SUBDIVISION APPROVAL FOR SECTION 3
aAukhwna
(Mark Giardina read the second application):
Located near the southwest corner of Salt and Schlegel Roads.
Applicant Tom Thomas of 800 Phillips Road LLC is requesting FINAL SITE PLAN &
SUBDIVISION APPROVAL associated with the construction of 60 townhomes on a 26.8-acre
parcel having SBL # 065.02- 1-40.222 located in an MHR Medium High Residential District under
Section 269-9 and 296-19 of the Code of the Town of Webster.
Appearing before the board was Mike Ritchie from Costich Engineering representing Tra-Mac
Development. We are here tonight requesting final site plan approval for Section 2 A & B of the
Bella Terra Subdivision, and we have been in front of this board a couple of times in the past
few months and we have worked with town staff with comments that were generated and most
recently the comments that were submitted from the town Engineer and PRC. We have
addressed those comments and re-submilted them by to town staff and there was a subsequent
comment letter that was sent out at the end of last week. I spoke with Mr. Chatfield and prior to
Pg. 69 May 21, 2024 Planning Meeting
the discussion I feel that they were, how would I say.... I] guess “boilerplate” or “loose end
comments” easements that need to be filed and we have acknowledged that they will be done,
and we are happy to work on those with town staff. We believe we addressed all the big items
that were present the last time around. I hope the size of the sheets are more manageable for the
board members this time. One of the larger issues last time I believe was lot 222 and lot 221 one
building was too close to the creek and actually we went with smaller units, and we were able to
shift those lots further away, so I believe we have addressed that comment and again, everything
else on the plan is consistent with the preliminary plan with the addition of a couple storm water
ponds that were added in after discussion with town staff. So, with that | would be happy to
answer and questions or comments that the board may have.
*
Paul, you have looked at this are you ok?
Yes
Keith, you guys are ok with this, right? 1 don’t want to beat a dead horse so...
it’s all Engineering detail at this point so if you fellows are ok with this, I think we can move
forward with this.
Yes
Does anyone have any questions or concerns. This has been here a few times;
it’s been tabled several times. We have dealt with it and have modified it and I believe we are to
a stage where they have covered all.
Remind me again about the Homeowners Association.
Any sale and the applicant has agree to it, but any sale of a unit and he is
going to own them all... Mike, do you want to go through it.
It is all designed (to meet town standards, as if it were to be dedicated and all will
be privately owned. The developer has agreed to build it to town standard, to have a letter of
credit, to have the town inspections done in order to make sure this ts built to the quality that the
town requires and you are correct Mr, Chairman, there will not be a homeowners association to
begin with if any lot in the development were put up for sale an offering plan for an HOA would
be required and formed and maybe submitted and approved by the state before that can proceed.
We are in agreement that can be a condition of approval and we have no issue with that. Like I
said, in terms of the plan that is in front of you, it is consistent with the preliminary plan that was
presented in front of this board ] think 6 years ago and the only difference being is that they are
going to be privately owned instead of sold.
I think Derek had a question last time about not having a HOA being such a large
development that they have to do something with the state or something?

If there is a need, (here are mechanisms for temporary water crossings that the
town can afford to get over there.

I guess this is the same thing, am [ right Matt? Is this the project for
subdivision approval?
| don’t think we have a separate site plan. I think it is just site approval. We are
filing a subdivision to create the lots.
