Commercial District under Sections 269-11 and 350-19 of the Code of the Town of Webster.
(Mr. Kosel had a question regarding the agenda stating directly south of Hard Road, he thought it
should be west. Mr. Artuso explained it is to the south of the property located at 925)
Appearing before the board was Brett Steenburgh and I am the Engineer for the applicant,
Liberty Restaurant Development for Popeye’s Restaurant at 929 Hard Road. Since we were here
last, we have gone through a round of comments from the towns designated Engineer. We also
went to the Zoning Board of Appeals to request relief from the parking requirements which the
parking requirements for this site would have required 202 parking spaces for the restaurant and
we have 24 parking space proposed for the 24-seat restaurant with the double drive through.
The Zoning Board of Appeals requested one minor addition to the plan and that would be the
inclusion to show somewhere we have snow storage there, so banked parking spaces if
necessary. Every time I go through these restaurants, the parking is empty, and the drive thru is
full. It just seems to be the way the fast-food trend seems to be going in the United States
especially post COVID. I would rather leave that area green then pave it and have vacant parking
spaces and the Zoning Board of Appeals tended to agree but we did include showing the
additional ten banked parking spaces along the site there.
The latest round of comments are from the towns designated Engineer. (SEE ATTACHED
LIST OF COMMENTS;RESPONSES; PLANS) were dated February
20. We addressed those
and sent them back in and they were late coming in because....we responded to them as quickly
as we could from February 20" and I think we sent them back in on the 23" but there is a
response letter I can go through the responses if you like, or you can. I don’t know if you had

a. Engineer’s Report (see attached).
b. DOH-347 Form (see attached).
c. Plan/Elevation View of meter and RPZ.
12. The Owner can install PE on the private portion if they prefer instead of Copper as PE is typically cheaper.
13. This location is in 610 zone the low water level in the tank {LWL) is
590. The elevation over the water main is
~414’. Hydraulic grade calc. is (590 — 414’) x 0.433psi/ft. = ~76 psi in the main. You can adjust the elevation over

requested this a couple of times and they have sent me the theoretical low flow values. See their responses

equivalent length of sidewalk.
The applicant will provide the requested letter of credit. Anote has been
added to the site plan that the letter of credit is required prior to a
certificate of occupancy.
Provide a revised signage plan that eliminates the “Famous Louisiana
Chicken” on the south elevation and eliminates the “Love that Chicken"
on the north elevation. Signage for “Popeyes” is acceptable on the
north, south and east face of the building, which is in keeping with the
adjacent businesses (Taco Bell and Dairy Queen.
We have shown on the conceptual elevations that the signs will be
removed, Once an architect is chosen for this building they modify the
elevations submitted to the building department.
5. Review the neon chicken on the east face of the building with the
Planning Board.
Although the applicant is happy to work with the town as much as
possible, the corporate office has certain brand designs that they need
to comply with. That being said we would ask that the this sign be
permitted.

Dear Mr. Artuso:
Please find attached the revised site plans and the conceptual building
elevations. The plans have been updated as per the comments provided
by MRB Group dated February 20, 2024. Based upon those comments we
offer the following responses:
l.
Review the Total Area of Disturbance and revise accordingly. It appears
that the entire site is being disturbed during construction, which is more
than the 36,000 SF indicated on Sheet C-6, Note
8. Due to the size of
the parcel, include the total area as disturbed.
We have increased the area of disturbance to 45,500 sf. to include most
of the parcel. However, the existing asphalt service road bisecting the
rear, the property on the west side of the service road and the existing
bio-retention basin have been left out of the area calculation as they
will be no ground disturbance in those areas,

The information previously provided regarding the pressure
zone and the elevation of the storage tank is not acceptable.
We have reached out to MCWA again io obtain this information. They
have informed me that it is their opinion that the computer model is
accurate to the existing conditions and that there is no need to perform
a field test. They did provide a graph of the anticipated residual
pressures during various flow conditions. | have attached their emails

