sign located at 855 Publishers Parkway applicant Todd LaVine is requesting sign approval associated with the installation of a 68.7 3qu ft internally lit building mounted facade sign for Webster Fitness company rebanding from Gold Gym on a 44.4 acre parcel located in an OP core Area North Office Park District under Section 265 5-7 of the code of the title Webster yes sir good evening my name is Todd LaVine uh representing Webster Fitness Company um here tonight seeking the board's approval uh we were placing a sign uh about approximately 68 Square ft uh box sign back lit uh for the front of the building and obviously the same size conforms to the building right d or Josh that fit it's uh it's much smaller than what they're Allowed by code yeah just so just the figures are lit basically yeah uh it's going to be a box sign okay so the whole thing will be lit but um the predominant you know everything other than the letters is black so really won't be giving off much l that meets Cod that's good okay anybody any questions concerns for it no okay somebody you want to make a do speaker Town Webster planning board considered a request by applicant Todd LaVine to install a 68.7 3 ft internally internally illuminated facade sign for Webster F Fitness company located at 855 Publishers Parkway on a 44.4 acre parcel having SPL number 079.0 6-1 32.11 the planning board classifies the proposed action as a type two action under Section 67 19.5 C9 of the State Environmental Quality review regulations and therefore is not subject to further review okay we have a motion need to second second all in favor okay uh somebody want to make a motion for approval for the sign fit sign I'll make a motion for the web Webster Fitness uh company sign for a 30 6873 squ ft an internally lit building mounted facade sign as Pres presented second all in favor I set you're all set good luck thank you very much appreciate it okay the second one I guess Vision Nissan Edition located at 75 Ridge Road the applicant Robert Sanders is requesting sketch plan review associated with the construction of a 1,400 squ ft building addition for an enclosed service entrance area an Associated facade improvements to an existing car dealership on a 2.43 acre parcel located in a medium intensity commercial District under sections 269-5511 of the code of the town of Webster yes sir good evening uh link sedra with BME Associates uh here tonight on behalf of division Auto Group uh we're requesting a sketch plan review for a, 1400t building addition to the existing Vision Nissan car dealership um we also have site we also have improvements to the site included some parking uh sign additional signage for customers and some access improvements to make sure we have access around the addition for emergency vehicles some restriping parking improvements as well the BU as well as the building addition um we provided you building elevations and floor plans for the proposal the the is basically for to receive um maintenance at a maintenance area for them to come pull the car in go to the maintenance desk and uh and drop the car off so this is something that the improvements and the maintenance thing is something that uh Vision Nissan themselves is looking to do at at a lot of their operations so um with that I here to answer any questions you got it sounds like uh we're on for Scotch tonight 25 ft space between the proposed addition and the proposed no parking pavement marking on there yeah okay if you don't park cars what are you going they getting rid of a bunch of cars I mean right now you're showing single parking along that line correct yes right now you've got double lines of cars and they're in the buffer zone they're going to have to well that yeah well they're not supposed to be there in the first place well that's not there I drove I drove back in you know this is a disaster this place I drove in there yesterday I could barely get back there and turn around and get out the back area you guys have got cars parked in within the 100 foot buffer in the back right in the back there MH they're not supposed to be there this has got some major issues this morning you had a delivery truck there this is stupid every project has to have a way to get a a truck delivery in there to unload here comes in here tonight and this morning you got a truck parked on a road unloading cars not too cool this has got some serious issues I think what you need to do with this is show where you're parking the cars right now that again you've got a double row along the side of the building there yeah and on your new drawing you're showing one row of cars not even half the number of parking spaces that thing is maxed out there isn't even room if there was a fire truck you couldn't even get it back there okay and um that that to me is all the problem now solution to it next door there's a piece of property belongs to markv that vacant piece in there yeah I think what Vision should do is negotiate a deal with them because there's nothing in there nothing proposed for it right now and see if they can make arrangements to use that for parking if they can do that then they come in then I think you got a better chance CH of looking at this addition I don't know the board that's just my opinion okay looking going through the site I mean if you look at there there's your site right there there's there's here's picture you want to see it maybe you got it you got it no no not oh yeah there you go I tried to give you an aial with the overlay on it as yeah and and the cars are way back mhm into the into the buffer zone they're not even supposed to be there got three rows of cars anyways what do you want to do um well I want to talk to the client and come back I would suggest I would suggest let's shorten this and don't kill anybody's time here tonight but okay I would suggest you talk to them see if they can negotiate a deal about getting that over there because the way it stands right now and another thing they will have to show where they can come in with a truck to unload like they were supposed to in the first place okay right now you can't even get a bicycle through there okay understood all right you want to you want to what do you want to do you want want to just table this until um yeah I'd like to table it keep it going I'd like to have a conversation you know with them about it's true yes right say just sketch plan anyway so you don't even have table it you can you can proceed with it and come up with something differ y um good is there any other comments from the board that