Welcome to the Planning Board meeting of March 3, 2026. We have quite a

ABERDEEN ESTATES PHASE 2: Located at Hazelhead Lane. Applicant Forest Creek Equity

Corp. is requesting FINAL SITE PLAN AND SUBDIVISION APPROVAL in association with

the development of 20 single-family residential lots on a 17.10-acre parcel having SBL# 050.02-1-

23.11 located in the R-3 Single Family Residential District under Section 269-10, Section 296-18

and Section 350-12 of the Code of the Town of Webster.

Appearing before the board was Jared Hirt with Evans Fox on behalf of Forest Creek Equity Corp.

and I’m here with Walt Baker, the Engineer. (NOT LOUD ENOUGH AND CUTS OUT) As the

budid is aWaie We uppedied before the boaid ia Debruaiy aad there Weie suite Commmelils and

feedback from the board which we took to hear. and we did have a chance to meet with some of

Pg. 36 March 3, 2026 Planning Meeting

the members of the town to discuss some of their concerns and issues. We have submitted revised

plans to the board. We've received comments back from the Engineer and PRC. I believe we’ ve

at a point now where we’re requesting indicated final for Phase 2 and we are tabling Phase

3. So, that being said, I open it up to the board for any questions, comments, and concerns that they

may have.

Anthony Casciani

Weil, | think we’ ve hammered this thing around so much. Mark, did you guys

have anything? I know you had some concerns.

Keith Mortimer

We have comments.

Anthony Casciani

Sure, go ahead.

Keith Mortimer

Do you want me to read them all?

Anthony Casciani

Well, have you given them....have both of you received the list of comments?

They got them, right. So, if you want to address them quickly or whatever.

Jared Hirt

We've addressed all the comments that I’m aware of today in writing.

Walt Baker

We ve received some substanual ones allerwards trom....

Anthony Casciani

And you’ve sent them back.

Keith Mortimer

That’s correct. Oh no, they’ve not sent anything back. We don’t have responses

to the comments. Our latest set of comments.

Anthony Casciani

So, how....... well, we very well can’t move forward with it.

Walt Baker

(NEEDS TO BE IN FRONT OF THE MIC) We just received them last week.

Jared Hirt

The comments that we received, all of the substantive issues that were addressed at the

last hoard meeting have been addressed For example. there was a discussion regarding a

conservation easement that was requested by the town which we sat with the members of the town

and essentially hashed out what that would look like and set forth in the plans 25 toot wide

conservation that would run along the easterly boundary line of the property. There were some

other comments that were set forth that you recall regarding setting specific heights with regard to

foundations, and something along that which have all been addressed. The rest of the comments

that remain as of right now are just, in my opinion, they're more technical in nature.

Keith Mortimer

Well, they’re technical but they're substantial regards to the storm water.

(SOMEONE MUMBLING)

Py. 3/ March 3, 2U26 Planning Meetng

Anthony Casciani

What do you feel we should be doing?

Keith Mortimer

They need to address our comments.

Jared Hirt

At this point, why can’t we approve it with conditions? We’ve gone through this now

three times. So, we've addressed all the..........

Anthony Casciani

Okay, suppose we give final approval for the phase two and no work, or

anything is commenced until all comments have been addressed by the applicant. Will that work?

Okay?

Ketih Mortimer

It’s just going to make....I just wanted to contend that it will make the pre mylar

process longer than what von exnected

Walt Baker

That’s fine.

Frank Ciardi

And they have a list of the comments?

Keith Mortimer

To my knowledge, they do.

Jared Hirt

{he comments are just set forth in your email trom last week, correct.

Ketih Mortimer

We have a comment letter dated on the 24"...

Jared Hirt

I just wanted to make sure that I wasn’t missing something.

Keith Mortimer

I'd also like you not to downplay what our comments are.

Jared Hirt

It wasn’t my intent in doing that. So.

Frank Ciardi

(NOT CLOSE ENOUGH TO THE MIC OR SPEAKING LOUD ENOUGH)

Keep....just so that they address the right part there. Is there comments just related to phase two

and phase three or are they kind of intesral?

Keith Mortimer

Nope, we've separated them out into phase two and phase three.

Drazen Gasic

The only,...thank you for adding a conservation easement. That was really

appreciated. Um, just not being privy to the discussion on the 25 foot with the rear setback being

50 feet. Is there a reason that it wasn’t 50 fool as a conservation easement back.

Jared Hirt

In terms of what you say, why wasn’t the conservation 50 feet?

Drazen Gasic

Yes

Pg. 38 March 3, 2026 Planning Mceting

Drazen Gasic

We’ ve tried to and you can speak more to this but we....yeah, we tried to address it

in terms of what our clear line was and have it in conjunction with that. So, okay.

Derek Anderson

The only thing that...(NOT SPEAKING LOUD ENOUGH OR USING THE

MIC)

Anthony Casciantr

Alright, then let’s do this. Why don’t we grant tinal approval tor phase two of

Aberdeen Estates and make that, well, we will go through our generic schedule here but: No

permits shall be issued until all Engineering comments have been addressed and deemed

complete by the Town of Webster Engineering Department. Will that work?

Jared Hirt

Yes, as long as we can make reference to...there’s a February 24" email that was sent

tous that included the camments and concerns that

Anthony Casciani

Whatever the comments are that you guys....... they can work that out with

Keith.

Drazen Gasic

So, it should not be limited just to that letter though because if you....if you for

example provide a response back but engineering has more comments on those response it

should not be just limited to that one it should be limited to until engineering is fully satisfies.

Frank Ciardi

How about we just say issues germane to the letter.

Anthony Casciani

Okay, we make that and along with that we’ ll make that:

APPLICANT REQUESTED THAT THE APPLICATION BE ‘TABLED.

DINKS AND LINKS

Located at Five Mile Line Road. Applicant Joe Cattalani is requesting

SKETCH PLAN REVIEW AND SUBDIVISION APPROVAL in association with the

development of an approximately 39,100 SF indoor/outdoor recreation facility on a 9-acre parcel

having SBL# 079.10-1-1.11 and SBL# 079.10-1-2.3 located in the HC High-Intensity Commercial

District under Section 769-5 Section 9796-14 and Sectinn 350-19 of the Cade of the Town of

Webster.

Appearing before the board was Joe Cattalani. Hello again. I was before you folks 6 months ago,

{ think in August our last meeting which went fairly well. I had to go through the DEC process

which was a bit time consuming a little shorthand there. In any event, we did finally get through

that process January 8". They told us that we need to develop a solid part of the road. So, over the

next week we submitted to the Planning Board of what that would look like went to ownership from

class LLC to kind of swap land around and the subdivision around so that 1t would work on the

south part which we were able to make work.

The town came back with some comments with respect to where the building would go, where the

parking lot would go, and where the field would go and we were able to make that work. So, all of

that was submitted in early February when the DEC asked for a specific map with wetland

disturbances laid out for the permit. We submitted that in early February and we met. So, the

building has moved around a little bit, and everything is on the south side of the road which actually

works out better from standpoint of people crossing the road. Now the parking is right up there

next to the building. There’s nobody crossing the roads anymore and the handicap parking is right

there instead of being, you know, on the side of the building. It seems to work out a little bit better.

We size the building down to 12 courts fram 14 to 40.000 square feet

SOMEONE FROM THE BOARD MUMBLING. CAN NOT HEAR AT ALL.

Dave Malta

(CAN NOT UNDERSTAND WHAT IS BEING SAID) USED CLOSED

CAPTIONING AND SOME OF IT STILL DOESN’T SHOW WHAT IS BEING SAID)

Relocating the drive that goes around the parking lots.............

Joe Cattalani

Now that’s where you have that, that is the only place that we could put that road.

Number one, it delivers right to our parking lot and number two, there’s two problems. One there’s

a small out parcel that was granted to whoever buys that paree! that’s up in that orange area that |

gave you guys and so if you cul into that. that parcel becomes without value and then on the right

Pg.41 March 3, 2026 Planning Mecting

side, the DEC did not want us to go into the wetland. And it worked out anyways because it come

tight down to the main curb cut into out building. Since the plans the you haver, we’ ve again spoke

with Keith and Josh about taking out the center curb cut and making cross through traffic so that

there’s only two curb cuts which is in the process of being done and there’ll be across the top as

well as the bottom and will do six _ ,but we'll stillbe_

Anthony Casciani

Did you recetve the comments and questions and addressed them all’?

Joe Cattalani

1 have.

Anthony Casciani

And the town....you are good with all this Josh? Not going to go through them

all.

Josh Artuso

Yeah, I think when he goes to submit for preliminary stage that those comments will

be reflected. So, yeah, this just being a sketch plan.

Anthony Casciant

Okay. All right, anybody have any questions.