LIST OF COMMENTS)
1. Review the Total Area of Disturbance and revise accordingly. It appears that the entire
site is being disturbed during construction, which is more than the 36,000 SF
indicated on Sheet C-6, Note
8. Due to the size of the parcel, include the total area
as disturbed.
We have increased the area of disturbance to 45,500 sf to include most of the parcel.
However, the existing asphalt service road bisecting the rear, the property on the west
side of the service road and the existing bio-retention basin have been left out of the
area calculation as they will be no ground disturbance in those areas.
Provide the results of fire flow test at the nearest hydrant along with the static and
residual pressure. This information shall be obtained from the MCWA. The
information previously provided regarding the pressure zone and the elevation of the
storage tank is not acceptable. We have reached out to MCWA again to obtain
this information. They have informed me that it is their opinion that the
computer model is accurate to the existing conditions and that there is no need
to perform a field test. They did provide a graph of the anticipated residual
pressures during various flow conditions. I have attached their emails and
graph to this letter.
Provide sidewalk along Hard Road per Town Code. In lieu of providing a sidewalk in
front of the property, provide the equivalent length of public sidewalk in the letter of
credit to the Town of Webster. Commercial Properties are required to provide
sidewalks or provide funds for the equivalent length of sidewalk. The applicant
will provide the requested letter of credit. A note has been added to the site plan
that the letter of credit 1s required prior to a certificate of occupancy.
Provide a revised signage plan that eliminates the “Famous Louisiana Chicken” on
the south elevation and eliminates the “Love that Chicken” on the north elevation.
Signage for “Popeyes” is acceptable on the north, south and east face of the building,
which is in keeping with the adjacent businesses (Taco Bell and Dairy Queen. We
have shown on the conceptual elevations that the signs will be removed. Once
an architect is chosen for this building, they modify the elevations submitted
to the building department.
Review the neon chicken on the east face of the building with the Planning Board.
Although the applicant is happy to work with the town as much as possible,
the corporate office has certain brand designs that they need to comply with,
That being said we would ask that this sign be permitted.
Provide provisions for additional “banked parking spaces” if necessary. The banked
parking spaces have been added to the plans.

building drain is a cleanout and has been labeled accordingly.
b. Does that black dot indicate a clean out for the lateral? If so then it should say on
the plans “Cleanout”. The dot has been labeled as a cleanout.
9. Plans show Air testing and Mandrel detail testing. Where was this to be
completed? The location of the what is to be air and mandrel tested has been
added to the notes on sheet C-3

