Proclamation for Excellence

In Eagle Scouting

Presented to

Sawyer Zimny, Nathan Westone, Mason Mitchell and Henry Schlafer

WHEREAS, The United States’ largest youth organization, Scouting America, is dedicated to

promoting self-reliance, courage, and patriotism among young people. In scouting, the rank of

Eagle Scout is the most prestigious award a Scout can earn, and is attained only after countless

hours of hard work, sacrifice, and commitment to the scouting creed; and

WHEREAS, The journey to Eagle Scout is a challenging one, lined with many tasks and

responsibilities that only the strongest of Scouts are able to overcome and master; and

WHEREAS, Sawyer, Nathan, Mason and Henry display qualities deserving of such a

distinction. For their Eagle Scout projects, Sawyer replaced two boardwalks along the Orange

Trail of the Whiting Road Nature Preserve. Nathan led a team in constructing a bridge and

boardwalk spanning fifty feet to connect trails in the Herman Road Forever Wild Forest and the

Whiting Road Nature Preserve. Mason collected donations and raised funds for 400 blessing

bags through St. Joseph’s Neighborhood Center for those in need around the community.

Henry’s service project included the construction of a kiosk and park bench at Webster’s Herman

Road Nature Preserve; and

Webster Town Board

WHEREAS Sawyer Zimny, Nathan Westone, Mason Mitchell and Henry Schlafer are models of

all that Scouting America represents and has contributed to our community in countless ways.

Sawyer, Nathan, Mason and Henry have assisted in many projects and community service

efforts; they are truly deserving of this honor.

NOW, THEREFORE, as the Supervisor of the Town of Webster, on behalf of the Webster

Town Board, do hereby present this Certificate of Achievement to Sawyer, Nathan, Mason &

Henry in recognition of earning the rank of Eagle Scout in Scouting America.

Thomas J. Flaherty, Town Supervisor

***

The meeting was open to the floor for public comment and the following Webster residents

appeared before the Town Board.

Dave Malecki, a Webster resident, came before the Board to give thanks to Public Servants, not

just elected officials, but paid Public Servants as well. Mr. Malecki’s second topic was to state,

“Just Bridge It 24/7/365”. Mr. Malecki suggests that the Irondequoit Bay Outlet Bridge has

failed to adequately serve pedestrians and cyclists for 40 years. He emphasized the need for

improved active-transportation options between Irondequoit and Webster. While Mr. Malecki

doesn’t expect Webster to fund the project, he does want the Town to support it, encourage

further investigation, and avoid blocking proposals aimed at improving walking and biking

access.

Sean Gleeson, a Pittsford resident, came before the Board to discuss the Renewable Natural Gas

(RNG) Project and represents REV, a company experienced in developing RNG projects

nationwide, including 50 similar projects and two with New York State Electric and Gas

Corporation (NYSEG). Mr. Gleeson notes that the Town is currently flaring valuable gas and

losing potential revenue. Based on REV’s experience, the cost estimates provided are accurate.

He also explained that multiple revenue sources and credits - such as Federal renewable fuel

standard credits and the new 45Z Production Tax Credit are available for RNG, making the

project financially attractive.

Christopher Nacca, Webster resident, came before the Board to raise concerns about his

difficulty accessing meeting schedules on the Town’s mobile website, noting that it only shows

meetings on the day they occur. This makes participation challenging for residents with busy

schedules, especially given recent discussions about encouraging civic involvement across all

ages. Mr. Nacca requested a clearer, more reliable way to view monthly meeting times. He also

reiterated a recurring point: people who work in the Town of Webster should be able to afford to

live here and future development should support fair wages and maintain Webster’s character.

Paul Adams, Director of Finance and Board members, discussed the reason for the following

Resolution. They discussed transferring $22,382.50 from the General Fund to close out the Dog

Kennel Capital Project. This money covers planning and design work previously done by MRB

before the Kennel Capital Project was abandoned due to high construction costs. Some design

expenses were intertwined with a separate $40,000 MRB invoice for the Highway Project, but

the $22,382.50 is solely for the Kennel Capital Project. The Board noted that a future Board,

taking office in January 2026, may revisit the idea of building a kennel or continue pursuing the

Intermunicipal Agreement (IMA) with other Towns. IMA negotiations with Irondequoit involve

coordination between Board members from each Town, and leadership will change in January

2026, some members recommend waiting until the new Board are seated before starting

negotiations.

Resolution No. 324: MOTION by Supervisor Flaherty, seconded by Councilman Cahill, to

approve the transfer of $22,382.50 from the General Fund to close the Dog Kennel Capital

Project H0240.

