the wastewater pre-treatment (VIEWING PAGE 37) facility. So, as ] said earlier there

is going to be a discharge over here on the west side between the two aeration basins so that

would be this pre-treatment facility discharges and comes through this line over here to the

Parshall flume and sewer and sewer meter and comes into the public main right here at this point.

Kind of working from left to right. So, these tanks on the left side of the aeration basins this is

the main wastewater, the building in the middle and then we have the equalization tanks on the

right and then on the north side for sludge unload, this is actually another closed building so the

trucks would pull in and the doors would close, and they could unload any of the sludge before

the site but that would all be done inside the building. The plan is that we will still be meeting

the 2 million gallons per day discharge at full build out. We will be meeting the pretreatment

requirements and all odors will be captured with the building and the tanks. So, the tanks are

closed top so there will be no odors leaving this area. Just to give you a little perspective on

what this wastewater looks like (VHEWING PAGE 38) and what the tanks look like. So, these

are similar type tanks thal were other facilities, so they are steel tanks with the close top, and this

is what those equalization tank basins look like, Before ] move off of utilities are there any

questions? On utilities or wastewater?

Anthony Casciani

These tanks that you are showing right now, those alt are pact of the

wastewater treatment facility?

Josh Hough

That is correct.

Anthony Casciani

That is impressive.

Josh Hough

Yes, all these tanks, the four large tanks and three smaller tanks are all part of the

wastewater.

Pg. 259 September 19, 2023 Planning Mecting (Special Meeting)

Jennifer Wright

And how tall are those?

Josh Hough

So, we are still going through some design. They are less than 50 feet, and they are

usually more like 35 to 40 but we will keep them below the height. Alright, so moving into

stormwater. (VIEWING PAGE 39) So, with the stormwater requirements we did have to do a

two part treatment system and that is so we can meet the water quality and water quantity

requirements so you can see and they are a little bit hard to see, because of all the grading as I

said earlier, the grading is from south to north and it is about a 20 foot difference from on the

southside of the facility to the north side so you can see our contours, quite a few of them. We

basically have two systems running along the eastside and the westside and these are the dry

swales the first part so as the water comes off the parking lots or the greenspace , it goes into

these dry swales and goes through a media that helps with the water quality before it goes into

our underground system and then goes over to our two large wet ponds that are on this north

west side and then these discharge , one discharge is oul to hear and there is a small drainage

way that runs on the back side of these residential properties. Which we have been working with

Pat Stevens at the Highway Department about making sure that this drainage swale is cleaned

out and that it is being maintained and so he is going to review that now and we spoke to the

neighbors to make sure that they are aware of that as well. The other pond discharges into this

current wetland system that goes out here to the north. We have two other small discharges and

so one is on the east side of this berm so we wanted to make sure that we weren’t causing any

flooding problems by putting the berm in so we put a small system that goes through here and

discharges to one of the existing points on the northside. Then there is also another swale that

discharges here on the southside and that is just a small system here that discharges in there as

well. (VIEWING PAGE 40) As part of the stormwater we do look are erosion sediment control,

so we have a three-phase plan. So, our very first one is the Initial: Before we go out, we want to

put protection on the wetlands, and we put in silk fence around the perimeter and do our

construction entrance and do preparation for stockpiles, The 2 phase is kind of what we cail our

Intermediate so that is kind of, as we start to put in the stormwater, and you can see the ponds are

Starling to go in and we start putting protection around those to make sure that they are not silling

up. We will use them as sediment basins as rainfall hits the site it comes down to the

stormwater basin and we will collect that sediment there and then from time to time we will have

to clean that out as we go through construction and then with Final, we will protect the site until

everything is stabilized and what that means is that either there is concrete or asphalt or gravel or

that the gravel is covered, and I believe it is 70-80 percent of the site.