I I need to discuss with them just just to make sure that they stop unloading and loading cars on Ridge Road I me this is a hazard like you can't believe they need to show the drawing without the cars in the buffer areas along the side and in the back and just a suggestion you know try to negotiate with markv for that piece of land it's right there right next to him be ideal now that's not zone for automotive that's commercial but I think something could be worked out there between the town and you know vision I'd suggest you take that Avenue right now you guys understanding that just just I wasn't too happy with what I was saying there okay all right yes okay good luck with for your input thanks a lot nothing basically just sketch so there's nothing until they come up with something new next item on the agenda P line way in-law suite located at 504 pipeline Lane the applicant Matt Barry is requesting accessory apartment waiver approval associated with the construction of a 1,72 ft attached accessory apartment addition to an existing single family residence on a 0.69 acre parcel in an R3 single family residential district under section 35-50 of the code of the T of Webster yes sir hey Matthew with uh spartic instruction I'm sending in for the home owners are out of town uh we are just looking for approval from the board to add an in-law suite for um Matt Barry's uh mother to move in um she's moving into more of a handicap need at this point and I know that a VAR is needed so we're just looking for the town's approval on that okay all right looks like look quite large the code says 35 % of the main or 750 ft uh sareet 75 750 square fet whichever is less um it exceeds that what is the square 4 that Josh I forgot what it was 5,000 on the on the main house or the proposed addition uh the proposed in-law suite is 1,72 square ft okay so quite a bit over so this board can if there're in agreements to it um I don't know I can't even see it on your drawing where um you're going to have one service servicing the whole house right yes sir okay that's good um one passage unobstructed passage from the new section to the in-law section yes you've got all this stuff right yes sir okay I mean I can't see it on here but uh no front entrance so you don't have that cuz they're coming in the other way okay I wrote some notes down and and so prior to a CFO the owner shall deliver to the town an agreement as per Town's requirements you know going to the county and so on you'll have to do that yes sir moving forward and the planning board can wave the size of it because it is oversized but we can change that but anybody go ahead and take a look at it and come up with something now I had a question there was a concern from a neighbor about AG neighbor on Sho road but that house is about three houses in from Sho road so I didn't understand where that was coming from yeah I think I think they submitted a letter to that yeah I can read it in the to the record if you'd like yeah well we can actually put this into read it into the record just the name address yeah Sandra and John baldwood my husband John and I welcome our neighbors and have problem with the Beres addition so long as it meets zoning requirements we are concerned about drainage onto the property that is located directly behind 505 504 pipeline a few years back we noticed that it was constantly wet about 20 ft into our property because the home and in other locations behind the homes on Pipeline on our property while clearing out some dead trees whatever that is we discovered one of one or two feet down and 20 ft into our property was a storm drain corrugated pipe buried contributing a great deal to the water and to our property we believe the building the builder of the homes on Pipeline may have uh drainag pipes well into our property as we notice other areas are constantly saturated all the time near the property line we would ask that any storm drainage pipes of any kind coming over the property line are removed during construction I don't think you're going to be running any pipelines no no sir right okay well end the record anyways it says thank you Sandra and John PA you got it you got a copy all right anybody take a look at it and I guess Josh you you've seen this it all conforms to what the code calls for uh yes the only thing is the size yeah what that we can right you have the ability to wave the side actually probably should do that as a separate motion because if it's it's oversized for the property that's the only to being presented tonight is is the waiver for the size well the size and and to be able to build it well they don't need a a plane board approval to build it right it's just for the waiver of the size no the whole thing the way that I read the code they are permitted as of right as long as they're following the regulations set in that code section but because they're they're exceeding the size allowance that's what triggered the need for them to come before this board right so otherwise they could have gotten the approval yeah if it was 7 and why do we have other ones always coming in well cuz usually they're not meeting all of the requirements for one reason or another right okay all right so would just be for the size and that's it that's simple yeah okay and then as far as that's interesting because So you you're going to have to review and make sure everything is like the passageways and so on and so forth right correct and and the floor plan that they provided shows that it meets there does it make any difference the fact this one application form that we have here it says the preliminary final but it's not written into the meeting agenda that I just read a few minutes minutes ago see right there it's just an accessory waiver approval so that's that's what okay that's how it all right should be list all right that'll simplify it actually all right yeah um still have to do a Seeker around it though right yeah yes you want to do a seek around that there yes the town of Webster planning board considered a request by applicant Matt Barry for a waiver to construct a 1,72 ft attached accessory apartment addition to an existing single family residence located at 504 pipeline way and a 0.69 acre parcel having s b number 06601 and I believe there's actually a digit missing from the tax p number that was in the at least on the online version 01 yeah there's a number missing from the tax paral number uh- 23.3 close enough uh planning board classifies a proposed action is a type two action under Section 67.5 c 25 of the State