Drazen Gasic

So, | just want to check. So, the PRC comments had a comment about the proposed

loop road. Does this drawing reflect what was intended in the PRC comments.

Joe Catalani

Yes.

Anthony Casciani

That's going across the north. North edge of the property around the back and

then it cuts back south into the property there.

Drazen Gasic

J mentioned Black Cherry Boulevard extension. Is that something....

Anthony Casciani

That’s something that was from years ago and when St. Ann’s was built if you

are familiar with Black Cherry Lane, it ends at the fence, right and the intent of that was to run a

roadway from there and across the parking jot in that general area of Lowe’s and the town at the

time had obtained a cul permit from New York State to put an exit right on to

104. It was a particular

area. vou know. anta the feeder similar to like 1p in the village there Rut [don’t know what’s ening

to happen with that now. And Black Cherry was actually built the town standards on that road at

the time. That's neither here or there but does anybody have any questions? ‘This again is a sketch.

We have done through it, and we have address the comments from PRC and so on.

Drazen Gasic

I just have one more question. So, St. Ann’s on the southwest side, is that considered

non-residential because the buffer would to 75 feet instead of 50 feet on the south side.

Josh Artuso

It is a multi-high density residential district.

Pe.42 March 3, 2026 Planning Meeting

Anthony Casciani

Alright. We did receive one letter from Dorothy Fait. She had some concerns

on the project and...for the record, what we’ll do is we will enter that into the record, and it can be

addressed for preliminary approval.

Well, it’s not a public hearing, that’s the next one. But you know what, if you’ve got a comment,

we'll let you address it. Just come up and give us your name and address.

(audience member speaking) I’m sorry I'm late to this. I had some health issues so now....

Anthony Casciani

Why don’t you give us your name, please.

Sean Whipple (DID NOT SIGN IN): I own 898 Ridge Road and that’s the Sunset Valley

manufactured hame cammunity TF don’t want to sav that Pm opnased ta this nraiect hut T have

some concerns being that the project butts right up to my community. For those of you that don’t

know Sunset Valley, it's a 55 plus senior citizen community. | am registered with the state, and I

have 53 homes sites in there. The average resident's age is 72 years old. I know pickle ball is very

popular and all, but this could really adversely affect my residents and my community the proximity

of the pickle ball courts. And | would like the town to take into consideration the layout of this

project and then along...... in between my community and the proposed project, there is some storm

drainage that the water comes off BJ’s parking lot and runs across the back of my property and

then u goes behind St. Ann s. ltdoesn t effect St. Ann s because that § the physical plant and then

the water dumps into a retention pond behind Lowe's. The problem is with this development how

it lays out it’s pretty much on top of that storm drain and I’m concerned with flooding and then on

my eastern boundary line | have a storm drain that runs the whole way down the eastern boundary

line and I don’t know if you can pull up 898 Ridge Road....

Anthony Casciani

Well, look, we got a Jong agenda...So, this wasn’t a public hearing. I just

wanted you to......if you want, do this, why don’t you put it all down on a document, put a letter to

us and give it to us. So, when he comes in for his preliminary approval, which is a public hearing

at that time when anybody can speak and then we can address it correctly at that time.

Sean Whipple

Okay, great. That would be great.

in the R-3 Single Family Residential District under Section 296-19 and Section 350-12 of the Code

of the Town of Webster.

Appearing belore the board was (NEVER SIAIED HIS NAME NOR WAS I)

ASKED) really what we are seeking is basically just a glorified lot line adjustment.

The reason we’re here is because it is five lots and it’s remaining five lots. Our goal here is to make

these five lots that are already severely non-comphant a little less non-compliant.

As you can see on the plans there are a lot of buildings that are very over the line, over most of the

boundary lines including one building that’s 20 feet over the current boundary line. Some of these

buildings, including 425 and 429 Ridge, have existed on Ridge Road since it existed as a trolley

line in the 1800's. 1036 Bay Road on lot 4 is one of the older buildings as well. The other buildings

were constructed sometime in the 40’s and 50’s and all five lots were in the same ownership all the

way back to the 40's and 50’s and just recently, as of last year, sold to a new owner, all five lots

and the new owner wants to rectify some of the issues that are at hand.

Anthony Casciant

Are these hooked to the sewer system or are they on separate?

Applicant

So, 429, 425, and 423 Ridge Road all have independent sewer hookup to the town

system, independent water, electric, and gas utilities. 1036 has it’s own hookups to the system

to....they have a leech field directly adjacent to what would be the right side or the south side of

the house and then they have public utilities feeding that. Really the only utility concern is with

1036A. 1036A was built originally built as a guest house and so the utilities have tapped into 1036.

The utilities, the gas and the electric do have individual meters that run to two or 1036A. So

1036A’s gas and electric meters do reside in the basement of 1036 alongside the 1036 meters.

Pg. 44 March 3, 2026 Planning Meeting

Anthony Casciani

You are confusing me. Are they combine or not. Do they al! have there own

services.

Applicant

1036A does not have it’s own water service. 1036A their water is a uniform system

from 1036.

Anthony Casciani

Okay, in my opinion, that needs to be rectified. ‘hat should have it’s own it

you're putting them on separate lots. Each one should have it’s own entity.

Applicant

They actually already are on separate lots.

Anthony Casciani

I know, but the water should be a service going to there directly metered on that

unit not fram the front That’s mv thinking anvwave

Applicant

The thing is, currently lot 4 and 5 are being sought after to be purchased together as

basically one sale. There is somebody interested in those two lots that would like to buy them and

still keep them, you know, adjacent to each other but own them together much like they are

currently owned.

Anthony Casciani

It’s looking like you want your cake and eat it too. Each one should be a separate

jot. Correct? Each one wall be tt's own separate lot.

Applicant

Yes

Anthony Casciani

And each one of those lots should have it’s own independent service-servicing

that lot. That’s my opinion anyways. I don't know of any other situations in town otherwise.

Anybody?

Dave Malta’ (CAN NOT UNDERSTAND WHAT IS BEING SAID, USED CLOSED

CAPTIONING) I mean, you’ re saying that the water service come from 1036 and it goes to 1036A,

right,

Applicant

That is correct

Dave Malta

So, what you're going to sell off [036 and the other lot next to it.

Applicant

So, basically, they’re on their own individual lots currently.

Dave Malta

Yeah, I understand. The service is unrelated to 1036A. It’s going to be different

Owlels.

Applicant

No, Where they're going, where they’ re being sold, those two lots are going to the same

OWiler,

Pg.45 March 3, 2026 Planning Meeting

Anthony Casciani

Suppose down the road he decides to sell one of them on a separate lot.

Applicant

So, that could be a legal binding...

Anthony Casciani

Well, how about we make it now? Make that one of the conditions now. I

mean, that’s standard procedure. You develop a lot, you have to have water, sewer, gas, electric,

you know and if there’s septic tanks. We did receive one letter, and I'll just quickly read it from

Mr. Pat Zan. (SEE Ait LACHED LETTER) So, he has legitimate questions he’s asking here. In

my opinion, something like this needs to be reviewed. I’m okay with what you’re doing, and I

understand what you’re doing, but each lot I believe should have it’s own services going to it and

the health department should probably be checking the septic tanks on those places back there.

They have probably been in there from the 1900’s. And this gentleman’s obviously concerned

because he is aware of the septic, so I don’t know if they’ re functioning properly or not. So, I believe

that should he checked hy Monroe County Health also

Applicant

Okay. I mean we did check that they do exist and there’s no plan to change them and

their location is a significant distance from any proposed line.

Anthony Casciani

You would need several variances and I’m okay with that. You know,

accomplish your goal, | can see that, but I believe you really need to have each one have it’s own

utilities, all utilities and individual to each unit and Monroe County Health check the septic systems

and make sure they are lunctioning properiy and then that would trigger a response, you know,

whether they need to be changed or whatever by the county because that’s who controls that.

Drazen Gasic

Tony | would agree with you. | mean, it's a unique scenario where the subdivision

is occurring in existing lots. In this case, utilities like septic tanks and septic leech filed location

should be identified; water lines and electrical lines; on it as well because leach fields themselves

would ave to have a setback from the property lines. So, it’s almost going to be a check to make

sure that the proposed lot line are set back far enough from the leech fields too.

Anthony Casciani

Do you have to do a SEQR on this?

Someone speaking

CAN NOT HEAR.

Derek Anderson

For 1036A does that have its own septic system?

Applicant

Yes, it does.

Derek Anderson

(CAN NOT HEAR WHEN SPEAKING, USED CLOSED CAPTIONING) So,

that’s separate from the septic system on 1036.

Applicant

That's correct.

Derek Andersoa

You stared cartier talking about the micters for 103GA. Those aie actually you

said, both the gas and electric and water are Jocated in the basement of 1036.

