captions Language: en :3 p.m. eastern time daylight savings time may I uh so we're going to start our Thursday March 14th uh Webster Town board Workshop um for those at home uh they probably have seen the augmented uh agenda for tonight we have four items for those at home that can see it and I'll explain to the people at the audience tonight we added a a fourth item at about 5:00 um and we will do it last after the three um presentations and it is going to be a resolution um the town board members will discern a resolution to set a public hearing for March 28th two weeks from tonight regarding uh changing the town code as it pertains to The Residency of the Town engineer position that be best way to describe it Bren and Charlie yes yes yeah okay so um but first up tonight we have a presentation by Bridget Harvey our communications director on the production of town board video and audio in this room for the town board meetings the planning board meetings and zoning board meetings so I'll hand A Time To You Bridget thanks Tom thank you for the opportunity to discuss the production of meeting videos for the town board meetings the planning board meetings and the zoning board meetings over the past four months I've been working with side supervisor Clarity Deputy supervisor caldi Steve peace Paul Adams other staff members of the town and Dan agu as we consider the different aspects of the solution we are working towards for videos as an update to the town board I'll briefly take you through some of the questions that as we work through this process so the first question would be why are we not using the equipment the town currently owns in this room and early on in this process that was definitely a strong consideration um it's been advised to us in those early stages by multiple field experts that this equipment is incredibly complex and would requireing require the hiring of an expert to use this equipment to reduce our meetings um quite um costly we're working with both Paul and Steve to assess the equipment we currently own its value and which assets will be part of our production plan going forward question two well what is the recommended path forward and in working with Dan Adu we received a formal recommendation which I'm happy to share with the town board um to utilize the MEO system which you'll see here tonight um to its ease of use its mobility and its affordability um coincidentally Dan's here tonight with us once again to test this technology which is becoming more prevalent in recording Live Events including Community meetings sporting events church services and so on um Dan joined us back in January to test this with three cameras and while the results of that test were promising it was clear that we needed more cameras than three um for a room of the size and for the layout that we have the recommendation is five to six cameras um tonight we are testing with five cameras the benefits of the moo system include the ability to hook into our existing soundboard the capability to cast presentations and other information directly onto the video screen and the flexibility to record meetings outside the confines of the Town board room if needed question three when can we expect a permanent solution so I can't promise a date but after this Workshop our team will have the opportunity to internally review the product of tonight's meeting and should output meet or exceed our expectations will likely move forward with working with Paul Adams and the finance department to purchase the equipment associated with the system um in that process we will also test live broadcasting with the system and our final question is what accounts for the length of this process um our team has been working on this long-term and Lasting solution for meeting videos and we've been intentional in making decisions and considerations that um not only are reactive to the immediate needs of the Webster Community but also are proactive and anticipating what will be most helpful and prudent for residents and others well into the future um as a side note as along with these changes that are coming in terms of meeting video output we're also to update accessibility within this room in terms of sound and visibility of our screens um as we move forward in the next several weeks I'll look forward to keeping the board updated as well as the community and I thank you for your patience and for your time and I'll welcome any questions um Jenny any questions for to have an approximate cost for the new solution and and how does that fit into the budget yep so we will work with Paul and the finance department to um discern where this is being paid for out of but the cost for that um the total cost is $3,890 53 we've already purchased a starter um three pack of cameras in their tripods and the cost for that was 97 76 so our remaining cost for the rest of the system will be $2,919 is there a you had mentioned taking some of the existing equipment and possibly selling it has any work been done to look at the value of the existing equipment so we have um the values at the cost of their original cost being purchased through 2017 through 2023 that amount is 29 $29 um however quite a bit of the equipment is still going to be used um including computer equipment um this Bolton board right here um our sound board um the snake on the floor that connects everything um so substantial amount will still be used okay and then maybe you can even possibly sell whatever's not going to be used correct to cover the small amount that the new system is going to C which would be IDE yes I don't have any other questions yeah and I would just have two comments um that for anybody that is watching live tonight at home uh or wherever on Facebook um or if they're watching a tape of this uh tomorrow or next week or the week after I can't stress enough that the five Neo cameras in this room is not the view you're getting so if you're watching this live right now now or you're watching a tape of it what Bridget just described the demo that is being done by Dan agu tonight with the five Meo cameras in this room is offline key people at the town will look at that demo and see if the quality of it both visually audio is something where we want to move forward with this so I think that's critical to understand uh the second thing is is that I I think it's very important to understand uh four months to the day since we started the process if you want to call it that of not using the hard uh assets that are in this room that have been bought since 2017 cameras and that um and I know that there has been some comments that have come in and questions about the quality of the audio and this and that of these Town board meetings or planning board meetings I can't stress this enough these are not all of a sudden new concerns from citizens watching listening these concerns came in at least to the supervisor's Office to me several came in prior to four months ago this has been an ongoing problem um of audio and visual from these board meetings for the people watching at home live or on tape so I really am excited about the fact that all of those complaints that came in pre- November of 20123 and for the four years I was supervisor I'd like to think this process is going to really solve that long term so those aren't questions those are cets Thank You Bridget you okay the good news we're six minutes ahead of schedule aren't we Dolly all right our next item up tonight is a presentation on uh Sandbar Park specifically uh knock on wood the bar restaurant that uh uh hopefully will be built down there um and that is going to be done by Jared Miller from campus and Dave Cox from pass I don't think anybody else is presenting this is that correct correct gentlemen I will the time to you well certainly appreciate the opportunity to come back to the board and give a update of the uh construction progress made in the 2324 construction season um and then like Tom said uh definitely want