Environmental Quality review regulations and therefore is not subject to further review okay you need a second second have a second all in favor all right in regard to this uh addition actually I'll make a motion quick I'll make a motion that we uh you're all in agreement with this think we um make a motion to Grant a uh actually it be like a variance accessory Department waiver a waiver approval all right for uh 504 pipeline way and and the waivers regard to the allowed is 750 square ft whereas the applicant is asking for 100 or 1,72 Square ft so the increase is beyond is is more than what the town allows and we're we're okay with that I guess right yeah correct subject to compliance with all the other stats that's good to put to in and that that would be subject to the code requirements and motion second all in favor hi we're good all right you're all set thank you sir yes sir don't we have to do approval for accessory building no no yeah that's right2 yeah okay thank you last uh scheduled item on the agenda tonight bird song at coner Cove subdivision located at the East End of Conover Cove Lane and Webster Road applicant Grove Underhill LLC is requesting preliminary final subdivision and site plan approval along with a public hearing associated with the care creation of nine lots for construction of eight single family residences and an Associated storm Water Management Facility on a 5.55 acre parcel located in an R3 single family residential district under sections 29620 and 350-12 of the code of the town of Webster yes sir good evening Fred Chelly from BME Associates representing the applicant uh Grove Underhill LLC uh also with us today are Mitchell Brodsky and Jeff Bell from Grove Underhill also Abby D'Angelo from BME as part of our design team uh the applicant is requesting preliminary and final subdivision approval for this project uh which was previously before the planning board uh for a sketch plan Hearing in December of 2023 the project is an eight lot single family um residential subdivision located on 5.5 Acres it's located on the west side of Webster Road it's east of the dead end of coner Cove uh Lane where there's a temporary turnaround and it's north of and adjoining the Webster Conservation area of the bird sanctuary Trail the project is currently vacant and includes sessional growth vegetation and the applicant proposes conventional development of the property meeting the underlying residential R3 zoning uh requirements as suggested by the planning board during the sketch plan review the development will include as I said eight single family lots uh one parcel will be is proposed to be conveyed to the town of Webster for a storm Water Management Facility and then there's also the public road connection uh an extension uh that'll connect Conifer Cove Lane on the west side of the project to Webster Road uh New York State Route 250 uh the the roadway and access point on 250 does meet uh the required site distances and the applicant is underway uh with the coordination of Permitting with the New York state do uh uh also included with the project would is the extension of Public Utilities including public sanitary sewer which will connect to the Conifer Cove existing sanitary sewer water main connection which is under the jurisdiction of the Monro County Water Authority there will be a connection in Conifer Cove right of way as well as a connection on uh route 250 lastly there will be a proposed storm water maintenance area uh and storm water management practices which will include the construction of a drive Pond uh bio retention area both of those practices are proposed to meet the New York State DEC requirements for green infrastructure and uh their storm water permitting and then there will also be site public uh sanit uh storm sewers installed within the rway and throughout the site to collect sight storm water runoff and uh direct it to the storm water facility uh the design uh of the project is has been based or is intended to comply with the town and state requirements as I mentioned with the storm water design requirements and the site run off generally will come in to the site either from the west from the two properties on Conifer Cove Lane and then also a majority of the site runoff that's coming from offsite is coming from the sanctuary Trail site drainage is generally contained within the development area and the air uh the runoff will be collected by storm sewers and directed to the facilities where it'll be treated for water quality and quantity uh it'll be discharged at rates that uh meet or reduce uh under uh existing conditions plan sets uh also includes a landscaping plan lot four of the project which is the adjoint on the south side of the road adjoining State Route 250 includes a proposed vegetated BB for buffering from the state road uh there is Landscaping proposed in and uh in and around the storm water facility uh further increasing the buffering from the site and the the design also includes a a general lot Landscaping theme of two trees per lot and the developer uh plans to um coordinate the individual plannings as provided based on placeholders and uh the Final locations will be coordinated through uh construction uh the home construction one last item on on landscaping and vegetation is that the developer will also look to preserve select trees within the site uh where it's available if it's a significant tree um or a tree in good health and and the grading and uh site disturbance will allow for preservation of those trees the project will require review and approval from the Monroe County Department of Public Health for the proposed water main and sanitary sewer extensions requires approval from Monro County Water Authority for the water main extension and then the dot also has the permitting process for connection of the subdivision Street to State Route 250 as well as the water main connection to the existing uh utilities on State Route 250 uh the applicant will continue uh to coordinate the agency a review and approval um throughout the town's approval phase as well the applicant has received comment letters from the residents at Conifer Cove and also the town engineer uh recently uh the applicant has provided a response letter to the neighbors uh that was copied to the town uh for the town's file um and then we'll also provide uh responses to the town Engineers uh comments after this meeting uh both the neighbor letter and the town engineer uh uh letters included uh comments on the anticipated traffic within the site and not necessarily whether