The one comment we were unable to address is, he requested that we get a fire flow
test from MCWA, and this would be the second time we requested the information. What MC has
provided me with is an interpretation based on a model of the water height in their tank and what the
flow rates would be for the hydrant in that area. Really looking at their data, they have more than enough
pressure to sustain any fire flow or any necessary fire flow conditions for the hydrants there based on that
and when I responded back to her this last time, she said you can assume that, that information is accurate,
and we don’t do flow test and we won’t be doing a flow test out there so but other than that [ believe we
have address everything else. We have added a note to the plan that the applicant provide a letter of credit
for the cost of sidewalk along the frontage since that is required as part of the zoning requirements. I
know there were some discussions here last time if we were providing sidewalks somewhere else and
how would we handle that because there are no sidewalks in that area. The applicant has agreed to provide
a letter of credit, it’s a 100.... 1 forget how many feet of sidewalk along the frontage line of 118 feet, 119
feet of Hard Road so that will be provided as part of the application.
There were a couple of signs and I think this board had raised a concern regarding the removal of the
signs of “LOVE THAT CHICKEN” and “LOUISIANA FAMOUS CHICKEN” and the applicant has
agreed to remove those signs and I did note that on the conceptual elevations and once we get site plan
approvals, we will get with the architect to do the final plans and it will be reflected in the plans that the
Building Department gets to issue a building permit. And there was a raised question about the neon
chicken on the east face of the building. We would like to ask that, that remain. The applicant,
Pg. 22 March 5, 2024 Planning Meeting
unfortunately, being a franchisee is kind of under some limitations with these changes that need to go
back to corporate, because corporate needs a certain branding and they requested that it remain. I did go
around, and McDonalds has 2-3 of the golden arches around their building; Colonel Sanders is pretty
apparent on Kentucky Fried Chicken, and this is something that is typical in their branding for Popeyes
and we respectfully ask that the board allow that to be constructed as designed and we went over the
banked parking. The rest of the changes were mostly minor changes, changing the pipe from SRS 26.1
which we have done; the manhole connection for sanitary sewer; adding labels to the clean outs; and
some of the sanitary testing which we be satisfactory addressed.
So, I think from an engineer review and technical review standpoint, I think we should be in good shape,
and I would be happy to answer any questions that the board may have at this time.
With regards to sign, are you talking about the chicken itself?
Yes
What about the sign next to it that spells the word CHICKEN because that was one of the
issues the last time they were here.
Yes
Is that going or is that staying?
Which one spells chicken? I am not sure which one.
When you are looking at the front elevation, when you are looking at Popeyes, it is to
the left of that. In the drive thru lane.
Looked at the plan and said no, that will not be there. It is actually a median island that
goes between the pass by lane and the drive thru lane. We found through experience that it just causes
problems with the snow blowing. It might work better in the south where they don’t get any snow but
that will not be included on the site plan.
1 don’t really think the rooster or the chicken or whatever it is there is really all that
big. It is their trademark; it is not really anything obnoxious or anything like that.
INAUDIBLE
On the sign where you took off that chicken, what are those windows there, |
questioned that.
Those are actually just decorative shutters is all they are. That is actually the freezer
and rather making it look like a freezer, they want to make it look like it’s part of the building, integrate
it. They have gone through a couple different designs, but this is what they have gone with.
Now the bio-retention in the front, what was the outcome of all that?
Pg. 23 March 5, 2024 Planning Meeting
We did an analysis on the bio-retention out front and what we found is it was designed
initially for an amount of impervious area. When Taco Bell was constructed, they constructed a
substantial portion of bio retention base and it had a significantly less impervious area then what was
assumed on that parcel and when we combine the two areas back through the bio-retention design
calculations, there is a lot of impervious area that is proposed for both Popeyes and the existing Taco
Bell. It has the bio-retention base, it has adequate capacity to treat the storm water INAUDIABLE for
the storm water for those locations.
Do you have landscaping?
We have additional landscaping out front as you had requested just to mimic the
existing bioretention landscaping as it goes down in front of the site.
What else...lighting is down Jit?
Everything is down lit. We did provide the town with a diagram with the lighting levels
basically not going over property lines and maintaining the recommended limits.
I have one finally thing, your dumpster enclosure.
That is masonry. It matches the building very well. It looks just like the building
finishes, and they designed it to basically look like.......... because many times, we tuck in right in behind
the building and it’s detached from the building, so we want it to look like it is part of the design rather
than something that was added on after.
There is 24 parking spaces, how many employees will you have at one time?
Typically, the staff is about 8 employees. We have 24 seats in the restaurant. My rule
of thumb is one space per three seats plus one for each employee for the max shift and that would put you
at about 16 spaces and we are at 24 spaces which exceeds that a little bit which I think the Zoning Board
of Appeals was happy to see that.
We did get a letter from the Zoning Board in regard to the banking space and I really
don’t have a problem with that. We have done that with other projects where it just comes along, and I
can’t even recall INAUDIBLE convert to parking....
And I will be honest with you, I have done these buildings with as little as 18 parking
spaces, and I have not see a problem as of yet. Like I said, the fast-food customer seems to be going more
towards....that is why we have a double drive thru because it seems to be going more thru that drive thru
then parking. People are just living their lives a little faster then they use to.
Do you have tables outside so that people can eat outside.
We do not, no.
Paul are you guys all set with this? Most of the comments are ENGINEER comments.
Pg. 24 March 5, 2024 Planning Meeting
It is just the one comment here for fire flow. I provided with a recommended note for the
approval.
If it is something INAUDIBLE this board. ..] have the equipment I just need somebody
to open the hydrant. I can drive up from Albany and take care of it. I feel confident that their data is
probably accurate enough, but we can.
The water authority will not allow anyone from the outside (BOTH PARTIES
SPEAKING AT THE SAME TIME)
(BOTH PARTIES SPEAKING AT THE SAME TIME)
But I have talked to water authority and the curve that was provided to you was inaccurate.
She sent me a new curve today.
So, we would like a fire flow test and signature and just put that on the approval.
(BOTH PARTIES SPEAKING AT THE SAME TIME)
INAUDIBLE they will do a fire flow test?
Just let them know it was a requirement. I will send them an email tomorrow and let them
know it was a condition.
It will be part of Engineering approvals.
Just have it added to the mylar.
(NOT SPEAKING LOUD ENOUGH) INAUDIBLE I know the lots to the north had
the two driveways tied into this parcel but is there actually an access agreement through the parking lot?
Yes. It is actually under one ownership. They are all land leases. It is a division of
Widewaters that INAUDIBLE parcels, so they have permission and that is why they have access
INAUDIBLE.
(NOT SPEAKING LOUD ENOUGH) I think that was part of the approval.
The road was stubbed there, wasn’t it?
It actually makes for a nice layout.
Ok, I think we addressed it all. We went through the minutes and everything that
INAUDIBLE he already brought up and addressed them all. Is there anyone wishing to speak for or
against this application? Not seeing anyone, we will close the public portion and bring it back to the
board.