Applicant

Yes. So, the basement at 1036 has a singular water meter for both 1036 and 1036A. It’s

a joint water system. But then there are two sets of gas meters and two sets of electric meters in the

basement of 1036.

Derek Anderson

(USED CLOSED CAPTIONING) They all would have to be separated.

Independent gas services, independent electric service, independent water service, no collocation

property. You don tknow. We re also going to have to find out how you have access back to the

property.

Applicant

Well, there’s...as far as...you mean driving access, they have their own existing curb

cuts and driveways as it is.

Anthony Casciani

But in the even von were to sell whoever owns that house in the hack there

Right there Josh, yeah. That access is from the other side and from Bay Road. That would need

some sort of an easement from those properties in the event something got sold down the road,

right? So, that should all be in place.

Derek Anderson

Now, does 1036 say that parcel actually L-shaped?

Applicant

Yes

Derek Anderson

So, that’s all one big parcel.

Applicant

So....

Derek Anderson

(USED CLOSED CAPTIONING) (Winds up having the residential house on it

the black and metal garage also has the metal barn and steel shed on it.

Applicant

Yes

Derek Anderson

(USED CLOSED CAPTIONING) So those are things that we'll be seeking

variances from.

Applicant

Yes, we have....

Derek Anderson

(USED CLOSED CAPTIONING) Access to the one in the back comes off of the

road to the south. Ideally, you probably want to get rid of the driveway into 1036 parcel too so that

you don’t have feeding both ways of single parcel. But the key is that they’re really both of those

parcels really need to have independent gas, electric and sewer services............ that do not rely

Si). . rage that’s actually... 02... T agree with Drazen this particular area we don’t know where the

separate system is. It should clearly show the layout of the septic system on the sites how the

various things tied into it and also demonstrate how it’s going to be corrected independent services.

Anthony Casctant

Tthink ......, before you actually show i, DP think what they should do is be

contacting Monroe County Health Department and make sure they’re even functioning. Don’t even

Pe.4/ March 4, 2UZ6 Planning Meeting

located, We don’t even care where it is right now . You know, we got to know that they’re

functioning first of all, then locate it .

Derek Anderson

Trying to verify that they truly are.

Anthony Casciani; And any crossing, you know, property lines. You’re going to need a bunch of

variances and understood that.

Applicant

Yes, we know that.

Anthony Casciani

That will fix it up. I have no issues with that. But the driveway that go into the

back and you're crossing that front one on Bay Road, that should have an easement across the

property and that should be written richt in these

Applicant

Well, currently they’re all owned by the same person.

Anthony Casciani

They are separate lots. J don’t care who owns them all. There’s one builder that

can own them. One builder can own them all, but when he goes to sell them, that’s where the issue

comes in. So, rather than mess with it then or get oversold, | think the time to correct it is right now.

sven Vellter: (NOL SPEAING LOUD ENOUGH, USED CLOSED CAPTIONING) I one person

is wants to purchase both of those properties, why can’t they be combined now and satisfy a tot of

the issues they have.

Applicant

Basically, we’d have to get the zoning variances to allow for multiple residences on one

property. Is that what you’re suggesting?

Anthony Casciani

Yeah, there’s no good reason to do that now,

Applicant

It was one of the things 1 was wondering as well.

Anthony Casciani

Alright. Why don’t we do this, why don’t you, when you come in for

preliminary approval. come in showing the lots as vou’re showing them. Something from Monroe *

County that the septic system is functioning properly from Monroe County Health, show any cross

lots how you're proposing to cross them, how you would get an easement be granted, and | don't

know the lot numbers I can’t’ see. Lot number 4 is that the one in the front there.

Applicant

Yes

Anthony Casciani

Okay, they need to grant an casement across lot number 4 to get to....what’s the

lot in the back...Lot

5. Okay, so I think that’s the things that need to be shown on the drawing.

Applicant

Okay. Emean, if they decided to puta fence up over that piece of driveway then access

has been eliminated as well.

Pe. 48 March 3, 2UZ6 Planning Meeting

Anthony Casciani

Well, I’m looking at the drawing, and it shows access going to the right and you

need to take it off the drawing if you are not going to have it there.

Applicant

Okay, I’m just coming up with some options to give the owners.

Anthony Casciani

These are the options.

Applicant

Yes

Drazen Gasic

Locate septic and water lines so that we know what they are.

Anthony Casciani

Each one separate water line too.

Applicant

Is that main concern really with four and lots four, five and six ....

Anthony Casciani

Each one, five lots need to have five separate utilities going in there.

Applicant

Yeah, we do know, like | said, that the three out on Ridge do have separate utilities.

Anthony Casciani

That’s fine. Then the ones, those there, need to be separated going back, lot

ive.

Applicant

Okay.

Derek Anderson

: (USED CLOSED CAPTIONING) I think the thing to keep in mind; this is still

an existing subdivision but effectively resub divide and the drawing should have a level of detail of

a subdivision for all the parcels. Not picking choosing the parcels. Access easements, utility

locations, anything you expect to see.

Applicant

Okay, so you want them on all five.

Walter Wirlo at 1048 Bay Road: (NOT SPEAKING LOUD ENOUGH, USED CLOSED

CAPTIONING) I'm the owner of the property next daor, The cancern | have is the creek that runs

through the middle of this property. And when Mr. Morowski owned the property back then, Elmer

Living who lived behind me is deceased, told me that he wanted to put a house there and the town

requested he had special septic system because he’s in proximity close to the creek. He decided

notto build a house because that was a concern of the....back then. And they had put the driveway

that goes along the person I think it was Mr. ....... who owned the house that | had before that I

purchased. He used to own that property and also some of the property that he sold to Elmer behind.

When he sold that property, there's a driveway was right along the side anid originally the house

was a ranch house with no garage. He came down that driveway and parked in the basement. So,

aty house has a drive in basement. When he sold the property to Morowski, he asked that they get

rid of that driveway because itivas in very close proximity of the property linac. £ don't kiow if it’s

legal as it is or you know, it meets the zoning standards. To answer his concern, Mr. Morowski

Py. 4¥ March 3, 2UZ6 Planning Meeung

just planted a bunch of pine trees along the side there to try and hide it, but the sons were in the

excavating business. So, they had equipment, you know, they could change things, whatever. And

they kept rebuilding that drive to the point where it was a little bit higher and on one side of my

house, because of all that grounds that runs down towards the creek, I get flooding all the time. At

one pint he put a culver... don’t know if he did put a culver just put some stones in there like a

French drain, silver drain but it doesn't work anymore. And I remember Mr............ at one point

his property used to get flooded because his property was in the back property because that creek

went back up because the culver that they had put in to drive across the properties get filled with

debris and so that would create a problem for him flooding and he was a nice guy and didn’t

address the issue because he didn’t want any problems with these things. So, but that's one of the

CONCEINS T HAVEL... cece cee eceeeec eee creek and whatever septic system they put in has to comply

with ....that goes into the bay.

Anthony Casciani

Okay, thank you. Actually, probably you should do that also, then it’s check the

stream, it should be checked and cleared. 1 don’t know. Who would do that Mark? Do you guys

do that or what?

Keith Mortimer

Well, we'd have to understand if it’s private or public drainage. 1 don’t know.

Derek Anderson

: (NOT SPEAING LOUD ENOUGH, USED CLOSED CAPTIONING) Well,

that’s where this uning has lo have a subdivision. You know, show how uulities includes. .....that

all has to be shown how it’s....no different than any other subdivision. It just happens to have

buildings already.

Frank Ciardi

(NOT SPEAKING LOUD ENOUGH, USED CLOSED CAPTIONING) I thought

there were for sale signs over there, wasn’t it? Just recently sold.

Applicant

Yes, it was sold in the fall.

Frank Ciardi

(NOT SPEAKING LOUD ENOUGH, USED CLOSED CAPTIONING) Was it the

buildings as well or was it just acres? | thought it was a sign that said land.

Applicant

No, it was 2.7 acres. It consists of all of this cuz J did all the survev work in the fall for

this. So, it is everything you see here. And then we just manipulated the lot lines to try to do the

best we could clearing the buildings,

Anthony Casciani

Okay, why don’t we do this. Probably just cut to the chase on it. Have your

engineer design this thing like it was a subdivision without the houses. Called a regular new

subdivision and answer all the things that Derek just mentioned. Just like a regular subdivision

coming in. Any steams on there; water flow; the drainage off the site and so on and so forth. Then

that along with Monroe County checking it and utilities being separate utilities going in, okay.

Applicant

Okay.

Py. 2U Maren 3, 2UZ0 Planning Meeting

FEEDBACK PROVIDED:

Submit an updated subdivision map showing the location of all utilities.

e Show and clearly label all existing and proposed septic systems and water lines on

the plans.

Provide separate utility connections for each lot.

Establish and document driveway access easements for Lot 4 and Lot

5. Coordinate with Monroe County Health Department to confirm that the existing

leach field is fully contained within the lot on which it is located.