to talk about um the plans moving forward for that restaurant pad so um we'll get right into it um first thing we want to talk about um not very excited for some but I particular the budget aspects of the project um just a quick run through and this is a very similar slide that we presented last time uh the original uh budget for the project the amount bonded for All Phases of the project was roughly 9.5 million um through uh some estimating internally uh we decided that for the phase that we have completed the original allocated budget for that phase was roughly 8.9 million um leaving an unallocated or available for future future phases amount of 586 th000 in change um so of that 8.9 um we utilized uh 7.2 uh for the three contracts one for the road one for the wall and one for the park uh and then there were also consultant fees uh foray for construction Management Services uh passero and ban Landscape Architects for Design Services um along the way there were also rg& costs incurred for um some reroutes of utilities and then on all of our projects we budget a construction contingency to pay for unforeseen things like unsuitable soils or elements found you know beneath the existing roadway that we encounter things like that so that's a budgeted amount to take care of those things so of those um of that budget contingency the project spent 9,383 to date uh with so that leaves roughly 250,000 remaining so that leaves our future available funds for we'll call them future phases um it's the remainder of the uh existing contingency um plus those unallocated funds we initially talked about um this project benefit benefited from a substantial amount of grants that were considered when the project was initially bonded um so we've got an asteris by it but right now it's 4.7 roughly $4.7 million in Grants received the asteris is because those are to date what we've received um totaling roughly 5.6 million dollar available for uh the future phase of uh so our schedule for the past few years um starting in 22 March 22 we start a construction clearing trees uh leveling out the ground and still starting our our fill operation at the end of 22 we were 85% complete with Lake Road 15% complete with the flood ball and 45% complete with the park uh that was roughly 15% ahead of schedule um at the end of 23 uh all of those items are substantially complete um we did a ribbon cutting on I believe the 25th of October uh and our goal for that was uh was the 31st right before the bridge turned so um the project was delivered on time and there are still a few items that are being worked on that were added to the project at the end things that uh in some cases the parks department thought certain items were necessary um and with the available budget some OD and and things like extra Ballers and things like that are going to be taken care of once the weather breaks so we'll go into the the granular detail of each uh the work completed on Lake Road uh was the completion of the sidewalks installation of the top course vas ball and the final Road Spring inst the street lighting uh installation of signage and finally one of the most impactful pieces was removal of the existing power poles uh down the down along the uh the bay workout stating for this project uh there is none so we are 100% complete so just a few photos of progress um we're going to do a a quick run through of video of the whole project at the end of the update so we'll get through these uh next one was the flood wall um the work completed this past construction season was the installation of the actual plug wall um completion of the fill operation associated with it uh that's bringing the grade up above the flood elevations removal of the existing Dock and replacement with the new dock um installation of the kayak launch uh and then installation of the railings along the C sidewalk so much of that work obviously pictured here then the final aspect was the park um the work completed on that was the installation of the the remainder of the sidewalks on the North side uh stone dust path that goes through the it's called Woodland Trail so that's what BRS you into the park around the back side of the playground uh installation of the actual playground components uh I'm sure if anybody drove through there they saw the installation of all the new landscaping and finally the installation of the shade structure in restroom facilities and as I mentioned before some of the additional items remaining um this the park decided to add a few additional Ballard just for safety uh in a few areas within the park so that work will be completed here uh sometime in a so hopefully this isn't too loud there somehow is sound associated with it but turn it down a bit but we'll do a quick run through of uh the progress made between 22 and 23 construction seasons so this video was taken um roughly the beginning of uh November obviously the the later pictures with all the grass growing in um so the anticipation is coming into the spring um all these areas will be uh fully grown in with with grass um there will be construction crews out to make sure that any of the areas that are a little sparse coming into the growing season are taken care of um and hopefully you know once the weather gets a little bit nicer all of the wonderful plantings that are in place are coming into bloom and you can really realize the all the full aspects of how nice the park really [Music] is one of the key features of the park was along that South right away you can see that multimodal path that the two people are bicycling along um the park obviously didn't have features like that U prior to the project so uh it's encouraging to go down there uh even now with the weather not being as nice as it will be see a lot use saw those types of features and the edge of that uh multimodal path is where the Roe used to be so the the road was actually that close to the Bay previously we shifted it further away to make uh room for that path so as the video comes to a close um we will kind of turn it over to Dave to give update on all restant related all right so when we were uh doing the original design for the the road and the park and everything like that we had always kind of planned for a structure um right where where the restaurant would be going and uh we were going back and forth with the dec and we couldn't come to a uh any resolution on on the allowable size of that restaurant and it actually was uh the restaurant partion was removed uh from the project at that time removed from the permitting so that we could you know stay on track stay on bud or stay on our timeline our schedule uh for the project um and then once we got the the project you know done and we had a ribbon cutting a lot of people from the dec uh were there at the ribbon cutting and they really got to see how great of a project it was and how great it turned out and I think that that really helped uh and the discussions that happened after that so then we had to submit a separate application uh for a restaurant on the site that you can kind of see in the picture here circled in red um and we negotiated back and forth and removed some some future impervious area and future sidewalks so they would we didn't have any increase in impervious area and we're actually able to get approved you know a 2300t building uh footprint uh the old building was 1600 square ft um and originally the de was is not wanting us to put in anything bigger than the 1600t uh footprint which really made it hard to find a you know someone uh a restaurant tour uh that would be able to work inside that small of footprint so um absolutely a huge win uh for the town and on this project to be able to come to uh you know get approval for the 2300 foot building footprint yeah this this uh view is a little bit zoomed out obviously um to get the grand scale of exact on site but uh for anybody driving past um if you do drive through there you will notice some colored Stakes uh sticking out