Ok, without looking at them, what do they say? Hopefully it’s not saying

No, it says drive thru and I think they might have....... no, I don’t think they
have anything other than entrance drive thru this way and exit. The only thing is only the back

There was a mix up with Skylight Signs. They inadvertently thought that tonight’s
meeting was on a different date, and they had a conflict, so they reached out to me this afternoon
and indicated that the salon owner was going to try and make tonight’s meeting which is why we
switched the order of the agenda items. It wasn’t a guarantee, but I think it is safe to say at this
point, that they are not going to be able to make it here tonight.
I did discuss the sign with them, and it does appear to meet all the code requirements. I tried to
ask a couple of questions that | anticipated that the board might ask about a particular sign to get
the verification and I can inform you that basically the sign that it is consistent of a black vinyl
material over the channel letters and they are internally lit with white LED lights so the sign
Pg. 31 March 5, 2024 Planning Meeting
during the day appears as you seen it on screen with black letters and then at night it is internally
lit and the black does shield and it’s not a bright white light that shins out and it does help the
brightness of the white lights but other than that, it meets the code requirements and if they were
not able to make it tonight, they respectfully requested if the board would approve the sign in the
absence of the applicant being present at the time.
(NOT SPEAKING LOUD ENOUGH) So the white part will be lit and only that
spot just behind the sign INAUDIBLE words, right?
No. Each letter is individually lit internally so the raceway that the sign letters are
on will not be lit just the letters themselves. So again, because of the black vinyl that they have
the letters during the day light it will look just like it shows on black lettering and then at night,
just the letters that you see would be internally lit. So, I asked him, will they look white, and he
said they will have a white appearance but it’s not a bright white light shining because of the
black perforated vinyl over it. So, I told him I would relay this information to the board, and I
didn’t make any promises. It is basically up to the board on how they would like to handle this.
Easy way to do that is what we do with a sign being there anyways, just the
figures are going to be lit, that’s it. That’s all, that is all they are proposing. Just make sure that is
all it is.
I didn’t want to see INAUDIBLE.
Right.

We did need a rear setback variance from the Zoning Board to allow the construction of the pool
house...
Pg.
33. March 5, 2024 Planning Meeting
One second, Josh, can you move the screen down a little bit.
Yes
So, they did grant me the rear setback variance at our last meeting however, they
only granted 30 feet and the original 25 feet that was requested though. They just thought the
additional 5 feet would be beneficial to the neighbors and INAUIDBLE fit better, and the plans
will be updated to show everything 5 feet closer to the home.
The homeowner has also received approval from their HOA for the construction of the pool and
pool house. If the board has any questions, 1 would be happy to answer them.
Yes, I was over there the other day, and you have an existing paver/patio?
So, what the Zoning Board thought, is take out 5 feet of those existing pavers and
replace it with the concrete INAUDIBLE so in essence they are not losing any patio area.
It’s too bad you have to do that.
Yes, it’s unfortunate but we didn’t see a big deal on it and the Zoning Board really
wanted that INAUDIBLE.
Because you are quite a distance in the back of the proposed pool house
because they are going back and there are trees. In leu of that, is there any possible way you
could change the design without having to tear it up? I think that is a shame to have to do that.
That was my first thought but yes, there are two lamp post INAUDIBLE
I know it. It’s beautiful setup there. What would happen if you took 5 feet off
of that post pool house and instead of that angle, just make it square. You would get your same
square footage but design it differently without having to tear that patio up. | think that is terrible
in my opinion anyways,
Now, what corner are you talking about?
Right there, you see where the pool house is.
Yes