So, talking about grasses. (VIEWING PAGE 41) The landscaping so we really wanted to

highlight the auto entrance. So, as you come into the facility there are trees that are going to be

along the auto entrance and as you drive past the guard house, we will have trees lining that drive

and as | said earlier, we will have trees in the auto parking Jot to provide some shade. We will

have some down at the truck area just within this island just to create a nice area. tis a grassed

area, and iis nice to have the trees there for the shade. The other big aspect of our landscaping

is along the berm and as you see, il is heavily treed. We are doing a combination of deciduous

and evergreen, and it is actually on both sides of the fence, and I] did a zoom in here so you can

Pg. 260: September 19, 2023 Planning Meeting (Special Meeting)

sec a better look at it, Primarily the trees will be on the residential side providing the screening

and we do have some trees on the Fairlife side and that is for sound, and it helps as the noise

comes off the vehicles when it hits the trees it starts to disperse it, but it also create a better

ambiance as you come into the site. The next slide, (VIEWING PAGE 42) actually we don’t

have that in there, but we do have some pictures of some of the trees if you wanted to see those.

We did work with some of the local landscaping companies just to understand what are the right

trees for this area. Whether it is protection against disease or making sure that they grow well in

this area, we have worked with a local nursery to make sure these are available. And one of the

last things that we wanted to talk about was the parcel assemblage. So, there are two phases of

this so the very first phase is subdivision of two lots and so the first one is this blue fot. So, it is

being broken into separate lots so that Fairlife can purchase this one here in blue and then on this

green lot it is being subdivided so we can take this parcel as well and then the red that you see is

the combination of all of this.

So, what we are currently doing right now on the subdivision is we are working with the county

surveyor, and he is reviewing the subdivision plans and those that have been created. We have

submitted those but unfortunately he was on vacation last week so it is going a little bil slower

bul we are suppose to gel comments tomorrow and as soon as we gel those comments, we will

turn (hose around and get thal recorded for the subdivision of these two lots and then

immediately after that we will have the combination lot and that will be to the town next

Wednesday for this red parcel to combine it all into the 110.4 acres so we are going through

those processes. Those are taking place.

Anthony Casciani

So, the five parcels have yet to be combined, correct?

Josh Hough

Yes, that’s correct.

Anthony Casciani

So that is where there is an issue.

Josh Hough

And that is where we woutd look to possibly have them a contingent item in the

resolution, and we understand that has to be done and we are working towards it, and we have

dates and times that we are working towards. Any questions about this part of it at all?

Anthony Casciani

No, it is quite a thorough description of the whole project that is for sure.

Josh Hough

Ewrll hand this back to Darren just to close things up.

(VIEWING PAGE 43) Darren Ward: | will just take this opportunity to summarize things up.

So, hopefully through this process you have seen that we met with out neighbors and local

communily. We have listened to them, and we have changed our design to try and miligate any

issues with they may have. Obviously tonight we have given you as much detail as we feel is

necessary and then we are looking for the town boards industrial use permit and such other

conditions as support seems necessary and appropriate so thank you very much for your time.

Pg. 261 September 19, 2023 Planning Meeting (Special Meeting)

Anthony Casciani

Ok, thank you. Why don’t we...ilis a public hearing, | am assuming there is

some residents here wishing to speak on this project. Well, lets do this, we will open it up to the

floor first. Is there anyone here wishing to speak for or against this project? No one? WOW!

Jennifer Wright

They must have done a very good job checking in with the neighbors.

Dave Malta

The presentation was very thorough and one of the best ones we have seen.

Mark Giardina

I got a question if ] could, security cameras, do you have them at the facility?

Darren Ward

Yes, we will.

Mark Giardina

And what about the hours for the security guards? Is it 24/7?

Darren Ward

Correct, 24/7.

Anthony Casciani

We did meet with some of you folks today and explained what the situation

was. It’s pretty difficult to move forward with an approval on this as much as everyone here

would like to do that but we don’t have lots combined yet, we don’t have mylars so it is going to

be difficult to give a subdivision approval on it and that would have to part of the preliminary

approval, so we spoke with you folks there today and Josh you were involved there 2? You were

online?

Josh Hough

No, | was involved afterwards. I wasn’t involved in the initial conversation, but |

did talk to Josh (Artuso) aflerwards.

Anthony Casciani

But anyway, consensus was to consider tabling this and even if we have to

have another special mecting in a week or two because there are different departments that are

still looking for miscellaneous items that they needed to have to be fully comfortable as opposed

to all these strings hanging. Let’s see if we can get it all combined and take another week on this

and it won’t impact a whole lot and J think you still have to go for the COMIDA Josh? Is that

correct?

tosh Artuso: Yes, thal is my understanding that it is taking place sometime in October .