of the ground um there was a lot of forethought put into uh the potential for a restaurant pad being there um so all of the utilities are already uh available and and tied into those locations so that once a building does go in place it really is Plug and Play so um there was a lot of uh preparation done for when this thing was permitted um and it'll make it a lot easier now uh given that uh we're one step closer to being able to build the building so uh the question that everyone wants to know is what's next um so really onto the the restaurant uh design portion of it so uh the town has been ing for you know a couple years now uh to find the right partnership they are in negotiations um with a with a restaurant tour um we're still not able to disclose who yet um but it is um getting very very close to that that point so we're very excited uh the town wanted to make sure that it was a a mutually beneficial partnership um and someone that would fit in down there and really be a benefit to the community and all the residents who who will visit that Park um so we're working on doing a 2300 foot building footprint um right now we are thinking possibly would have two levels um so that second floor would be able to look out and see the lake on one side and the bay on the other very very unique um opportunity there just a great great place that uh you know residents or people from the public can uh go there and have some food or some drink and and and enjoy the lake on one side and the bay on the other that's there's very few places uh in the world that you uh you get to look at the bay and a lake on you know in that close proximity um so the next steps are really to develop those bid documents those construction documents for the for that restaurant so that then they can start construction hopefully uh this year they can start it uh with the goal of completing it in 2025 so it' be very exciting to that that's the final puzzle piece uh to this park that'll really put the bow on it and um and have even more people wanting to go there to experience the absolutely great Park that it is now it is just such an improvement uh from what it was before uh and we're already seeing so much more activity down there uh people going down there um riding bikes walking playground equipment um even through the winter um you know the town was getting that Park was getting used so this summer is going to be uh it's going to be getting used a lot absolutely so with that uh we'll open up to any any questions and again thank you for having us you look into um like a parking space we make sure that we have enough parking are this unique you know parts and restaurant that we about to have and also about handicap accessible yeah so the the parking areas are all set up for uh handicap accessibility there's ramps um on and off the sidewalks directly adjacent to where the the restaurant building will be um I think almost all aspects of the park are handic accessible as designed um the parking itself um coming from it being a large gravel area it was hard to determine exactly how many parking spots there were uh I think at this point if you count up all the roadside parking along with the two parking lots that were constructed I think you're roughly between 110 and 120 I have to count exactly 110 120 parking STS available at the and you don't know how much was there if you had to ballark what was the how manys I say 60 or 70 would be my my gut F yeah it's tough because it was it was uh essentially gravel to the RightWay so it was not necessarily the safest parking situation prior so it's kind of hard to gauge and and when you have just kind of a random gravel area the parking is very inefficient you know people will not Park know there's no line so people Park far away or or parking different directions so when you have a very organized parking layout it's much more efficient you can fit so many more cars and it's much safer yeah the big the biggest component of the just the parking and that aspect of it is there's now um signage in in crosswalks uh that lead you from the north side to the South which was not the case prior and you know just walking down there if you get anywhere near those crosswalk signs people are are stopping to let you across the street so big advantage of uh making those improvements yeah and previously people were just parking on the on the actual Road on the actual travel Lane you know which made it even more unsafe you know now where we have designated you know parallel parking so all the parking spaces are much safer uh and just much much Safer travel through that area I it's absolutely beautiful down there I mean I know folks are are a little sad and disappointed and miss the Bayside and I do as well but the improvements you you cannot like deny the there's so many families down there at the playground all the time um and people are now making investments in the houses down there there's a ton of improvements being made to the houses in the video you can see where they opened up the road to the houses that are on the Lakeside and like it's just it's quite stunning down there really is and I I'm I wish I knew who this restaurant tour was so anybody the board knows we don't there's like just a secret small group inside the board that knows I am really looking forward to finding out who that's going to be um I do have I have a question that whole like curved sidewalk behind the restaurant the restaurant will have access will they be able to have access to that to put tables out there yeah the goal is to leave a a walkway beyond what the footprint of the restaurant so that at any time you're not part of the restaurant you can still walk through there uh from from all of the initial Concepts that we've seen I'm sure you're producing um it isolates that space so that you know people just taking a casual walk through there don't have to walk through the middle of tables um so it'll be held off of that a significant amount but but the restaurant will have tables in the back area where you can see Overlook the bay and just really enjoy outdoor seating in that grass area where you come around and you go down the stairs MH that won't get flooded anymore so you can actually enjoy that space as well no so there's no there's yeah there's no there's no controlling the flooding to that point right so that so that while there's not water in that area it it was raised up slightly but not to an extent where it's going to prevent the water from coming up I mean that's nature um that wall was put in place to kind of hold that back right so it won't affect the restaurant but that l um will potentially be be flooded but it can still be used when it's not as it was before that's correct and I don't know if you can go backwards on the the screen but the M m159 78 flood ball the picture collage you have if you look at that in the bottom left you know that stairwell down is really going to that grass area with the trees where all the goose poop is and all that stuff that the Bay Side used to stage drinks and whatever before you came over to eat if you think about it that was very flat that's how much it's been raised by those stairs that gives some perspective but those stairs is they're they're they come down and go outside the brake wall so if the water does rise it's possible that someday there'll be water up to the third or fourth stair case the restaurant tour is aware that hey if the water stays at levels of 250 or 246 or whatever you're going to have all that grass area down there with the trees to do what you want in the summer or whatever but we make no uh we can't control the water we built brake walls and stuff for the patio and all that so that there won't be a foot of water inside the restaurant like there was in the Bayside a couple times in 17 and 19 the restaurant tour does understand it and I want to just say this that the reason why there's been a real uh confidentiality of who the restaurant tour is is because