or not there will be a large generation uh of trips from the proposed eight Lots it's more of a consideration to uh potential changes in the distribution of traffic between the existing development to the north of the property and the property itself we've been in contact with Town staff uh and we're working to refine a scope as far as to determine the the scope of that study to figure out and uh come up with some anticipated distribution for the project and we'll continue to work with the town as that as uh we uh come up with more information uh there were also comments pertaining uh both in the town Engineers letter and the neighbors met that letter that uh requested uh the applicant to consider the site runoff we do acknowledge that uh there are some areas that have saturated soils on site um just in regard to this is we've uh We've proposed our storm water management facilities again per the DC regulations these are intended to uh reduce the runoff from the developed site and it will discharge it at rates at or below existing conditions uh the site discharges at the northwest corner of the project into an existing Swale which leads to a a storm water Culvert with then an easement to the town of Webster and that's located on property at um I skipped over it it's uh 1291 Foothill Circle uh the developer also views the project location relative to the sanctuary Trail as an appealing feature and desires to preserve as much existing vegetation along that South line of the project where it adjoins the town's property and we'll work with the uh applicant as far as uh identifying any significant trees that should be should be um retained in there um generally speaking on our on our plans we have proposed a sale along the back property line and we'll look to uh increase that vegetated buffer as much as we can while maintaining the Swale to provide proper drainage for the Lots uh lastly we did receive a correspondence from the town today which raised the question of whether or not this project uh would qualify as a uh the proposed project would qualify as a type one Seeker action we're not aware of any recent or new Seeker regulations or revisions um recently and and we are confident with that the project is would be considered an unlisted action under Seeker uh we do acknowledge though that the State Department of Health has issued letters recently I believe it was in February of this year which indicated realy subdivisions uh qualify as a type one action however that type one action is included Within the list that's maintained by the New York State Department of Health um as that's uh within the within the states list of that uh just a couple of things to keep in mind with that is that uh number one it's defined in the New York state do code not the Seeker code um the New York State Department of Health is not an involved or interested party in this project uh as this is realy subdivisions are typically taken care of uh through the town subdivision code 296 and also with the Monroe County Department of Public Health um this is further supported by the distribution of the do uh do letter to Wayne Ontario and Yates counties only um uh which each of these counties or none of these counties uh uh have a local or a um countywide Health Department so uh in in those cases the New York State health Department addresses Seeker um and they have their own type type one list on there we have prepared a uh a long form eaf as requested by uh by the town and we're happy to provide that to the uh town tonight um however we do not believe that this would be considered a type one action under the Seeker regulations so with that uh happy to entertain any comments or questions from the board as we go through this well we have received some comments from the neighbors and Conifer Cove um we' had meetings with you guys in in the past here um there was a lot of concern about traffic coming from Holly Road and down Bolam Lane and making it a cut through and we kind of just breezed over it well I spent a little time looking at it and kind of understanding it better my opinion anyways and today going through I was looking at I talked to the highway super intendent because generally when a you got a hammerhead like that the intent was for that road to go through that was the intent of this thing um but looking at this I in my opinion I think Highway superintendent is okay with it the way it is leaving it as it is dead end and my feeling is for these eight homes they're rentals they're going to be rental units that's what I heard last time anyways I'm still holding well that's not quite accurate M we don't really know what the market going to all right we have to use the microphone just give us your name my name is Mitchell bratsky okay and I'm the applicant um we are still exploring the possibility of renting houses but but it's not our intent to rent all of the houses and we don't know what the market will bear at that price level okay again back to what I was my thought on this for these eight homes is to make that a private drive and dead end it the same as confor Cove uh you can make that a private road you can make it I don't know if you want to make it a it wouldn't be a dedicated just make it a private drive and uh leave it as a little complex of its own I think that's that's my thought on it um Highway superintendent was okay with it because traffic would I can see that as being a a serious cut through there somebody somebody brought that up I remember at the last meeting and I thought well you know but then after looking at it yeah I can see where that would very possibly be and how how long has coner Cove been there how long have you folks been there we've been there since 199 19 so you've been there So you you're kind of kind of ground into this right yes yeah okay it's not public comment yeah sorry okay um that's my thought on it anyway but you know what it is a public hearing so we'll open it and if anybody wants to get up and speak more than welcome just give us your name and address you have to go up to the microphone oh Sor just give us your name and address yes I'm Isabelle Kaplan I'm at 1278 Clear Pond Lane which is uh on the other side of the bird sanctuary trail from this development I would just like a clarification of what you were talking about about the Dead End Street are you proposing then to have a circle at the end and not have it go through no there would be nothing and and and and kind of for Cove yeah no that would stay just the way it is so how could the houses nothing this new