Paul Adams, Finance Director, provided explanations for the following budget transfers and
budget amendments. He explained the budget transfers essentially cover the employee
compensation changes from the settlement of the White-Collar Union Contract. There were also
some health insurance changes which put everyone on the high deductible insurance plan and
that meant the amount for health savings account contributions went up. There are four main
pieces to the budget amendment. There is a $120,000.00 transfer from the General Fund to the
Finn and Gravel Road Retention Pond Project. The Town is hoping to receive additional grant
funding for the Project. There is a $55,000.00 transfer to handle the Courthouse repairs. It was
previously authorized for $180,000.00. The amount of $125,000.00 had already been transferred
so this second transfer fully funds the Project at $180,000.00. There is a $238,000.00 transfer
from the General Fund to the Highway Building Capital Project. The Bond Resolution was
passed on February 23, 2023, and the expenses incurred for the Project prior to that are not
allowed to be part of the Bond. So, they have to be covered by the General Fund or through
some other means. The Parkland Trust Fund Budget is being expanded by about $290,000.00 for
the purchase of twenty-eight acres of land on Herman Road. To cover the cost of the purchase,
the Town is receiving a Grant of just over $270,000.00 and there was a donation gift from Mary
Dombovy for around $30,000.00.
Resolution No. 270: MOTION by Supervisor Flaherty, seconded by Councilwoman Cataldi, to
approve budget transfers as presented by the Director of Finance.

Mike Crosby, Verizon Wireless Radio Frequency Engineer, and Steve Fantuzzo from the Nixon
Peabody Law Firm appeared before the Town Board to request the Town Board refer to the
Planning Board an application to construct and operate a rooftop microcell wireless
telecommunications facility on an existing building owned by St. Ann’s Senior Housing located
at 900-965 Cherry Ridge Boulevard.
Webster, like many towns, has areas of better coverage and areas of worse
coverage and that coverage can be defined as both coverage and capacity. In this case we have
in building coverage issues. We have a notorious long-time problem area, which is the Lowe's
Hardware Store, that is something that we have heard about for years. This site started off
originally intended to help improve that particular area and that was why we had originally
named it the “Five Mile and 104” site because it was just generally in that area and that is often
times how we name the sites based on where that coverage area is intended to serve. In the
process of trying to identify the best location that would have the least intrusive means to impact
the community but yet solve the problem that we are facing, our real estate people scoured the
area looking for different options and the rooftop of the Cherry Ridge buildings came up.
During our visit with those folks, to do what we call a design visit, they made sure that we were
fully aware of how bad the coverage was inside their buildings and asked us if this site was going
to fix those problems. I advised that this site was originally intended to serve from their facility
towards the intersection of Five Mile and 104 but since we were there it certainly would help us
because our other sites, like the Schroeder rooftop, this site here at Hard and Ridge are all
experiencing congestion capacity issues. So, in order for us to offload the capacity related issues
of the neighboring sites, we have to build a new site that has dedicated dominant service to a
certain area. So, we examined what our intentions were for the site, and we identified that in fact
we could add a second antenna that would also help to improve the coverage throughout the rest
of their facility. It is really a matter of killing two birds with one stone, so to speak. I think that
that is the best use of our opportunity here and like I say it does help the other adjacent sites,
specifically Schroeder which is also severely overloaded. We have plans in the future that we
want to come back and try to make that particular small cell a little bit better. That is part of our
natural evolution of the sites is as new technologies become available, as we acquire additional
bands of spectrum from the FCC, oftentimes we have to come back in the future and do some

Webster Town Board
upgrades either to antennas or additional radios or things like that. There is other natural
evolutionary type work that will be coming in the future for the adjacent sites. We have already
done that in many cases but for this particular one this is a natural puzzle piece that fits in a
particular area for us. I think that anybody that has used Verizon service in Lowe's are already
well aware of the issues that we have there. The residents and the administrative staff of Cherry
Ridge have definitely made us aware of their concerns as well, so we are confident that this will
in fact be helping them as well.

Supervisor Flaherty stated that the next proposed Resolution has been presented and bantered
around for a couple of months. Mary Herington, former Town Engineer, did a presentation a
couple of months ago regarding the consideration of a time and materials standing contract with
one of the engineering firms to help the Town where needed on special projects.
Josh Artuso, Community Development Director, stated the Resolution is for general engineering
support for assistance with engineering reviews, signing off on site plans, etcetera in the absence
of a Town Engineer.
Pat Stephens, Highway Superintendent, shared that the services will definitely come into play
with the Stormwater Pollution Prevention Plans (SWPPP) moving forward which Mary was
definitely the primary reviewer on. He is very familiar with all the tactics but having someone to
help with those big and small projects moving forward is something the Town is going to need in
the short term.
Resolution No. 274: MOTION by Councilwoman Cataldi, seconded by Councilman Cahill, to
contract with and authorize the Town Supervisor to execute an agreement for Professional
Services for General Engineering Services with the MRB Group, The Culver Road Armory,
145 Culver Road, Rochester, New York 14620 at standard hourly rates for each applicable
billing class plus reimbursable expenses. The term shall be on an as needed basis up to
December 31, 2023, and is subject to an annual renewal option between the Webster Town
Board and MRB Group.

Roy Meyvis, who attended the meeting but did not appear before the Town Board, has requested
a License Agreement to install a shed within the Town drainage easement.
Pat Stephens, Highway Superintendent, is supportive of the owner’s desire to install a shed

the placement of the shed and the shed will have no negative effects on the drainage of the
overall area including the neighboring properties. All zoning and permits approvals are required.

Eric Kronenberger, who attended the meeting but did not appear before the Town Board, has
requested a License Agreement to install a fence within the Town drainage easement.
Pat Stephens, Highway Superintendent, is supportive of the owner’s desire to install a fence
within the drainage easement along the eastern edge of the property. The fence will need to
remain outside of the easement, 10’ from the centerline of the existing drainage pipe, along the
southern property line. All zoning and permits approvals are required.
Resolution No. 283: MOTION by Supervisor Flaherty, seconded by Councilwoman Nguyen, to
grant limited relief from an established easement at 436 Pineville Lane, Webster.

recorded in the Monroe County Clerk’s Office in Liber 282 of Maps, Page 98, on and along the
rear (eastern) and right (southern) boundaries of the property at 436 Pineville Lane, Town of
Webster; and
WHEREAS, Eric Kronenberger and Kimberly Saxton are the owners of the property located at
436 Pineville Lane, Town of Webster, Tax ID #050.03-6-59; and
WHEREAS, Eric Kronenberger and Kimberly Saxton have applied to erect an approximately
186 (total) linear feet of fencing as follows: six foot high wooden privacy fence along the
southern property line, 90 feet of six feet tall chain link fence along the eastern property line,
and 16 linear feet of six feet tall wooden privacy fence along the northern property line of
436 Pineville Lane and upon and within the aforesaid easement in conformance with the height
and setback requirements as set forth in the Code of the Town of Webster, and that in the event
the placement and/or height of such fence is not in such conformance, such fence shall not be
constructed unless the proper variance(s) is/are received from the Town of Webster Zoning
Board of Appeals; and

aforesaid six foot high wooden and chain link fencing to exist upon and encroach within said
easement; and