really until the engineering and the preconstruction people who we think are going to be pastoral and campus until they work on the design of a 2300 squ foot base restaurant and some of the aspects of that and work with restaurant tours Architects and Engineers this may not happen with that restaurant tour because the reality is is that if the cost of it uh and what that restaurant tour wants to do ends up being $5 million that's not going to happen um so it's very important that right now the first thing we need to do is hire the staff that's going to work for the town not a municipal project and that's what this is and I want to make this very clear that this restaurant bar uh is a completely separate project to the one that these gentlemen just gave you a Reconciliation of the numbers on the $9.5 million bonding that was done a couple years ago by this town board was for phases one two and three of sanar park now phase one is the park and all those they showed you phase two is the education center at the end of the park at the Far West Side um that we haven't started to even really talk about the design and all that and phase three is a pathway that runs I'm sorry the east side of the park the pathway runs along the Lake West behind Castaways and down toward the hojack line and all that that's what we that's a municipal project that was bonded for9 half million doesn't mean we borrowed $9.5 million dollar is that correct Paul that's correct all right but that's what it encompassed and back then we said the reason why the bar restaurant is a completely separate project is because it will be a public private partnership and the type of bond that needs to be obtained Mr Addam taxable that's correct because the municipality is going to own the land which is Park land and the building and then a private purveyor vendor will run the business that's in it there's a lot of preceden of that around the county and the state but we found that that that cannot be encompassed under this standard Municipal Bond tax uh uh exempt and all that so long story short as we design this building we can't really go out and say we got to deal with this restaurant tour because if the building's uh cost in that bond is $20,000 a month if the restaurant tour is not willing to pay $20,000 a month or some type of creative percentage of their POS system so that we can at least put the taxpayers of the town in a position to recoup that it's a starter the restaurant tour is well aware of that but really to get full details of whether this works these gentlemen and what they do at their firms need to start the foundation work no pun intended for the town to work on the design and the different accouterments to figure out well how much in today's day and age would that cost and as I've learned from these you could take the same 2300 ft building with a second floor that they describe which is going to be incredible if that's what it comes to to be you could build that for $10 million exaggeration to make a point because if you want to Guild it with gold Guild it with gold and if it's your home and you want to do that you have the money great but you could also build that for $1 million if you go down to not build to getting gold and maybe go with the U I don't know what's the best example for using for homeowner do you want lenan in your kitchen or would you like Corinthian tile that we bring over from the granite uh quaries of Egypt now we all know those are going to be considerably different cost whatever cost that's going to be on the taxpayers of Webster has to have the ability to be recouped through the rent paid by the restaurant tour it's just simple as that and the the good thing is the restaurant tour unequivocally irrefutably understands that but until we get in and really sharpen the pencil on that and you guys once you're hired because you're not hired right now so you have no reason to do that work for the town once you're hired the next day you can sit down with this restaurant tours Architects Engineers all that and figure out something so that in a month or two knock on wood you can come back here to a workshop and we say well here's the design and here's the restaurant tour because we have reached a point where we have a deal in principle both dollars design timeline of when it's going to be broken ground and when it's going to be open all the things that everybody wants to know including yours dream but you can't serve a wine before it's time so tonight I'm going to tell you this right now I would like to move to after this presentation that we put a resolution or resolutions on the town board agenda for next Thursday night uh March 21st that is the town engaging for the restaurant bar project at sanb Bar Park completely separate project than phase one two and three that's bonded for $9 half million correct Paul correct the town board pardon in addition to the 9 and half million yeah hiring them to start that project is outside that and that is something the town board will have to discern uh because we wouldn't even know we wouldn't know what to buy that project for we have grand money for that building too so that is correct some is some has been spent but there are still y so J I got to tell you something as anxious as anybody to open the curtain and say there's the restaurant tour there's the design everybody start falling in love with it these are the accoutrements here's the timeline of when we're going to break ground and helical pilings and when we think it'll be open they have to do basically a Gant chart if you're familiar to figure out all the parallel things that happen and some of the ones that are sequential in that timeline so that we're not telling the community we think it's going to open in June of 2025 but we just pulled that date out of the air the date that we pull out when we present next time hopefully in two months is a very wellth thought out research Gant chart type of sequence of events parallel events and one that really to tell you the truth we have to be far enough along with the restaurant tour where there's commitments on both sides but the first step we can talk about till the Cs come home is the town has to hire a preconstruction advisor such as campus and an engineering firm such as um Paso Professional Services is that correct Paul correct pasero has more data on that area from nine years being down there this started back in 2015 or 16 is that correct Dave that's correct was that when the first grant there was a grant $118,000 and it's not closed out yet is that correct the grand I'm talking about educal area down there to have a do where kids go down yeah plus the educational area um we actually um sold Yankee Stadium and uh those funds which is 324,000 which we received from the school district is earmarked for that purpose okay 324,000 is earmarked for phase two the education set right for the education so let's come back to the bar restaurant restant okay totally separate project not encompassed in the $9.5 million not earmarked with $324,000 all right I'm playing the crowd here that they're not here for the education center I could be wrong we'll see after they're here for the B restaurant so passo and Bayer first got engaged by the town Circa $118,000 Grant to do a study of what could be done at San Bar Park they had meetings in here in 2016 and showed Boards of what it could look like the engaged community members some of them might be here tonight and everything was going along swimmingly no pun intended and then there was floods in 2017 and it kind of stopped the process and then there was a bigger flood in 2019 and at that point the state came out and said you know we got a problem here we're going to dedicate all this money to call ready grants and the town applied for the ready grants and said hey we're going to do this work down at sanbar Park with the to the state's money of Grants to secure the shoreline because of these floods and how do we do that and