subdivision possibly could have it would have nothing to do with Conor for coov it'd be separate parel but are you saying that a road would cut through and intersect 250 no no no I'm just saying coner Cove would stay exactly as it stands right now yes the new development would have a private driver or whatever more than likely a private drive you you wouldn't have put a turnaround in just for those Eight houses would be a separate going out to 250 well I guess I'm still confused when you say go out to 250 do you mean that one could could be at the corner of 250 in this new extension or you saying the traffic would have to go back no West and then no it has nothing to do with it the eight homes see the way the look at it right there there it is right there yes there's eight homes yes okay they would just go out on to 250 oh so there would be access to 250 they would exit on 250 cuz nothing they would not be connected in other words I'm trying to what he's talking about is only this parcel would be connected to 250 yes people living here would not be able to correct correct unless you want the road to go through I don't think so am I right and another question this storm Water Management Facility is that will you have to use the microphone go back to the mic sorry the storm Water Management Facility does that involve pumps and noise and any kind of activity like that it's just just a pond a pond okay thank you very much okay sure enough yes ma'am good evening I'm Cecilia robell I live at 1291 Foothill Circle um I have not heard a about whether you are dynamiting for basements so please tell us that I have a few questions so I'll stay here until they answer them all wait a minute what is the question you directed to are dynamiting for basements okay you ask the board you don't ask the applicant that's the correspondence what other questions any other ones um there's Wildlife out there has the dec been contacted it's the time where The Fawns um the foxes with their kits have they contacted the dec to decide when would be an appropriate time to start that is a requirement ma'am well it might not be a requirement but we live on this Earth um and I would like to understand more about the drainage I went back when they were doing the um perk tests we didn't have a large snow pack this year um I'm sure they had the figures I'd like to know if they extrapolated for the drainage for when we have a normal snow pack and rain and when it's above normal because right now that land floods my backyard those are my questions hope they three of them are answered generally a subdivision like this the applicant builds it and then there's swales you know drainage pipe storm swer running to the pond that pond is engineer it's not they don't just dig a hole and say Here's a pond I I understand that that's engineer to take care of what the flooding would be in any situation with the residents with impervious surface that would be there that's how that's controlled I understand and that's why they did the perk test to figure out about the water but this was a abnormally drier year so I don't want them just using those numbers for engineering for this year but extrapolating those numbers for when we have regular snow and rainfall and when we have above regular rain they they base that on a 100e storm that's how it's based okay well I didn't know that that's why I'm asking that's that's what they do they base that on a 100e you know rain storm or okay a really big storm 100 year which we get probably three times a year now but okay you know what about basements but that's how it's based then what about basements and what about dynamiting okay dynamiting I I would have to defer that but I don't think there's any reason for dynamiting there is there no I can answer Frome we Advanced our test below 10t so um you know that's typical so we did not R any okay all right thank you ma'am thanks M anyone else yes sir uh my name is Greg michler and I live at 1271 Conor for Cove Lane and I've been there since 1990 I was like the third or fourth house built on the lane um I just wanted to comment on your proposal that we keep the Dead End Street the exactly the way it is today and uh I think that that is an excellent idea um because we've been living essentially and people have bought houses essentially on a dead end culdesac type Street and uh you know to take it through to 250 just presents a whole host of problems we'd have more traffic it's a nice straight road so you know people tend to go faster when it's straight the rest of the development uh north of us has all Curves in it and stuff so that's just a an issue that uh I guess I would like to reinforce is that I really like the idea of if you're going to uh if you're going to take those eight homes and just put them right on to 250 and and that would be it there would be no through traffic that would be great okay thank you um there was an original there one just one other question there was in the original plan um well actually I don't think that M matters now nope it doesn't that's it thank you okay thanks a lot thank you anyone else wish to speak yes sir good evening and thank you for the time my name is Mark Nicholson I live at 1274 Clear Pond Lane I have clear view of this I'm also chairman for the village zoning and planning boards so I've been through this once or twice I've taken a close look at this this has two issues for me I think you've addressed both of them one you told what it what it looked like in the plans here was that there was going to be a connection to Conifer Lane what I'm hearing now is that there's not going to be a connection to Conifer Lane but we are going to still we're going to put Eight houses to exit out on 250 that one I kind of and I have to use that myself on a regular basis there's anywhere usually from six to eight cars waiting to get out on to 250 why wouldn't we turn this right around and take it back in through and I I think the name of the road is MIL Creek that's one that's just one idea that I have if you're going to limit it to 28 um I'm not sure how that works the other the other one is this is a this is a uh cheap Counting let's say I did this from my back porch but there's anywhere between 75 and 150 people that use that bird sanctuary Trail what we've done at the end of this and I think the original plan I saw either took the trail through or didn't go through and I've looked at some zoning maps and it's not clear to me but there's something going on there and the state has put in a road or a a connection between the Chota