1037 RIDGE ROAD: Located at 1037 Ridge Road. Applicant Terry Giangreco is requesting

SKETCH PLAN REVIEW in association with the development of a 7,000 SF single story dental

office on a 1.35-acre parcel having SBL# 079.15-1-8.005 located in the MC Medium Intensity

Conunercial District under Section 269.5 and Section 350-18 under the Code of the Towa of

Webster.

Appearing before the board was lan Kuchman with McMahon LaRue Engineers Surveyors here to

present the project on behalf of Dr. Terry Giangreco. Famously known for owning all of the get

Straight orthodontic offices through Monroe County. We are seeking to build another dentist office

here in Webster on Ridge Road adjacent to Brewsters Ice Cream. Looking to build between 6 to

8.000 square foot building with two primary dentists and professional dentists operating out of this

building with 14 to 17 chairs altogether, orthodontist and pediatric dental care. With that said, you

know, we’re looking for a site layout that'll provide a 3 to | ratio of chairs to parking spaces.

Operationally, that means one person in the chair, one person in the waiting room, and one person

checking out. That’s how these dental operations work these days. Pretty efficient.

So, the site that we’re showing provides 56 spaces and gives us about that sweet spot of a 3 to 1

ratio. Looking at zoning code based on the more conservative building layout of just north of 8,000

square feet. We exceed the minimum parking code there. We are looking for monument signage

out front of course sprinkling some landscaping and some shade trees throughout to provide some

more natural buffer to the adjacent businesses along with some streetscaping along Ridge Road.

The verdict still out on how we’re going to do storm water on the site, but rest assured there will

be storm water mitigation on the site while at the sume time trying to maximize building layout and

parking layout. Not a whole lot of space to traditional ponds so it is likely going to he going

underground with proprietary storm water detention water quality. And then | have a little bit of a

pocket behind the building for green infrastructure. So, meeting all the storm water requirements.

One of the big obstacles with he site is going to be some utility relocation. We have a gas line and

some overhead power that transcends out site off of Ridge Road to the U-Haul storage facility in

the back. So. overhead power is definitely going to have to be relocated with RGE_ [think we are

suil in the design phase. Trying to figure out how we re going to handle underground gas, either

work around it or relocate it.

Pg. 31 March o, 2U20 Planning Meeung

We met with PRC last month. We just missed the deadline to get in front of you guys last month,

so we did meet with town staff and Mr. Casciani himself, and we got some valuable impact. One

of which, you know, the intensity of the parking and the use. We’re gonna, even though we’ re not

proposing a new curb cut on Ridge Road, we will be working with Keigh and the engineering

department in New York State DOT to make sure that we’re not overloading Ridge Road from a

traffic count standpoint. We’ve also been in touch with the town sewer department identified that

there is an exisling sanitary lateral available and we're in the process of working with Monrve

County Water Authoring to ensure that there’s also a service available so that new services won’t

be being provided. Just a matter of time. So, yea, we’re working with the architect to fine-tune the

building drawings and designs as we speak. What you see now is a pretty good close representation

of the order of magnitude. I imagine when we come before you with the application, maybe some

slight tweaks certainly going to incorporate PRC comments and then any comments that you guys

have here tonight, So that said, T would like to open it up and get your comments on what we call

sketch or concept application and then take that feedback into the design.

Derek Anderson

(NOT SPEAKING LOUD ENOUGH, USED CLOSED CAPTIONING) Is this

the same group that filled the property for 15-20 years???

lan Kuchman: Nope. Brand new owners of the property. There was a site plan approval | think

half a decade ago, but I don’t think that project ever went through.

Derek Anderson

(NOT SPEAKING LOUD ENOUGH, USED CLOSED CAPTIONING) This

whole....this parcel If I remember right Tony was all part development in the back. Completely

got changed when we turned into.....................08 but it’s essentially the same use that was

included in those plans. The reason I bring that up is because it was part of that overall...... that

one thing that our research existing retention was built as part of that whole development size

Jan Kuchman

(NOT SPEAKING LOUD ENOUGH, USED CLOSED CAPTIONING) Yes, we

are in touch with the engineering department to see if we can get our hands on that original slip to

see if that was for us. Yeah, great point.

Derek Anderson

(NOT SPEAKING LOUD ENOUGH, USED CLOSED CAPTIONING) The

site’s gone through, you know, several different configurations over the years, In particular.

driveway one time was a divided driveway back to a single driveway. Ice cream

Anthony Casciani

How could you get it over there? I think that’s what we discussed already.

Derek Anderson

(NOT SPEAKING LOUD ENOUGH, USED CLOSED CAPTIONING) There

Was deo... eee

Anthony Casciani

(HARD TO HEAR) One nice thing about this setup, too, is that there’s not

another curb cut on Ridge that is coming out of the side there so that’s good

Py. 32 Macho, 2020 Planning viecung

Derek Anderson

(NOT SPEAKING LOUD ENOUGH, USED CLOSED CAPTIONING) Now, it

still works within it. I mean, the original concept of the parcel is.....................08 self-storage,

but the idea of having a dentist office on this parcel has been around.......... access to the driveway.

ee ee |

Anthony Casciani

Probably the biggest concern at the site, you addressed it, is the drainage. How

you going to handle that? Whether you sheet it to some point to a pond you can get to it or in

underground driveway in the parking lot whatever you’re proposing that’l] come in your building

design landscaping want to show that for preliminary approval. You know what to do with the

building.

Drazen Gasic

For me, it’s just, again, it being a road, landscaping. One think may be considered,

Pm not sure if this is the location of the building. but if vou flip-flop vour parking Int with the

building, it gives you a little bit more drainage in the back, but you could also get rid of your

monument signage and just pul signage on the building. Right now, your signage is being blocked

by the hot box that’s out there.

jan Kuchman: Yeah, that’s something that we’ ve been kind of that's why I’m planting the seed that

we may make some modifications because not only drainage but also it might help us avoid having

to relocate that gas.

Dennis Gorlick, Chair of the Conservation Board: (NOT SPEAKING LOUD ENOUGH, USED

CLOSED CAPTIONING) We usually don’t get formal reports at this stage. We’re going to want

beet eseneees as well. Tall trail and on the conservation board. It’s interesting that some of the

comments that you brough up were just exactly similar things that we looked at. We did a

preliminary walk through a couple days ago and um the drainage, we are interested in how you're

going to handle the drainage because there’s a lot of nonpermanent surface. And let’s ee, do you

have the site up again. I just wanted to see what the....there is a swale on the west end that you

mentioned right there, and we noticed that in there, there’s four or five, four PVC stand pipes that

are down because that’s fairly low and the question was how does....we were wondering how that

tied in with existing or proposed storm water rain off it. Looks like it’s something set up initially

to take care of excess connect to a sewer system. Is that part of your plan? That was something I’d

be interested in finding out and also the hack, there seems to be a little swale that seems to be drv

between that your proposed building and the storage area doesn’t really show up much. It does dip

down. Looks pretty dry and the moment, but it get wet and runs olf and back. So, 1 looks like

you're looking at that. That’s some you saw as well. One thing we concurred about was, I’m not

sure exactly from that diagram exactly where the western edge of the property is. It looks like it

jogs around in the back. The little dog led in that coat comes out. And if you go all the way south

which and then goes up right a little piece and then goes back. Okay, so we were curious about that

whether or not any of the trees that sce to be between that product. There’s a few really large,

shaped trees that are there. [ don’t know if those are on your property or the next property next

door. But they’re big and old enough. Josh, I don’t know if you can take a look at some of the

photos that show, So, they appear to be trees that even if they*re not right where you're going fo

have to be doing some clearing, They’re big enough and old enough that you're going to have to

Pg. 93 Maren 3, 2020 Planning Meetung

be really really on these trees. And then those are evergreens. But there’s another picture that

shows and one more, and you can kind of see those evergreens and then you can see the branches

of a very ,very large...................065 It’s looks like a very big vehicle. It’s true. The trunk is

about this big. So, if it’s not on your property, we have to do some clearing under. The conservation

board was concerned about how you can avoid getting to close to that tree to damage it even though

it looks like it’s on the adjacent property as you work.

Anthony Casciani

So, Dennis, can we have them flag the trees that are on the site that are good

trees? Maybe flag the trees, you know or mark them.