marry it with the project that was started in 20156 is this correct D yep it's been a long hist down there so because Paso has been so involved in it their breath of knowledge and documents and surveys and all that in my opinion and Paul I think you would share this there is no doubt that's the engineering firm we engage with for this restaurant bar anybody else that we would engage with probably hundred tens of thousands of dollars to catch up what's G on it's already in your database correct campus having been the project manager not pre construction because we didn't get you until construction they already have such a knowledge of the area having done 20122 and 2023 they once again are the obvious choice now I'd like to think and this will be next week's resolutions all right and the town board will have a chance to to look at this we made we think that's the right decision in a way that they're not like we're the only game in town so they're they're going to charge us 10 times what would have been a competitive bidding situation that is not the case I'm very comfortable and you will see that as we dub tail till next Thursday on those resolutions so does this have to go out to bid uh Professional Services are under our procurement of a municipal bid it's good uh um practice as Paul will tell you to look at two or three different uh things bids whatever you want to call it not not required to be uh bid okay so just your choice what's a project itself the construction aspect that's definitely that yeah and part of this and I want want to get you all home early but I think people are Sor mostly here for no keep asking questions one of the things that is is is we really need to work with the restaurant tour on in parallel to their design and working with their Architects and working with their Engineers is how much of the project is the town building and paying for and if you buil a house or whatever vanilla box the the the the uh the shell some people like to call it and and then all the ards ovens and seats and lolium and all the finishings if the restaurant tour wants to pay for that and install it on she or he's dime that's going to bring the bond cost down for the town because we're not paying for all that stuff they're paying for that upfront which would bring also their rent payments down because they minimized their bond did I lose anybody on that one that's got to be worked out we're not there that's like at third base we're not to first base first base to me would be next Thursday if we engage our preconstruction to help with bid design and our engineering engineering firm to help with the design of a municipal building that's all I got how do I do that moving my head as far as the microphone all right trying Bridget any other comments or Jen ask questions on this till the till nine o'clock tonight if you'd like I have one more question shoot away so I'm I'm looking at the budget update and and there's 9.5 million that was bonded not spent not necessarily going to be spent I see Thea funds you talk about the contingency remaining and the unallocated funds and then the grants received that weren't all spent yet they weren't all received or spent yet they 4.7 million they weren't all rece so there there's potential to have more grants than what's shown and that's why there's an asct so there's 5.6 million remaining does that mean the cost up to this point has been 3 roughly n million no no the cost so all the costs are on the left hand side so the contractor bid totaling 7.2 is is the actual cost of the contracts the consultant fees are what uh campus passo Bayer uh some of our special inspection fees those are all encompassed in that consultant fees y so those line items on the left um are all what what total up to the expenditures for the project oh and then the construction into the contingency of what was um spent versus remaining and yeah so the the difference between the 9.5 and the 8.9 is you know we like Tom said the preconstruction aspect um a lot of times we're involved in the pre-construction where we can budget the project uh as we did on the on the highway garage we'll set up a budget um because the the bonded amount was above where our estimates came in uh when we initially came into the project we only allocated what we thought was necessary for the current project being bid so that's where that 8.9 comes in okay um so that was our what we allocated as a budget for phase one um so of that allocated budget um we came in $253,000 under budget of what we allocated from the total bond amount so all of those equal the 8 sitting here adding yeah it's just the way it's laid out I just whatever I didn't know y it's interesting because when when uh Jared and Dave were talking about putting together a presentation tonight um we went back and forth about whether it would confuse the issue to give a Reconciliation of the park phase one of the park and then have the the agenda item be a presentation on The Sandbar Park Restaurant should we just not talk about Park and Reconciliation and just start with sandb bar PR I'm sorry with with the restaurant now we decided that hey let's kill two birds with one stone let's give an update on the 9 and a half million dollar bonding what's happened in 22 and 23 the construction Seasons what the the bill on that was between keer and all that and then when you rolled into Sandbar Park and I knew that this could be a problem is that you almost have to like okay now we're talking about something completely different completely different than 9 and a half million Phase 1 two and three we're talking about a restaurant bar that has had no bonding has had nothing now in a couple months uh we will talk about whether we start the process on phase two and phase three the the the education center that's at the East End Of The Bay and the walking path that goes west along the lake behind Castaways and toward the OJ line and all that stuff now we made a conscious decision that let's not start in this in in March April of 2024 with Phase 2 and three let's start with the restaurant bar because our gut was at the Town governance and our Communications people and reading certain things that that's where the interest level is of this community and that doesn't mean the community is not interested in an education center and I think once it's built they'll be very happy it's there and I think once the phase three the path is built they'll be very happy it's there but anybody that lives in Webster knows that they everywhere I go what's going on with the restaurant down at sanb Bar Park what's going on with the restaurant down at San Bar Park so it just seemed like we're not the brightest or I'm not the brightest guy anymore but why don't we start with the restaurant bar and that's what we're doing now once we get past that hopefully b or not bonding but do the resolutions next week and then come back in a couple of months with a workshop to introduce the restaurant tour and all the de that then somewhere along the line we probably should turn our attention to having a presentation on okay what do we got on on on phase two the education center because then things like Paul said we got $324,000 sitting in our Park of a reserve account from the sale of Yankee Stadium that's not in your reconciliation numbers because we really we're not talking about phase two and phase three tonight I think it was important to give a Reconciliation of what has happened down there today phase two and phase three will come later what that later is I don't know we made a conscious decision that the pulse of the community was this part looks great when's our restaurant going to be down there and that's why we're starting that first makes sense any other question no I think it's important uh to not and not that anybody has to SK over it but the the most critical component of getting that restaurant Ball moving um was was passero pursuing and and obtaining that initial permit from the dec um that