Anthony Casciani

Am ] correct in what | am saying? As far as having all (he complete...

Josh Artuso

Yes, I think by enlarge the majority of technical comments have been adequately

addressed there 1s just the remaining issue of the sub-division of land issue.

Pg. 262 September 19, 2023 Planning Meeting (Special Meeting)

Anthony Casciani

And that makes it difficult for approval and you really can’t make it subject to

that because there is really nothing....we are putting the cart before the horse basically by doing

that in my opinion anyway. So, would you be ok with tabling it?

Darren Ward

Yes

Anthony Casciani

We talked today, and we went through it all and pretty much the way it ended

up geiling resolved somewhat. So, do you want to request to be tabled to another meeting when

I don’t know. I think this board is more than willing to have another special meeting to address it

and move forward with it whether its next week or the week after.

Josh Hough

Yes, my only concern is that we will have them....the mylars, we will have

comments Wednesday on the County surveyor.

Anthony Casciant

You will have them then?

Josh Hough

That is what he is committed to he said comments Wednesday and probably get

mylars by Thursday or Friday and get those submitted and then we are supposed to have the

combined lot by Next Wednesday. So, just thinking timing wise, next week might be a little too

soon.

Anthony Casciani

So, two weeks?

Josh Hough

Yes, that would probably be...

Josh Artuso

So, that is a regularly scheduled meeting for October

3. Anthony Casciani: Ok, so we will schedule it for October

3. Josh Hough: That sounds like the plan.

Darren Ward

Thank you!

Anthony Casciani

Ok, so the applicant is requesting to table to October

3. RESOLUTION 23-115 Jennifer Wright made a motion to TABLE

APPLICATION TO 10.3.23 which was seconded

Ok, thank you. You did one heck of a job with this, and you covered all the

bases with it.

Someone speaking from the audience. Approached the podium but didn’t state her name of

address: She stated that communication could have been better. We were completely missed on

the first neighbor meeting, we were not aware of it what so ever and the second one came about

two weeks prior, I travel for work and I couldn’t’ make it to the second week by the time we

were given notice of it so this is the first time I actually saw this entire presentation and now I

have to digest i{ to try and give information or ask questions so and I think it was really unclear

of what was unclear at this meeting and if we should be here or not. We got different dates, we

gol different letters, we got different emails. So, you are going to come back in two weeks, I

think that really needs to be clear to the neighbors and what this meeting is and if they should be

asking questions or what is should be for is my first thing. So, I think it would be great if we Just

had some more information like you are digging into the sewer right behind our house, what

does that mean for our system? Right, there is going to be drainage right behind our house, What

does that mean for us? That is not really, your asking for you know, positive or negatives that is

really not what this meeting is for but those are still questions that we have as neighbors, right?

Anthony Casctani

Actually, this meeting is a public hearing and that is intent for people to, you

know, any issues that they may have to bring up because once this is done, then we close the

public hearing and then it’s just up to the board to make a decision on. You are more than

welcome on anything you feel.,..] would rather get it aired now as opposed to when they come

back because itis all fresh right now and when they come back, { don’t want (o go through the

whole thing again so if they can just highlight some of the particulars.

Person from the audience

| think there is a lot of gray right....you guys came, you took the

pictures, and you did all that stuff but now we are talking sewage things are going to be 50 foot

high possibly, so what is that going to look like, you know those kinds of things. We still have

questions. This is the first lime we are seeing anything on the sewer and that is going fo come

right from our property so what is that going to mean for us if anything. But we don’t know, that

is the kind of stuff (hat } am just (rying to digest after this presentation because again, I couldn’t

come to any of the meetings and we weren't even told of the first meeting so that is the kind of

stuff that am looking for and } think there is a lot of good and it’s great that we see all the

pictures and stuff and J think there is a lot of great information.

Mark Giardina

Could we gel your name?

Sydney Labore at 725 County Line.

Pg. 264 September 19, 2023 Planning Mecting (Special Meeting)

Anthony Casciani

Alright, what will do...we shouldn't close the public hearing, will keep it

open so if there are comments at the next one that you want to bring up will still have it open that

you can do so.