Trail or whatever they call The Wanted Xerox I apologize and the bird sanctuary Trail so that thing runs around North Pon Park through the bird sanctuary Trail and then over to the Chota Trail and all the way over to the rec center and turns around and comes back okay what I haven't heard is confirmation that this board has decided this is the end of the development you know I'm missing the end of the well what I'm saying is where else do we go if you take a look at the maps got maybe 100 fet are you talking about Webster or I'm talking about Webster we can make a decision on what we Zone that and we can also make a decision on how many more houses we're going to put back there I don't know if you've got any room for any more and what I was hoping the board would do is stand up and say we don't have anymore we need to go to the zoning board go to the planning board go wherever we need to talk about resoning You' got me totally confused and by the way I can help you with that but no I don't think I need help I've been here 48 years I don't think I need any help with this I appreciate that thank you this piece of property has been there anybody could have bought it it's just a separate parcel of land it's zoned residential the developer is proposing residential and the story it isn't confus it isn't anything to do with bird song with the sanctuary or anything it doesn't impact that whatsoever now I if I understood you right you didn't want eight more cars going out on the 250 nope so then okay so then what we'll do we'll open it up so those cars will all go up through Conifer Cove and out the other way is that correct well no don't laugh I mean that was an option I don't know option is I appreciate your comment there is no other option there it is look at it tell me how you what would you do with those Eight houses well I would take them right into Conifer Cove it's eight houses how much traffic is that going to put out and really stop it and likewise why not put those 8 houses not very much traffic you said on to 250 we do that okay I appreciate your comments is there anything else you want to give us apparently not thank you okay thank you my God anyone else wish to comment yes sir I'm sorry I have some questions about Jason Breen 1259 con for coov Lane uh can you just tell just give us your name and address Jason Breen 1259 Conor for coov Lan okay sorry um can you just explain the process how it's going to go on from here like what the next steps are yeah right now I mean I'm just making a suggestion I don't even I'm open it to the floor I don't even know what the board wants to do they might still want to connect it I don't even know okay my thought was just to eliminate the problem guys have been there forever why change it leave the road as it is and just make those Eight houses go out on to um 250 I only speak for my family I think we would be on board with that I don't know how that well that anyway no no that's we won't go there because they got to the board's got to decide this understood but but the process would be this is a sketch this would be a sketch of it you know they're looking for preliminary and final I don't believe we're ready to do a preliminary and final okay on the thing so my only other comment is if developer would like to talk to some of the residents to have some of our input offline we'd be open to that too just a down just do that that's all I have you want to hear I'm sorry you wanted to hear no we just I wanted to me be made clear that we'd like to sit down with him too and talk him yeah I guess yeah all right all go okay thank you anyone else want to see yes ma'am oh yes sir go ahead you already spoke go ahead good evening uh my name is Hugh Lee I live at 1290 con of forco with my wife Grace and I first let me say I appreciate your uh opportunity to open this up to the floor I also appreciate the uh Communications we've had but I most appreciate the suggestion that you just made Mr chair because I think that would Sol just that is only a suggest suggestion for your consideration and I hope that you would all consider that because I think it takes care of many of the issues you saw in the letter as well as uh some of the concerns I personally have uh ranging everything from the traffic that solves that problem to um issues I would have in terms of you know rental changing the potential um character of our Communications of our community because there's of the transition issues any concerns I'd have over the the uh retainment area um I I think that the the traffic area more than uh overcomes those concerns that were in the letter so uh I would speak to some of my fellow uh neighbors that support any discussion you have further and encourage you to consider strongly uh going into 250 and and as as your exit and entrance thank you okay thank you um has anybody the board have any I don't know what do you want to do with it I think your idea is excellent I agree I agree do I Tony that's a win-win for everybody I agree it's a win-win for the people in can for Cove it's a win-win for this particular development cuz we're not going to have tons of cars driving through there as well this is you know it's the right way to go it's definitely the right way to go okay so so for the applicant then let's start with before we do that meeting is still open yes ma'am go ahead did you want to speak sorry or two more things um you got one Isabel 1278 clear F Lane can you please talk about um whether there are closer to that microphone there please the the uh implications of rental properties versus residential owner properties what I don't know anything about um what restrictions there might be or what requirements there might be and and I just have never encountered that thing my other question is if you if you make this short road that goes from 250 only the five or six or eight houses down is there going to be a turnaround so a garbage truck can come in and and then you know get out again this is a dead end right that would be same as kind of for Cove yeah the same as is so it's so it's wide enough for a trucks have to be designed for trucks to be able to turn around okay I'm just curious about you know unless you lived in there and you want them to turn around your driveway they do that sorry say that again no that's I'm just kidding around no I said unless your driveway was there you could make they could turn around you let them turn around in your driveway I'm just kidding around never mind you're not kidding you're kidding yeah okay so can you talk about um the