permit was you know the whole reason why that thing can move forward I don't think with the limits on square footage um you'd be even able to have the conversation so agre that was the and that process started early November so almost immediately after we were done with construction so um it's trying to keep it moving right yeah so just didn't want to lose sight of the fact that that was uh that was probably the the biggest compon everything here is is making sure we were able to get that the permit thank you for your efforts and moving that forward and nothing M fast nothing I'm learning you come from private like I and it's it's we're impatient by Nature torture and one of the things why why there's such a confidentiality of this restaurant tour Chris pyo our parks and R commissioner and I have met with the restaurant tours team many times and one of the things that we are trying to work with them on is the expectation of timelines they just are blown away that how could it take from November 5th applying or whatever for a DEC permit and us having to Lobby everybody Under the Sun to finally get approved on February 14th December January it took three and a half months that was almost like I they could not understand that that's extremely fast that's extremely I extr you know you know in my four plus years I'm like I'm starting to learn that okay I have an unrealistic expectation of time frames in government based on my 30 years in private business and it it still drives me a little nuts but at least I'm starting to understand it more you can't play City yes and um so the restaurant tour um there were times that I thought during this process they were like you know what time is money we're out we're on other projects and this and that they're not out they're they're still excited about this but once again over the next two months as we put I call it the Gant sh you know here's the timeline if if the realities of we're going to be realistic on timelines especially when stuff leaves our control and goes to agencies like the dec and shipo and some of these other federal agencies that you're not going to get them to move any faster than they move and right that will affect the timeline of building a building there and I just want the restaurant tour to go into it with her his eyes wide open to that which I think you know and Katie you you work with Chris Chris is pretty candid about things I've enjoyed being with him because he doesn't mince words but he has a good bedside Manner and it's going well but I'm hoping that it continues to go well as you guys if you're hired by the town work with the restaurant tours Architects Engineers designers whatever and in two months we can come back here and look what we got on the edge of my seat thank you thank you thank you Dolly I'm sorry I know you had a big plans tonight but uh we 24 minutes behind now aren't we um our next item is a presentation on Cyber Insurance um and I think it's going to be done by Steve pce our director of it here at the town and possibly Paul Adams our finance director and we have royalty in the building tonight uh Joe pesi is here who is the town's uh insurance broker agent SAR whatever we we haven't come up with the name yet Joe if the town board members in the Q&A have something that you're more apt to answer than Paul and Steve we might ask you to come up all right now wait a minute are you you guys aren't here for cyber security wa minut we get done with the B restaurant and you're leaving next time wow okay um I guess I read that wrong I thought they were cyber security people there I okay I'm are you a comedian tonight all right I'm G hand the time to stepen Paul all right I got a quick PowerPoint presentation here I apologize on the computer guy I know how to make them work I don't know how to use them so let's see where they gowhere there it is is definitely not go to the bottom on the bottom right by The Zo chart and just click the slh there we go there you go there we go uh of course you know every everybody always wants to know what is cyber Insurance cyber Insurance just like it's used to help protect against losses resulting from a Cyber attack or incident uh and from an IT perspective uh cyber insurance is an important part of our security it's an important posture now of course there's much more terms in there that you're what that means U course the Cyber attack is most people know what that is you know somebody hacking your computer they steal your information they pull up your monitor you know all other that good stuff but there are other things also way to say incidents um attack is an incident but also an incident could be anything that results in the loss of your data or information or access or to a tech L computer information like that and to help protect all that we have a security plan and to represent that security plan we have our security in a posture it's kind of like you know you have old kid from soping stoping stoping that's beginning of your security then as you become stay up straight up straight your posture is more more rigid so that that's what you mean by our security or in posture is how well we're implementing our plan um our plan does consist of I don't want to details we secur stuff and public forum you don't want to devolve too much information but uh our security plan does involve a few things here is we see policy procedures and try to do our best Implement standards uh patching or software where uh Britain actually has provided some cyber security uh training to our employees this year which was very nice uh we always try to make sure we mult multiple done everything vendors Hardware software connectivity all sort of stuff uh we' always try to do our best to provide at least privilege access uh we've been R out multiactor authentication uh that's still an ongoing project we're still Lo that more but we do have it in place uh data encryption and of course with security organizations that help us monitor our presence online and a lot good stuff so um of course security plan like I said just like you loate slouches you know plan always your children are always growing so always try to keep all the changes new technology comes out moves fast moves fast um uh when you're looking at security posture and TR Implement security plan there's always one main weakness no matter how well you break your plan there's one main weakness and that's people okay I'm not talking users I mean users do things they're part of part of the problem but in this instance when I talk about people talking about people in general uh people are F people create technology so watchic dictates technology is followable the only technological solutions that are secure are thees that you use I mean even rting something out on a piece of paper and pencil there's still security risk with that so I mean unless you want to keep it all up here if you're [Music] 1984 uh so why do we need c security well since all technology is available it helps mitigate our risk um we do our best to keep everything safe and secure we doest to keep everything locked down so that we don't have any problems but it's not a matter of problem happen it's a matter of when a problem happens you just like you drive a car long enough change you're going to get into a car accident so you can think cyber security Insurance like car insurance so you get in an accident your insurance is there to help protect you and of course in Frid ni tools and features and things like that as well and Joe if I say anything wrong please speak up um this is probably where Joel probably be answer a couple questions I don't understand includes uh but this is what is incl would be including our cyber security presented to us uh all our liability coverage and event discovering reporting coverages um some of it I understand some of it I don't understand which I hate to admit but you know I'll learn as we go um so you know basically there's lots of things that can happen so it