So, if you took off 5 feet and you would have 14 feet, do you see what I am
saying. Instead of that angle. It is just a thought; ] was just looking at it.
I do have a quick markup here of the whole thing moved 5 feet if you just want to
look at it.
You do?
I do have the plans marked up because we didn’t get a chance to update the plans.
(THE APPLICANT APPROACHED THE BOARD WITH PLANS THAT WERE MARKED
IN RED) I don’t know how set the homeowner is on that design, we could talk to them and
maybe reconfigure it.
I don’t know if the homeowners would prefer to do something like that.
We have not had any discussions with altering that pool house design. We have
gone by whatever the Zoning Board wanted essentially.
Yes because you have posts out there.
It is unfortunate. After the Zoning Board meeting, we did reach out to the
homeowner just to make sure that was ok, and they were fine with it. I mean they would
probably prefer not to but that is what they needed to do to get the Zoning Board variance.
And that is the design of the pool house they want so.
That is the only print design that INAUDIBLE, and I don’t know if there is
alternative designs that INAUDIBLE.
The exterior is probably going to match the house I would assume?
Yes, and [ don’t actually have samples of the INAUDIBLE, but I am sure it is
going to match.
That’s ok. Any questions?
I have one question, INAUDIBLE. (EVERYONE TALKING AT ONCE)
It is written, PRELIMINARY FINAL SITE PLAN FOR AN ACCESSORY STRUCTURE.
Why are we INAUDIBLE, isn’t this an accessory structure?
What is the question?
Pg. 35 March 5, 2024 Planning Meeting
INAUDIBLE. NOT CLEARLY SPEAKING. ( He was questioning the way the
agenda was written and didn’t understand)
Well, they are one in the same.
Not according to the checklist that I have.
I am not quite sure what you mean? We typically advertise that just like that, every
time.
Well, what I am going to do is give preliminary approval for INAUDIBLE.
Right.
We are not INAUDIBLE
Oh, I see, because accessory structures are exempt from the preliminary or from the
concept? We still have to
INAUDIBLE
I don’t think it is really an issue.
I want to make sure we are doing the right thing. (MR. MALTA APPROACHED
JOSH ARTUSO)
So, you are getting hung up on the site plan? Well, they are submitting a site plan.
It’s really a site plan modification because it is not just a structure. You have
a pool involved so it is a site plan.
INAUDIBLE
Isn't it for 500 sq feet INAUDIBLE and that kind of pushed us into requiring an
approval INAUDIBLE.
Correct, yes.
Anybody, any questions? It is a nice area of yard and fits in there. It will
look nice. The building structure that they are proposing is very nice. Ok, you guys are all ok
with it?
YES
Pg. 36 March 5, 2024 Planning Meeting
Anyone wish to speak? I guess not so we will close the public portion of the
meeting.

located in an HC High Intensity Commercial District under Section 265-7 A of the Code of the
Town of Webster.
Appearing before the board was Erin Ferrente. We are actually in the plaza right now and we are
just moving to a bigger space because we are expanding. We have been there since October
2021, and we are moving into this space and just need a bigger sign because our space is a lot
bigger. You can see us towards the back of the plaza.
When you go in there, it’s like a lobby in there.
No, that is not the space that you are thinking of. It is the one right next to Cold
Stone and it use to be a clothing store 21 years ago so to answer your question, yes, it will be our
lobby.
Now, is that sign lit?
Yes, it will be lit. All the letters individually and then the black underneath is like
a pill box.
So just the letters are lit?
Yes, and then the pill box underneath is [it to.
Size is ok Josh?
Pg. 39 March 5, 2024 Planning Meeting
Yes, they are permitted 24 sq ft and they are proposing 31.5.
