Extension Request

Planning Board Resolution 22-091 Project Number: 2023-TB-0010; 1013 Ridge Road-Splash Car Wash (“Project”)

I am a member of FoxFive L.L.C. and 962 Ridge Road LLC, the co-applicants and property owners of the above-referenced Project (“Applicant”). Site Plan approval was granted for the Project at the October 4, 2022 meeting of the Webster Planning Board (“Site Plan Approval”), a copy of the minutes of the meeting are attached hereto for reference. The Site Plan Approval included a Final Approval Checklist. Number 5 of the Final Approval Checklist states, “Significant construction shall occur within one year, as deemed by the Planning Board, to expire on 10.4.23.” The Site Plan Approval was then extended by for one year to October 4, 2024 pursuant to the attached approval dated September 7, 2023. We are submitting this letter to respectfully request that the above Site Plan Approval be extended for an additional year, to expire on October 4, 2025. The reason for the request for the extension is that Applicant and its purchaser (the developer of the Project) are parties to a lawsuit over a contract dispute, which prevents the development of the Project until the litigation is resolved. We request that the requested extension of the Site Plan Approval be placed on the Agenda of the September 3, 2024 meeting of the Planning Board. Thank you for your attention to this matter.