covers lots of stuff um we got here and then of course not only we receive financial coverage uh we do get PR rates with cyber threat pre uh cyber threat prevention vendors fing test and all sorts of cool toys and stuff that I keep out so so in conclusion uh with every Ching technology technological climate no guarantees an attack or incident will never occur uh a cyber insurance policy should be considered uh it is from a IT department standpoint part of our security posture and our security plan it should be something that seriously thought about now um with all that being said I know we've been trying for a few years now all yeah yeah over the past few years we really have not had sufficient uh cyber security Insurance uh it's been tough to get a carrier to get interested but uh changes we've made to the department and know for the Govern that kind of put a big Target on our back so that they kind of elevates us not RIS and then um some of our our security posture wasn't quite as rigid as it should be um we like Paul say we had put a lot of things in place now we've been able to implement a lot more Technologies the fost those technology come down we actually be able to acquire them and Implement them and different things now so we've been able to get improve our security posture which have improves our chances of being able to acquire that insurance and then hopefully Jo you know government's earn the big bad wolf of cyber security events and we're a little more insurable I hope I know I know the governments you know I can almost he to you whenever something's happening in the Middle East I can almost tell you when's happening we get an influx of spam and fishing THS and all sort of stuff just because even as a local entity we still get flood all yeah some of the revisions Steve's department has made has allowed us to comply with the request of the carrier so come up with uh a couple options for us uh one has an aggregate of a million dollar coverage the other one is 2 million uh premium for the 1 million is about 11,000 for the 2 million is about 18,000 so we can choose uh which one to go with I would probably lean toward the the 2 million yeah to be safe I don't think 18,000 is a bad price to pay the DED are 10,000 per occurrence with an aggregate of 30,000 so not too bad either we do the best we can and like I said it's not if it's a when hopefully the well after I'm have you been any security incidents that cost a to of money that it cost a to of money no we have had a few in in the years past we mitigate take care of it didn't cause us any issues it didn't cause any problems so I don't know if anybody heard that question I was quite far from the microphone when I asked it so I was just asking if there was any occurrences and what may have cross the town yeah we've had some minor occurrences but but uh we've been able to actually mitigate those relatively quickly and keep everything safe uh was it a dur when like a Ukraine war kicked off we were part of AOS attack where they were basically trying to knock us off the line and keep us from functioning uh but with the Rundy the system that we have we were able to basically fight that off as they were attacking us we were saying no go away go away to away you know F over there F over there to kind of work around that attack as it was in progress so they it never happened causes any issues I think maybe one usually claimed that their email got locked up on them or something so does this to upgrade our system to and everything I'm sorry does this need to be upgrade for our system for this you know inss uh no the systems don't need to be upgraded um well they're continually upgraded but we usually try to have a plan in place to keep them current so that that way they have the latest and greatest protection from the latest greatest vulnerabilities that are always being like I said technology is created by people and if people create it people can break it so yeah it's interesting um I can't I don't think it can be uh underscored that we we were not eligible for cyber uh Insurance because the controls and things we needed in place we didn't have in place a couple years ago um everybody was like who then your question about well did we get hacked or did we lose any money we didn't so that's all good so the past is the past um there's also the analogy of and I know Joe you're going to like this as an insurance agent you know I've owned my home for 27 years Joe I have fire insurance on my home I've never had a fire I don't think I need fire Insurance never had a loss is that how it works I didn't think so um what has happened over the last four years um I'm going to say Co was the start of this because Co made our organization have to kind of look at how we were structured from an automation or it perspective um and the best way I can explain it and Steve you tell me for the most part when an employee of the Town a town computer system when they came into work at 8:00 or 8:30 in the morning and they open their their computer and email and systems and whatever when they left at 430 that was it when they left the building there was no remote access now anybody watching this and whatever probably knows that is not the way the world Works uh in in the rest of the world but that that was somewhat pretty common for government which was a culture shock to me being in you know private Co made us have to look at like either we're paying these people and sending them home which the taxpayers weren't going to like uh or we figure out a way for some of them we send home to have them operate remotely and that's where I got can't be see your staff has done a lot in the last four years to get us from where we were that through all that Co and getting people working remotely and then that kind of Open the Eyes to well hey you know maybe we shouldn't be storing everything on our servers we should go into the cloud and take a look at some of our applications and blah blah blah so this is just been like almost a snowball rolling down hill um and it's that crazy use of it it's kind of like this is how it and how users that work need to access things in the 21st century in 2024 where our inspectors at at the construction sites instead of taking notes on a paper are like you Dan they have one of those iPads and they are updating what the site looks like and in real time it's going into uh computer system database whatever this is what we've been doing and because of that it does start to make you a little bit more risky for being haed however we've tried to counteract that with you know going into the cloud and taking some of our big uh systems the app uh the application or the software providers they give us a much better level of security uh when you go into the cloud both in the security but also in the redundancy of redundancy and all of those moves and I don't want to you know Joe our insurance agency as that was happening we went from we don't have enough of the things we need to get Cyber Insurance to well now we do have enough of the things we do have dual authentication um for certain things to once again keep the bad guys out but there is no system where you can keep the bad guys out 100% And anybody tells you that they have a system like that con he's lying to you I I can show you logs of hundreds of thousands of attempts every day yes so get a plan where it's like the Matrix I don't see the K anymore I see I guess I would say this and you know I go back to the joke it's not a joke I I shouldn't have to have fire insurance anymore Joe never had a fire and past performance should indicate that I don't need fire Insurance well we've never had a hack on our computer system well we we have a lot of changes to our computer system that make it more risky but we've also taken some steps to make it less risky I guess I would just say this if we decide to go with cyber insurance at a premium of 11,000 18,000 I tend to lean on what Paul thinks is the best bang for the