Dennis Gorlick

Well, we might be able to mark them, but there’s really only a small stand of

existing trees and again the southwest edge. And I’m not sure they’re really on your property or

they’re right adjacent. but ’'m concerned that if vou go right up to them again trees, which has

happened at some other developments sites recently that we’re concerned about. Like the fact that

there’s a number of....Oh, there’s a ..........0...cccee ee So, it’s a little....that one looks a different

than that arial view. The tree that’s in that little dog ???? leg, we’! probably need to check that

carefully when we get to the next phase. I’m assuming we’ll probably get to...... so, that’s what

we Can do at some point. There was one more thing. Shade trees, the shade trees that had been in

your plan, it sounds like youre going to try and keep a buffer of trees in there, And that was

something please about. So, sounds like you looked at....you know that there’s one picture in the

last second picture [rom the last. in the muddle picture, those are the stand pipes under the stand

pipes. You notice those? So, does that indicated that their might be already an existing storm water

drainage system that you’re going to tap into or is that one of the things you still have to find out

about.

Jan Kuchman

Yes, I can just respond. Do you want me to respond.

Jan Kuchman

So, those stand pipes are old clean outs from the abandoned storm sewer that used

to run through the U-Haul storage facility. When the built the U-Haul, they abandoned it. So, where

that ends up terminating on Ridge Road is actually where we’re going to be tying into our sewer

lateral. Other than that, J appreciate your comments about drainage, the rear drainage and the tree

protection. We'll go our there and mark the trees that will be saved. We will try and save the good

trees.

Anthony Casciant

Okay you are here for sketch plan, and you know where 1m going with the

building type of structure, right and landscaping obviously, you know how all that goes. If you can

fix that nice along the front there that will be good. A little extra. Okay, with all that, I guess we’ re

all set. Thank you.

Appearing before the board was (DOUG BEAHEL WAS NOT IN ATTENDANCE) (NO ONE

SIGNED IN) Larry Adler, and I am one of the partner of Blue Team View. We are happy to be

here to talk about our proposed location on Hard Road. Seven Brew is a drive-thru only, beverage

only coffee stand. We sell expresso based drinks, smoothies and energy drinks. We don’t sell any

food. and we don’t make any food. The only thing that we do have is a prepackage muffin top

The building that we have is a 510 square foot prefabricated building. It comes in three pieces.

We put il on a stem wall and basically the building is complete in three days. Again, it’s a double

lane double land drive-thru, this, the site plan that we have stacks about 22 to 24 cars and has

parking for 12 parking spaces on it and in addition to the building and again...sorry, the building is

only tor employees. ‘he public doesn’t go into the building. It’s only for our baristas and our staff

.We, the 99.9 percent of the traffic will be from the cars. We do allow walk up for customers to

come but it’s a very, very percentage of what we get there. We also have about a 340 square foot

remote covier and storage area. The building and the cooler are clad in a niche which 1s a board.

It meets like bricks and you can see on here and we have a freestanding dumpster corral that also

matches the exterior of the building. So, I know that staff and Erika has some back and forth with

Doug. There was a comment letter thal was sent to us, and I think we’ve either have addressed it

or have noted so that for the next submission you know we'll address the comments. This is a

Remember | think we discussed that. Could that be subdued some or lighten down? It know that’s

your trademark, but Pm going back to...... you’ve got these planning and developing guidelines.

In the guidelines, it's very specific. Corporate branding could be reduced, you know. So, if there’s

a way of reducing the number of those bright purple lights you have, [ think this thing could be a

simple operation.

Larry Adler

So, what we would like to do is as we....the next meeting there’s different ways that

we can shield the Weht in certain areas so that it is exactly what yourre saying. Put it down and it

tones it down just a little bit. It is a trademark and you know if we're near a residential area

Py. > Mareh 9, 2UZ0 Planning Meeung

sometimes, we'll turn off, you know, we turn off the lights at night, but you know, we’re mindful

of the neighbors if there’s an area that we have to worry about. But it is the trademark, but we

want to work with the town and make it work.

Anthony Casciani

And again, I think we can work something out with it, but I don’t think you can

compromise on it. I don't know. I’ve seen pictures at night and it’s, you know, your whole gable

ends and soifils and everything were all lit up and it’s pretty bright.

Derek Anderson

Really should show compliance with lighting. The drawings

Derek Anderson

The drawing itself should show the lumens... BOTH PARTIFS SPFAKING AT

Anthony Casciani

Yeah, they may be able to handle that, but my concern is, it’s corporate branding

and it’s really bright. That’s what I’m saying. If they can reduce that down because that’s what our

guidelines say, unless we just....... don’t know.

Derek Anderson

Make sure it’s reduced down and making sure the lighting stays on the parcel.

Larry Adler

Yes, I think by law regulation we have to do.

but we can look into that and we can also......I know like I said there’s been some shields that will

help abate some of the light that comes out.

Anthony Casciani

Okay, just take that information for what iU(s worth. See what you can do to

subdue the lighting. Other than that, | have no issues. The site is there and it’s the last piece that’s

right there.

Pp. 0 March 3, 24040 Planning Meeung

Drazen Gasic

I agree with the lighting for sure. The other one is your access employee path to the

dumpster. If you can extend that striping into the dumpster because right now your employee

essentially has to go into lane one which is an oncoming lane in order to get to a dumpster with

what they’re carrying. So, if you extend that past the curb for the foot traffic going back there. The

one I think PRC comment had, the snow storage, that one if you don’t mind to. You have curb and

it goes all the way to the east so where are you storing all the snow that’s on site that will

accumulate. The last one for me is just striping so you know blue typically ADA striping and you

have blue that you’re using throughout your site, and it can be confusing what is ADA a path

potentially or ADA parking compared to it all being blue. So, I would encourage you to distinguish

only using the blue for ADA parking and yellow for around the dumpster along your drive lanes

and whatnot.

Anthony Casciani

Your ......how does the drainage go across the front there? Near the pond that

goes across,

Larry Adler

The detention basin in the front............

Anthony Casciani

Okay, It goes right straight across right from Taco Bell and Dairy Queen and so

on, correct. You are going to have the same configuration and then your landscaping, all of that

area, okay. Okay, I guess were good. See you when you come back in.

FEEDBACK PROVIDED:

e Consider revising the pavement striping colors so they are clearly distinguishable

from the ADA-required blue striping.

e Extend the pedestrian striping to provide a continuous connection to the dumpster

enclosure.

Indicate the designated snow storage areas on the plans.

Consider incorporating light-dimming controls for the corporate lighting fixtures.

VERIZON OWN; Located at Lake Road and County Line Road. Applicant Robert Burgdorf for

Bell Atlantic Mobile Systems d/b/a Verizon is requesting SKETCH PLAN REVIEW in

association with a 125-foot telecommunications tower and associated ground-mounted equipment

on a 7.8-acre parcel having SBL# 037.03-1-44 located in the LL Large-Lot Residential District

under Section 269-5 and Section 350-13 of the Cade of the Town of Webster.

(THE RECORDING OF THIS MEETING IS NOT CLEAR AND CUTS OUT AS WELL. HARD

TO HEAR WHEN NO ONE IS SPEAKING CLEARLY INTO MICS)

Appearing before the board was Robert Burgdorl of the law firm Nixon Peabody here tonight on

behalf of Verizon Wireless. (DID NOT SIGN IN) Also with me tonight is Nico Facy. He is a site

acquisition consultant for Verizon Wireless who’s available for testimony to the extent it may be

helpful or necessary. Verizon Wireless is a public utility licensed and regulated by the

Py. > Marcio, 2020 Planing Viecung

Federal Communications Commission and it’s responsible for providing wireless communications

and all of its license areas, which is really most of the United States, but including the Town of

Webster in the cell that we call the Lake Road cell. It currently has inadequate coverage in the

Lake Road cell and to remedy that, the only way to remedy that is to place a transmitting facility in

a technologically appropriate spot in order to cure that....those service efficiencies. In order to

understand why we've selected the site and while we’re here, it helps to take just a minute to go o

er suine basics of cellular technology, cellular telephone technology and design network.

In order for it to work, you have to picture, as the name cellular says, a honeycomb group of cells.

The ideas is to place a transmitting facility in the middle of each cell, the typological middle. So,

that broadcast to the entire cell without unduly overlapping neighboring cells or gapping. So, if

you picture a cell turned upside down, you lift that up and that beam gets wider. Higher the antenna,

the wider the beam, the lower smaller the footprint. As you move in one direction, whole footprint

moves over. If it’s too far west, itll interfere to the west and gap in the east and vice versa. That

and the fact that topography will affect this. It’s incredibly weak, weak radio signal. It’s can’t

bleed into the neighboring cells. So, snow on leaves on tress can impede it. Topography can

impede it. It has also got a plan for population centers and roads where the main traffic is and of

course work in conjunction with all the neighboring ceils. All of this means that there is extremely

limited flexibility as to where the facility can be placed will build the system on the computer and

they'll develop what’s known as a search area and the search area will show and that doesn’t mean

that everything just outside it might not but basically the bullseye where it needs to be. 1 don't

know who’s controlling the screen, but you went to the search area, which is exhibit G, page 8,

that would show you the search area we’re talking about and essentially needs to be in that search

are in order to work, otherwise it won’t work within the network. And we can review the

propagations in a minute, too.