difference between rental property restrictions versus ownership restrictions if if they build the homes and the applicant wants to rent them he has the right to rent them it's like you have your house if you wanted to rent it you could rent your house right I don't believe so not in my neighborhood yes you could I don't believe so anybody can rent their house if it's if it's a single family house like I don't think that's true the only way that that there could be a restricted a restriction to that effect is if it's in the deed is as an exception exactly so now if the development said we don't allow homeowners to rent their property and you buy your property you buy it according to that right but that's not the norm the norm is if you own a property you certainly got the right to rent it and these are going to be new construction and at the cost of what it is for new construction today the rental on a house like that would probably be $3,500 a month well you know that may not be an issue for some people that's but that's not my concern my concern is if there are other factors that would that would be positive or negative for the neighborhood that's all my that's my concern and I don't know what the rules are for the town okay well appreciate it we'll have to look into that thank you thanks a lot there's another oh yeah there you are behind the pole sorry go ahead Wendy Jones I live at 760 Webster Road um I live right down from there I a big concern is left-hand traffic turning into these drives right now what we get is Bell Arbor right there people are waiting to turn into Bell arbo cars are going off the shoulder to go around especially at high 5:00 um Peak traffic times now you're going to have another Street on 250 with people turning left waiting to get in and that was my concern is this many car streets that people are trying to turn into and these cars are just flying down 250 the RO it's pretty scary sometimes down 250 I agree i' like put that out there you look at the other side of it though if the road was con I mean it is buildable that's a given y i but now if we connected it through can you imagine how many more cars would be going down there no I understand that but I so that's a benefit yeah I was hoping like a dead ended be 50 you would be yeah I mean that's at this point anyways yeah well that's what I was hoping I just want to put that out that thank you very much okay anybody else any comments I'll be I'll be quick I think you guys address most of the stuff my name is Pat Stevens I live at 1291 Conifer C Lane uh directly adjacent to this property uh I think Tony what you put together uh addresses most of my concerns our biggest concern was the connection the 250 um I did throw a couple of numbers together um they mentioned the straightaway and the speeding um I took a look at all the connections to 250 all the way down through um the the longest one other than this one that's that was proposed in unless you know the board takes your solution was about 650 ft uh the straightaway section off of 250 with no intersections and no curves for what's proposed here is about 1,300 ft so uh that that's across about 20 streets that connect to 250 within the town of Webster um so this would be twice as long of a straight away than any other Street that's in town and I can certainly tell you that um the speeding and the issues with that would be major so obviously what you proposed would would address that uh then just to talk about the rental use um new construction that instantly goes into rental certainly within everybody's right to do put a single family home into rental if the market supports it which I I think it very well may uh but what you can't do in that situation is have uh Public Utilities to to those properties uh the roadways the drainage the storm water facility if you're if you're renting your you have a rental Community or rental properties uh that you're developing new it that stuff should remain private not be maintained by the other taxpayers if you're running a profitable business with these new developments so um most of the other stuff you addressed I think the the takeaway of the connection um addresses most of my other concerns or major concerns anyway um you know we we hope to continue talks with with a developer about possible purchase of the property you talked about the only way you can deal with it is a purchase it we we have tried but currently that's not something that uh folks are open to so um hope we can progress that but otherwise the what you're proposing uh what you mentioned I think makes a lot of sense okay thanks a lot I appreciate it yeah you're right that's a good point too that would be a RAC track right from uh from Balsam Lane all the way to 250 be one straight shot going down through there yes sir go ahead I'm Sam Kaplan at 1278 Clear Pond Lane um why haven't you considered the possibility of not having um a connection from 250 to this new development and forcing everyone to drive the long way around that would also alleviate the traffic but would not um have another entryway into 250 is that a possibility as well I'm not following you I'm sorry I'm saying to to keep the dead end so you cannot you cannot enter from 250 the cars in the new development have to go out the same way as the cars that are that the houses are currently uh inv that development what are he saying is no no so keep some keep keep a buff there houses go all the way through yeah that's what we were that's what that lady brought up before that that gentleman would that be an equal solution no again as as Mr Stevens just said too that which is a good point that would that would definitely be a racetrack right up through there with the cars going on a straight shot through why don't why would you want why would you want to connect them into there I mean these houses these people where do you live I'm sorry I'm on Clear Pond Lane so on the other side of the so you're not even near there no I'm not right doesn't really affect me that much I'm just okay so I understand what these people are saying they live there they're saying we don't I'm suggesting maybe they would like a different way of looking at it and because of the complaint about cars turning from 250 into this area and and the cars that speed past you while you're trying to make a left turn this will have nobody the way it is nobody's going through and you'd be dead ended at 250 now that wouldn't happen no no it would not definitely be not good planning I don't know you just be extending that road a little bit the