financially U and I think you said the $2 million coverage of the $10,000 per occurrence 30,000 aggregate annual premum 18 deductible if we come back here in 10 years and Charlie you're going to still be the town attorney in 10 years we're all still here in 10 years and we look and we say you know that we just spay all Factor equal 10 years $180,000 in premiums that assum as the premiums don't go up big assumption not going to happen and we never got hacked and we never had a a claim well then you could make the argument we wasted $180,000 over 10 years I'll tell you what one of these one cl one of these millions millions in both direct cost but also that soft cost of loss of productivity if we're shut down and whatever now that town you know we're paying our staff and we can't service our citizens how much does that cost so and as Joe knows I come you know my my father was in insurance for a long time so I I get it and I this one I I got to say does make a lot of sense yeah I mean like I said we we it department is a staff three people we have what 14 departments I know 14 I've lost of years uh we've went from free facilities to one two three four five six seven I think now way that we have to take care of and then like you said with Co everything started to go remote and you know people take stuff working from home which give me many sleepless nights because like you said we were the government everything interal we we kept it that way uh luckily we able to find that solution it didn't cost us any money except for M man hours the IT department to be able to get a remote but it security wise it wasn't the best solution so but we were able to then implant things in s a whole ball roll with well how can we make this better how can we make this more secure how can we make this so that people can still use it and still balance that security versus usability though and of course you know like I said get security versus usability and we make the security a little bit better that's for insurance yeah and one of I'm just one of the things I like about insurance and I admit I'm a I'm the son of an insurance but the insurance almost creates a check and balance audit to you don't just all he we got insurance so bad let it fly we can just get lazy and who cares we got insurance no it's the exact opposite you have to stay on top of things and you have to show that insurance carrier that from year to year you meet the Audits and this and that that you haven't taken the foot off the gas of protection the protection is not cyber Insurance that's disaster protection the protection is how you constantly dayto day work on your system and checks and balances and securities and stuff your yeah anyway any other comments or questions I I don't think we talked about this Paul this isn't a resolution type thing I mean it's a oh I I don't think so uh it's protection that we need and um I think we're just going to go forward with it they have budget of monies available so know we've been trying I know I got two years for but trying Bor that so yeah I think at least four four or five so you should have the F in there somewhere right okay and uh I guess that's it he any more questions sounds good the agenda item that we we got onto the digital uh on the website right Bridget it's is up there but our our agenda that was handed out tonight um doesn't have this last item I mentioned it back an hour and 15 minutes ago that we will be doing this at the end I'm going to actually hand the Baton to Bron conard who runs our uh here in town he and Charlie Jesse Our Town attorney somewhat worked on this today and the town board the three of us here tonight are going to consider doing a resolution tonight to set a public hearing for two weeks from tonight March 28th right here in this boardroom uh it'll be published in the Webster Heralds Wednesday March 20th Edition um the public hearing would be to consider changing a part of town code that has to do with the residency of the Town engineer positionen uh Charlie if you do want to give any other description to this just um the the board resolution contains the justification but uh as the board will probably recall I was here 29 days ago um talking about a reporting to the board about the recruitment efforts for Town engineer and the retention of a contingent fee uh recruiting firm and that has brought us uh success and uh we have um a verbal confirmation from a uh highly qualified candidate uh but who ALS but who already lives um in a town in mon County but that is not the town of Webster and uh having been recruiting for this position for eight months um I feel comfortable coming to this board to ask for a residency waiver for this position um the board authorized a local law four years ago for a temporary residency waiver and this would make it a permanent residency waiver and I can answer any uh questions that that uh board members may have I don't have any questions we talked about it when you were here before how challenging it's been and all of the things you tried to find a qualified candidate for the position it's a very important position it's much needed right now so it makes a lot of sense to wave The Residency requirement if you have a qualified candidate so we can get that position f j hopefully you know that individual would love Webster as much so he can uh move over here permanently maybe at some point clarify too um we really had already waved as pointed out this is changing it from what was effectively temporary or to a Perman like I said tonight we're just setting a public hearing for 14 days from now so there there's no no real decision making being done tonight it's just chewing up for decision but two things that I'll say if Bron and or Charlie came to us uh back on August 1st a couple days after our beloved Town engineer Mary Harrington moved down south if they came to us with this uh proposal I'd be like no go out and do the process of recruiting and posting for a town engineer and we wouldn't have because no you wouldn't have it's a legitimate uh public policy decision and I would only Bring It forth when we have documented evidence of recruitment difficulty yep and I mean that has been very documented in this boardroom right up through when you said what 29 days ago or whatever that look we said to the board this is not a Webster problem this is actually a it's pervasive and we we need to think outside the box and we looked at recruitment firms and whatever so it makes sense to me based on what we've been through to do this or to consider it and I guess we'll see what the public hearing says maybe there'll be people and we hadn't thought of it's not a fate to compl complete nothing ever is second thing I got to say and I hope this doesn't hurt any negotiation of your offer and acceptance that you're doing with this uh person read but we had queued that interview up with our five person or four person committee for this person is it five I think we had slotted an hour it was a 2hour and 15 minute interview I was very impressed and so I think were everybody that was on that committee um so I'm I'm very excited to see if we can get this person into the four of being our town engineer and it'd be great so any other comments or questions is this what you oh sorry congratulation not yet is this a plan to I think it's an exception is it I'm going to make a motion uh for the western town board to schedule a public hearing to amend the article six of chapter 56 of the Webster Town CT town code permitting a town engineer to reside anywhere in Monro County or in an adjoining County within the state of New York and to publish the announcement of that public Hearing in the Wednesday March 20th 2024 edition of the Webster heral in said public hearing will be at 5:30 p.m.
on Thursday March 28th at the vanning town courthouse here in Webster supervisor FL I councilwoman w i councilwoman I ladies and gentlemen that concludes our Workshop tonight exting thank you for coming