This particular site we’re proposing here at the intersection of Lake Road and Monroe/Wayne

County Road is 125 foot tal! mono pole and | think everyone knows what they look like. It’s nota

tower; it’s not a guide. It’s not like a............ work. It’s like a light standard and this particular

one is ....it would be at 100 by a 100 foot site and we will shelter or equipment cabinet surrounded

by a chain-link fence, When coming to the site and taking that search area, the site acquisition

consultant goes out, and they try to find a suitable site by first finding a Cole location opportunity.

If we can find the existing tower in or near the search area, we go on existing tower, existing

building if it’s tall enough. We then look for municipal property as your code requires if it’s

available. Look for industrial property if that is available and, in the end, we examine the site and

come up with what we think is the best site given the alternatives that are available and that’s how

we ended up at this site,

Procedurally, this requires a special permit from the Town Board and site plan approval from this

board and height variance 125 teet vs 100 trom the ZBA. Procedure also requires county 239 M

review and a notice requirement, So, I want to get all those procedural items out of the way. I

know there’s no decision being made tonight. I just wanted to get those out on the record. I happy

to go aver as much of the RF information as the board would Tike and to go over the site selection

analysis but there are two important points that I do what to raise because | think were think were

Py. 5d March 9, ZuZ6 Pianminy Meeuny

the last on the agenda, so I think everybody’s here for this particular one. And the two topics that I

would like to hit are our claims of health effects and second is effective prohibition on under

federal state law. As to the first, claims of health effects, and I predict that there’s going to be a lot

of folks here that area going to raise fears of heath affects, 1 mean I predict there’s this topic. The

first is that this topic is fully preempted under federal law from being considered by municipality

as part of the zoning process. Entertaining or allowing exploration of this topic is a violation of

federal law. Penrod. It is not a topic that this board can explore, and Verizon Wireless more or less

willfully enforce it’s right in that respect and there’s no basis for it. So, the second point is if

anybody’s actually interested in anybody’s interested in the science behind it and check the facts as

a courtesy because we’re not required under federal law. We’ve submitted a lot of information

already to the town board and that’s available.

So, in reading the facts to he concerned but further on this fact that has alwavs mace the most sense

to me as far engineers have explained it and it’s just common sense. This is a radio signal. Humans

have been broadcasting them for a 100 years. It is a run-of-the-mill radio signal. Nothing more.

The only difference is it is an extremely week radio signal. It has to be because as explained earlier

it can’t bleed over and interfere into the non-cells. So, if one is concerned about this, they have to

be lots, millions of watts in some cases. Where is the concern over the police broadcasts? Tow

truck communications often far more powerful, And if one’s really concerned about this incredibly

weak radio signal coming from the tower, remember that phone you’re holding, it has to be able to

broadcast back to the lower. So, if they check the power density, they better be lar more concerned

about pressing the phone to their head if they’ re being honest about the facts and the power density

that come from radio broadcasts. Nevertheless, despite all that, at previous hearings in this town,

neighbors came out and raised all kinds of odd arguments. They claimed they were lied to about

asbestos. I don’t know what that has to do with this site or they found weird maha sites saying that

cell phones cause cancer. ] have been to three towns since the pandemic where people got up here

and vigorously argued that cell towers cause COVID. I don’t know where to go with that. I mean,

there are a lot of weird conspiracy theories.

If anybody’s interested in science, the information is there. It’s an incredibly weak radio signal.

That’s all it is and we are happy to oblige, but it'll be outside of the process. If somebody wants

more information, it will not be part of this process, We are done with that issue in this town. We

will rely on federal law and not engage further. So again. the town cannot entertain these allegations

of adverse health effects as violation of federal law. It is reversible error. There’s nothing more

we can add to that and won't. On the second topic, eltect of prohibition. | predict there will be a

number of people who just simply say we don’t like it. We don’t want to see it. We want you to

turn it down. Just turn it down. What they don’t understand is that there is no option for that. A

municipality cannot turn down one of these facilities without offering a viable alternate site. Simply

get up here and say turn it down is meaningless and is frankly a waste of everybody's time.

Obviously rely on your own attorney but here’s the law in the nutshell is you still, .,.in all the cases

over the last 40 years that we’ve had case law both federal and state and it's essentially the same

whether you're under federal law as an FCC licensed carrier under state law as a public utility. A

municipality cannot prohibit a carrier from having a site that works in that coverage area, but it may

reasonable regulate. So, what does that mean? It means two things, for the municipality. First it

Py, oY March 3, 20260 Pianning Meetin

8 8 &

can impose reasonable site improvements which is really this board, site plan board it’s typically a

planning board thing; landscaping, security sometimes we move it on a parcel, those are some of

those kinds of site type things. That’s reasonable regulation. The second thing municipality can

do under reasonable regulation is it can require the cure to go to a different site provided and this is

a distillation of all the federal and state law provided it works from a technical standpoint and is

available without unreasonable cost and unreasonable delay works available without unreasonable

cost, unreasonable delay that ia a nutshell and Verizon doesn't care where we are. We could care

less where the facility is as long as it works from a technical standpoint, sites available and we can

proceed without a reasonable cost and reasonable delay. Completely indifferent, completely

agnostic as to where it is. But what a municipality cannot do is simply say no to site if there’s not

an alternative. Once we’ve made our ............... case, which we’ ve done in Exhibit F & G which

is we’ ve shown that we need it, we’ ve shown the need for it, we’ ve shown the search, we’ ve shown

where we need it fo be, we’ve scrubbed the search area. we’ ve shown the alternatives, we’ ve done

all that. So once that’s done, a municipality can’t simply turn it down, it’s got to find it. So, we

always encourage the community if they've got a better idea and sometimes it happens. I mean,

the site act people do a good job. They’ve been doing it for a long time, but we have new sites

where that comes into play, but we won’t go away. So, anybody who just says trend down with

auto viable alternative is just really wasting everyone’s time. With that, with those two points made

we're happy to talk about the search area. We have to talk about what we looked at. We're happy

to talk about the...if you want somebody to put up the site plan to actually show the site plan itself.

There's Just nob MUCh LO tcc eee ce cece ee eae ihey don't. There's no lights on this, by the

way. Under 200 teet , don’t need to light it under FAA. And again, that’s probably a good one, that

picture right there. Which just shows it’s, you know, monopoles or photo simulation and what it

would look like from the road. I think everybody’s pretty familiar with these at the base of the

chain link fence. If you’re not familiar, happy to talk about the RF issues. I know we have a long

agenda, and I don’t want to take more of your time than is necessary. We are happy to answer any

questions the board might have or respond to any questions that are from the public that are

legitimate to be asked.

Mark Giardina

Does this tower include a faraday shield?

Robert Burgdorf

Are you talking about lighting protection.

Mark Giardina

No, a faraday shield?

Robert Burgdorf

I have to have one of the engineers try. If you’re talking about lightening

protection, got a lighten rod. I don’t know what a faraday shield. I have never heard of it. I’ve

been here for 37 years for Verizon. I don’t remember heard of a faraday shield.

Mark Giardina

They use it in the terms in radio where your in the same building where your

transmitter is located, they put up basically chicken coupe wire to absorb any possible radiation.

We're talking about health concerns earlier. So, ] was just wondering if this tower has a faraday

shield.

Although / am not technically a resident of Webster, our home

sits within 300 yards of the proposed site, with our property

lines less than 100 yards away. We do not currentiy struggle

with cell service and the tower would stand right outside our

doors and negatively impact part of our everyday life.

We are preparing to start a family, and we chose this home

because it feels peaceful, hopeful, and the perfect place where

our future chitdren would grow up. We imagined quiet

momings, kids playing outside, and a neighborhood that felt

Saje and natural. A 125-foot industnal ceil tower across the

street is deeply upsetting. While the FCC has established

exposure guidelines and regulations, research on fong-term

exposure ~~ particularly conceming fertility and reproductive

health —~ is sti being conducted. As someone hoping to

become a parent, it is difficult not to worry about what that

could mean for our future family.

Beyond potential health concerns, this tower would disrupt the

entire neighborhood. Instead of open sky and the peaceful

setting we fell in fove with, we would face a constant industrial

presence. it would be a daily reminder of something we never

evpected to live beside

We understand the need for retiable cell service and we are not

against progress. We are simply asking that careful thought be

given to placing this structure farther from residential homes.

We want to begin this next chapter of our lives feeling confident

in the safety and serenity of our surroundings — not

Proposed celt tower at Lake Rd. and County Line Rd.