Resolution No. 327: MOTION by Supervisor Flaherty, seconded by Councilwoman Wright, in

support of Congressman Nick Langworthy’s Energy Choice Act (H.R. 3699, S. 1945) and in

opposition to New York State’s mandated natural gas ban.

WHEREAS, affordable and reliable energy is essential to the health, safety, and economic

prosperity of New York families, businesses, and communities; and

WHEREAS, natural gas remains a dependable, cost-effective, and clean-burning energy source

used by millions of New Yorkers to heat their homes, cook their food, and power their

businesses; and

WHEREAS, in 2019, New York State enacted the Climate Leadership and Community

Protection Act (CLCPA), which mandates aggressive emissions reductions and serves as the

foundation for sweeping energy restrictions, including efforts to phase out natural gas; and

WHEREAS, building on the CLCPA, Governor Hochul and the New York State Legislature in

2023 enacted provisions in the state budget banning natural gas and other fossil fuel hookups in

most new residential and commercial buildings, effective 2026 for smaller buildings and 2029

for larger buildings, thereby eliminating consumer choice and limiting access to affordable

energy; and

WHEREAS, these top-down policies undermine affordability, threaten reliability during peak

demand, and strip away the freedom of consumers and businesses to choose the energy sources

that best meet their needs; and

WHEREAS, Congressman Nick Langworthy of New York and Senator Jim Justice of West

Viriginia introduced the Energy Choice Act (H.R. 3699, S. 1945), Federal legislation that

ensures State and local governments cannot restrict consumer access to natural gas and other

affordable energy sources, thereby protecting freedom of choice for New Yorkers and all

Americans; and

WHEREAS, the Energy Choice Act would safeguard households, small businesses, hospitals,

farmers, and manufacturers from harmful government overreach and preserve access to an “allof-the-above” energy strategy that strengthens reliability and affordability:

BE IT FURTHER RESOLVED

That the Webster Town Board urges Congress to pass the

Energy Choice Act to defend consumer choice, protect energy affordability, and preserve reliable

access to natural gas for New Yorkers.

BE IT FURTHER RESOLVED

That copies of this resolution be sent to. Congressman Nick

Langworthy, Senator Jim Justice, the New York Congressional delegation, Senators Chuck

Schumer and Kristen Gillibrand, Governor Kathy Hochul, and leadership of the New York State

Legislature.

Kyle Taylor, Attorney for the Town, Paul Adams Director of Finance, and Dennis Kohlmeier,

Police Chief, discussed an insurance settlement related to a wrongful - arrest lawsuit. The

settlement could be paid from General Fund operating money or from the Town’s $222,0000

insurance reserve. Dennis Kohlmeier, Webster Police Chief, explained the case: a 2021 retail

theft led to an arrest warrant based on statements from store security and an out-of-county

deputy. The person arrested was later found to have been misidentified after new information

surfaced from a third incident. Charges were dropped, but the individual filed suit. The

insurance carrier has been handling the legal defense and it is now recommended a global

settlement take place. Kyle Taylor, Attorney for the Town, clarified that the Resolution is to

approve the settlement and allow the attorneys, not the supervisor, to sign the final stipulation.

Resolution No. 332: MOTION by Councilwoman Cataldi, seconded by Councilman Cahill, to

consent to and approve the settlement after mediation in the matter of Moore vs Town of

Webster, Et Al.

WHEREAS, on January 31, 2024, a lawsuit was commenced in Federal Court in the Western

District of New York, against the Town of Webster, Kohl’s, Inc. and four other defendants,

arising from a February 2022 incident resulting in alleged violations of the plaintiff’s

constitutional rights; said lawsuit was assigned Case No.: 24-cv-6062; and

WHEREAS, the Town’s insurance carrier retained counsel to defend the Town Defendants in

this matter, which counsel has continued to defend the Town throughout the proceedings; and

WHEREAS, discovery and pretrial motion practice was conducted among the attorneys for the

various parties; and

WHEREAS, the parties by their attorneys, entered into meditation proceedings on

November 5, 2025, which resulted in a settlement of all claims set forth in the lawsuit; said

settlement agreement will require a $37,500 payment from Town, which will be paid by the

Town’s insurer and will include the $25,000 deductible pursuant to the Town’s insurance policy:

NOW, THEREFORE, BE IT RESOLVED:

That the Town Board hereby agrees to approve the settlement agreed to after mediation and

consent to the attorney(s) representing the Town insurer to enter into a stipulation to discontinue

the above-referenced matter.