what is it Conifer cve Lane you just extend that a little bit but have a dead end before 250 no I I see what you're saying I don't think that would where you guys St that would even make sense what no okay thank you anyone else wish should comment Steve minman 1279 count of for Cove Lane uh I just wanted to thank everybody here today and um just wanted to um agree with your suggestion I think it's a good plan for all on coner that's it okay thanks so I I would take it the consensus is what we're talking about here keeping it separate right y okay can head in that direction you guys want to think that way all right so all right go ahead want come up share thank you Mr chair and be on behalf of the applicant thank you uh to the public for for your comments and input on the project um the applicant actually would would consider that disconnection from Conifer Cove um however uh the the developer would prefer to maintain that road as a dedicated roadway um so that one of the things with that is is if we go to a dedicated roadway then uh if you recall back from the sketch plan we had presented a cluster development and then also the conventional we went conventional based on uh you know the the feedback we were getting at that time um I guess I would would ask the board if they would be open or to reconsidering uh potential for cluster development so that um number one we can maintain a a public dedicated Road um but one of the things that I see is is that could be problematic is if we have a culdesac or a hammerhead turnaround at the end of that that's dedicated to the town we're going to lose some lot areas uh our Lots right now we we've got them at minimum lot sizes right now based on the current code um so that would be one of the the reasonings for pursuing the the cluster development um so we would we would hope to get the board support um what would they give you maybe another couple of lots in there pardon me what would they give another couple of lots overall well no so our our original submission for the proposed cluster uh based on code and the calculations that are required through the town code uh it allowed n nine lot development so you get another lot um yes uh but some of the feedback that we were getting from the town was they wanted to maintain the storm water maintenance all on one parcel so while this project does meet the size requirements for N9 Lots we did lose that one building lot uh for the storm water management area so um you know that that's that's some of those things that we need to keep in mind if we're if we're changing those layouts or changing the uh configuration of the roadways uh another consideration and it it it it doesn't happen very often but uh maybe just a consideration to the town uh a hammerhead turnaround takes up less room than a conventional culdesac does so that might be another uh ask through the conventional uh or the the cluster developing is uh perhaps to get some waiver from that uh I have to admit I'm I'm not too Keen or too up to date on the town's uh development RS as it pertains to Hammerheads versus culdesac but uh we would like to explore that I would suggest maybe is getting together with the with the highway superintendent on that and um see how that would work out I understand what you're saying a hammer had would be basically the same as as kind of for Coes yes and we can we could pull that back away from the actual Westerly boundary Lane wonder if wonder if there would be a way to connect up enough that one hammer head between the two Parcels you know what I mean what do you think yeah okay all right that may be something we'd be happy to sit with the town or perhaps even PRC at the next PRC meeting I think that would be you know what I mean would they have a hammerhead at the end of their road that I don't know how it would work but if you combine it just make one shared Hammerhead winds up being a street that runs all the way through would be straight through run yeah you're right they'd be doing that yeah all right but a hammerhead if the town would be okay with it that's something you can negotiate with Town yeah I mean a color sack and there kind of ridiculous actually um all right and as far as being a dedicated or private road those are things that we have to just get together and figure out how and what what the requirements would be um again your question about uh getting one more you get what another lot in there maybe uh there's there's potential but I mean we would start with what we have now and work work from there so um you know you be okay with with cluster type development it's a small small piece and I mean cluster really doesn't make it any different than what you folks have as far as size it's just a total separate enti also what does that mean I don't see a benefit there a little bit smaller Lots smaller I don't see a benefit of doing a cluster you don't see a benefit to it no okay all right no all right we'll um see what you come up with thank you yes and we'll keep in touch with the town and um we're table for for this evening then um yeah we can we can carry on with Town staff okay sounds good thank you thank you that B yeah well right now right now yeah we have to table it but not to what date you want to table this to any special I don't think we can really know a date yet until we get together and we'll just table it to a future table it for tonight and then perhaps uh just keep it on the agenda for the next for the next meeting for further discuss July July 2nd yeah all right yeah so so I mean so the applicant hasn't agreed to the the call to SEC yet but it's definitely in consideration and it's something we'll work with it between now and the next meeting okay thank you very much all right so we'll we'll all right so I'll make a motion we table this until a motion you the table July second okay that's motion a second second all in favor I okay we're good all right we good thank you thank you all right anything else we've got meeting I think we're done yes sir so what happened to the what happened I'm sorry what happen just yeah until they come in with whatever they the the change but the anyways yeah the road the way it's now the road will not be connected through okay okay that's bottom line everything else is all all going to have to be modified yes okay all right with that I'm going to close the public hearing I guess we're all set May 21st I'll make a motion to approve the minutes from May 21st oh you motion okay I need a second all right second all in favor thank you yeah I forgot to tell you