My name is Kelly Rasmussen, | am writing to strongly oppose

the proposed construction of a cell phone tower right across the

road from our home and in the heart of our neighborhood.

lam the mother of two young children and as a parent, my first

responsibility is to protect my children’s health. safety and well-

being. The thought of placing a large industrial tower so close

to where families live, play and raise their children is deeply

troubling. While some agencies, including the Federal

Communications Commission, set exposure guidelines, |

remain very concerned about the long-term, cumulative effects

of radiofrequency emissions- especially on devetoping bodies

and brains. Science continues to evolve, and when it comes to

my children, unceriainty is not something | shout simply

accept.

Beyond health concerns, this tower would permanently change

the character of our neighborhood. We chose to buy our home

in this area because it is safe, peaceful and family-oriented. A

tail cell tower would dominate our skyline, replacing the sense

of comfort, security and nature with an industrial presence that

does not belong in a residential nature setting containing young

families, children, animals and wildlife.

Safety during severe weather events is another concern. As a

mother, | cannot ignore the fear of structural failure cr falling

debris during strong storms. Even the possibility of it adds

unnecessary anxiety to daity life. Additionally, construction and

maintenance activities could increase noise, traffic and general

disruption.

We have no issues with cell service; we do understand the

importance of it However, that need must be balanced with the

rights of families to feel secure in their own homes. We

respectfully urge decision makers to consider alternative

tocations that are farther away from residential homes.

designed to keep them safe and allow them to play and exptore

the outdoors and not have it be dominated by industrial

infrastructure. Would any of the board members want to look

out your window or walk out your front door and immediately

see a 125ft tall industrial cell phone tower?

For these reasons as a concerned mother, | ask you to put their

well-being first and consider alternative locations. | respectfully

request that decision makers carefully evaluate the impact on

It goes through the tower though. You still have power going through the tower,

You have electrical power versus an RF transmission. Are you talking about the

Mark Giardina

Talking of the power generated from the tower itself. The whole tower.

Robert Burgdorf

The tower doesn’t generate any power.

I used to be in radio business. They used to have faraday shields at one radio station

There's a concern that I'm sure some of these people have about, you know, health. You're saying

Robert Burgdorf

I have never heard of a faraday shield in almost 40 years.

A report from the Environmental Health Sciences organization

identifies the risks, normal accepted distance standards and

recommendations for cell tower placement.

Thirty years ago in 1996 the Federal Communications

Commission recommended 1500 feet of distance from

residences. Since then numerous states, communities and

other countries have set not just recommendations but

requirements of 1,500 to 1,640 (1640 feet equals 500 meters)

or outright banning them.

Public information shows that property values for adjoining

properties will be negatively affected. Both from the RF

towers near residential properties reduce home values and a

family's financial investment. and homes are usually the single

largest mvestment for families

A study in the Journal of Real Estate Finance and Economics

found:

* Multiple filings to the FCC note that cell towers negatively

affect aesthetics and property values.

* Asurvey of 1,000 buyers found:

* 94% are less interested in a home near a tower.

* 79% would never buy or rent near one.

classifies cell towers as a “Hazard and Nuisance”, requiring

appraisers to adjust values automatically downward by almost

proposed cell phone tower at Lake and County Line Road

| would like to go on record as being strongly opposed to the

proposed focation of this cefl phone tower. | am very concemed

the home of Kelly and Dan Rasmussen who live directly across

the street approx.300 feet from proposed location of tower.

There are 2 young children living in this home. My primary

concem is for the health impacts of tiving so close to a cell

phone tower. ims Concem 1s supponed py segnincant research

(one example attached below). Additionally, there is little doubt

that building the tower in proposed location will significantly

reduce property values of homes immediately adjacent to

proposed site. This is also supported by research from the real

estate industry The Verizon proposal laughably indicates that

this celi phone tower will actually increase property values!

Windmill Farms will enjoy significant financial profit from thus

project- the contract with Windmill Farms contained in the

Venzon proposal includes a signing bonus, a monthly lease

and an annual escalation clause. The dollar amounts were

redacted from the proposal, but quick research indicates that

average monthly fee to Windmill will most fikely be in the

neighborhood of $3000. Windmill Farms has several other

possible locations on their property which are sti within the

zone requested by Verizon and are further from existing

homes. Seems that since they are the ones who will profit if this

proposal moves forward, that the proposed tower be located at

the back of their orchards where it will be less of an eyesore

pose fewer health risks and have less negative impact on

values of adjacent properties. This would be a much more

neighborly approach by Windmill Farms.

Additionally, the proposed height of this tower is 125 feet which

is significantly higher than the current 100 foot height allowed

by the Zoning board.

Proposed call tower at comer of County Line Rd. and Lake Rd.

Verizon claims that a new tower ic needed at the mtersertion of

Lake Road and Monroe-Wayne County Line Road in the

northeast comer of Webster in Monroe County. The reason for

the tower is to, "remedy service nadequacies in and around

the northeastem area of the Town of Webster." That statement

is quoted from page one of the 140 page document prepared

by Nixon Peabody on behatf of Verizon/Belt Atlantic Mobile

vysrems. [live at 1280 Lane Road aiid iy iuuse is 450 feet

Also, as Mr. Janson commented in this same forum, residents

in this area wif suffer decreased home values in addition to

significant impact on potential buyer interest if this tower is

constructed at the proposed site. | have consulted with a

prominent Real Estate broker who works extensively in thie

between. I don’t know where the property line is, but it looks like that farmland is all part of the

Windmill Farm. So, it’s all there. So, the location where it is on that spot right there Josh, if you

go down Wayne Monroe Wayne County Line Road and go down to that house that I believe is the

estate or the home and that’s the grounds Windmill Farms. Now, if you go just a little bit below

that right there, there’s a driveway that goes in back to that field all the way back. In my opinion,

that cell tower could be located way back there by those trees and you're still going to get the same

reception. | think that would appease a Jot of the people. I’m hoping that will be the case and this

isn’t new to us. I ‘ve been here for every cell tower that came into this town from the very first one.

And we’ve had them relocate several. There was one......1 want to tell you a little story. On Bay

Road there was one that if you went north or south on Bay Road, where the Masonic Lodge is there

and you would have looked at that tower right in front of you because there is a little slight curve

in the road. Asked them if they could relocate that back onto the...... long story short, they located

it hack on the masonic temples property back there. You ride down Bay Road, you don’t even know

there’s a cell tower there. Ihe one on Lake Road, by Pellet Road just a couple years ago we had, |

don’t know 2-3 years ago wherever it was now I don’t even know and that came in, they got it

located all the way back . There were concerns and people saying the same thing, I don’t want it

and bottom line is I don’t want to see a cell tower. That’s a big part of it and I understand I wouldn’t

cither. So, they located it all the way back in the property. Is it a bad thing now, no. You know

what, if you ride down Lake Road, | bet you several people here ride down and you don’t ....never

seen that tower, your neck will have to turn 95 degrees to see it back there in the woods. And I

think this could be located and done the same way. They would not have to disturb the farmland.

They could utilize. ...the way I see it, that farm road that’s there currently to put that tower back by

that woods. And I think that would be a solution that everybody would be able to live with. I’m

hoping that will be the case.

Robert Burgdorf

It’s very helpful input, Mr. Chairman. That’s the kind of thing that we’ re looking

for. What we will do if this is the board’s desire, that’s the message we’ re getting is we will go back

to the landlord. It’s got to be available. We'll go back to the landlord, has to be retested by RF. It’s

so close that, I don’t get to make the decision, it has to be retested. And the Town Board has also

got to prefer this because we got a special permit there. So, we will do our due diligence and see if

we can make that work. But we have no objection to doing it. We are completely agnostic as to

whether it’s at the corner or back there. If it works and we can get the right permissions.

Anthony Casciani

‘The closest resident to this at that point would be the owner of the property.

Again, you don’t have to build. If you came in off .,.relocated it back in that ficld off of Lake

Road, you would have to put a driveway going all the way back there and you would have to cross

that creek, and I don’t know what that creek is. ] think that maybe a major......

Mg. 62 March 3, 2026 Pianaing Meclig

Anthony Casciani

That is why I am suggesting coming off of Basket Road or off County Line

Road going and putting it back in that field. No one will ever know that it’s there and that could

solve this whole issue.

Drazen Gasic

Don’t break my rule, Tony. This is just because it’s so sensitive and just for people

in the public, it is important to know that a lot of this information that Mr. Burgdorf indicated is

available to town for you to view as well. One of the things I quoted with the rest of the town is

just making sure the information is accessible to the community to kind of answer those concerns

to reassure you about the science that’s there. You know whether it is a QR code with the same

application materials so it’s digitally available to the direct neighbors so that way they can review

it for themselves or if it’s on a website or something for them to look at. You know, just having the

correct information out there can help a long way with the communication in town.

Robert Burgdorf

I agree, may I suggest, the information we have submitted some very good

information to the Town Board. It wasn’t part of this particular process. So, if the town was able to

make that, I don’t know how you do that with your website....

Drazen Gasic

If it’s available at the library. The physical copy is usually more accessible at the

library. Thal was one thing we put up there. The other one is just the current location, like Tony

mentioned, if you’re right on Lake Road, you are driving up and down the hill. The first thing you

are going lo sec is thal. Hs a vicw sore. So, besides the health concern, there is always the view

concern, Similar to Tony, I spent a good amount of time trying to see within the existing land owner

where could it be a good location for this. So, Josh roughly where your cursor is...if you just go a

little bit farther south...a little bit more down....right there is, I have GIS resources and that area

was outside of a wet landing concern hydrology concern. It’s slightly higher from the location

Tony had but again, it’s a lease agreement so you could offer the land owner a more upgraded

access road that they could use for farming while you also have access to the back. The other

location that I found because again you're really looking for a 76 x 36 panel. That’s essentially

what is your footprint of your fence limit would be, and this would take you out of our side of our

township is across the road. If you just go a little bit more south there, you’ ll see...going south

right there, you'll see that road right there in that location you are well within I think more than

couple a thousand plus feet away from any neighboring resident owner. That is, right there, 140

foot by 80 foot of a space pad and you would just have to maybe upgrade that a little bit road hack

up to...but you’re within your zone and I’m saying is this...is like Tony said you’re so far secluded

that you’re not visually going to sec it.....LVERYONE SPEAKING AT THE SAME

TIME......same land owner.

EVERYONE SPEAKING AT THE SAME TIME.

Drazen Gasic

Yeah, this considered your V zone that you had and the same land ownet

Anthony Casciani

I don’t really care where you locate it. My point of this whole thing was get it

off of Lake Road and put it back in the woods, Now, vou can go on the east side. west side

wherever. Just ....

Py. GS Mamwiros, 2020 Piaiiiung Viccuig

Robert Burgdorf

That one may be a bit far to the south. Again, they are......... we're starting to get

pretty far from the search area, but sometimes it works. So, we'll have it tested.

Drazen Gasic

And my last comment, just the collocation policy that you have on here. So, you

know, you can tell us what your equipment will produce, but whoever you lease to on that tower it

just seems that your collocation policy is not very limiting to leaves it open to somebody coming

in putting something on there. So, 1 wonder if there’s anything with the town that later on whoever

proposes to put anything on the poll would have to go back to the town for approval as well. But

again, it’s not very limiting. It’s only three lines.

Robert Burgdorf

This approval would not apply to others. Any other carrier would have to come

for approval to this town. What most towns ask us to do is to make a very liberal collocation policy

because they want carriers to be able to go on our towers. They want us to go on other towers. And

with all the major carriers, we have master license agreements, which means we go into another

town, and we point to it and there’s a site license agreement that’s already worked out. So, this

collocation is....... there’s great pressure.

Anthony Casciani

Alright. Again, just for the record, we'll lake these letters thal were sent and we

can’t read them all tonight because most of them just came this afternoon. What PII do is Pll give

them to Katherine and will put them in the file, and we’ ll send a copy to the applicant and let them

address anything on here they feel needs to be addressed when they come in for preliminary. Again,

this is simply a sketch plan. There’s no conversation, no open floor, or anything else. So, is that

working okay so far for everybody?

SOMEONE FROM THE AUDIENCE YELLING OUT, WHEN WILL THEY COME BACK

Anthony Casciani

It will be published before. Now again, not a public hearing. I know some of

you live near by and across the street and here and there. There’s all kinds of stuff and stories going

around and half of them are bull. Pll keep it short with that.

SOMEONE FROM THE AUDIENCE YELLING OUT

Anthony Cascian1: Hold on, so what we’ll do, I'll open this if somebody has to come up and speak

and say something. We will give you two or three minutes. Just a short, bul please, if somebody

else want to, don’t repeat the same things and let’s don’t beat it to death. Just....if you have

something new that can help us, God bless you.

Robert Jansen

I live right across the street from where this would be. Okay, if you could pull up

page 105 aad Ewill show you where ay hioiese ts,

Anthony Casciani

Okay, so you are close by.

»

Py. G4 Maich 5, 2020 Vlauinig Mecung

Robert Jansen

Yes,385 feet. Okay, I can’t talk about health issues. 1 would if I could, but I will

address the issues of value. There’s no question that towers have an effect on property values that

are located nearby. In this proposal on page 125, you will find a list of 26 properties that are

within 500 feet of the proposed tower. There’s plenty of evidence that the journal on real estate

finance and economics that did a thousand per buyer survey and asked them, what would you think

about being near a tower? 75% said, “No thanks. I don’t really want to buy or rent there. 94%, I

would never buy near there. Average cost to the nearby properties someplace between 10 and 30%.

In my case, that’s 50 to 150,000 dollars. That would be the impact to me. Who would reimburse us

for that loss of value? And in most cases, a home is a family’s biggest investment. So, if you take

that kind of hit, we have some real new homes in our neighborhood. This is called a rural

neighborhood. We've had four new homes go in across the street in the last year or two. There's

another development, three homes going in just up the street from that. There's a new one right at

the end of the field. That's my house at the far end of that picture. There’s the tower. We’re 380

feet from that. If you have to turn left and look across Lake Road in this package of proposal, there's

no picture that shows that right across the road there are a number of homes. They're about 400

feet. So, the value would be significant. That is a major concern to us. | appreciate Mr. Burgdorf's

comments about being willing to look at proposals on the farm. I understand they have every right

to do what they want. There's a lot of lund. You think you could push back to the edge of the

orchards on both sides.

Anthony Casciani

Well, that’s what.... why we're suggesting to take if off that spot and move it

back.

Robert Jansen

There’s orchards on both sides and counties. We could go way back on both of

them and exceed the 1500 foot kind of standard accepted level now. If you look at the literature, so

! appreciate the ability for people to consider another choice, getting back in the orchards would

be great. Thank you for taking the time.

Anthony Casciani

Okay, anybody else. Again, my point here is reading your letters, and ] think

everybody’s got the same situation. You don’t want to see a tower right on Lake Road. And I

would have to agree 100% with you on that. And what we can do is the best we can do and that

being hopefully they cooperate and can relocate that back in......I don’t care if it’s on one side of

County Line Road or the other side, just get it hack in the woods somewhere. And we’ve done it

before and they have cooperated very very nicely in the past. And again, we’ve had a lot of towers

come into the town, And this one here, what you folks are doing here is no different than any other

tower that’s ever been here. So, the only thing they have to get a variance for the extra 25 feet

because our code says 100 feet. In my opinion, I think the code...1 spoke to the supervisor earlier

and | think that’s something that should get changed. Allow 125 feet. We though years ago at 100

feet we'd not have conspicuous towers, but then it turned out that you needed more towers because

they didn’t reach as far. So, with that said, we'll end with that and hopefully, they can change it,

ADMINISTRATIVE MATTER:

Anthony Casciani

When Lowe’s originally came in, it was developed and built and so on and so

forth. One of the stipulations was that there was to be no storage. They have been meticulous

with keeping their site clear for years. We’ ve allowed them to put lawnmowers, snowblowers,

and miscellaneous things in the front. The kept it neat and clean and so on and so forth. A little

while later they wanted to put some sheds over there and we were a little concerned initially, but

We went along with it. That was along the west property line there by the roadway and I think

you’ ve got like four of them there, something like that, no big deal. That has not created any

issues. And now they’re proposing some parking spaces for some trailers. And again, this isn’t

like it’s right on, on the main highway like you go our Ridge Road west and it looks like flea

markel. You know, everybody's got everything out in front of the stores and stuff. This is kept

well managed very nicely.

Appearing before the board was Hans, the store manager from the Lowe's and | am here with

Joseph Ster, my operations manager. Thank you for the opportunity to come to the board. As you

can see on the image, what we are asking for is to be able to set up and propose up to |5 spaces

little wider than a parking spot. I am just asking for your approval on the said location to

Sven Vetter

My only question is, thinking back on the pickle ball courts and how their traffic is

going to flow. How would that impact the traffic flow.

Anthony Casciani

1 don’t think it does at all because it’s totally a separate piece. The road is all

One of the towns concerns is an image from last spring and there was a large

stockpile of mulch in this for a good period of time. As the other properties develop and this

access road becomes heavily used, I just think you should keep in mind not to keep as many

stock piles of mulch in that location.

Anthony Casciani

Okay, so you’re stockpiling your stuff. Probably need to move some of them.

Pp. Gs Miaich o, 2026 Vlaaimiiig Mlechiug

Drazen Gasic

The other concern Josh, just is the bad mulch and there’s always those months and

you have rain events phosphorus coming from the mulch that’s going into the storm water

system which could green plumes even more. So, just be careful if your keeping this amount of

storage should really be in an enclosure somewhere.

Anthony Casciani

Yeah, That all. It’s all bagged and sealed. That stuff is not loose. They don’t
